village, paroisse, canton ou partie d'ioeux, compris dans la circonscription du bureau.\" 2167.Ce plan doit être accompagné d'une copie d'un livre de renvoi dans lequel sont insér s : \" 1.Une description générale de chaque lot de terre porté sur le plan ; \" 2.Le nom du propriétaire de chaquo lot autant qu'il est possible de b en assurer ; \"3.Toutes remarques nécessaires pour faire comprendre le plan.\" Chaque lot de terre sur le plan y est indiqué par un numéro d'une seule série, qui est inscrit dans le livre de renvoi pour y désigner le même lot.\"2168.Après que copie des plans et livres de renvdr-aété déposée dans un bureau d'enregistrement pour toute sa circonscription, et qu'il a été donne avis par proclamation tel que mentionné en l'article 2169, le numéro donné à un lot sur le plan et dans le livre du renvoi est la vraie description de ce lot et suffit dans tout document quelconque ; et toute partie de ce lot est suffisamment désignée en déclarant qu'ello fait partie de ee lot et en indiquant à qui elle appartient, avec ses tenants et aboutissants : et tout terrain composé de parties de plus d'un lot numéroté est suffisamment désigné en déclarant qu'il est ainsi composé, et en indiquant qu'elle partie de chaque lot numéroté il contient.\" La description d'un immeuble dans l'avis d'une demande en ratification de titre, ou dans l'avis d'une vente par le shérif, ou par heitation forcéo, ou de toute autre vente ayant les effets du décret, ou dans telle vente ou jugement do ratification, ne sera censée suffisante que si elle est faite conformément aux prescriptions du présent article.\" Aussitôt après que lo dépôt do toi plan et livre de renvoi a été fait et qu'il en a été donné avis, les notaires sont tenus, en rédigeant les actes concernant les immeubles indiqués sur tel plan, do désigner ces immeubles par le numéro qui leur est donné sur ie plan et dans le livre de renvoi, de la manière prescrite ci-dessus ; à défaut de telle désignation l'enregistrement ne peut affecter le lot en question, à moins qu'il ne soit produit une réquisition ou avis indiquant le numéro sur le plan et livre de renvoi comme étant celui du lot qu'on veut affecter par tel enregistrement.\" 2169.Le dépôt des plans et livres de renvoi primitifs dans une circonscription d'enregistrement est annoncé par proclamation du Gouverneur en conseil, fixant en même temps le jour auquel les dispositions de l'article 2168 y deviendront en force.made Up to some precise date, up to which it shall be corrected as far as possible, and this date .-\u2022hall be marked upon it, and it «hall be signed by the said Commissioner, and remain of record in his office ; that a copy of each such plan and Book !' Reference, cortified by the Commissioner of Crown Lands, shall be deposited in the office of the Registrar in whose country or registration division the placo to which they refer is situate, and shall there remain open to inspection of the public during offico hours ; that whenever the plans and Books of Reference, with respect to any county or registration division have been deposited as aforesaid, in the office of the Registrar thereof, the Governor in Council may declare tho same by proclamation ; And considering the following provisions of articles 2106, 2107, 2108, 2109, 2170, 2171, 2172, 2173 and 2170a of tho Civil Code of Lower Canada, to wit : \"2160.The Commissioner of Crown Lands furnishes each registry office with a copy of a correct plan, made in conformity with the provisions of chapter 37 of the Consolidated Statutes* for Lower Canada and tho statute.27th and 28th Vict., ch.40, showing distinctly all tho lots of land of each city, town, village, parish, township, or part thereof, comprised within tho division to which such office belongs.\"2167.Such plan must bo accompanied by a copy of a book of reference in which are setforth : \"1.A general description of each lot of land shewn upon the plan ; \" 2.The name of the owner of each lot, so far as it can bo ascertained ; \"3.All remarks necessary to the right understanding of tho plan.\" Each lot of land shewn upon tho plan is designated thereon by a number which is one of a single series, and is entered in the book of reference to designate the same lot.\" 2108.When a copy of the plans and books of reference for tho whole of a registration division has been deposited in tho office for such division, and notice has been given by proclamation in the mannei- mentioned in article 2109, the number given to a lot upon the plan and in the book of reference is tho true description of such lot, and is sufficient as such in any document whatever : and any part of such lot is sufficiently designated by stating that it is part of such lot and mentioning who is tho owner thereof and tho properties conterminous thereto ; and any piece of land composed of parts or more than one numbered lot is sufficiently designated by stating that it is .-.ocomposed and mentioning what part of each numbered lot it contains.\" No description of an immovable in the notice of application for confirmation of title, or in the notice of a sale by the sherifl or by forced Imitation, or of any sale having tho effect of a sherill's sale, or in the shoritPs deed, or in the judgment of confirmation, will bo deemed sufficient unless it is made in conformity with tho provisions of this article.\" As soon as such plan and book of reference have been deposited and notice thereof has been given, notaries passing acts concerning immovables indicated on such plan are bound to designate such immovables by the number given to them upon such plan and in the book of reference, in the manner above prescribed ; in default of such designation the registration does not effect the lot in question, unless thore is filed a requisition or notice indicating the number on the plan and book of reference as being that of the lot intended to bo effected by such registration.\"2109.The deposit of the original \"plans and books of reference in any registration division is declared by a proclamation from the Governor in Council, fixing at the samo time the day on which the provisions of article 2108 shall coma into force therein. 3361 \" 2170.A compter de ce dépôt, lo régistrateur doit préparer l'index mentionné en second lieu dans l'article 21G1.\"2171.A compter do l'époque fixée dans tello proclamation, le régistrateur doit faire l'index dos immeubles et le continuer jour par jour en inscrivant sous chaque numéro de lot indiqué séparément au plan et au livre de renvoi un renvoi à chaque entrée faite subséquemment dans los autres livres et registres, affectant tel lot, do manière à mettre toute porsonno on état de constater facilement toutes les entrées faites sub-séquemmeut concernant ce lot.\"2172.Dans les dix-huit mois qui suivent la proclamation du Gouverneur pour la mise an force des dispositions de l'article 21 OS, dans une circonscription d'euregistrement,l'enregistrement de tout droit réel sur un lot de terre compris dans cette circonscription y doit être renouvelé au moyen de la transcription, dans lo livre tenu à cet effet, d'un avis désignant l'immoublo affecté en la manière prescrite en l'article 2108, en observant les autres formalités prescrites en l'article 2131 pour le renouvellement ordinaire de l'enregistrement des hypothèques.\" Il est tenu un index des livres employés à la transcription de l'avis mentionné au présent article, de la même manière que l'index mentionné en l'article 2131.\"2173.A défaut de tel renouvellement, les droits réels conservés par le p vernier enregistrement n'ont aucun effet à l'égard des autres créanciers ou des acquéreurs subséquents dont les droits sont régulièrement enregistrés.\" \" 2176a.Chaque fois que le plan des lots de terre d'une cité, d'une ville, d'un village, d'une paroisse, d'un canton, ou d'une division quelconque de ces localités, faisant partie d'une circonscription d'enregistrement, a été faite conformément aux dispositions du chapitre trente-sept des Statuts He fond us Eour le Bas-Canada, et de l'acte vingt-sept et vingt-uit Victoria, chapitre quarante,!o Lieutenant Gouverneur en conseil peut faire déposer au bureau du régistrateur de la circonscription d'enregistrement qu'il appartient, une copie correcte de ce plan, ainsi qu'une copie du livre de renvoi qui s'y rapporte.\" Le dépôt de tels plan et livre de renvoi est annoncé par une proclamation du Lieutenant-Gouverneur eu conseil, fixant en même temps le jour auquel les dispositions do l'article deux mille cent soixante et huit deviendront on force dan?cette circonscription d'enregistrement, relativement à la localité dont le plan des terres a été déposé ; et à dater de l'époque fixée dans la proclamation, toutes les dispositions du code s'appliqueront à ce plan et à ce jfrra de renvoi, ainsi qu'aux terres ou propriétés comprises dans ce plan, et à tous les contrats, hypothèques ou actes quelconques, concernant ou affectant telles terres ou proprié tés, de la même manière «pie si le dépôt du plan de toute la circonscription d'enregistrement eut été fait coufi rmément à l'article deux mille cent soixante et six.\" Et Attendu que, par un acle de la Législature de Notre dite Province do Québec, passée dans la trente-cinquième année de Notre Rogne, intitulé : \" Acte pour amender la loi concernant les plans et livres de renvoi des cadastres,\" tel que modifié par un autre acte de la même législature passé dans la trente-neuvième année de Notre Règne, sous le chapitre vin.t sixième, il est ei.tr'autres choses en substance statué qu'en autant que sont concernés les proclamations qui pourront être émanées à l'avenir en vertu des dispositions de l'article 2169 du Code Civil ou do la section cinq de l'acte de cette provincoj trente-deux Victoria, chapitre vingt-cinq, le délai de dix-huit mois fixé par l'article 2172 du dit Code, pour le renouvellement de l'enregistrement dos droits réels est prolongé, par le dit acte, à la période de doux ans à dater du jour fixé dans la proclamation lancée à cet effet.\" 2170.The registrar so soon as such deposit has been made, must prepare the index to immovables mentioned in tho second place in article 2161.\"2171.From and after the day appointed by such proclamation the registrar must, from day to day, make up and continue the index to immovables by entering under the number of each lot separately designated upon the plan and book of roterenoe, a reference to each entry thereafter made in the other books and registers affecting such lot, so as to enable any person eas'ly to ascertain all the entries concerning it made after that time.\" 2172.Within eighteen months after the Governor's proclamation bringing the provisions of article 2108, into force in any registration division, the registration of any real right upon any lot of land within such division must be renewed by means of the registry at length, in the book kept for that purpose, of a notice describing the immovables affected in the manner prescribed in article 2108 and conforming to the other formalities prescribed in article 2131 for the ordinary renewal o I the registration of hypothecs.\" An indox must be kept for the books used for the registration of the notices mentioned in this article, in the same manner as the index mentioned in article 2131.\" 2173.If such renewal be not effected, the real rights preserved by the first registration have no effect against other creditors and subsequent purchasers whose claims have been regularly registered.\" 2170a.Whenever the plan of the lots of land of any city, town, village, parish, township, or any division whatsoever of such localities, forming part of any registration division, has been made in conformity with the provisions of chap ter thirty seven of the Consolidated Statutes for Lower Canada, and of the act twenty seventh and twenty eighth Victoria, chapter forty, the Lieutenant Governor in council may cause to be filed in the office of the registrar of the proper registration division, a correct copy of such plan, together with a copy of the book of reference relating thereto.\" The deposit of such plan and book of reference is announced by a proclamation of the Lieutenant Governor in council, whioh at the same time determines tho day upon which the provisions of the article two thousand one hundred and sixty eight, shall come into force in such registration division, tespecting the localities whereof the plan of the lands has been so filed ; and from the date of the period lixed in such proclamation, all the provisions of the code shall apply to such plan and to such book of reference, and to all lands and properties comprised in the said plan, and to all contracts, hypothecs or acts whatever, concerning or affecting such land or property, in the same manner as if the plan of the whole registration division had been deposited, in conformity with article two thousaud one hundred and sixty six.\" And Wi i eke as by an act of the Legislature of Our said Province of Quebec, passed in the thirty fit tlx year of Our Reign, intituled : \" An act to amend the law respecting cadastral plan and hooks of reference,\" such as modified by another act of the same legislature passed in the thirty ninth year of Our Reign, under chapter twenty six, it'is amongst other things in effect enacted that in so far as regards proclamations to be hereafter issued under the provisions of article 2109 of tho Civil Code, or of section five of the act of this Province, thirty second Victoria, chapter twenty five, the delay of eighteen months fixed by article 2172 of tho said Code for the renewal of the registration of real rights is extended by the said act to the period of two years from the date fixed in the proclamation. 3362 Et Attendu que l'Honorable Commissaire des Terres de la Couronne de .Votre l'rovince de Québec, a fait préparer, sous sa direction, des plans corrects des diverses localités constituant le oomté de Verchères, dam la circonscription d'enregistrement du comté de Verchères, avec des livres de renvoi qui s'y rapportent j Et at-tendu que les dits plans et livres de renvoi ont été dressés jusqu'à une date précise marqué en iceux, lesquels sont signés par notre dit Commissaire des Terres de la Couronne et restent dans les archives de son bureau ;
