seule série, qui est inscrit dans lo livre do renvoi pour y designer lo même lot.\" 2108.Après quo copio des plans et livres do renvoi a été déposée dans un bureau d'enregis-^5 trement pour toute sa circonscription, et qu'il a été donné avis par proclamation tel que mentionné \u2022 en l'article 2109, le numéro donné à un lot sur lo -çu plan et dans le livro de renvoie est la vraie des-, cription de co lot et suffit dans tout document quelconque ; et toute partie de ce lot est suffisa.n- ' ment désignée on déclarant qu'elle fait partie do ce lot et eu indiquant à qui elle appartient, avec ses tenants et aboutissants ; et tout terrain composé de parties de plus d'un lot numéroté est suffisamment désigné en déclarant qu'il est ainsi composé, et en indiquant qu'elle partie de cha pié lot numéroté il contient.\"La description d'un immeuble dans l'avis d'uno demande en ratification de titre, ou dans l'avis d'une vento par le shérif, ou par licitation forcée, ou do toute autre vente ayant les offots du décret, ou dans telle vente ou jugement de ratification, no sera censée suffisante que si elle o=t faite conformément aux prescriptions du présent article.\" Aussitôt après que le dépôt de tel plan et livre de renvoi a été fait et qu'il en a été donné avis, les notaires sont tenus, on rédigeant les actes concernant les immeubles indiqués sur tel plan, de désigner ces immeubles par lo numéro qui leur est donné sur le plan et dans le livre de renvoi, do la manièro prescrite ci-dessus ; à défaut do telle désignation l'enregistrement ne peut affecter le lot en question, à moins qu'il no soit produit une réquisition ou avis indiquant le numéro sur lo plan et livro de renvoi comme étant celui du lot qu'on veut affecter par tel enregistrement.\"2169.Le dépôt des plans et livres de renvoi primitifs dans une circonscription d'enregistré-mont e^l annoncé par proclamation du Gouverneur Canada, with a Book of Reference to each s'iob plan ; that oaoh of tho said plain and books of remain of record in his office ; that a copy of each such plan and book of reference, certified by the Commissioner of Crown Lands, shall bo deposited in tho office of the Registrar in whose county or registration division the placo to which they refer is situato, and shall there remain open to iuspoc-tion of the public during ofiico hours j that whenever tho plans and books of reference, with respect to any county or registration division have been deposited as aforesaid, in the office of the Registrar thereof, tho Governor in Council may declare the same by proclamation ; And considering tho following provisions of articles 2106, 2167, 2168, 2169, 2170, 2171, 2172, 2173 and 2176a of tho Civil Co lo of Lower Canada, to wit : \"2166.Tho Commissioners of Crown Lands furnishes each registry office with a copy of a correct plan, made in conformity with the provisions of chapter 37 of the Consolidated Statutes for Lower Canada and tho statute 27th and 2Sth Vict., ch.40, shewing distinctly all tho lots of land of each city, town, village, parish, township, or part there-, of, comprised within tho division to which such office belongs.\"2167.Such plan must bp accompanied by a copy of a book of reference in which are setforth : \" 1.A general description of each lot of land shewn upon the plan ; \" 2.The nam a of the owner of each lot, so ixv as it can be ascertained ; \" 3.All remarks necessary to the.right understanding of the plan.\" Each lot of land shewn upon the plan is designated thereon by a numboir which ii onoofa single series, and is entered in the book of reference to designate the same lot.\"2108.When a copy of the plans and books of reference for tho wholo of a registration division has been deposited in tho office for such division, and notice ha* been given by proclamation in the manner mentioned in article 2169, the number given to a lot upon the plan ami in the book of reference i3 tho true description of such lot, and is sufficient as such iu any document whatever ; and any part of such lot i~ sufficiently designated by stating that it is part of such lot and mentioning who is tho owner thereof and tho properties conterminous thereto ; and any piece of land composed of pirts or more than one numbered lot is sufficiently designated by stating that itissocom-poso i and mentioning what part of each numbered lot it contains.\" No description of an immovable in the notice of application for confirmation of title, or in the notice of a .salo by the sheriff or by forced licitation, or of any salo having the effect of a sheriffs sale, or in the sheriffs deed, or in the judgment of confirmation, will bo deemod sufficient unless it is made in conformity with the provisions of this article.\" As soon as such plans and books of reference have been deposited and notices thereof has been given, notaries passing acts concerning immovables indicated on such plan aro bouud to designate such immovables by the number given to them upon such plau aud i:i the book of reference, in tho manner above prescribed ; in default of such designation the registration does not effect the! îi in question, unless^thero i3 filed a requisition or notice indicating the numbor on the plan and book of reference as being that of the l ot intended to be effected by such registration.\"2169.The deposit of the original plana and books of reference in any registration division is declared by a proclamation from the Governor in 1 en conseil, fixant en môme temps le jour auquel les dispositions de l'article 2168 y deviendront en force.\" 2170.A des immeubles et le continuer jour par jour en inscrivant sous chaque numéro de lot indiqué séparément au plan et au livre de renvoi un renvoi à chaque entrée faite subséquemment dans les autres livres et registres, affectant tel lot, de manière à mettre toute personne en étit de constater facilement toutes les entrées faites subséquemment concernant ce lot.\"2172.Dans les dix-huit mois qui suivent la Sroclamation du Gouverneur pour la mise en force es dispositions de l'article 2168, dans une circonscription d'enregistrementjl'enregistrement de tout droit réel sur un lot de terre compris dans cette circonscription y doit être renouvelé au moyen de la transcription, dans le livre tenu à cet effet, d'un avis désignant l'immeuble affecté en la manière prescrite en l'article 2168, en observant les autres formalités prescrites en l'article 2131 pour le renouvellement ordinaire de l'enregistrement des hypothèques.\" 11 est tenu un index des livres employés à la transcription de l'avis mentionné au présent article, de la mémo manière que l'index mentionné en l'article 2131.\"2173.A défaut de telle renouvellement, les droits réels conservés par le premier enregistrement n'ont aucun effet à l'égard des autres créanciers eu des acquéreurs subséquents dont l«s droits sont régulièrement enregistrés.\" \" 2176a.Chaque fois que le plan des lots de toi re d'une cité, d'une ville, d'un village, d'une paroisse, d'un canton, ou d'une division quelconque de ces localités, faisant partie d'une circonscription d'enregistrement, à été faite conformément aux dispositions du chapitre trente-sept desStatuts Refondus pour le Bas-Canada, et de l'acte vingt-sept et vingt-huit, Victoria,chapitre quarante,le Lieutenant-Gouverneur en conseil peut faire déposer au Ijurean du régistrateur de la circonscription d'enregistrement qu'il appartient, une copie correcte do ce plan, ainsi qu'une copie du livre de renvoi qui s'y rapporte.\"Le dépôt do tels plan et livre de renvoi est annoncé par une proclamation du Lieutenant-Gouverneur en conseil, fixant en mémo temps le jour auquel les dispositions de l'article deux mille cent soixante et huit deviendront en force dans cette circonscription d'enregistrement, relativement à la localité dont le plan des terres a été déposé ; et à dater de l'époquo fixée dans la proclamation toutes les dispositions du code s'appliqueront à ce plan et à ce livre de renvoi, ainsi qu'aux terres ou propriétés comprises dans ce plan, et à tous les contrats, hypothèques ou actes quelconques, concernant ou arlectant telles terres ou propriétés de la même manière que si le dépôt du plan do toute la circonscription d'enregistrement eut été fait conformément à l'article deux mille cent soix .ante et six.\" Er Attendu que, par un acte de la Législature de Notre dite Province de Québec, passée dans la trente-cinquième année de Notre Règne, intitulé : \"Acte pour amender la loi concernant les plans et livres de renvoi dc3 cadastres,\" tel qu'expliqué par un autre acte de la même législature passé dans la trente-neuvième année do Notre Règne, sous le chapitre vingt-sixième, il est entr'autres choses en substance statué qu'en autant que sont concernés les proclamations qui pourront être émanées à l'avenir en vertu des dispositions de l'article 2169 du Code Civil ou de la section cinq de l'acte de cette province, trente-deux Victoria, chapitre vingt-cinq, le délai de dix-huit mois fixé par l'article 2172 du dit Code, pour le renouvelle- Council, fixing at the same time the day on which the provisions of article 2168 ehall come into force therein.\" 2170.The registrar so soon as such deposit ha« been made, must prepare the index to immovables mentioned in the second place in article 2161.\"2171.From and after the day appointed by such proclamation, the registrar must, from day to day, make up and continue the index to immovables by entering under the number of each lot separately designated upon the plan and book of reference, a reference to each entry thereafter made in the other books and registers affecting such lot, so as so enable any person easily to ascertain all the entries concerning it made after that time.\"2172.Within eighteen months after the Governor's proclamation bringing the provisions of article 2168, into force in any registration division, the registration of any real right upon any lot of land within such division must be renewed by means of the registry at length, in the book kept for that purpose, of a notice describing the immo vables affected in the manner prescribed in article 2168, and conforming to the other formalities prescribed in article 2131 for the ordinary renewal of the registration of hypothecs.\" An index must be kept for the books used for the registration of the notices mentioned in this article, in the Bame manner as the index mentioned in article 2131.\" 2173.If such renewal bo not affected, the real rights preserved by the first registratisn have no effect against other creditors and subsequent purchasers whose claims have been regularly registered.\"2176a.Whenever the planofthe lots of land of any city, town, village, parish, township, or any division whatsoever of such localities, forming part of any registration division, has been made in conformity with the provisions of chapter thirty seven of the Consolidated Statutes for Lower Canada, andof tho act twenty seventh and twenty eighth Victoria, chapter forty, the Lieutenant Governor in council may cause to be filed in the office of the registrar of the proper registration division, a correct copy of such plan, together with a copy of the book of reference relating thereto.\" The deposit of such plan and book of reference is announced by a proclamation of the Lieutenant-Governor in council, which at tho same time determines tho day upon which the provisions of the article two thousand one hundred and sixty eight, shall come into force in such registration division, respecting the localities whereof the plan of the lands has been si filed ; and from the date of the period fixed in such proclamation, all the provisions of the code shall apply to such plan and to such book of reference, and to all lands and properties comprised in the said plan, and to all contracts, hypothecs or acts whatever, concerning or affecting such land or property, in the same manner as if the plan of the whole registration division ha 1 been deposited, in conformity with article two thousand one hundred and sixty six.\" And WnEUKAS Ly an act of the Legislature of Our said Province of Quebec, passed in the thirty fifth year of Our Reign, intituled : \" An act to amend the law respecting cadastral plans and books of reference,' ' such as explained by another act of the same legislature passed in the thirty ninth year of Our Reign, under chapter twenty six, it is amongst other things in efiect enacted that in so far as regards proclamations to be hereafter issued under the provisions of article 2169 of the Civil Code, or of section five of the act of this Province, thirty second Victoria, chapter twenty five, the delay of eighteen months fixed by article 2172 l'inspection du public, pendant les heures de bureau, savoir : depuis neuf heures du matin jusqu'à trois heures de l'après-midi, chaque jour de la semaine, les dimanches et jours de fêtes d'obligation exceptés, ainsi qu'il est prescrit par lo dit acte ; Et Attendu qu'à l'égard des dits plans et livres do renvoi, Notre dit Commissaire des Terres de la Couronne s'est en tous points conformé aux dispositions du dit acte, tel qu'amendé par le statut de la ci-devant Province du Canada, 27 et 28 Vict., chap.40, et aux dispositions du Code Civil du Bas-Canada qui s'y rapportent.Et attendu que le LIEUTENANT-GOUVERNEUR de notre dite Province de Québec, de l'avis du Conseil Exécutif do ladite Province, a fixé lo vingt sixième jour du mois de janvier pro-chain,comme devant être le jour à partir duquel les dispositions clo l'article 2168 du Code Civil du Bas Canada deviendront et seront enforce dans la dite circonscription d'enregistrement du comté de Brome, relativement au dit township de
