Attendu que la décision majoritaire dudit Conseil d'arbitrage a été rendue le 5 novembre 1941, c'est-à-dire antérieurement à la mise en vigueur de l'arrêté en conseil fédéral C.P.8253, relatif aux salaires en temps de guerre, remplacé depuis par l'arrêté C.P.5903; Whereas the majority decision of the said Arbitration Board has been taken on November 5, 1941, that is previous to the enforcement of the Federal Order in Council P.C.8253, relating to the wartime wages, now replaced by Order P.C.5903; Whereas two of the proposed modifications have not yet been rendered obligatory; Whereas one of the contracting parties has petitioned the Department of Labour to modify the said decree according to the recommendations of the said Arbitration Board; Whereas, pursuant to the provisions of section 8 of the Collective Agreement Act (Revised Statutes of Quebec 1941, chapter 103), the Minister of Labour has given notice of his intention to recommend the approval of the said modifications of the decree number 2011, of September 9, 1939, and amendments, governing the baker trade in the Island of Montreal ; Whereas the said notice has been published in the Quebec Official Gazette on February 27, 1943; Whereas The Minister of Labour, having consulted the contracting parties, has deemed advisable to accept the objections presented to him; cette semaine de vacances est payable d'avance audit salarié.L'employeur a le privilège de désigner lui-même la période pendant laquelle le salarié peut prendre telle semaine de vacances.6.\u2014Nonobstant les dispositions précédentes, dans les boulangeries ayant à leur service vingt (20) voitures ou moins, il est loisible de remplacer ladite semaine de vacances par treize (13) journées de vacances payées distribuées comme suit : Employés de l'intérieur: congé payé les mercredis des mois de juin, juillet et août; Vendeurs ou distributeurs: congé payé les jeudis des mois de juin, juillet et août.Cependant, un employeur qui désire se prévaloir de cette alternative doit obtenir le consentement écrit des salariés concernés et en déposer une copie au comité paritaire ; it may, however, consist of less than fifty-seven (57) hours without any effect on the weekly minimum rates of wages stipulated in section III hereof; after fifty-seven (57) regular hours, any work shall be considered as overtime work and shall be paid, for each overtime hour, on the basis of the minimum wages for the fifty-seven (57) hours week.\" \"The fifty-seven (57)-hour limitation shall apply exclusively to employees of classes B, C, 1) and E, and not to the salesmen, foremen and inspectors.\" 2°.The following section X-A is added: \"X-A.\u2014Holidays with pay:\u2014a.\u2014Any employee subject to the present decree shall !>e entitled to one week's holidays after each complete year of employment for the same employer, and he shall be paid in advance for said holidays.The employer has the privilege to designate himself the period during which the employee will have his holidays.6.\u2014Notwithstanding the foregoing provisions, in bakeries having twenty (20) wagons or less, it is permissible to replace the said holiday week by thirteen (13) vacation days, with pay, distributed as follows: Inside employees: paid holiday every Wednesday of the months of June, July and August; Salesmen and deliverers: paid holiday every Thursday of the months of June, July and August.However, an employer wishing to enforce this provision shall obtain the consent, in writing, of the employees concerned and file a copy of same with the Parity Committee ;
