means any employee mainly committed to the delivery or storage of goods sold or to be sold in an establish governed by the present decrree with a véhicule, truck, bicycle or any other means.i.\u2014\u2014 The word \"supervisor\" means any employee who is in charge of one or more departments in an establishment governed by tbe decree even under the direction of a manager.j.\u2014 The word \"superintendent\" means any employee who Sees to the administration of one or more establishments.le.\u2014 The word \"book-keeper\" means any employee who does work similar to that of an accountant as defined in subsection \"e\" of this section.I.\u2014 The word \"collector\" means any employee generally assigned to collect moneys due and overdue.to.\u2014 The words \"stenographer\" and \"typist\" means any employee who makes out invoices, statements of account, or circulars, etc.n.\u2014 The words \"commission agent\" means any employee who is assigned to sell outside the establishment whether they receive a percentage or a fixed salary.II.\u2014 Territorial jurisdiction:\u2014 This decree governs the city of Arvida and the towns of Jonquière, Kénogami, St.Joseph d'Alma and the territory comprised within a radius of two (2) miles from their limits.III.\u2014 Professional jurisdiction:\u2014 This decree applies to any person, partnership, corporation, municipal and school corporation, financial, industrial, and commercial establishment, professional men's chambers and offices, and all notary's, lawyer's, physicians', agencies' offices, etc.However, it does not apply to.a.\u2014 insurance companies; 6.\u2014 banking concerns; c.\u2014 industrial or commercial establishments that are, or will be, subject to a collective labour agreement negotiated in accordance with the prescriptions of the Professional Syndicates' Act, or of the Collective Agreement Act.d.\u2014 railway employees.e.\u2014 employees of the pulp and paper industry.IV.\u2014 Duration of labour:\u2014 The duration of labour in the establishments governed by the decree shall be as follows: a.\u2014 Industrial establishments:\u2014 Forty-eight (48) hours per week, p.m.les lundi, mardi, mercredi, jeudi et vendredi; de 9.00 a.m.à 10.00 p.m.le samedi et la veille des fêtes chômées.2.\u2014 Personnel masculin: de 8.00 a.m.à 6.00 p.m.les lundi, mardi, mercredi, jeudi et vendre- de 8.00 a.m.à 10.00 p.m.le samedi et la veille des fêtes chômées.3.\u2014 Une heure doit être accordée aux salariés pour leur repas du midi et une heure également pour leur repas du soir les jours où ils sont appelés à travailler dans la soirée.4.\u2014 L'employeur peut faire travailler ses salariés jusqu'à 10.00 p.m.du 20 au 24 décembre \u2022inclusivement et du 28 ua 31 décembre inclusivement de chaque année, sans rémunération supplémentaire.d.\u2014 Nonobstant les dispositions du paragraphe précédent, les salariés des hôtels, restau rants, cafés, débits d'essence et des entreprises exclusivement consacrées au camionnage sont assujettis à la semaine de travail de soixante (60) heures.e.\u2014 Nonobstant toutes es dispositions relatives aux heures de travail, incluses dans le présent décret, la Loi du repos hebdomadaire (S.R.Q.1941, chapitre 166) et les règlements pris en son exécution doivent s'appliquer intégralement.Clause conditionnelle:\u2014Les dispositions du présent article concernant la durée du travail ne doivent en aucun cas constituer une dérogation aux dispositions de la Loi des établissements industriels et commerciaux (S.R.Q.1941, les dimanches ainsi que les jours de fête suivants doivent être chômés et payés:\u2014 le Premier de l'An, l'Epiphanie, l'Ascension, la St-Jean-Baptiste, la Confédération (1er juillet), la fête du Travail, la Toussaint, l'Immaculée Conception et la Noël.b.\u2014 Financial establishments:\u2014 Forty-four (44) hours per week, distributed in accordance with the requirements of the concern.Notwithstanding the foregoing provisions, in professional men's chamber and offices, in lawyers', notaries', doctors' and other similar offices, the work week shall consist of forty-eight (4S) hours distributed according to the requirements of tbe concern.c.\u2014 Commercial establishments: (wholesale and retail) Fifty-one (51) hours per week for female employees and fifty-seven (57) hours per week for male employees, distributed in the following manner; 1.\u2014 Female employees:\u2014from 9.00 a.m.to 0.00 p.m., on Monday, Tuesday, Wenderday, Thrusday and Friday; from 9.00 a.m.to 10.00 p.m.on Saturday and the eve of days kept as holidays.2.\u2014 Male employees: from 8.00 a.m.to 6.00 p.m., on Monday, Tuesday, Wednesday, Thursday and Friday; from 8.00 a.m.to 10.00 p.m., on Saturday and the eve of days kept as holidays.3.\u2014 These employees shall be given one hour off for the noon meal and another hour for the evening meal wdien required to work in the evening- 4.\u2014 The employer may keep his employees to work until 10.00 p.m.from the 20th to the 24th December inclusive, and from the 2Sth to the 31st December inclusive, of each year, without paying tbe overtime rate.d.\u2014 Notwithstanding the provisions of the preceding subsection, employees in hotels, restaurants, cafe*, gasoline stations and concerns exclusively engaged in the transport by truck are subject to the sixty (60) hour week.e.\u2014 Notwithstanding any provisions concerning working hours contained in the present decree, the Weekly Day of Rest Act.(R.S.Q.1941, chapter 100), and the regulations enacted for its carrying out, shall fully apply.Proviso:\u2014The provisions of the present section, concerning the duration of labour, must, in no instance, constitute a derogation of the provisions of the Industrial and Commercial Establishments' Act (R.S.Q.1941, chapter 175), of the decrees enacted under its authority, nor of the bylaws made by competent municipalities.V.\u2014 Overtime:\u2014a.\u2014 All overtime worked by the employees governed by the present decree shall be paid for at the rate of time and a half starting from the second hour worked in any day or week over and above the regular working hours specified in the present decree.6.\u2014 However, employees working in commercial establishments in which the regular working hours are lower in amount than those determined in subsections \"c\" and \"d\" of section IV, must also be remunerated at the rate of time and a half for any overtime worked in any day or week, starting from the second hour worked a.\u2014 Tout salarié I droit à une semaine de vacances payées après une année de service dans un établissement régi par le présent décret.b.\u2014 Ces vacances doivent être accordées après entente entre le salarié et l'employeur.c.\u2014 Toutefois, tout salarié qui n'a pas pris ses vacances a droit à leur accumulation et s'il quitte le service de son employeur ou s'il est justement renvoyé, le montant dû pour les jours de vacances ainsi accumulés auxquels il a droit, doit lui être payé.d.\u2014 Toute absence non motivée d'un salarié peut être retranchée de la durée des vacances pour autant de jours où telles absences se sont produites.VIII.\u2014 Expérience:\u2014 L'employeur doit reconnaître le temps d'apprentissage ou de service fait précécemment dans un autre établissement, pourvu que le salarié fournisse un certificat de qualification ou une déclaration assermentée attestant la durée de son apprentissage ou de son service chez tel ou tels employeurs.IX.\u2014 Frais de
