Whereas a draft of these Regulations must be published by the Minister in the Québec Official Gazette with a notice that upon the expiry of 90 days following this publication they will be submitted for the approval of the Lieutenant-Governor in Council; Whereas the publication required by the Act has been made in the Official Gazette dated 12 June 1974; Whereas the period of 90 days prescribed by the Act has expired; Whereas this regulation amends the Regulation respecting the Public Health Protection Act (O.C., 1444-74) published in the Official Gazelle of 8 May, 1974, p.1827; It is ordered upon the recommendation of the Minister of Social Affairs: That the Regulation annexed hereto amending the Regulation respecting the Public Health Protection Act be approved.That the said Regulation come into force on ! February 1976.Guy Coulombe.Clerk of the Executive Council. 1306 QUÉBEC OFFICIAL GAZETTE, January 30.1976.Vol.108.No.7 Pari 2 Règlement modifiant le Règlement en vertu de la Loi de la protection de la santé publique (Loi de la protection de la santé publique, 1972, c.42, a.50, par.b, c et d) 1.Le règlement en vertu de la Loi de la protection de la santé publique (A/C 1444-74 du 17 avril 1974, 2456-75 du 11 juin 1975 et 3913-75 du 10 septembre 1975.Gazene officielle des 8 mai 1974, p.1827, 9 juillet 1975.p.3323 et 10 septembre 1975, p.4871) est modifié en remplaçant l'article 7.002 par le suivant: ((7.002 Toute requête pour l'émission ou le renouvellement d'un permis doit être faite par écrit: si toutefois une requête est relative à un permis visé au paragraphe d de l'article 7.001, elle doit être faite en remplissant une copie du formulaire AE-I produit en ANNEXE 5 au présent règlement.» 2.Ledit règlement est modifié en ajoutant après l'article 7.005b un article 7.005c comme suit: «7.005c Un permis de service d'ambulance ne peut être délivré qu'à une personne qui: a) est âgée de 21 ans ou plus; b) est domiciliée au Québec depuis au moins 12 mois; c) est elle-même propriétaire ou locataire ou agit pour le bénéfice d'une corporation, société ou association, ayant son siège social au Québec, qui est propriétaire ou locataire de véhicules munis de l'équipement conforme aux spécifications décrites par le chapitre IX du présent règlement et dont le personnel a les qualités requises par ledit chapitre.3.Ledit règlement est modifié en remplaçant l'article 7.006 par le suivant: ((7.006 Nonobstant les dispositions des articles 7.004 et 7.005, le ministre délivre un premier permis d'embaumeur ou de directeur de funérailles à toute personne qui agissait comme embaumeur ou directeur de funérailles ou qui, dans le cas d'un permis de directeur de funérailles, représente une corporation, société ou association qui agissait comme directeur de funérailles depuis au moins 12 mois, en date du 17 avril 1974.Nonobstant les dispositions des articles 7,005a et 7.005c, le ministre délivre un premier permis de laboratoire ou de service d'ambulance à toute personne qui, le premier janvier 1976, exploitait un laboratoire ou un service d'ambulance depuis au moins le 17 avril 1974, à la condition que la demande de permis soit faite avant le premier avril 1976.Regulation amending the Regulation respecting the Public Health Protection Act (Public Health Protection Act, 1972, c.42, section 50, subparagraphs b, c and d) 1.The Regulation respecting the Public Health Protection Act (O/C 1444-74 dated 17 April 1974, 2456-75 dated 11 June 1975 and 3913-75 dated 10 September 1975, Official Gazelles dated 8 May 1974, p.1827, 9 July 1975, p.3323 and 10 September 1975, p.4871) is amended by replacing section 7.002 by the following: \"7.002 Every application for the issuance or renewal of a permit must be made in writing; if, however, the application respects the permit contemplated in subparagraph d of section 7.001, it must be made by completing a copy of Form AE-1 in SCHEDULE 5 annexed to this Regulation.\" 2.The said Regulation is amended by adding after section 7.005b.section 7.005c as follows: \"7.005c An ambulance service permit may be issued only to a person who: (a) is 21 years of age or over; (b) has been domiciled in the province of Québec for at least 12 months; (c) is himself the owner or tenant, or acts on behalf of a corporation, partnership or association, having its corporate seat in the Province of Québec, which is the owner or tenant of vehicles containing the equipment which complies with the specifications described in Chapter IX of this Regulation and whose staff has the qualifications required in the said chapter; 3.The said Regulation is amended by replacing section 7.006 by the following: \"7.006 Notwithstanding the provisions of sections 7.004 and 7.005, the Minister shall issue a first embalmer's or funeral director's permit to every person who has been acting as embalmer or funeral director or who, in the case of a funeral director's permit, represents a corporation, partnership or association that has been acting as funeral director for at least 12 months, dated 17 April 1974.Notwithstanding the provisions of sections 7.005a and 7.005c, the Minister shall issue a first laboratory or ambulance service permit to every person who, on the first of January 1976, has been operating a laboratory or an ambulance service since at least 17 April 1974, on condition that the application for the permit is made before the first of April 1976. exercées avant le 17 avril 1974 et qui ont continué à être exercées depuis.Si un requérant désire étendre le champ d'activités de son laboratoire, il doit remplir les conditions exigées par le présent règlement pour ces nouvelles activités.Un permis ne peut être renouvelé que si le requérant remplit les conditions énumérées au présent règlement.» 4.Ledit règlement est modifié en ajoutant après le chapitre VIII un chapitre IX comme suit: «Chapitre IX NORMES D'ÉQUIPEMENT, D'OPÉRATION ET DE FONCTIONNEMENT DES SERVICES D'AMBULANCE, LES LIEUX OÙ CES OPÉRATIONS DOIVENT ÊTRE CONDUITES ET LA QUALITÉ DU PERSONNEL EMPLOYÉ Préliminaires 9.000 Tout véhicule servant habituellement à transporter des malades ou des blessés sur civière est une ambulance au sens du présent règlement et tout propriétaire d'un tel véhicule est considéré comme exploitant un service d'ambulance.N'est toutefois pas considéré comme une ambulance le véhicule qu'une entreprise utilise pour assurer gratuitement un service de secourisme sur un terrain dont elle est propriétaire, concessionnaire ou locataire.Aucune indication ne doit toutefois laisser croire qu'un tel véhicule est une ambulance.9.001 Le détenteur d'un permis de service d'ambulance ne peut transporter des personnes nécessitant des soins médicaux ou se trouvant déjà sous traitement médical que dans une ambulance, sauf en cas de nécessité absolue.9.002 Le conducteur d'une ambulance doit arrêter son véhicule sur la scène de tout accident et fournir ses services à toute personne accidentée à moins que l'ambulance ne transporte déjà un malade ou un blessé dont l'étal ne permet pas de retarder le transport ou qu'il soit en route pour aller recueillir une personne à la suite d'un appel d'urgence.9.003 Le détenteur d'un permis de service d'ambulance doit faire parvenir au ministre, avant le premier avril de chaque année, un état indiquant les coûts facturés par mille parcouru avec une personne transportée au cours des 12 mois précédents.9.004 Le détenteur doit tenir un registre de tous les appels et des réponses données à ces appels.Le registre doit indiquer l'heure de réception des appels et l'heure d'arrivée de l'ambulance sur les lieux dans chaque cas.The first permit contemplated in the second paragraph shall only be issued, in the case of laboratories, for activities which were carried out prior to 17 April 1974 and which have been continued since.If the applicant wishes to extend the field of activities of his laboratory, he must fulfill the conditions required by this Regulation for such new activities.A permit may only be renewed if the applicant fulfills the conditions set forth in this Regulation.\" 4.The said Regulation is amended by adding after Chapter VIII, Chapter IX as follows: \"Chapter IX STANDARDS GOVERNING THE EQUIPMENT, OPERATION AND FUNCTIONING OF AMBULANCE SERVICES, THE PREMISES IN WHICH SUCH OPERATIONS ARE TO BE CONDUCTED AND THE QUALIFICATIONS OF THE STAFF EMPLOYED Preliminaries 9.000 Every vehicle whose usual object is the transport of sick or injured persons on a stretcher is an ambulance within the meaning of this Regulation and every owner of such vehicle is considered to be operating an ambulance service.The vehicle which a business uses to ensure free first-aid service on the premises of which it is the owner, dealer or tenant shall not be considered an ambulance.No indication must, however, lead to believe that such vehicle is an ambulance.9.001 The ambulance service permit holder may transport persons requiring medical care or who are already undergoing medical treatment solely by means of an ambulance, except cases of absolute necessity.9.002 The ambulance driver must stop his vehicle at the scene of every accident and provide his services to every injured person unless the ambulance is already transporting a sick or injured person whose condition does not allow for a delay in transport or unless he is on his way to answer an emergency call.9.003 The ambulance service permit holder must forward to the Minister, prior to the first of April of each year, a statement indicating the costs invoiced per mile per person transported during the preceding 12 months.9.004 The holder must keep a register of all calls received and the answers to such calls.The register must indicate the lime at which the calls were received and the time of arrival of the ambulance on the premises in each case. 1308 QUÉBEC OFFICIAL GAZETTE, January 30.1976, Vol.108.No.7 Pari 2 9.005 Le détenteur qui désire abandonner l'exploitation du service doit en aviser le ministre, par courrier recommandé, au moins 90 jours à l'avance.Il doit de même aviser le ministre de toute modification du service qu'il offre ou du territoire qu'il dessert.9.006 À compter du premier janvier 1977.tout service d'ambulance doit pouvoir être rejoint par téléphone en composant un numéro branché sur au moins 2 lignes d'entrée à usage simple; au moins une ligne doit être réservée aux appels d'entrée; l'utilisation de ces lignes et de ce numéro doit être limité aux seules activités d'ambulance.Ce numéro doit être inscrit dans les pages jaunes de tout annuaire téléphonique publié dans la région desservie après le premier janvier 1976, sous la rubrique «Ambulance» seulement, avec une inscription différente pour chaque localité desservie.Section I ÉQUIPEMENT DES VÉHICULES § 1 \u2014 Équipement général 9.101 Le détenteur d'un permis de service d'ambulance doit voir à ce que toutes ses ambulances soient constamment maintenues dans une condition de fonctionnement adéquate.9.102 À cette fin, le détenteur de permis doit procéder aux inspections, vérifications et réparations nécessaires et maintenir une fiche pour chaque véhicule.Cette fiche doit indiquer la date et la nature de chaque inspection, vérification ou réparation.9.103 Une ambulance doit être identifiée de façon à la distinguer de tout autre véhicule.Elle doit: a) être entièrement et uniformément de couleur jaune pour véhicule prioritaire, conforme aux spécifications décrites à l'ANNEXE 6 au présent règlement; b) porter 4 fois le mot « AM BULANCE » écrit en couleur bleue, dont une fois sur chaque côté, aux dimensions de 45 pouces de longueur par 6 pouces de hauteur, une fois à l'arrière, aux dimensions de 25 pouces de longueur par 4 pouces de hauteur, une fois à l'avant, inversé, aux mêmes dimensions qu'à l'arrière, le tout en caractères de style « Helvetica médium»; c) porter 5 emblèmes «étoile de vie» conforme aux spécifications décrites à l'ANNEXE 7 au présent règlement, de couleur bleue sur fond blanc dont une sur le toit, aux dimensions de 42 pouces par 42 pouces, une sur chaque porte avant, aux dimensions de 12 pouces par 12 pouces, un à l'avant et un à l'arrière aux dimensions de 6 pouces par 6 pouces.Les paragraphes a et b ne s'appliquent pas aux ambulances utilisées par un service de police municipal, une Communauté Urbaine ou la Sûreté du Québec.9.005 The holder who wishes to give up the operation of the service must so advise the Minister, by registered mail, at least 90 days in advance.He must also advise the Minister of any change in the service he provides or of the territory he serves.9.006 Effective from the first of January 1977, every ambulance service must be capable of being reached by telephone by dialing a number connected to at least 2 single usage lead-in lines; at least one line must be reserved for coming in calls; the use of these lines and this number must only be limited to ambulance services.This number must be entered in the yellow pages of every telephone book published in the region served after the first of January 1976, only under the heading \"Ambulance\", with a different entry for each locality served.Division I VEHICLE EQUIPMENT § 1 \u2014 General Equipment 9.101 The ambulance service permit holder must ensure that all his ambulances are maintained in satisfactory working condition at all times.9.102 For such purpose, the permit holder must make the necessary inspections, verifications and repairs and keep a chart for each vehicle.This chart must indicate the date and nature of each inspection, verification or repair.9.103 An ambulance must be identified so as to be distinguishable from all other vehicles.It must: (a) be painted entirely and uniformly yellow for a priority vehicle, in compliance with the specifications described in SCHEDULE 6 to this Regulation; (b) bear the word \"AMBULANCE\" 4 times painted in blue, once on each side, measuring 45 inches in length by 6 inches in height, once on the rear, measuring 25 inches in length by 4 inches in height, once on the front, inverted, measuring the same as on the rear, the whole in \"Helvetica Medium\" style letters; (c) bear 5 \"star of life\" emblems in compliance with the specifications described in SCHEDULE 7 to this Regulation, blue on a white back-ground, one on the roof, measuring 42 inches by 42 inches, one on each front door measuring 12 inches by 12 inches, one on the front and one on the rear, measuring 6 inches by 6 inches.Subparagraphs a and b do not apply to ambulances used by a municipal police department, an Urban Community or the Québec Provincial Police. Partie 2 GAZETTE OFFICIELLE DU QUÉBEC.30 janvier 1976.108e année.N° 7 1309 L'espace consacré à la publicité, y compris à la reproduction du nom de l'exploitant ou du détenteur de permis ne peut dépasser 100 pouces carrés sur chacun des côtés du véhicule.9.104 Le véhicule doit être équipé d'un moteur à essence d'un minimum de 135 HP net à 8 cylindres et d'une capacité minimum de 300 pouces cubes.La conduite et les freins du véhicule doivent être assistés; l'alternateur doit être d'une capacité minimum de 90 ampères, de 12 volst avec 2 courroies d'entraînement.Le véhicule doit être équipé de 2 accumulateurs d'une capacité individuelle minimum de 90 ampères/heure, de 12 volts; il doit être équipé d'une transmission automatique, avec un minimum de 3 vitessess avant.Le véhicule doit être équipé d'un pneu de secours accessible sans déplacer les civières, d'un système de refroidissement du moteur répondant à des exigences de haute performance et d'un tuyau d'échappement à embouts soudés.9.105 Le véhicule doit être séparé, par une cloison, en 2 parties distinctes: a) un compartiment réservé aux personnes transportées; b) un compartiment réservé au conducteur.La cloison doit être pourvue d'une porte coulissante permettant le passage d'un individu entre les 2 compartiments.Cette porte et la cloison doivent pouvoir arrêter tout objet en cas de décélération brusque.9.106 Le compartiment réservé aux personnes transportées doit être isolé et insonorisé.Ses dimensions minimums doivent être de 105 pouces de longueur par 69 pouces de largeur à la base des fenêtres et de 52 pouces de hauteur à l'intérieur, entre le plancher et le plafond.Les fenêtres doivent pouvoir être obstruées.9.107 Le réseau électrique du compartiment réservé aux personnes transportées doit être contrôlé indépendamment de celui du reste du véhicule.9.108 L'espace nécessaire pour la civière permanente prévue au paragraphe 13 de l'article 9.118 doit être aménagé dans le compartiment réservé aux personnes transportées.Des courroies ou des attaches doivent être prévues au plancher et aux murs pour l'immobilisation de la civière.9.109 Un banc, situé dans le côté droit du compartiment réservé aux personnes transportées, doit pouvoir servir pour le transport des malades ou blessés assis.Le compartiment réservé aux personnes transportées doit être muni d'un deuxième banc, escamotable, destiné au préposé d'ambulance.9.110 Tout objet ou pièce d'équipement non utilisé doit être fixé ou remisé dans un cabinet à fermeture.Les contenants de solutés doivent être en matière souple.The space reserved for advertising, including the reproduction of the operator's or permit holder's name must not exceed 100 square inches on either side of the vehicle.9.104 The vehicle must be equipped with a minimum 135 net HP gas engine at 8 cylinders and a minimum capacity of 300 cubic inches.The command and brakes of a vehicle must be assisted; the alternator must have 12 volts, 90 ampere minimum capacity with 2 transmission belts.The vehicle must be equipped with 2 minimum individual capacity 12 volts, 90 ampere per hour batteries: it must be equippped with automatic transmission, with a minimum of 3 front gears.The vehicle must be equipped with a spare tire accessible without having to move the stretchers, a motor cooling system meeting the requirements of high speed and an exhaust pipe with welded nozzles.9.105 The vehicle must be divided by a partition into 2 distinct parts: (a) a compartment reserved for persons transported; (b) a compartment for the driver The partition must contain a sliding door permitting an individual to go from one compartment to the other.This door and the partition must be able to stop any object in case of sudden deceleration.9.106 The compartment reserved for persons transported must be insulated and sound-proof.It must be at least 105 inches in length by 69 inches in width at the base of the windows and 52 inches in height within, between the floor and the ceiling.Blocking of the windows must be possible.9.107 The electrical system of the compartment reserved for persons transported must be controlled independently from that of the remainder of the vehicle.9.108 The necessary space for the permanent stretcher prescribed in subparagraph 13 of section 9.118 must be located in the compartment reserved for persons transported.Straps or fasteners must be anchored to the floor and to the walls to immobilize the stretcher.9.109 A bench capable of being used for the transport of seated sick or injured persons must be installed on the right side of the compartment.The compartment reserved for persons transported must contain a second folding seat, to be used by the ambulance attendant.9.110 All objects or items of equipment not in use must be firmly attached or stored in closed cupboards.Fluid containers must be of pliable matter. 1310 QUÉBEC OFFICIAL GAZETTE.January 30.1976.Vol.108.No.7 Pari 2 9.111 Des pones, situées à l'arrière du véhicule ainsi que du côté latéral opposé au conducteur, doivent donner accès au compartiment réservé aux personnes transportées.Ces portes doivent être d'une hauteur d'au moins 45 pouces; la largeur doit en être d'au moins 45 pouces à l'arrière et 30 pouces sur le côté.9.112 Les surfaces des marchepieds et du plancher du compartiment réservé aux personnes transportées doivent être recouvertes d'une surface antidérapante et être faciles d'entretien.9.113 Lorsqu'un malade ou un patient se trouve dans le compartiment réservé aux personnes transportées, la température doit être constamment maintenue entre 20° et 23° Celcius.9.114 Une ambulance doit en outre être munie de l'équipement de sauvetage suivant: 1) 2 cordes de 7a pouce en sisal ou l'équivalent, de 50 pieds chacune et de 1000 livres de résistance; (3) be at least 18 years of age; (4) know how to operate all the equipment which must be in an ambulance, effective from the date on which such equipment was installed; (5) know the provisions of the Act and this Regulation respecting ambulance services.For the purposes of subparagraph 2, 2 years of experience on a full-time basis as ambulance driver or attendant is equivalent to one year of schooling successfully completed.9.203 In addition to the conditions set forth in section 9.202, a driver must have taken a preventive driving course, he must hold a motor vehicle chauffeur's permit
