Whereas pursuant to paragraph / of section 9 of the Provincial Parks Act (R.S.Q., 1964, chapter 201).the lieutenant-gouverneur en conseil may make, amend and revoke regulations for the following purposes and generally, all purposes necessary for the carrying out of this Division; Whereas pursuant to unconsolidated section 16b (1978, chapter 65.section 45) of the Wild-life Conservation Act (R.S.Q., chapter C-61), the lieutenant-gouverneur en Conseil may, by regulation, establish wildlife sanctuaries, development and conservation zones, and controlled zones, and; (a) determine the conditions under which hunting or fishing are permitted there; (b) totally or partially prohibit the carrying, transportation or possession of hunting or fishing gear; (c) determine the conditions with which a person must comply if, for recreational purposes, such person has access to, stays or travels in such zones or sanctuaries or engages in any activity, and the duties such person must pay; Whereas il is advisable to replace the Regulation respecting hunting in wildlife sanctuaries for species other than moose, made by Order in Council 1311-79 dated 9 May 1979; It is ordered, therefore, upon the recommendation of the ministre du Loisir, de la Chasse et de la Pêche; That the Regulation respecting hunting in the Pare des Laurentides and in wildlife sanctuaries for species other than moose, attached to this Order in Council, be made.Louis Bernard, Clerk of the Conseil exécutif. 2460_GAZETTE OFFICIELLE DU QUÉBEC.June 25.1980.Vol.112.No.29_Part 2 Regulation respecting hunting in the Parc des Laurentides and in wildlife sanctuaries for species other than moose Provincial Parks Act (R.S.Q., 64, c.201, s.3 and 9, par.7) Wild-life Conservation Act (R.S.Q., c.C-61, unconsolidated section 766 (1978, c.65, s.45)) 1.In the Parc des Laurentides or a wildlife sanctuary mentioned in Column I of Schedule A, hunting is permitted for the species of birds or mammals designated in Column II.2.For a species or a group of species designated in Column II of Schedule A.the hunting seasons are established in Column III.the daily limits in Column IV and the possession limits for the duration of the stay, which apply only for overnight stays, in Column V.3.A person who hunts the species of birds or mammals designated in Column II of Schedule A in the Parc des Laurentides or a wildlife sanctuary mentioned in Column I must hold an access permit which costs three (3,00 $) dollars a day for small game hunting and five (5,00$) dollars for Virginia deer.Despite the provisions of the first paragraph, it is not necessary to hold an access permit to hunt in the Plaisance Wildlife sanctuary.4.In the Anticosti Island Wildlife Sanctuary, hunting Virginia deer is permitted in accordance with the procedures for lodging mentioned in Column I of Schedule B and at the rates mentioned in Columns II and III.Noie: Although the text of the Revised Statutes of Québec does not at present include texts of amendments made to Acts after 31 December 1977, references to Acts are made in the Regulation above as if the texts of those amendments were in fact included.Howerver, the term \"unconsolidated\", where used, indicates that references are made in accordance with the numbering used in amending Acts subsequent to 31 December 1977 identified in parentheses.The cost for bunting Virginia deer in the Anticosti Island Wildlife Sanctuary is established in accordance with one of the following four (4) procedures for lodging: Lodging in a tent with guide includes: \u2014 5 days on the island, including 4 days hunting; \u2014 all meals accommodation on the island; \u2014 limit of two (2) deer per hunter; \u2014 guide service (I guide per 2 hunters); \u2014 return air transport from Sept-Fles or Mont-Joli to Anticosti; \u2014 land travel on the island; \u2014 transport of game to Sept-fles or Mont-Joli.Lodging in a tent without guide includes: \u2014 5 days on the island, including 4 days hunting; \u2014 all meals and accommodation on the island; \u2014 limit of two (2) deer per hunter; \u2014 return air transport from Sept-Iles or Mont-Joli to Anticosti; \u2014 return transport from Port-Menier airport to the tent or hunting territory, if necessary; \u2014 transport of game to Sept-Iles or Mont-Joli. Part 2_GAZETTE OFFICIELLE DU QUÉBEC.June 25.1980, Vol.112.No.29_2465 Slay\tTariff (per resident hunier)\tTariff (for non-resideni humeri Column 1\tII\tIII Slay in tent with guide\t925$\t1 155$ Stay in tent without guide\t700$\t875$ Stay in cabin\t325$\t400$ Stay in bush camp (Baie de l'Ours) reserved for Québec residents\t20$\t 714-28-2-0 SCHEDULEB ANTICOSTI ISLAND WILDLIFE SANCTUARY \u2022I t t # i Pan 2__GAZETTE OFFICIELLE DU QUEBEC.June 25.1980.Vol.112.No.29 2467 O.C.1606-80, 28 May 1980 POLICE ACT (R.S.Q.c.P-13) Standards for hiring constables and cadets of the Sûreté du Québec \u2014 Derogations for constables on autoroutes Concerning the Regulation authorizing certain derogations to the rules of eligibility to become a member of the Sûreté du Québec.Whereas pursuant to section 44 of the Act to amend the Police Act (1979, chapter 67), assented to on 21 December 1979, the constables appointed under paragraph g of section 17 of the Autoroutes Act (R.S.Q., chapter A-34) who are in office on the date of the coming into force of the said amending Act are eligible to become members of the Sûreté du Québec by preference over any other person if they have the required qualifications; Whereas pursuant to the same provision, the Government may, after consulting the interested parties, authorize certain derogations to the existing rules of eligibility or exempt these constables from certain prescribed conditions; Whereas after consultation with the interested parties, it proves necessary to make exceptions or to provide for certain derogations to the rules of eligibility prescribed in By-law number 7 of the Commission de police du Québec respecting standards for hiring constables and cadets of the Sûreté du Québec and the municipal police forces approved by Order in Council 461 dated 3 February 1971 and amended by Order in Council 1642-79 dated 6 June 1979; Whereas it is advisable to make a regulation to that effect; Whereas pursuant to section 55 of the Interpretation Act (R.S.Q., chapter 1-16).wherever an Act comes into force by proclamation, the regulations contemplated therein may validly be made and published before the date of the proclamation; It is ordered, therefore, upon the recommendation of the ministre de la Justice: That the \"Regulation authorizing certain derogations to the rules of eligibility to become a member of the Sûreté du Québec\", attached hereto, be made; That the said Regulation be published in the Gazelle officielle du Québec.Louis Bernard, Clerk of the Conseil exécutif.Regulation authorizing certain derogations to the rules of eligibility to become a member of the Sûreté du Québec An Act to amend the Police Act (1979, c.67, s.44) I.Despite subparagraph b of section 3 of \"By-law number seven (7) of the Commission de police du Québec respecting standards for hiring constables and cadets of the Sûreté du Québec and of municipal police forces\" approved by Order in Council 461 dated 3 February 1971 and amended by Order in Council 1642-79 dated 6 June 1979, constables appointed pursuant to subparagraph g of section 17 of the Autoroutes Act (R.S.Q., chapter A-34), and who hold a position on the date of the coming into force of the Aci to amend the Police Act (1979, chapter 67), meet the conditions of eligibility prescribed by this provision if they have been considered to be of good moral character according to the conclusions of the inquiry made into such person by the Office des auto-routes du Québec upon beginning their duties with the Office. 2468_GAZETTE OFFICIELLE DU QUÉBEC.June 25.1980.Vol.112.No.29 722-0 2.Such constables are exempt from the application of the conditions of eligibility provided for in subparagraphs h and j of section 3 of the said By-law.3.Such constables are equally exempt from the conditions provided for in section 4 of the By-law that would make them ineligible and shall therefore be considered as having successfully undergone a medical examination required by this provision despite the fact that they do not meet all the requirements.4.This Regulation shall come into force on the date of the coming into force of the Act to amend the Police Act (1979, chapter 67). Whereas pursuant to subparagraph a of section 82 of the Wild-life Conservation Act (R.S.Q., chapter C-61), the Government may.in addition to the other regulatory powers assigned to him by this Act.make regulations for fixing types and categories of licences, for residents or Canadian or foreign non-residents, limiting the number of licences of each category and determining the conditions to be fulfilled by applicants for and holders of licences, the form, cost, tenor and term of such licences, the manner of replacing them in case of loss and the cost of such replacement, ihe obligations of trustees authorized to sell such licences and their fees, and indicating the obligations of a licence holder in case of a change of address: Whereas pursuant to subparagraph e of section 82 of the Wild-life Conservation Act (R.S.Q.chapter C-61) the Government may, in addition to the other regulatory powers assigned to it by this Act.make regulations dividing the Province of Québec into hunting zones and determining, within each zone or part of a zone, the animals or classes of animals which may be hunted and the periods of the year or the parts of the day during which hunting for such animals or classes of animals is prohibited: Whereas it is advisable to amend the Regulation respecting moose hunting in the Laurentides and Mont-Tremblant Parks and in the following wildlife sanctuaries: Chibougamau, Dunière, La Vérendrye, Matane, Mastigouche, Portneuf and Saint-Maurice, made by Order in Council 1310-79 dated 9 May 1979; 2470 GAZETTE OFFICIELLE DU QUÉBEC.June 25.1980.Vol.112.No.29_Pan 2 It is ordered, therefore, upon the recommendation of the ministre du Loisir, de la Chasse et de la Pêche: That the Regulation amending the Regulation respecting moose hunting in the Laurentides and Mont-Tremblant Parks and in the following wildlife sanctuaries: Chibougamau.Dunière.La Vérendrye.Matane.Mastigouche.Portneuf and Saint-Maurice, attached hereto, be made.Louis Bernard.Clerk of the Conseil exécutif.Regulation amending the Regulation respecting moose hunting in the Laurentides and Mont-Tremblant Parks, and in the following wildlife sanctuaries: Chibougamau, Dunière, La Vérendrye, Matane, Mastigouche, Portneuf and Saint-Maurice Provincial Parks Act (R.S.Q., 1964.c.201), ss.3, 9, par.J, and s.36 Wild-life Conservation Act (R.S.Q., c.C-61) unconsolidated section 76b (1978, c.65, s.45) and s.82, subpar.a and e I.The Regulation amending the Regulation respecting moose hunting in the Laurentides and Mont-Tremblant Parks, and in the following wildlife sanctuaries: Chibougamau, Dunière.La Vérendrye.Matane.Mastigouche, Portneuf and Saint-Maurice, made by Order in Council 1310-79 dated 9 May 1979 is amended by replacing section 3 by the following: \"3.A hunting party may kill only one moose (male, female or young) and a wolf or a coyote.In the parks and wildlife sanctuaries mentioned in Schedule A, each party may also kill a blank bear except in the wildlife sanctuaries of Dunière and Matane.\" Note: Although the text of the Revised Statutes of Québec does not at present include texts of amendments made to Acts after 31 December 1977, references to Acts are made in the Regulation above as if the texts of those amendments were in fact included.However, the term \"unconsolidated\", where used, indicates that references are made in accordance with the numbering used in amending Acts subsequent to 31 December 1977 identified in parentheses. Part 2_GAZETTE OFFICIELLE DU QUÉBEC.June 25, 1980.Vol.112.No.29_2471 2.Section 7 of the Regulation is replaced by the following: \"7.Number of hunters and parties.Composition of a party.For a park or wildlife sanctuary: a) the total number of hunters authorized to hunt appears in Colomn III of Schedule A; b) the total number of hunting parties authorized to hunt appears in Column IV; c) the number of hunters in a party appears in Column V.In Mont-Tremblant Park and the wildlife sanctuaries of La Vérendrye and Matane, the leader of a party may use the services of a guide who constitutes the third person of the party.\" 3.Section 11 of the Regulation is replaced by the following: \"11.In the sectors of parks and wildlife sanctuaries where moose hunting is authorized, travel is permitted at any time for the following persons: a) the licence-holder and his companions entered on the right of access for the hunting sector specified thereto; b) the employees working in such parks in the performance of their duties.However, travel for cases not specified in the first paragraph is permitted only between 10 00 and 15 00 and between 19 00 and 22 00.4.The Regulation is amended by replacing Schedule A by the one attached to this Regulation.5.This Regulation comes into force on the date of its second publication in the Gazelle officielle du Québec. (b) \"Act\": the Crop Insurance Act (R.S.Q.chapter A-30); (c) \"Régie\": the Régie de l'assurance-récolte du Québec; (d) \"average yield\": the yield per hectare determined in accordance with section 6; (e) \"total yield\": the product of the average yield multiplied by the number of insured hectares expressed as a mass; (f) \"insured yield\": the quantity of the crop that corresponds to 80% of the total yield; (g) \"actual yield\": the yield determined by an individual appraisal; (h) \"flue-cured tobacco\": tobacco intended for making cigarettes.Division II ELIGIBILITY 2.Eligible areas Any area of at least 4 hectares of flue-cured tobacco cultivated and declared in an application for insurance that must be signed by the producer before 30 April of the year during which the protection will be in force is insurable under this program.Any area of land leased after 30 April or cultivated on an occasional basis is not eligible for insurance.Members of the same family who are domiciled at the same place are considered as one producer within the meaning of the Act, where they use the same buildings for drying, grading and storing the crop.However the flue-cured tobacco crop is the subject of a different insurance contract where it is registered under a distinct sale number and is handled separately at the time of the picking, drying, grading and storage.3.Crop plan and operation Insured flue-cured tobacco must be cultivated in accordance with a crop plan, in agreement with the techniques recommended by the Conseil des productions végétales du Québec or approved by the Régie and adapted to the specific requirements of the farm and region.It must also be cultivated on a farm having the proper facilities: in particular, an irrigation system, an adequate water supply and the buildings necessary for drying, grading and sorting the crop. 2478 GAZETTE OFFICIELLE DU QUÉBEC.June 25.1980.Vol.112.No.29 Part 2 Division III 6; Average yield: PROTECTION 4.Scope: The insurable crop is protected against: (a) the harmful effects of the forces referred to in paragraphs a to g inclusive of section 24 of the Act; (b) flood, where it is an exceptional occurrence and is caused by a force of nature; (c) insects and uncontrollable plant diseases.5.Duration: The insurance is in force every year from the beginning of planting, to the extent that planting is possible, until the end of picking.The insurance protects the flue-cured tobacco crop provided that the planting, depending on the zones, is carried out between the following dates: Zones Municipal County Planting dates I Berthier, Joliette, L'Assomption, Montcalm 111 Pontiac Champlain.St-Maurice 17 May to 17 June 18 May to 18 June 19 May to 19 June The planting period may be extended in any zone beyond the deadlines indicated above upon the express authorization of the Régie.In that case, the average yield may be reduced accordingly.Flue-cured tobacco is not protected by the insurance for damage caused by forces of nature that are covered but that occur after noon (12 00) of 12 September.The final dates for protection may be extended by the Régie in the cases stipulated in the second paragraph of section 25 of the Act.provided that the insured person notifies the Régie in writing of his delay to carry out the harvest and specifies the cause as soon as possible.(a) Where a producer is insured for the first, second or third year, he is granted the average yield of his zone established from the data obtained by producers insured for the last seven (7) years.(b) Where a producer is insured for the fourth, fifth, sixth or seventh year, the annual average yields obtained on his farm are used, to which are added the averages for the zones, to establish a seven (7)-year cycle.The annual averages for the zones are adjusted according to the producer's performance without, however, exceeding the limit of the regional average.The year of the lowest yield is excluded from the seven (7)-year cycle, and the figure is divided by six (6).(c) Where a producer has data on his yield for seven (7) years of insurance, he is granted the annual average yield obtained on his farm, from which the year of the lowest yield is excluded, and the figure is divided by six (6).(d) The average yield may exceptionally be based on a ten (lO)-year cycle, where it appears obvious that the average established for a seven (7)-year cycle does not correspond to the production capacity of the farm.In that case, the two (2) years of the highest yield and the two (2) years of the lowest yield are excluded and the figure is divided by six (6).7.Alteration of agricultural program: An insured person may change the cultivated and insured areas provided he submits his application therefor before I July.The Régie verifies the eligibility of the new areas and re-evaluates, where applicable, the insured yield and the assessment payable.8.Percentage of protection: The insurance covers 80% of the total yield. Part 2_GAZETTE OFFICIELLE DU QUÉBEC, June25.1980.Vol.112.No.29 2481 13.Decrease in yield: Where there is a loss in yield, the indemnity to which the insured person is entitled is determined according to the difference between the insured yield and the actual yield valued on the basis of the unit price.Of this amount, the value of any quantity of nondescript tobacco that exceeds 2% of the total quantity must be deducted.The actual yield of the crop is determined as follows: The quantity of the crop picked and not delivered to a purchaser, and the total quantity of flue-cured tobacco delivered to a purchaser, upon presentation of supporting documents, excluding the quantity of nondescript tobacco (N.D.) that exceeds 2% of the total quantity delivered and that was not graded for an insured cause of damage.Where the condition of an insured crop requires a total or partial destruction on an area of at least one undivided hectare, the producer must make a request to the Régie.Upon its acceptance, the producer proceeds with the total or partial destruction of the crop, and the decrease in yield registered will be combined with the one that will eventually affect the residual part of the crop.However, for the purposes of establishing the average yield, all the planted areas must be considered.14.Confined risks: The Régie, after accepting a confined loss in a flue-cured tobacco crop, may settle the loss without waiting for the actual yield of the crop at the end of the growing year, provided that: (a) the confined loss is caused exclusively by hail; (b) the damage occurs during the growing period that precedes the first picking of tobacco; (c) the damaged areas constitute a minimum of one hectare and are undivided; (d) because the loss so confined is total, no quantity of tobacco can be recovered; (b) \"insured person\": a producer who is eligible to receive or holds an insurance certificate; (c) \"field\": land which is clearly delimited and on which a category of insured crop is cultivated; (d) \"loss index\": the ratio between the indemnity paid by the Régie and the premium collected; (f) \"grain-corn\": corn grown for its grain; (g) \"Régie\": the Régie de l'assurance-récolte du Québec; (h) \"total yield\": the product of the average yield multiplied by the number of insured hectares expressed as a mass at 15% moisture; (i) \"insured yield\": the quantity of crop which corresponds to 70% or 80% of the total yield; (j) \"average yield\": the yield per hectare determined in accordance with section 6; (k) \"actual yield\": the yield determined by an individual appraisal.Division II ELIGIBILITY 2.A producer must apply for insurance for all the areas of grain-corn he cultivates, before 30 April of the year for which the protection is in force.Land leased after 30 April or cultivated occasionally does not qualify for insurance.The minimum area for any category is fixed at 4,0 hectares.3.Crop plan: The crop insured must be cultivated in accordance with a crop plan in conformity with techniques recommended by the Conseil des productions végétales du Québec or accepted by the Régie.(e) \"Act\": the Crop Insurance Act (R.S.Q., chapter A-30) 2484 GAZETTE OFFICIELLE DU QUÉBEC.June 25, 1980.Vol.112.No.29 Part 2 Division III PROTECTION 4.Coverage: The insurable categories of crops are protected against: (a) the harmful effects of the forces described in subparagraphs a to g and subparagraph j of section 24 of the Act; (b| flood, where it is an exceptional occurrence and is caused by a force of nature; (c) insects and uncontrollable plant diseases.5.Duration: (a) Protection begins with seeding and continues until 31 October, the final date set for harvest.The crop is not protected by the insurance where seeding continues after I June.(b) The deadlines for protection may be extended by the Régie in the cases provided for in the second paragraph of section 25 of the Act, if an insured person informs the Régie in writing that the harvesting has been delayed and states the reason immediately.6.Average Yield: Where a producer was insured for the first, second or third time with the Régie during the last six years, the average yield is determined upon submission of vouchers, with a maximum of 6 600 kilograms per hectare for the drained land and 5 600 kilograms per hectare for undrained land.During the first three years in which a producer is insured, no increase in the average yield may be granted when the loss index is higher than 1,0.Where a producer has three years or more experience with the Régie during the last six years, the average yield is limited to the average of the actual yields obtained.7.Alteration of agricultural programme: The insured person may change the areas cultivated and insured, provided that he applies before 1 July.The Régie will check that the new areas are eligible, and will re-evaluate the insured yield and assessment payable.8.Percentage of protection: The insurance covers 70% or 80% of the total yield at the producer's choice.Division IV NOTICE OF DAMAGE 9.Period for submitting notice: (a) As soon as a producer observes that a crop has suffered damage due to a cause covered by the insurance, he must inform the Régie immediately, so that the representative of the Régie may observe the cause of the damage and appraise it while the crop is still standing.(b) The insured person must submit a notice of damage whenever there is a cause of damage.(c| The deadline for giving notice of damage is determined by the final date for the harvest.10.Contents: The notice of damage must identify the crop affected, the probable cause and extent of the damage, and the dale on which it occurred.A notice of damage given orally must be immediately confirmed by the insured person in writing. Part 2 GAZETTE OFFICIELLE DU QUÉBEC.June 25.1980.Vol.112.No.29 2485 Division V APPRAISAL 11.For the purpose of determining the actual yield of the damaged crop, an inspector from the Régie will make an individual appraisal.12.The individual appraisal is made by taking field samplings of the crop.Where it is impossible to use the method of field samplings or it does not yield the desired results, the individual appraisal may by a physical count of the crop that has been garnered, silaged, or delivered.13.The sampling of the crop in the field is carried out using the following methods and procedures: 1.Determination of the sites to be sampled: The area of the field being known, the coordinates of the sites to be sampled are established by using the table of random numbers.2.Taking of Samples: The quantity of the crop on each site is sampled by means of standard measuring instruments.3.Analysis of samples and computation of the actual yield: The samples taken on the sites are weighed and a moisture test is made; the weight is then adjusted to correspond to a quantity of graincorn containing 15% moisture.The actual yield thus obtained is spread over the area sampled to arrive at the actual yield per hectare.Division VI INDEMNITY 14.(a) The maximum compensation rates per hectare for the operations carried out are: i) Special protection: disking 6,40$ harrowing 8,00 plowing 20,00 ii) Emergency measures: disking 8.00$ harrowing 10.00 plowing 25.00 sowing of corn 43,00 iii) Special emergency measures: For insects and diseases of an epidemic nature, the Régie may defray all or part of the cost of preventive works.lb) Special Protection: Where the harmful effect of a force of nature prevents the insured person from completing his seeding, he is entitled to the compensation mentioned above for the works carried out.In addition, he is entitled to 100% of the cost of nitrogeneous fertilizers and to 20% of the cost of potassium and phosphated fertilizers spread before the final date of seeding in accordance with the recommendations of the Conseil des productions végétales du Québec.However, vouchers must be filed with the Régie.In addition, he will be entitled to a lump sum payment of 25,00 $ per hectare.Following payment of compensation for unseeded areas, the insurance for those areas is cancelled. 2486 GAZETTE OFFICIELLE DU QUÉBEC.June 25.1980.Vol.112.No.29 Pan 2 (c) Emergency measures: A producer is always bound to carry out the emergency measures necessary to counter the harmful affects of a cause of damage likely to affect the yield.Compensation is paid for the emergency measures authorized by the Régie and carried out in accordance with its recommendations at the rates prescribed in paragraph a.However, if the producer fails to carry out the recommended measures, no compensation will be paid and the insurance for the areas concerned is cancelled.(d) Abandonment: An insured person who obtains authorization from the Régie to abandon a damaged field receives a maximum lump sum payment equal to 80% of the insured value of the field.In that case, the harvesting costs avoided do not apply.(e) Decrease in yield: The indemnity to which an insured person is entitled following a loss of yield due to the harmful affects of one of the forces of nature described in section 24 of the Act is computed according to the difference in mass between the insured yield and the actual yield valued on the basis of the unit price fixed by the Régie.This compensation may not in any case exceed the insured value.ifi Harvesting fees avoided: Any harvest for which an indemnity is payable and which was not completed on the date prescribed is subject to a reduction of indemnity for the harvest fees avoided, at the rate of 25,00 $ per hectare.(gl Limited risks: There will be a reduction for the fees avoided, and, after appraisal, an indemnity may be paid without wailing for the actual yield of the harvest at the end of the growing season on condition that: 1.The limited risk is due to the harmful effect of one or more of the following forces: (a) hail; (b) hurricane; (c) excessive heat or moisture preventing pollination of the corn; (d) premature frost preventing the grain from ripening.2.Where the grain is not pollinated, the effected areas are seeded on the same date and constitute a minimum area of 5 undivided hectares; 3.In the case of hail, hurricane or premature frost preventing ripening, the affected areas constitute a minimum area of one undivided hectare; I n the case of premature frost, the deadlines by regions for sending a notice of damage are as follows: \u2014 12 September for regions04,05, 08, 10and II;
