Concerning the \"Regulation amending the Regulation applying the Real Estate Brokerage Act*'.Whereas, under subparagraphs a, b, c, d, e, /and g of section 20 of the Real Estate Brokerage Act (R.S.Q., c.C-73), the Government may make regulations to determine : (a) the qualifications required of any person applying for a permit or registration certificate or a renewal, the conditions he must comply with, the financial statements and information he must produce, the terms of the security he must furnish or the deposit that may be made in lieu thereof, the examinations he must undergo and the fees he must pay ; (b) the form of applications for permits and certificates, of permits and certificates, and their duration ; (c) the issue of a broker*s permit to a trustee in bankruptcy or liquidator or to the testimentary executor or heirs of a deceased holder, but only for the time required to permit the sale of liquidation of the business ; (d) the manner of keeping the books, accounts and records of brokers and registered builders and their inspection by the Superintendent; (e) the occupations or professions that a broker, registered builder or salesman may engage in ; (f) the information and documents that a broker, registered builder or salesman must give to the parties to any real estate transaction; (g) the advertising of brokers and registered builders.Whereas it is advisable to further amend the \"'Regulation applying the Real Estate Brokerage Act\", made by Order in Council 2848 dated 19 October 1967 and amended by Orders in Council 1490 dated 1 April 1970, 1158-78 dated 12 April 1978, 2135-78 dated 5 July 1978, 980-80 dated 2 April 1980 (replacing Order in Council 2560-79 dated 12 September 1979) and 3532-80 dated 12 November 1980; Whereas the last paragraph of section 20 of the same Act stipulates that any regulation made under that section shall come into force on its publication in the Gazette officielle du Québec or on such later date as is fixed therein; It is ordered, therefore, upon the recommendation of the Minister of Financial Institutions and Cooperatives : That the \"Regulation amending the Regulation applying the Real Estate Brokerage Act\", attached to this Order in Council, be made.Louis Bernard, Clerk of the Conseil exécutif.Regulation amending the Regulation applying the Real Estate Brokerage Act Real Estate Brokerage Act (R.S.Q.c.C-73, s.20) 1.The Regulation applying the Real Estate Brokerage Act, made by Order in Council 2848 dated 19 October 1967 and amended by Orders in Council 1490 dated 1 April 1970, 1158-78 dated 12 April 1978, 2135-78 dated 5 July 1978, 980-80 dated 2 April 1980 (replacing Order in Council 2560-79 dated 12 September 1979) and 3532-80 dated 12 November 1980, is further amended by replacing sections 2 to 4 by the following : \"2.Every person applying for a broker's or salesman's permit or a registration certificate or for renewal thereof must: (a) reside in Québec; (b) be at least 18 years of age; (c) establish his honesty, solvency and competence ; (d) have sufficient knowledge of the practice of real estate brokerage and of the legislation relating to real estate transactions ; (e) not be the holder of a permit or certificate that has been suspended ; (f) not have had his permit or certificate revoked within the 12 months preceding the application.The requirements prescribed in the first paragraph also apply to a representative designated by a 3484 GAZETTE OFFICIELLE DU QUÉBEC.November 25.1981.Vol.113, No.50 partnership or corporaiion for the purposes of the Real Estate Brokerage Act.As of 1 January 1982, despite subparagraph cof the first paragraph, the Superintendent may issue a salesman's permit to a person who is declared bankrupt if he considers, after studying the case, that the person meets the other requirements of the Real Estate Brokerage Act and of this Regulation.3.As of 1 January 1982, the requirements respecting the solvency of a person applying for a broker's permit are as follows: (a) prove that his assets exceed his liabilities by at least 10000$, without considering the unpaid value of the goodwill; and (b) prove, in the case of a corporation, that the share capital issued and paid by the shareholders is 10 000 S minimum.Nevertheless, if the share capital issued and paid is less than 10000$ but the undistributed profits and initial surplus appearing in the statement of the corporation, in addition to the share capital, total over 10000 $, the corporation is presumed to meet the requirements.4.As of 1 January 1982, a person applying for a broker's permit or a registration certificate or for renewal thereof must prove he carries, for the duration of the permit or certificate applied for, a professional liability insurance policy in case of error or omision made in the discharge of his duties.The insurance policy must include the following terms : (a) the coverage must apply to professional acts performed by an employee of the broker or registered builder ; (b) the amount of coverage must be at least 100 000 S per claim and 300000$ for the aggregate of claims filed during the term of the coverage; (c) an undertaking on the part of the insurer to pay in lieu and stead of the insured, within the limits of the coverage, any amount, except for a franchise not exceeding 2 500$.that the insured may legally be bound to pay to a third person for any claim filed during the period of coverage; (d) an undertaking on the part of the insurer to notify the Superintendent within 30 days of cancellation or non-renewal of the insurance contract.4A.A person applying for a broker's permit, or the representative of a partnership or corporation applying for a broker's permit, must have acted as a salesman in Québec, or held employment related to real estate transactions, for at least 2 years during the 5 years preceding the application.A person applying for a broker's or salesman's permit, or the representative of a partnership or corporation applying for a broker's permit, must have a Secondary V diploma or an equivalent diploma recognized by the ministère de l'Éducation du Québec.A certificate of Secondary V test results issued by the ministère de l'Éducation du Québec is considered an acceptable equivalence.4B.A person applying for a registration certificate must hold a licence issued by the Régie des entreprises de construction du Québec under Division III of the Act respecting building contractors vocational qualifications (R.S.Q.c.Q-l).\".2.Sections 5 and 6 of the said Regulation are replaced by the following : \"5.A person applying for a broker's permit must submit, along with his application, financial statements dated within 6 months at the most.A person applying for renewal of his broker's permit must have submitted the financial statements for his last fiscal year within 6 months following the end of that fiscal year.6.The financial statements submitted by a person applying for a broker's permit or for renewal thereof must: (a) be drawn up so as to represent his financial situation accurately ; (b) include a financial statement, a statement of capital, a statement of changes in financial position, a statement of earnings and.in the case of a corporation, a statement of its undistributed profits; (c) be drawn up in accordance with generally recognized accounting principles; (d) bear his signature or, in the case of a partnership or corporation, the signature of an anthorized person.\".3.The said Regulation is amended by adding, after section 7, the following sections: \"7A.A person applying for a broker's permit or a registration certificate must submit a copy of the deed of corporation, of the partnership contract and of the registration of firm name, the address of each branch, the name of the person in charge of each branch and the names of the silent partners.7B.Every broker, salesman, registered builder or representative of a partnership or corporation must inform the Superintendent of any change in the address Pan 2 GAZETTE OFFICIELLE DU QUÉBEC.November 25.1981.Vol.113.No.50 3485 of his domicile or of his place of business within 10 days following such a change.7C.A person applying for a permit or certificate must include with his application 2 copies of a recent, full-face, 5 cm x 5 cm photograph.The date when the pictures were taken must be indicated on the back.In the case of a partnership of corporation applying for a broker's permit or a certificate, the designated representative must also comply with the first paragraph.\".4.Section 8 of the said Regulation is replaced by the following sections: \"8.The security prescribed in subsection 2 of section 6 of the Real Estate Brokerage Act must be furnished : (a) in the form of a surety bond issued by a company authorized to stand surety under the Guarantee Companies Act (R.S.Q., c.C-43); (b) in cash, by certified cheque, postal money order, bank money order or certified payment order drawn on a savings and credit union, to the order of the Minister of Finance ; or (c) in the form of a bearer bond convertible at any time, issued or guaranteed by the Government of Canada or of one of the Provinces, whose market value is at least equal to the amount of security exigible.8A.The security referred to subparagraphs b and c of section 8 may be furnished by the applicant for a permit or certificate, or by a third party.Where the security is furnished by the applicant, on his own behalf, he is subject to the same obligations as the surety in addition to those imposed upon him as principal.8B.The security remains in force for the term of the permit of certificate.The security may nevertheless be cancelled following 2 months' notice from the surety, addressed to the Superintendent, and upon written proof provided to the Superintendent that the same notice was sent to the broker, salesman or registered builder concerned by registered mail.8C.All security furnished in accordance with the terms of subparagraphs b and c of section 8 is forwarded by the Superintendent to the Minister of Finance, who holds it in trust until its date of expiry, and for a period of 2 years following that date.Security furnished by surety bond is kept by the Superintendent.8D.The security covers claims filed within 2 years following cancellation or expiry of the security for acts committed by the permit or certificate holder while the security was in force.\".5.Sections 13 and 13A of the said Regulation are revoked.6.Section 14 of the said Regulation is replaced by the following sections: \"14.The fees for examination of an application for a broker's permit, salesman's permit or registration certificate are as follows : (a) 50 S for a broker's permit or a registration certificate ; (b) 20 S for a salesman's permit.14A.The fees for the issuing or renewal of a broker's permit, salesman's permit or registration certificate are as follows: (a) 150$ for a broker's permit or a registration certificate ; (b) 40$ for a salesman's permit.The fees for renewal of a permit or registration certificate issued during the 3 months preceding the expiry date of the permit or certificate are reduced by one-half.14B.The fees for each revalidation of a salesman's permit under subsection 2 of section 7 of the Real Estate Brokerage Act are 25 $.14C.The fees for a first or supplemental examination are 15$.\".7.Section 15 of the said Regulation is replaced by the following : \"15.The applicant must submit to the Superintendent, along with his application, a cheque or money order to the order of the Minister of Finance covering the fees prescribed in sections 14, 14A, 14B and 14C\".8.Section 16 of the said Regulation is replaced by the following sections : \"16.An application for the issuing or renewal of a permit or certificate must be made on one of the following forms, the texts of which are attached to this Regulation : (a) Form A: application for a broker's permit or a builder's registration certificate ; (b) Form B : application for a salesman's permit ; (c) Form C : application for renewal of a broker's permit or builder's registration certificate; (d) Form D: application for renewal of salesman's permit. 3486 GAZETTE OFFICIELLE DU QUÉBEC.November 25.1981.Vol.113.No.50_Pan 2 16A.The permits and certificates are drawn up in accordance with the following forms, the texts of which are attached to this Regulation: (a) Form 1 : broker's permit, applicable to an individual; (b) Form 2: broker's permit, applicable to a partnership or corporation; (c) Form 3: salesman's permit; (d) Form 4: registration certificate, applicable to an individual ; (e) Form 5: registration certificate, applicable to a partnership or corporation.16B.Bonds, accounts and records must be kept by the broker or registered builder, using the following forms, the texts of which are attached to this Regulation : (a) Form 6: prescribed entries in respect to a real estate transaction; (b) Form 7 : quarterly report of trust transactions ; (c) Form 8: declaration and authorization respecting accounts in trust ; (d) Form 9 : declaration respecting absence of trust transactions.\".9.Section 18 of the said Regulation is replaced by the following: \"18.An application for renewal of a permit or registration certificate mus; be submitted to the Service du courtage immobilier du Québec by 30 September of each year.However, any application for renewal of a permit or certificate submitted during the months of October or November remains admissible.In such a case, the Service du courtage immobilier du Québec may send the renewed permit or certificate after 1 December.10.Section 19 of the said Regulation is replaced by the following : \"19.Where the holder of a broker's permit dies or is declared bankrupt, the Superintendent may: (a) grant the trustee, liquidator, executor or heirs of the deceased or bankrupt permit holder, a broker's permit for 6 months, with powers limited to the sale or winding up of the business; (b) exempt the person referred to in subparagraph a from taking an examination to obtain a broker's permit.Where the sale or winding up of the business is not completed within the 6 months, the Superintendent may extend the term of the permit.A salesman's permit holder employed by a broker who dies or is declared bankrupt is deemed to be a salesman for the trustee, liquidator, executor or heir holding the permit referred to in subparagraph a of the first paragraph.\".11.Section 20A of the said Regulation is replaced by the following: \"20A.During the month preceding the deadlines indicated below, the broker or registered builder must submit a detailed statement of his trust transactions to the Superintendent by completing Form 7 for the following periods: Deadline for sending report 1 May 1 August 1 November 1 February Trust transaction period covered 1 January to 31 March 1 April to 30 June 1 July to 30 September 1 October to 31 December A broker or registered builder who receives no sums of money for the account of others in the course of his business is exempt from submitting the quarterly reports referred to in the first paragraph, provided he includes with his application for a permit or certificate or for renewal thereof, an affidavit or solemn affirmation to that effect drawn up in accordance with Form 9.Nevertheless, a broker or registered builder who avails himself of the exemption in the preceding paragraph, but who then receives sums of money for the account of another person in the course of his business, must submit the prescribed quarterly reports.\".12.The said Regulation is amended by adding, after section 20C, the following section: \"20D.The trust account referred to in Division IV of the Real Estate Brokerage Act must be opened in Québec\".13.The said Regulation is amended by adding, at the end of section 21, the following paragraph: \"For inspection purposes, the broker or registered builder must keep the books, accounts, records and documents prescribed in the Real Estate Brokerage Act and in this Regulation for at least 5 years.\".14.Section 22 of the said Regulation is revoked.15.Sections 23, 24 and 25 of the said Regulation are replaced by the following sections: \"23.Where a mandate to carry out a real estate transaction is given in writing, the broker or registered Part 2 GAZETTE OFFICIELLE DU QUÉBEC, November 25, 1981.Vol.113.No.50 3487 builder who enters into the contract must provide one signed copy to the mandatary, keeping the other for his records.The obligation referred to in the first paragraph also applies to a salesman who enters into the contract on behalf of the broker or registered builder by whom he is employed.24.Any exclusive mandate given to a broker or registered builder must contain a clause stating that it expires on a specific, predetermined date.24A.All information and documents that a broker, registered builder or salesman gives the parties to a real estate transaction must have been checked by him.25.A broker, salesman or registered builder carrying out a real estate transaction must immediately submit to each of the parties a duly signed copy of every document establishing acceptance or refusal of an offer to purchase or of sale related to the real estate transaction.25A.The broker or registered builder must identify himself by the name indicated on his permit or certificate and mention that he is acting as a broker or registered builder on any document related to a real estate transaction.\".16.The said Regulation is amended by adding, after section 25A as added by section 15, the following: \"25B.The offer to purchase form provided by a broker, registered builder or salesman to the parties involved in a real estate transaction must reproduce the following paragraphs in cases where the broker or registered builder receives a deposit: (a) With this offer to purchase, I tender a deposit by cheque in the amount of $.drawn to the order of.Name of broker or registered builder in trust, which is to be deposited in trust if my offer to purchase is accepted.At the signing of the deed of sale, this amount will be applied to the purchase price.(b) (After the signature of the prospective purchaser and before the signature of the prospective vendor) RECEIVED FOR DEPOSIT IN TRUST The undersigned certify(ies) having received from the prospective purchaser the deposit mentioned in this offer to purchase.Date Signature of broker, registered builder or salesman in his employ Date Signature of broker, registered builder or salesman in his employ Where the broker, registered builder or salesman signs the receipt described in subparagraph b of the first paragraph, he is not required to provide the receipt prescribed in section 20B.\".17.Sections 26 and 27 of the said Regulation are replaced by the following sections: \"26.A broker or registered builder who advertises a real estate transaction must include in the advertisement his name as indicated on his permit or certificate and the fact that he is acting as a broker or a registered builder.The name of the broker or registered builder and the fact that he is a broker or registered builder must be included in any advertising regarding a real estate transaction in which the name of a real estate salesman in his employ is mentioned.27.A broker or registered builder may advertise a real estate transaction in collaboration only with a person who holds a broker's permit or a registration certificate.28.Every broker or registered builder must comply with the following rules for advertising a real estate transaction : (a) the facts stated in the advertising must have been checked by the broker or registered builder ; (b) the price announced or offered must be that agreed upon with the owner or his mandatary; (c) to post a \"for sale\" or \"for rent\" sign or other such sign to the same effect on the property of another person, the broker or registered builder must obtain the prior consent of the owner or his mandatary.\".18.The said Regulation is amended by replacing Forms A and C by Forms A and C attached to this Regulation.19.The said Regulation is amended by adding, after Form 8, Form 9 attached to this Regulation.20.This Regulation comes into force on the 10'\" day following the date of its publication in on the conditions it determines to make or order such improvements or structures as he deems expedient, and entrust bodies approved by the Minister with the management or with responsibilities respecting the management of such zones or sanctuaries for purposes of development, conservation and harvesting of wildlife resources; (f) prohibit or regulate commercial operations therein ; (g) determine the cases in which a person or a group of persons may be kept out or expelled; (h) prohibit or regulate the presence of dogs in such zones or sanctuaries.Such regulations come into force on users for the night; \"user\": person who has access to, or stays or travels in a wildlife sanctuary for recreational purposes.DIVISION II ACCESS Control of exits 2.A user who holds a right of access or exceeded maximum capacity: (3) a risk of serious damage to the environment exists: (4) there are specific needs of protection for a species of animal in a particular location or for a determined period.Work card 4.Upon request by a Reception Officer or Warden, a person who has access to, or stays or travels in the wildlife sanctuary for work purposes must produce a document proving that he has actually been assigned to such work.Conditions for staying in the sanctuary 5.A person who has access to, stays, or participates in an activity in the wildlife sanctuary for recreational purposes must respect the dates, times and places indicated on the right of access pass, where such a pass is required.Long excursion 6.To participate in a long excursion, a person must obtain a right of access pass from the reception station, or wildlife sanctuary office, at a cost of 3 $ per person per day for a community shelter, 3 S per campsite in a trail camping ground and 3 $ per canoe per day for canoe tripping.Fishing 7.To fish in the wildlife sanctuary, a person must hold a right of access pass, which costs 2 S per person per day.Recreational camping ground 8.To camp on a recreational camping ground, a person must obtain a permit for which the rate is as follows : (1) if the site has been cleared, but no water, sewers or electricity are provided, the cost is 4 $ per site per day : (2) if the site has been cleared, and one of the following services is provided water, electricity or sewers, the cost is 6$ per site per day; (3) if the site has been cleared, and two of the following services are provided: water, electricity or sewers, the cost is 7 $ per site per day; (4) if the site has been cleared, and all three services are provided: water, electricity or sewers, the cost is 8 $ per site per day.9.To camp in a wilderness recreational camping ground, a person must obtain a permit which costs 3 $ per site per day.DIVISION III GENERAL RULES Protection of environment and equipment 10.In the wildlife sanctuary, no user may: 1.fell or mutilate trees or bushes without a licence to cut timber issued by the Minister of Energy and Resources under the Lands and Forests Act (R.S.Q.c T-9); 2.paint or deface natural formations such as rocks; 3.dispose of waste or garbage elsewhere than in the places provided for that purpose ; 4.spread harmful substances such as oil, gas or pesticides: 5.damage moveable or immoveable property belonging to the Gouvernement du Québec.Tidiness 11.Every user must leave any place he has occupied and any equipment he has used clean and in good order.Dogs 12.No dogs are allowed in the wildlife sanctuary except those inside a vehicle crossing the sanctuary via Highways 175 or 169 or a seeing-eye dog accompanying its master.Hunting gear 13.No person may be in possession of hunting gear in the wildlife sanctuary unless he holds a right of access pass for hunting in the sanctuary or a permit to possess hunting gear issued by the Minister. or order any improvements or structures in the wildlife sanctuary, as he deems expedient and entrust approved bodies with the management or with responsibilities respecting the management for purposes of harvesting of wildlife resources in the wildlife sanctuary.Supply outlets 16.No person may operate a supply outlet in the wildlife sanctuary unless a concession contract has been granted by the Minister in accordance with the terms and conditions prescribed in the Regulation respecting government concession contracts made by Order in Council 2516 dated 3 August 1977.Vehicles 17.No user of the wildlife sanctuary may drive a vehicle elsewhere than on roads intended for motor vehicles, or use such a vehicle for purposes other than going to or returning from the place of an activity.18.Every person driving a motor vehicle must obey the speed limits posted along the roads within the wildlife sanctuary, and park in the areas laid out and marked for the purpose.Public peace 19.Any user must refrain from shouting, using a loud speaker or other amplification system, distributing circulars, pamphlets or brochures, and soliciting.Posting of bills 20.It is prohibited to post bills outdoors, except bills concerning activities and services offered by Parks and Wildlife Sanctuaries.Gatherings, entertainment 21.Any form of commercial entertainment or sports gathering is prohibited in the Wildlife Sanctuary.DIVISION IV RECREATIONAL ACTIVITIES Long excursions 22.To go on a long excursion, a person must be the holder of a right of access pass.23.On a long excursion, a user may stay no more than two nights at the same trail camping ground or in a community shelter or group shelter.24.A user who is the holder of a right of access pass for a long excursion must notify the reception station of his return.Camping 25.Canoe tripping may be undertaken only on routes indicated for that purpose on the document given to the holder of a right of access pass for the practice of that activity.Boats 26.Life jacket: every person using a boat in the wildlife sanctuary must have a life-saving cushion or life jacket in his possession, in accordance with the standards prescribed in Order in Council C.R.C.1978.c.1487.27.Number of passengers : no boat made available to the public for fishing in the wildlife sanctuary may hold more than 3 persons.28.Private boats: no private boat may be used except on the lakes and rivers designated for the purpose at each reception station.29.Motor boats: motor boats are prohibited except on the lakes and rivers designated for the purpose at each reception station.The maximum power of such motors also appears in the list.Snowmobiles 30.Snowmobiling is authorized on the trails marked and laid out for the purpose.Camping and site on a recreational camping ground must take possession of it on the same day.36.A user may not camp on a recreational camping ground for more than 7 consecutive days.Trail camping ground 37.The maximum number of occupants per site in a trail camping ground is 9.Catches 38.A hunter or fisherman must declare or show any catches for purposes of counting and weighing.Places are designated for that purpose at the reception station.Certain pans of fish or game may be removed for study purposes.Hiking 39.Hiking is authorized only is areas identified for that purpose at the reception station.Skiing excursions 40.Skiing excursions are restricted to trails identified for that purpose.41.In the winter time, only skis may be used in areas identified for the practice of that activity.Snowshoeing 12.Snow shoeing is restricted to areas identified for that purpose.Aircraft 43.Except in cases of force majeure, no one may use an aircraft to reach a recreational activity area in the wildlife sanctuary or a point different from that determined on the pass, without holding a right of access pass issued by the Minister for that purpose.DIVISION V FINAL PROVISIONS Expulsion 44.Any person who contravenes the Wild-life Conservation Act (R.S.Q.c.C-61), any provisions of this Regulation, the Fisheries Act (R.S.C., 1970, c.F-I4) or the Highway Code (R.S.Q.c.C-24) is subject to immediate expulsion from the Wildlife Sanctuary.45.This Regulation replaces the Regulations of the Laurentide Provincial Park made by Order in Council 865 dated 11 May 1965 and the Regulation section 53 of this Regulation; \"Group camping ground\": camping ground designed to receive organized groups of 12 to 36 persons; \"Recreational camping ground\": camping ground designed to meet the needs of users who wish to enjoy recreation and camping in a natural setting for several days and where the site has no water supply, electricity or sewers ; \"Trail camping ground\": camping ground designed to meet in a natural setting, the lodging, recreation and educational needs of the user as he carries on a recreational activity; \"Short excursion\": outing of less than one day.without an overnight stay en route ; \"Park Warden\": person designated by the Minister to enforce the Parks Act (R.S.Q.c.P-9) and its Regulations; \"Long excursion\": outing with at least one overnight stay; \"Superintendent\": person designated by the Minister to manage the Park ; \"Bunkhouse\": building situated along an excursion route, accommodating groups of approximately 8 to 20 users for the night used very little and set apart for preservation, observation and appreciation of the environment.DIVISION II ADMITTANCE Zoning 2.The Parc des Grands Jardins is divided into zones indicated on the zoning map in Schedule I.Preservation of the Caribou 3.The admittance of park users to all of the park, with the exception of Zones A-1 and P-1, is permitted only with the authorization of the Superintendent issued in accordance with section 9 from 15 September to 15 December.However, travel across the park to get to the Réserve des Laurentides is only permitted for persons who hold a right of access pass for hunting in the reserve of for holders of a permit to that effect issued by the Superintendent.4.From 15 December to 15 May, park users are admitted only to Zones A-l and P-l of the park.Preservation zone 5.A park user may be admitted to a preservation zone only for an excursion not involving an overnight stay in that zone, such as hiking or boating, or to participate in an organized educational activity.Moreover, short skiing or snowshoeing excursions are permitted in Zone P-l.6.Users may travel within the zone only on trails laid out and marked for that bunkhouse ; (3) picnicking; (4) scuba diving, fishing, sailing, short or long hikes, boating, bicycling and climbing; (5) participating in an organized educational activity; (6) observing the natural environment.Moreover, short skiing or snowshoeing excursions are permitted in Zone A-1.Reception and service zone 8.No person may operate a business within the park.However, in reception and service zones, grocery and convenience stores and rental shops for articles necessary for activities authorized in the park, are permitted if a concession contract has been granted by the Minister for that purpose in accordance with the standards prescribed in the Regulation respecting Government concession contracts made by Order in Council 2516 dated 3 August 1977.Superintendent 9.The Superintendent gives special authorization for activities not mentioned in this Regulation provided these activities : 1.are compatible with the types of usage provided for in the zoning plan ; 2.do not damage the natural environment; 3.do not disrupt the peace and quiet of park users; 4.do not interfere with the wildlife.10.The Superintendent may temporarily prohibit an activity or deny access to part or all of the park if: 1.the safety of park users would be in jeopardy ; 2.the facilities have reached or exceeded maximum capacity ; 3.there is a risk of serious damage to the environment ; 4.there is a specific need to protect an animal species on a particular site or for a determined period.DIVISION III GENERAL PROVISIONS Protection of environment and equipment 11.In the park, no park user shall: 1.fell, mutilate, cut or introduce any kind of plant or part thereof ; 3510 GAZETTE OFFICIELLE DU QUÉBEC.November 25.1981.Vol.113.No.50_Part 2 However, the collection of edible vegetable products is permitted solely for immediate consumption except in preservation zones where such collection is prohibited at all times; 2.subject to section 46.kill, capture, mutilate, molest, bother, feed or tame an animal; 3.bring in an animal except a seeing-eye dog accompanying a blind person ; 4.paint, deface, or remove any part of a rock or other natural formation; 5.spread harmful substances such as oil, gas or pesticides ; 6.dispose of waste or garbage elsewhere than in the containers and places provided for that purposes; 7.use or throw a detergent such as soap or any other harmful substance in a lake or watercourse in the park; 8.put charcoal or charcoal residues elsewhere than in the recipients or places provided for that purpose: 9.damage moveable or immoveable property belonging to the Gouvernement du Quebec.Authorizations 12.Except for the case mentioned in section 26, a park user who has obtained a permit to practise an activity must return it to the reception station when he leaves the park.Tidiness 13.Every user must leave any place he has occupied and any equipment he has used clean and in good order.Fishing tackle 14.The possession of fishing tackle in the park is prohibited except for the holder of a fishing permit.15.A person not authorized to fish must transport any fishing tackle inside the vehicle.Arms and hunting gear 16.The possession or transporting of arms or hunting gear in the park is prohibited.However, a person to whom a permit has been issued to travel across the park to get to the Réserve des Laurentides may transport an arm or hunting gear in the trunk of a vehicle or in a closed case inside the vehicle.Fortuitous events and force majeure 17.Park users must obey the instructions of the Superintendent or his substitute designated for that purpose in any case of force majeure or fortuitous event, particularly in the case of fire, flood or a search to help a person in distress.Work card 18.Any person visiting the park for work purposes must show the Reception Officer a card or document proving that he has actually been assigned to such work.The said person is subject to the same obligation as a park user, except for the requirements of his work.Parking 19.A park user may park a vehicle only in the places marked or specially laid out for that purpose.Motor vehicles 20.No park user may drive a motor vehicle elsewhere than on roads intended for motor vehicles, or use such a vehicle for purposes other than going to or returning from the place of an activity.Public peace 21.Within the park, a park user must refrain from shouting, using a loud-speaker or other amplification system, distributing circulars, pamphlets or brochures, and soliciting.Posting of bills 22.It is prohibited to post bills outdoors, except bills concerning activities and services offered in Québec parks.Gatherings, entertainment 23.Any form of commercial entertainment or sports gathering is prohibited in the park.DIVISION IV RECREATIONAL ACTIVITIES Long excursions 24.To go on a long excursion, a person must obtain a permit from the reception station or park office, at a cost of 3 $ per person per day to spend the night in canoe tripping.25.On a long excursion, a park user may stay no more than one night at the same trail camping ground or in a bunkhouse an no more than three nights at a recreational camping ground.26.A user who has obtained a permit to practise a long excursion activity must indicate his return to the reception station.Skiing excursions 27.In winter, cross-country ski trails are reserved strictly for skiing.Boats 28.Life jacket: To use a boat in the park, a user must obtain a permit at a reception station and have a life-saving cushion or life jacket in his possession, in accordance with the standards prescribed in the Small Vessel Regulations made by C.R.C.1978.c.1487.29.Number of passengers: No boat made available to the public for fishing by the ministère du Loisir, de la Chasse et de la Pêche may hold more than 3 persons.30.Pnvate boats: No private boat may be used except on the lakes and rivers designated by the Superintendent for each type of boat and listed at each reception station.31.Motor boats: The use of motor boats is prohibited.Bicycling 32.Bicycling is permitted only on roads intended for motor vehicles.Snowmobiles 33.The use of snowmobiles by park users is prohibited.Camping, campfires 34.Camping and campfires are permitted only in the areas designated and laid out for that purpose.Group camping ground 35.A group or an association must obtain a permit the cost of which is 3 $ per day per group of 12 persons in the same group to camp on a group camping ground.36.A group or an association may camp for a period of not more than 14 days on a group camping ground.Recreational camping ground 37.A person must obtain a permit the cost of which is 3 $ per day per site to camp in a recreational camping ground.38.Any person who rents a site in a recreational camping ground must occupy it on the same day.39.The maximum number of occupants per site in a recreational camping ground is 6 persons.40.Camper may stay at a recreational camping ground for a maximum of 7 consecutive days.41.Only one tent, tent-trailer or trailer is allowed per site in a recreational camping ground.42.The recreational camping ground site must be vacated before 14 h.43.Only one motor vehicle may be parked at the place provided for that purpose on each recreational camping ground site.Any other motor vehicles must be parked in the parking areas provided for that purpose.44.Campers must refrain from making noise after 23 h on a recreational camping ground site.Fishing 45.Fishing is prohibited in preservation zones.46.In the other zones, fishing is authorized on the lakes designated by the Superintendent and indicated on the permit.47.Subject to section 45.to fish in the park a person must hold a permit which costs 2 $ per person per day.48.A park user who tripping is restricted to the routes indicated for that purpose by the Superintendent, on the document given to the holders of a permit to practise that activity.Climbing 51.Climbing is permitted only at the places designated for that purpose by the Superintendent and listed at the reception station.Scuba diving 52.Scuba diving is permitted only in the lakes and rivers designated for that purpose by the Superintendent and listed at the reception station.DIVISION V FINAL PROVISIONS 53.The powers and duties of a Reception Officer are: 1.greeting and informing park users; 2.subject to section 3 and section 9, issuing permits; 3.collecting fees for certain activities; 4.requiring of a person working within the park, a card or document from the employer showing that he has actually been assigned to such work.54.In addition to those indicated in sections 3.9 and 10.the powers of a Superintendent are: 1.indicating the routes or places for certain activities in accordance with sections 30.46.49 to 52; 2.giving instructions in cases of force majeure or fortuitous event, as stipulated in section 17.55.Park Wardens must enforce the Parks Act and this Regulation.56.Any person who contravenes the Parks Act (R.S.Q.c.P-9), any provision of this Regulation, the Wild-life Conservation Act (R.S.Q., c.C-61), the Fisheries Act (R.S.C., 1970, c.F-14) or the Highway Code (R.S.Q., c.C-24) may be expelled from the park on the spot.57.Any person who disturbs the peace, particularly by fighting, shouting, yelling, swearing, singing, using insulting or obscene language, being drunk leasing articles required for the practice of activities authorized in the Park are permitted, if a concession contract is signed for that purpose by the Minister, in accordance with the standards practice of activities not provided for in this Regulation on condition that such activities: 1.are compatible with the types of usage provided for in the zoning plan : 2.do not cause deterioration of the natural environment; 3.do not interfere with the peace and well-being of the other users; 4.do not interfere with wildlife.8.The Superintendent may interrupt temporarily the practice of an activity or access to part or all of the Park if: 1.the safety of the users is imperilled; 2.the capacity of the installations has been fully reached or surpassed ; 3.there is a risk of seriously damaging the environment: 4.there are specific needs of protection for a species of animal in a particular location or for a determined period.DIVISION III GENERAL PROVISIONS Protection of the environment and of installations 9.In the Park, users may not: 1.destroy, mutilate, remove or introduce any kind of plant or part thereof.However, the collection of edible vegetable products is authorized solely for the purpose of consumption as food on the site, except in the preservation zones where it is forbidden at all times; 2.subject to section 26, kill, capture, mutilate, molest, disturb, feed or tame the animals; 3.introduce animals, except a sceing-eye dog accompanying its master; 4.paint, deface or remove rocks or other natural formations: 5.spread harmful substances, such as oil, gasoline or pesticides; 6.deposit garbage or other wastes elsewhere than in the containers and places prescribed for that purpose; 3520 GAZETTE OFFICIELLE DU QUÉBEC, November 25, 1981, Vol.113.No.50 7.use or discard cleaning products, such as soap, or any other harmful substance in the lakes or watercourses of the Park ; 8.discard charcoal or ashes elsewhere than in places provided for building fires or specifically designed for that purpose ; 9.damage moveable or immoveable property belonging to the Gouvernement du Québec.Authorization 10.Except for the case provided for in section 24, a user who has obtained a permit of authorization to practise an activity must return it to the Reception Station when leaving the park.Cleanliness 11.Users must leave any place occupied by them and any installations used by them in order and clean.Fishing tackle 12.Fishing tackle may not be carried in the park except by the holder of an authorization to fish.13.A person who is not the holder of an authorization to fish must transport any fishing tackle inside a vehicle.Arms and hunting gear 14.Arms or hunting gear may not be carried or transported in the Park.Fortuitous events and irresistible force 15.Users must obey the instructions of the Superintendent or his substitute designated for that purpose in the case of irresistible force or fortuitous events, particularly in the case of fire, flood or a search to help a person in distress.Work card 16.A person who circulates in the Park for purposes of work must show the reception officer a card or a paper from his employer proving that he is assigned to such work.The said person is subject to the same obligations as a user, except for the requirements of his work.Parking 17.A user must park only in the places identified or specially arranged for that purpose.Motor vehicles 18.Users may circulate in the Park in motor vehicles only on the roads suitable for motor vehicles, and may not use such vehicles for any purposes other than that of going to and returning from the place where the activity is to be practised.Public peace 19.A user must refrain, within the Park boundaries, from shouting, using a loudspeaker or other public address system, distributing circulars, pamphlets or folders or from soliciting.Posting of notices 20.Any posting of notices outside buildings except those related to activities and services offered by the Parks of Québec is prohibited.Gatherings and entertainment 21.All forms of commercial entertainment or sports gatherings in the Park are prohibited.DIVISION IV RECREATIONAL ACTIVITIES Long excursions 22.To undertake a long excursion, a person shall obtain an authorization from the reception station or the office of the Park administration, at a cost of 3$ per person per day to spend a night in a community shelter or 3 $ per location per day to spend a night in a trail camping ground or 3 S per canoe per day for canoe trips.23.During a long excursion, a user may not stay more than one night on the same trail camping ground or in the same community shelter and more than three nights on the same wilderness recreational camping ground.24.A user who has obtained authorization to undertake a long excursion must indicate his return to the reception station.Fishing 25.Fishing is prohibited in preservation zones.26.Fishing is authorized in the other zones in lakes and rivers designated by the Superintendent and indicated on the permit of authorization. Part 2 GAZETTE OFFICIELLE DU QUÉBEC.November 25.1981.Vol.113.No.50 352! 27.Subject to section 25, in order to fish a person must obtain a permit of authorization for which the rate is 2 $ per person per day.28.A user who has obtained an authorization to fish must declare or show his takes to the Reception Officer when leaving the park or when asked by a Reception Officer or a Parks Officer.Canoe tripping 29.Canoe tripping may be undertaken only on routes indicated for that purpose by the Superintendent on the document given to the holders of a permit of authorization for the practice of that activity.Skiing excursions 30.In the winter time, ski trails may be used only for skiing.Boating 31.Life jacket: To use a boat in the Park, a user must obtain a permit of authorization from the reception station, and must have a life cushion or life jacket, in accordance with the standards prescribed by the Small Boats Regulation established in C.R.C., 1978.c.1487.Private boats 32.Private boats may be used only on rivers and lakes designated by the Superintendent for each type of boat and indicated at each of the reception stations.33.Number of passengers: No boat made available to the public for fishing by the ministère du Loisir, de la Chasse et de la Pêche may carry more than 3 persons.34.Internal combustion engines: The use by users of boats propelled by internal combustion engines is prohibited.Bicycling trips 35.Bicycling trips are permitted only on roads suitable for motor vehicles and on appropriately marked trails.Snowmobiles 36.The use of snowmobiles by users is prohibited.Camping, fires 37.Camping and fires are permitted only in the places designated and arranged for those purposes.Group camping 38.To camp in a group camping grour.d.a group or association must obtain a permit of authorization, for which the cost is fixed at 3 $ per day per group of 12 persons in the same group.39.A group or association may camp for a period of not more than 7 consecutive days on a group camping ground.40.A person who leases a site on a recreational camping ground must take possession of it the same day.41.The maximum number of occupants per site on a recreational camping ground is 6.42.A user may not camp on a recreational camping ground for more than 7 consecutive days.43.Only one tent, tent-trailer or trailer may be installed per site on a recreational camping ground.44.The site of the recreational camping ground must be vacated before 14 h.45.Only one automobile may be parked in the place provided for that purpose in each site of a recreational camping ground.Any additional vehicles must be parked in the parking spaces arranged for that purpose.46.Users must not make any noise after 23 h in a recreational camping ground.47.To camp on a recreational camping ground, a person must obtain a permit of authorization, for which the rate is 4 S per site per day.48.To camp on a wilderness recreational camping ground, a person must obtain a permit of authorization for which the rate is 3 $ per site per day.Scuba diving 49.Scuba diving is authorized only in the lakes and rivers designated for that purpose by the Superintendent and indicated at the reception station. 3522 GAZETTE OFFICIELLE DU QUÉBEC.November 25.1981.Vol.113.No.50_Part 2 Sailing 50.Sailing is authorized only on the lakes designated by the Superintendent for that purpose and indicated at the reception station.Climbing 51.Climbing is authorized only in the places designated by the Superintendent for that purpose and indicated at the reception station.DIVISION V FINAL PROVISIONS 52.The powers and duties of a Reception Officer are: 1.to receive and inform users; 2.subject to section 7, issue permits of authorization; 3.collect the duties charged for practising certain activities; 4.require from a person who works in the Park a card or paper from the employer proving that he is assigned to such work.53.The Superintendent's powers, in addition to those mentioned in sections 7 and 8.are: 1.to indicate the trails or places where certain activities may be practised in accordance with sections 26.29.32.49.50 and 51 ; 2.to give instructions in cases of irresistible force or fortuitous events.54.The Park Wardens must see that the Parks Act and this Regulation arc enforced.55.A person who contravenes the Parks Act (R.S.Q.c.P-9).any provisions of this Regulation, the Wild-life Conservation Act (R.S.Q.c.C-61).the Fisheries Act (R.S.C.1970.c.F-14) or the Highway Code (R.S.Q.c.C-24) is subject to immediate expulsion from the Park.56.A person who disturbs the peace, in particular, by fighting, shouting, yelling, swearing, singing, using insulting or obscene language, being drunk, or annoying or molesting other persons is subject to immediate expulsion from the Park.57.This Regulation comes into force on 25 November 1981.
