\u2014 Amendments concerning the Regulation amending the Regulation respecting the application of the Health Insurance Act.Whereas pursuant to subparagraph h.2 of section 69 of the Health Insurance Act (R.S.Q., c.A-29), the Government may, after consultation with the board or upon its recommendation, make regulations to give a definition of \"person with a hearing handicap\", determine the hearing aids which are to be considered insured services for the purposes of the seventh paragraph of section 3, fix the cost of purchase, fitting, replacement or repair thereof, prescribe the conditions on which they may be furnished, fitted, replaced or repaired, prescribe the terms and conditions regarding claims and payments, fix the age of the persons with a hearing handicap who may benefit thereby and determine classes of such persons; whereas the Government has made the Regulation respecting the application of the Health Insurance Act (R.R.Q., 1981, c.A-29, r.l) and it is advisable to amend it; Whereas the Régie de I'assurance-maladie du Québec has been consulted with respect to those amendments ; IT is ordered, therefore, upon the recommendation of the Minister of more than 30 hours per week, save in exceptional cases and after written agreement with the Parity Committee ;\" 2 by adding the following paragraphs; \"(n) \"watchman\": employee whose duties consist mainly in surveillance work and cleaning the establishment or business place.\" (o) \"continuous service\": the uninterrupted period during which an employee is bound to the employer by a work contract, even if the carrying out of the work was interrupted without the contract being cancelled.\" 2.The Decree is amended in subsection 2.01 : 1.by adding the following subparagraph to paragraph 1 : \"(f) surveillance work and cleaning the establishment and the grounds of the establishment where work governed by this section is carried out.\" 2.by replacing paragraph 2 by the following: \"(2) The decree does not apply to work mentioned in paragraph 1 when exclusively performed for their own service or for the employer's needs; when carried out on motor vehicles rented to a private individual and to a corporation on a short or long term basis, such work is considered as having been performed for the public and not for the employer's own service or needs.\" 3.The Decree is amended by replacing subsection 2.02 by the follow ing : \"2.02 Territorial jurisdiction: this decree shall apply to the municipalities listed in Schedule 1.\" 4.The Decree is amended by replacing subsection 3.01 by the following: \"3.01 For servicemen, tire specialists, pump attendants and washers, the standard workweek shall be 44 hours, scheduled over 5 or 6 continuous days of work with a maximum of 9 hours a day.\" 5.The Decree is amended by replacing subsection 3.04 by the following: \"3.04 Any employee may demand up to 1 hour off without wages to take his meal beyond any period obliged to wait to be given work.3.07 An employee shall be considered as being at work during the coffee break.\" 6.The Decree is amended by adding, after subsection 4.01, the following subsection 4.02: \"4.02 For computing overtime hours, annual vacations and general holidays with pay shall be considered as workdays.\" 7.The Decree is amended by replacing subsection 5.01 by the following: \"5.01 An employee who reports to the work place at the express request of his employer or during the regular course of his employment and who works less than 3 consecutive hours, shall be entitled, except for a fortuitous case, to wages equal to 3 hours at his usual hourly wage rate except when he is entitled to a higher amount because of overtime hours.\" 8.The Decree is amended by replacing section 6.00 by the following: \"6.00 General holidays with pay 6.01 The following days shall be general holidays with pay whatever day of the week they fall : New Year's Day, 2 January, 1 July, Labour Day, 25 and 26 December, the afternoons of 24 and 31 December.6.02 No one can reduce an employee's wages because a day listed in subsection 6.01 is a holiday.6.03 The holiday pay for each paid general holiday shall be equal to the employee's wage for one working day provided that he worked or was on an authorized leave during the regular workday which precedes or follows the holiday.6.04 When a holiday falls on a Tuesday, Wednesday or Thursday, it may be celebrated on the following Friday or Monday after agreement between the parties, provided that a notice of such agreement be transmitted to the Parity Committee at least one month before the date of the holiday.6.05 An employee who works on a holiday shall be paid his regular rate in addition to receiving the holiday pay.6.06 When an employee is on annual vacation during one of the holidays provided for in subsection 6.01, the employer shall pay him the holiday pay provided for in subsection 6.03 6.07 For any employee-, St.John the Baptist Day shall be a general holiday with pay, pursuant to the National Holiday Act (R.S.Q., c.F-l.l).\" 9.The Decree is amended by replacing subsection 7.01 by the following: \"7.01 The qualifying year shall be a consecutive 12-month period during which an employee is progressively entitled to the annual vacation.The qualifying period shall extend from 1 May of the preceding year to 30 April of the current year.\" 10.The Decree is amended by replacing, in subsections 7.02 and 7.03, the words \"on 1 April\" by the following: \"at the end of the qualifying year.\" 11.The Decree is amended by replacing subsections 7.04 to 7.09 by the following: \"7.04 The employee who, at the end of the qualifying year, has 10 years of continuous service with the same employer, shall be entitled to 3 weeks of annual vacation; 2 of these weeks are continuous.7.05 The annual vacation pay subject to subsections 7.02 and 7.03 shall be equal to 4% of the employee's gross wages during the qualifying year.For the employee mentioned in subsection 7.04, the pay is equal to 6 % of the employee's gross wages during the qualifying year.7.06 When an employee subject to subsections 7.03 and 7.04 is absent because of sickness or accident or is on a maternity leave during the qualifying year and such absence reduces his/her annual vacation pay, s/he shall then be entitled, as the case may be, to 2 or 3 times the average weekly wages earned during the period worked.The employee subject to subsection 7.02, whose annual vacation is inferior to 2 weeks, shall be entitled to such amount at the prorata of the days of vacation s/he has accumulated.7.07 The annual vacation shall be taken within 12 months following the end of the qualifying year.A period of salary insurance, sickness or disability, interrupted by a vacation taken in accordance with the 1\" paragraph is continued, if necessary, after such vacation, as if it had not been interrupted.7.08 An annual vacation of more than 1 week may be divided at the employee's request.A vacation of 1 week or less cannot be divided.7.09 When an employee quits his employment he receives the vacation pay acquired before the preceding 1 May, if not taken, in addition to any pay owing to him for the period elapsed since this date. 3470 GAZETTE OFFICIELLE DU QUÉBEC.December I.1982.Vol.114.No.54 Part 2 7.10 An employee has the right to know the date for his annual vacation at least 4 weeks in advance.7.11 The employer is forbidden to replace the vacation mentioned in subsections 7.02, 7.03 and 7.04 by a monetary compensation.However, at the employee's request, the 3\" week of vacation may be replaced by a monetary compensation when the establishment closes its doors for 2 weeks on the occasion of the annual vacation.7.12 The employee shall receive the annual vacation pay in one payment only before the beginning of the annual vacation.7.13 The employer may close his establishment for 1 or 2 full weeks of annual vacation.7.14 No employee may take more than 2 weeks of continuous vacation during the months of June, July and August, unless otherwise agreed upon by the employer.7.15 Despite any other provision of this section, the employer shall grant to the employee conditions at least equal to those provided for in sections 66 to 77 of the Act respecting labour standards (R.S.Q., c.N-1.1).** 12.The Decree is amended by replacing subsection 8.00 by the following: \"8.00 Bereavement leave: 8.01 An employee may be absent from work for 1 day, without a loss in wages, on the occasion of the death or funeral of a child, the person to whom he is married or with whom he lives maritally, within the meaning of paragraph b of subsection 3° of section 1 of the Act respecting labour standards, his father, mother, a brother or sister.He may also be absent for 3 other days on such occation, but without wages.8.02 An employee may be absent from work for 1 day, without a loss in wages, on his wedding day.An employee may also be absent from work, without wages, on the wedding day of one of his children or for 2 days on the occasion of the birth or adoption of a child.8.03 To take advantage of the leave provided for in subsections 8.01 and 8.02, the employee shall inform his employer before the beginning of the standard workday and if possible, at least 2 hours in advance.\" 13.The the nature and amount of deductions made; (k) the amount of net take-home pay.\" 14.The Decree is amended.by replacing subsections 9.05 and 9.06 by the following: \"9.05 No advantage having pecuniary value may be taken into account in computing the wages provided for in this decree.9.06 An employee is deemed not to have received payment of the wages due to him if the cheque delivered to him is not cashable within 2 working days following receipt of the cheque.9.07 The wages of an employee must be paid directly to him, at his place of employment and on a working day.The wages of an employee may also, at his written request, be remitted to a third person.9.08 If the usual pay day falls on a general holiday, wages are paid to the employee on the working day preceding such day.9.09 No signing formality other than that establishing that the sum remitted to the employee corresponds to the amount of net wages indicated on the pay sheet may be required upon payment of wages.9.10 Acceptance of a pay envelope by an employee does not mean that he has renounced payment of all or part of the wages due to him.9.11 ' No employer may make deductions from wages unless he is required to do so pursuant to an act, a regulation, court order, collective agreement or decree, or unless he is authorized to do so in writing by the employee.The employee may at any time revoke authorization, except where it pertains to membership in a group insurance plan, or a supplemental pension plan within the meaning of the Supplemental Pension Plans Act (R.S.Q., c.R-17).The employer shall remit the sums so withheld to their intended receiver.9.12 Any gratuity paid directly or indirectly by a patron to an employee belongs to him by right and does not form part of the wages that are otherwise due to him.Any gratuity collected by the employer shall be remitted to the employee.The word \"gratuity\" includes the service charge added to the patron's bill.9.13 Despite any other provision of the Decree, the employer shall pay the employee at least the minimum hourly wages that would be payable to him according to the Regulation respecting labour standards (R.R.Q., 1981, N-l.1, r.3) or according to any further regulation that could amend or replace it,\" 15.The Decree is amended by replacing section 10.00 by the following: \"10.00 Miscellaneous provisions 10.01 Except in the case of a contract for a fixed period or for a specific undertaking, an employee who has at least 3 months of continuous service shall be entitled to a written prior notice before he is dismissed or layed off for at least 6 months.This prior notice shall consist of 1 week if the employee has less than 1 year of continuous service ; 2 weeks if he has from 1 to 5 years of continuous service ; 4 weeks if he has from 5 to 10 years of continuous service and 8 weeks if he has 10 years or more of continuous service.10.02 Except in the case of grave fault by the employee or of a fortuitous event, an employer failing to give such prior notice must pay to the employee, at the time his employment terminates, a compensatory indemnity equal to the employee's wages for a period equal to the period of the prior notice.10.03 At the expiry of the contract of employment, an employee may require his employer to issue him a work certificate stating exclusively the nature and the duration of his employment, the dates on which his employment began and terminated, and the name and address of the employer.The certificate shall not carry any mention of the quality of the work or the conduct of the employee.\" 10.04 For temporary employees whose duties are described in paragraphs g, h, k and n of subsection 1.01, the sole provisions of the Decree that do not apply are those listed in subsections 3.01 to 3.03, 3.05 and in sections 4.00 to 6.00.* 10.05 For temporary employees whose duties are described in paragraphs a, c to e and i of subsection 1.01, the standard workweek shall be scheduled from DIVISION m CANCELLATION, SUSPENSION AND REVOCATION OF A LICENCE 7.Where a request for cancellation, suspension or revocation is presented by the attorney of the Board, and that, prima facie, the facts mentioned may give rise to the application of sections 43 and 44 of the Act respecting building contractors vocational qualifications, the Board must convene the licence holder.The Board must indicate in the notice of convocation the specific reasons for this convocation, the date, the hour and the place of the hearing.The notice of convocation must include a warning to the holder of the licence that his licence may be 3480 GAZETTE OFFICIELLE DU QUÉBEC.December I.1982.Vol.114.No.54 Part 2 cancelled, suspended or revoked, as a result of the hearing.8.The notice of convocation is sent by registered or certified mail or by any other means deemed appropriate by the Board, in accordance with circumstances.This notice is sent to the last address mentioned in the licence holder's record.9.The notice of convocation must reach the licence holder at least five days before the hearing.DIVISION IV REPRESENTATION 10.To be admitted as a representative of a petitioner or a licence holder in a proceeding, the representative must produce a written appearance for the record as well as a copy of his mandate, save if representation is by advocate.11.To cease as representative, the representative must notify the Board in writing.12.To revoke the mandate of a representative, the petitioner or the licence holder must produce a writing for the record.DIVISION V HEARING 13.At the request of the licence holder or the petitioner, a preliminary meeting may take place to confer on the means to be used to simplify or shorten the inquiry.14.In the case of a request for revision, the Board forwards to the petitioner or to his representative, if such is the case, a written notice mentioning the date, hour and place of the hearing.15.If, at the start of the hearing, the petitioner or licence holder fails to make an appearance, the Board proceeds in the manner that it feels the most appropriate by giving the reasons for its decision in writing.16.The Board may grant, for cause, a postponement or may adjourn the hearing.It may, of its own authority, based on grounds, postpone the hearing or adjourn on conditions that it deems appropriate.17.The president or, in his absence, the vice-president of the Board conducts the discussions and sees to the proper holding of the hearing.18.The president or, in his absence, the vice-president authorizes the members governed by the third paragraph of section 8 of the Act to ask questions each in turn after the attornies or representatives have declared that they have no further questions to ask.19.The hearing starts with an explanation of the reasons for the convocation by the attorney of the Board, after which, the witnesses called to testify are sworn in or give a solemn affirmation and state their names, first names and occupations.20.During a hearing of a request for cancellation, revocation or suspension, the attorney of the Board presents his case first.During a hearing of a request for revision, the petitioner presents his case first.21.The petitioner or the holder of a licence may, with the permission of the Board, and upon conditions that it determines, tape a session of the Board with a taperecorder, or take stenographic notes or register the session by any other similar means.22.All representations take place once the evidence has been completed by both sides.23.Consultation begins once all representations have been completed by both sides.24.The president or, in his absence, the vice-president directs discussions during the consultation.25.During a hearing, the members of the Board as well as the licence holder or the petitioner must respect the rules of decorum 26.The members, named under paragraph 3 of section 8 of the Act, must advise the president or vice-president of any interest they may have in a matter that is to be heard by the Board.This declaration does not exclude its author from the consultation or the hearing.27.The members of the Board may not enter the room when the hearing is in progress.Only the members who have been present during the entire hearing of a matter may participate in the consultation. DIVISION VII SUMMONING OF WITNESSES 30.The attorney of the Board or the petitioner or the licence holder who wished to present a witness may summon by subpoena served at least five days before the hearing.DIVISION VIII DEClSi.^N 31.No document -nay be produced after the hearing.32.When the Board has began to consider a case, it may of its own authority, or at the request of the petitioner or the licence holder reopen the hearing for the purposes and upon the conditions it determines ; the Board advises the licence holder or the petitioner thereof.33.The original decision is part of the minutes of the session of the Board at which it was rendered.A copy of the decision must be forwarded to the licence holder or to the petitioner or to his representative by registered or certified mail.Where circumstances so require, the Board may forward the decision by any other means it deems appropriate.34.When making its decision known to the petitioner or to the licence holder, the Board
