Whereas under section 22.0.1 of the Hydro-Québec Act (R.S.Q., c.H-5), the said Bylaw is subject to the approval of the Government.It is ordered, therefore, upon the recommendation of the Minister of Energy and Resources: That Bylaw No.343 abrogating Hydro-Québec Bylaw No.334 and amending Hydro-Québec Bylaw No.321 establishing electricity rates and their conditions of application, a copy of which is attached hereto, be approved.That this Bylaw be published in the Gazette officielle du Québec.Louis Bernard, Clerk of the Conseil exécutif__ Bylaw No.343 abrogating Hydro-Québec Bylaw No.334 and amending Hydro-Québec Bylaw No.321 establishing electricity rates and their conditions of application I.Bylaw No.321 is amended by the addition of the following Divisions XI and XII: DIVISION XI RATE DISCOUNTS FOR INDUSTRIAL CUSTOMERS §1.Definitions 101.Definitions: For the purposes of this Division, the following terms have the meanings hereinafter described: \"additional consumption\": The difference, resulting from a capital investment, for any consumption period, between the power and energy consumption of the said period, and the reference power and reference energy.\"maximum additional consumption\": The highest additional consumption established between July 1, 1983, and December 31, 1985, in the case of a power increase of less than 5 000 kilowatts, and between July 1, 1983, and December 31, 1986, in the case of a power increase of 5 000 kilowatts or more.\"reference energy\": The highest monthly consumption of a contract to which this Division applies, recorded during all the consecutive monthly consumption periods preceding July 1, 1983, up to a total of thirty-six periods.\"reference power\": The maximum power demand of a contract to which this Division applies, recorded during all the consecutive monthly consumption periods preceding July 1, 1983, up to a total of thirty-six periods.\"capital investment\": A capital expenditure that results in consumption of electricity by installations serving in the manufacture, assembly and processing of goods and commodities, or in the extraction of raw materials.The following are considered as capital investments, notably: \u2014 the addition of production equipment, \u2014 the construction of buildings, \u2014 the introduction of new technologies.§2.Conditions of Application 102.Application: This Division applies to customers with an annual general-use contract who under- 106 GAZETTE OFFICIELLE DU QUÉBEC, January 25.1984.Vol.116.No.4 Part 2 take a capital investment, and so advise Hydro-Québec in writing.103.Discounts: The percentage discounts applicable under this Division are as follows: Year Discount Increase of Less than 5 000 kW 5 000 kW or more 1983\t50 %\t50 % 1984\t50\t50 1985\t50\t50 1986\t50\t50 1987\t50\t50 1988\t40\t50 1989\t30\t35 1990\t20\t20 1991\t10\t10 1992\t0\t0 The discounts apply to the additional consumption for each consumption period without however exceeding the maximum additional consumption.104.Establishment of the bill: A customers electricity bill for a contract subject to the rate discounts covered in this Division is established as follows: 1.A first bill is established according to the prices and conditions of the applicable general rate from the energy and power of the consumption period concerned\".2.A second bill is established according to the prices and conditions of the applicable general rate for the reference energy and reference power adjusted according to the number of days in the consumption period concerned; 3.The percentage discount as provided for in Section 103 is then applied to the difference between the bills established according to Subparagraphs 1 and 2; 4.The customer's total bill is established by subtracting the amount of the discount established according to Subparagraph 3 from the amount of the bill established according to Subparagraph 1.When a consumption period overlaps two calendar years, the discounts provided for in Section 103 apply on a pro rata basis to the number of days in the consumption period that belong to each of the respective years.§3.General 105.Notice: The written notice given by the customer to the effect that he is undertaking a capital investment must be received by Hydro-Québec no later than December 31, 1984, in the case of an increase in consumption of less than 5 000 kilowatts, and at the latest by December 31, 1985, in the case of an increase in consumption of 5 000 kilowatts or more.106.Restriction: The discounts set out in Section 103 apply provided the maximum additional consumption in power is in excess of 5 % of the reference power and exceeds 200 kilowatts.DIVISION XII DUAL-ENERGY RATES 107.General: This Division applies to annual contracts under which electricity is delivered in whole or in part for use in a dual-energy system.108.\"Dual-energy system\": A system that can be used for the heating of water, of space or for any other heating process that uses electricity as the main source of energy and a fuel other than natural gas or wood as the auxiliary source of energy, and in which the energy sources are used in a strictly alternative way.§1.Dual-Energy Systems in Apartment Buildings 109.Application: A customer is entitled to Rate BM described hereinafter for an annual contract that meets the following three conditions: \u2014 the contract must be for an apartment building equipped with a dual-energy system that meets the needs of three dwellings or more; \u2014 the installed capacity of the dual-energy system must not be less than 30 kilowatts or more than 99 kilowatts; \u2014 the electricity delivered for the dual-energy system must be metered: \u2022 separately in the case of an apartment building that has bulk metering; \u2022 separately or by the metering equipment for the collective services in the case of an apartment building that has separate metering for each dwelling.110.Rate BM: The dual-energy monthly rate, called Rate BM, is as follows: 7,35 $ fixed charge, plus 2,90 « per kilowatthour for the first 1 200 kilowatt-hours; 2,60
