Whereas the Government is the owner of the territory where the establishment of the ecological reserve is projected; » Whereas the territory is free from any encumbrance; Whereas the Government is of the opinion that an ecological reserve should be constituted to preserve in its natural state a maple grove made up of sugar maple and yellow birch, which are uncommon species in Gaspésie, and typical of a warmer climate in that region of Québec and of a landscape characterized by a deep valley flowing into the St.Lawrence River; Whereas the Conseil consultatif des réserves écologiques has, in a notice dated 21 May 1978, recommended the establishment of the Manche-d'Épée Ecological Reserve; Whereas on 18 December 1978, the Commission de toponymie approved the name \"Réserve écologique de Manche-d'Épée\" for the projected reserve; Whereas the second paragraph of section 2 of the Act prescribes that every regulation made under that section shall come into force on the date of its publication in the Gazette officielle du Québec or on any later date fixed therein; It is ordered, upon the recommendation of the Minister of the Environment: That the Manche-d'Épée Ecological Reserve Regulation, attached hereto, be made.Louis Bernard, , Clerk of the Conseil exétutif Manche-d'Épée Ecological Reserve Regulation An Act respecting ecological reserves (R.S.Q., c.R-26, s.2) i 1.Establishment of the ecological reserve: The territory described in section 2 is established as an ecological reserve under the name \"Manche-d'Epée Ecological Reserve\" bearing number 012-01-1984.2.Description: A territory having a regular shape and being part of the township of Taschereau, Gaspé electoral division, including the southern half of lots 21, 22, 23, 24, 25, 26 and 27 of range II, township of Taschereau, and the portion of range II comprised between the southern extension of the dividing lines of lots 20/21 and 27/28 of range II mentioned above; the territory situated some four kilometres south of the locality of Manche-d'Épée, may be described more specifically as follows: starting at the intersection of the back line of range III and the southern extension of the dividing line between lots 27 and 28 of range II; thence, north astronomically following, over a distance of approximately 2 438 metres, the extension of the said dividing line between lots 27 and 28, and the southern half portion of the dividing line between the lots; thence east astronomically, over a distance of approximately 1 830,63 metres, to the dividing line between lots 20 and 21 of range II of the township of Taschereau; thence, southerly following the dividing line between lots 20 and 21 of range II to its meeting point with the back line of range III of the township, that is over a distance of approximately 2 438 metres; WHereas under section 220 of the Act respecting the Government and Public Employees Retirement Plan, Schedule I to the Act may be amended by the Government and any Order in Council made to this end may have effect six months before its adoption if it so provides; Whereas it is expedient to amend the Regulation respecting the composition, packing and labelling of dairy products (R.R.Q., 1981.c.P-30, r.2) in order to adapt container standardization to technological developments in the industry and to market practices, and to enable deregulation of certain containers.It is ordered, on the recommendation of the Minister of Agriculture, Fisheries and Food; and (2) by adding the following after paragraph i: \"(j) \"cheese products\": processed cheese, processed cheese spread cream cheese or cream cheese spread\".2.The following is substituted for section 11 : \"11.Only containers of the capacity or mass prescribed below may be used for the following corresponding dairy products: (1) a 75, 100, 150, 250 or 500 millilitre container or a 1, 2, 4, 10,2 or 11,4 litre container for an ice cream container whose capacity exceeds 60 millilitres; (2) a 75, 100, 150, 250 or 500 millilitre container or a 1, 2, 10,2 or 11,4 litre container for an ice milk, sorbet or frozen yogurt container whose capacity exceeds 60 millilitres; (3) a 2, 10, or 20 litre container for ice cream, ice milk, sorbet or frozen yogurt mix; (4) a 160 or 385 millilitre or 1 litre container for concentrated milk, concentrated partly-skimmed milk or concentrated skim milk; (5) a 300 millilitre container for condensed milk; (6) a 125, 250 or 500 millilitre container or a 1 or 2 litre container for cultured cream; (7) a 100, 250 or 500 gram container or a 1, 1,5, 2,5, 5 or 10 kilogram container for whole milk powder, partly-skimmed milk powder or skim milk powder, whether instant or not; (8) a 125, 250 or 454 gram container for prepackaged butter or calorie-reduced butter whose mass exceeds 20 grams and which is not separated into portions or units of a mass of 20 jrams or less in microprints, butter servers or patties on cardboard or paper; (9) a 500 gram container for prepackaged butter or calorie-reduced butter whose total mass exceeds 20 grams and which contains prepackaged 125 or 250 gram units; (10) a 125, 250 or 500 gram or any multiple of 500 gram container for prepackaged cheese whose mass exceeds 60 grams, other than: (a) cottage cheese; (b) cold pack cheese and cold pack cheese foods; (c) natural cheese; id) prepackaged cheese products sold in individual portions or units individually wrapped, other than slices; (II) a 125.175.250.500 or 750 gram or any multiple or 500 gram container for cottage cheese; (13) a 15, 250 or 500 millilitre or a 1 or 2 litre container for cream other than cultured cream; (14) a 150 millilitre container for modified milk distributed under the Program of Free Milk Distribution in Elementary Schools approved by the Government under Division VI of the Act respecting the Ministère de l'Agriculture, des Pêcheries et de l'Alimentation (R.S.Q., c.M-14); (15) a 15, 200 or 500 millilitre container or a 1.2, \\ 4, 10 or 20 litre container for a liquid dairy product not covered by paragraphs 1 to 14; (.16) a 75, 100, 12^5, 175, 250 or 500 gram or any multiple of 500 gram container for a prepackaged dairy product whose mass exceeds 60 grams and which is hot described or specifically exempted by paragraph 1 to 15.\" 3.The following is substituted for subparagraph b of the first paragraph of section 13: ! \"(b) the name and address of the person by whom the product is manufactured; or (c) the name and address of the person for whom the i product is manufactured; and the factory's operating permit number or registration number.\".; i '¦ 4.This Regulation comes into force on the date of its ' publication in the Gazette officielle du Québec. 1708 GAZETTE OFFICIELLE DU QUÉBEC.May 16.1984.Vol.116.No.21 Part 2 Gouvernement du Québec O.C.962-84, 25 April 1984 An Act respecting the accreditation and financing of students' associations (1983, c.33) Accreditation Committee Members Expense Allowance Accreditation Committee Members Expense Allowance Regulation Whereas, under section 36 of the Act respecting the accreditation and financing of students' associations (1983, c.33), members of the Accreditation Committee are entitled, to the extent provided In regulation of the Government and on the presentation of vouchers, to an expense allowance as reimbursement of reasonable costs incurred by them in the performance of their duties; Whereas it is expedient to make a regulation to that effect; It is ordered, therefore, upon the recommendation of the Minister of Education: That the Accreditation Committee Members Expense Allowance Regulation, attached hereto, be made.Louis Bernard, Clerk of the Conseil exécutif Accreditation Committee Members Expense Allowance Regulation An Act respecting the accreditation and financing of students' associations (1983.c.33, s.36) 1.Costs for travelling, accommodation and telephone calls incurred by Committee members while performing their duties may be reimbursed as an expense allowance.2.Only travel expenses incurred in Québec may be reimbursed under section 1.3.A Committee member who uses his own motor vehicle is entitled to compensation in the amount of 0.215 $ per kilometre travelled.He is also entitled to reimbursement for actual costs incurred for tolls and parking.« 4.A Committee member who uses public transportation or a taxicab is entitled to reimbursement for actual costs incurred.A Committee member who travels by airplane is entitled to reimbursement for the price of an economy class ticket only.5.Accommodation expenses include lodging and meals and are reimbursed up to the following maximum amounts, including taxes and tips: (1) for a trip lasting at least 12 hours with bed or rental of a room in a hotel: 73,00 $; (2) for a trip lasting from 12 to 18 hours without bed or rental of a room in a hotel: 36,50 $; or (3) for a trip lasting less than 12 hours, the following meal expenses: (a) breakfast: 5,55 $; (b) lunch:: 7,65 $; (c) dinner: .11,45 $.Meals that are included in public transportation costs are not reimbursed under subparagraph 3 of the first paragraph.6.A Committee member who makes a telephone call while performing his duties is entitled to reimbursement of the actual costs thus incurred.He shall produce with his claim the name of the person called and the reasons for the call.7.A Committee member shall produce with his claim information about the duration of the trip, particularly the arrival and departure times, and vouchers for the costs claimed as reimbursement.8.This Regulation comes into force on the tenth day following the date of its publication in the Gazette officielle du Québec.2611 i Part 2 GAZETTE OFFICIELLE DU QUÉBEC, May 16, 1984, Vol.116, No.21 1709 Gouvernement du Québec O.C.976-84, 25 April 1984 An Act respecting the Régie du logement (R.S.Q., c.R-8.1) Rent \u2014 Fixing or revision \u2014 Amendments Regulation respecting the criteria for the fixing or for the revision of rent (Amendment) Whereas under subparagraph 3 of section 108 of the Act respecting the Régie du logement (R.S.Q., c.R-8.1), the Government may make regulations for the application of articles 1658.15 to 1658.17 of the Civil Code, establishing, for such categories of persons, leases, dwellings or land intended for the installation of a mobile home as it may determine, the criteria for the fixing of rent or for the revision of rent and the rules of implementation of these criteria; Whereas under subparagraph 6 of section 108 of the Act respecting the Régie du logement (R.S.Q., c.R-8.1), the Government may make regulations prescribing, subject to section 85, what must be prescribed by regulation under the said Act and articles 1650 to 1665.6 of the Civil Code; Whereas article 1658.i5 of the Civil Code specifies that the tribunal seized with an application for the fixing of rent or for the revision of rent determines the rent exigible in accordance with the regulations; Whereas article 1658.17 of the said Code specifies that the tribunal seized with an application for the readjustment of rent under article 1658.13 determines the rent exigible in accordance with the regulations, taking into consideration the variation imputable to operating costs for which the application for readjustment is made; Whereas the Government made the Regulation respecting the criteria for the fixing or for the revision of rent (R.R.Q., 1981, c.R-8.1, r.I), amended by the Regulations made by Orders in Council 702-82 dated 24 March 1982, 1939-82 dated 25 August 1982 and 901-83 dated 4 May 1983; Whereas it is expedient to further amend the said Regulation in order to add to the criteria that must be taken into consideration when application is made for the revision or readjustment of rent; Whereas such a Regulation comes into force on the date of its publication in the Gazette officielle du Québec or on any later date fixed therein; It is ordered, therefore, upon the recommendation of the Minister of Housing and Consumer Protection: That the Regulation amending the Regulation respecting the criteria for the fixing or for the revision of rent, attached to this Order in Council, be made.Louis Bernard, Clerk of the Conseil exécutif Regulation respecting the criteria for the fixing or for the revision of rent (Amendment) An Act respecting the Régie du logement (R.S.Q., c.R-8.1, s.108, subpar.3 and 6) I.Section 1 of the Regulation respecting the criteria for the fixing or for the revision of rent (R.R.Q., 1981, c.R-8.1, r.1), amended by the Regulations made by Orders in Council 702-82 dated 24 March 1982, 1939-82 dated 25 August 1982 and 901-83 dated 4 May 1983, is further amended by: (1) substituting the following for the first paragraph: \" \"expenditures\": operating expenses of an immoveable comprised of taxes, premiums, costs and expenses covered by paragraphs c, d, e and / of section 2 and management fees equivalent to 5 % of the revenues of the immoveable;\"; (2) inserting the following after the fourth paragraph: \" \"estimated rent\": rent appraised in relation to rents for comparable dwellings situated in the immoveable or the neighborhood, where a dwelling is: (a) unoccupied; (b) occupied by the lessor or his family; (c) occupied by an employee whose work is related to the immoveable; or (d) used for operating the immoveable;\"; (3) inserting the following paragraphs at the end: \" \"revenues\": rents and, where applicable, the estimated rents of an immoveable for the last month of the period considered, multiplied by twelve, and any other revenue derived from operating the said immoveable; \"net revenue\": revenues of an immoveable less expenditures related thereto, for the period considered.\". 1710 GAZETTE OFFICIELLE DU QUÉBEC, May 16, 1984, Vol.116, No.21 Part 2 2.Section 2 is amended by: ( 1 ) substituting the following for paragraph /: \"(f) the percentage applicable under Schedule 1 to maintenance costs and services assignable to the said dwelling during the period considered and borne by the lessor;\"; (2) substituting the following for paragraphs /\" and j: \"(i) expenditures assignable to the said dwelling that the lessor is called upon to bear during the year following the period considered for new services put in place during the said period; and (j) the percentage applicable under Schedule I to the net revenue assignable to the said dwelling for the period considered,\"; (3) inserting the following paragraph at the end: \"If rent for a dwelling is not monthly, the tribunal determines the said rent by making the necessary adaptations.\".3.The following is substituted for paragraph c of section 3: \"(c) the percentage applicable under Schedule 1 to the net revenue assignable to the said dwelling for the period considered, multiplied by two.\".4.The following is inserted under paragraph IV of Schedule I: \"V.Applications for the fixing or for the revision of rent for leases ending between 1 April 1984 and 31 March 1985 or applications for the readjustment of rent for which notices of readjustment of rent are made in 1985: Percentage for heating oil: 6,0 % Percentage for electricity: 3,0 % Percentage for gas: 4,0 % Percentage for other energy sources: 3.0 % Percentage for maintenance costs and services: 7,0 % Percentage for management fees: 8,0 % Percentage for major repairs, major improvements or installation costs for new services: 13,0 % Percentage for net revenue: 4,0 %\".5.This Regulation comes into force on the date of its publication in the Gazette officielle du Québec.2612 Part 2 GAZETTE OFFICIELLE DU QUÉBEC.May 16.1984.Vol.116.No.21 1711 Gouvernement du Québec O.C.978-84, 25 April 1984 Hotels Act (R.S.Q., c.H-3) Hotel establishments and restaurants \u2014 Amendments Regulation respecting hotel establishments and restaurants (Amendment) Whereas under section 11 of the Hotels Act (R.S.Q., c.H-3), the Government made the Regulation respecting hotel establishments and restaurants (R.R.Q., 1981, c.H-3, r.3); Whereas the Regulation prescribed, in particular, standards for the layout, construction and maintenance of hotel establishments and restaurants; Whereas it is expedient to revoke certain provisions of the Regulation; outdoor recreation centres and areas; youth hostels; family vacation centres; and establishments of the ministère du Loisir, de la Chasse et de la Pêche.\".3.The following is substituted for subsection 2 of section 14: \"(2) A permit expires on 30 April of each year.\".4.The following are substituted for section 20 to 31: \"20.À hotel permit may be issued for one of the classes of establishments defined in section 21 and offering sleeping accommodation on a daily or weekly basis.21.A permit may be issued for each of the following classes of hotel establishments: (1) \"hotel\": an establishment, including a private house especially converted for the purpose, comprising one or more buildings and offering at least 6 rooms for rent, and at least 90 % of whose rooms are not directly accessible from outside; (2) \"motel\": an establishment to which the definition \"hotel\" applies, except that at least 90 % of its rooms are directly accessible from outside; (3) \"hotel-motel\": an establishment to which the definition of \"hotel\" applies, except that from 10 % to 90 % of its buildings are accessible from outside; (4) \"inn\": an establishment comprising one or more buildings and offering for rent at least 6 rooms but not more than 50.and offering meals; (5) \"tourist cabin\": an establishment comprising at least 6 separate sleeping accommodation units, maintained and rented on a daily or weekly basis.\".5.The following is substituted for section 32 to 39: \"32.A restaurant permit may be issued for the following class of restaurant: \"restaurant\": an establishment where food is served and eaten on the premises.\".H.Division VI including sections 40 to 124 is revoked.7.The following is substituted for section 125: \"The holder of a hotel permit shall, before I December of each year, declare to the Minister the maximum price he will charge for each room or rental unit from 1 May to 31 October of the following year, and from 1 1712_GAZETTE OFFICIELLE DU QUÉBEC.May 16.1984, Vol.116.No.21_Part 2 2613 November to 30 April of the year after.He shall also specify the meals included in the price, if any, and give any seasonal differences, together with the dates between which they will be in force.\".8.Sections 131, 142, 144 and 145 are revoked.9.The following'is substituted for subsection 1 of section 146: \"(1) Only the purpose of the establishment, the designation authorized for the class, and the official classification symbol granted by the Conseil du tourisme may appear on the main signs and the secondary signs; however, the signs may have a space to indicate meetings, activities held in the establishment, or any other miscellaneous services offered.\".10.Sections 147 and 151 are revoked.11.The following is substituted for section 155: \"155.Furniture and equipment in hotel establishments and restaurants must be well maintained, clean and in good working order.Service staff in the establishments must be clean and wear clean clothes.\".12.Sections 156 to 159 and 161 to 163 are revoked.13.The following paragraph is inserted after section 164: \"Section 7 of the Act applies in the case of a restaurant permit holder found guilty of an infringement of the Agricultural Products.Marine Products and Food Act (R.S.Q., c.P-29) or of the Dairy Products and Dairy Products Substitutes Act (R.S.Q., c.P-30); the occasion of a wedding: to the bride and to the groom, and to the direct relatives of the bride and groom; 2° on the occasion of a death: to the direct relatives of the deceased.\".
