respecting public elementary and secondary education (1984.c.39) Establishment of the territory of a school board Establishment of the territory of a school board Whereas the Government, by Order in Council 310-85 dated 21 February 1985.has constituted new school boards on certain territories; Whereas the Minister of Education, in accordance with section 487 of the Act respecting public elementary and secondary education (1984.c.39).has indicated, by a notice published in the Gazelle officielle du Québec.Part II.Number 10.dated 27 February 1985, page 1021.the territories of the new school boards within which the election of a council of commissioners was to be held on the third Monday of June 1985, and which has been postponed until the second Monday of December 1985 under the Act to amend the Act respecting public elementary and secondary education (1985, c.5); Whereas section 492 of the Act provides that the existing school boards not subject to that notice by the Minister shall agree upon the boundaries of the new school board with the Minister; Whereas certain existing school boards have agreed upon the boundaries of certain new school boards with the adoption of a Regulation An Act respecting manpower vocational training and qualification (R.S.Q.c.F-5) Pursuant to section 32 of the Act respecting manpower vocational training and qualification (R.S.Q., c.F-5), the Minister of Manpower and Income Security, madame Pauline Marois, hereby gives notice that the Regulation amending the Regulation respecting the vocational training and qualification of manpower in the construction industry was adopted on 24 April 1985 by the Order in Council 799-85 appearing below with the text of the Regulation as approved.This Regulation comes into force on the day of the publication of this notice in the Gazette officielle du Québec.Pauline Marois, Minister of Manpower and Income Security Gouvernement du Québec O.C.799-85, 24 April 1985 Act respecting manpower vocational training and qualification (R.S.Q., c.F-5) Vocational training and qualification of manpower in the construction industry \u2014 Amendment Concerning the Regulation amending the Regulation respecting the vocational training and qualification of manpower in the construction industry Whereas, pursuant to section 30 of the Act respecting manpower vocational training and qualification (R.S.Q.c.F-5), the Government adopted the Regulation respecting the vocational training and qualification of manpower in the construction industry (R.R.Q., 1981.c.f-5.r, 3); Whereas there is reason to amend the Regulation; Whereas, pursuant to section 31 of the Act, the Regulation amending the Regulation respecting the vocational training and qualification of manpower in the construction industry was published in the Gazette officielle du Québec of 21 November 1984 with a notice stating that any objections to its adoption must be submitted within thirty days; Whereas the objections brought forward, following such notice, were duly considered; Whereas there is reason to adopt this Regulation with amendments; It is ordered, therefore, upon the recommendation of the manpower vocational training and qualification (R.S.Q.c.F-5, s.30)) 1.The Regulation respecting the vocational training and qualification of manpower in the construction industry (R.R.Q., 1981, c.F-5, r.3) is amended by adding the following after section 11 : \" 11.1 Exemption from the qualification examination, setter mechanic (glazier): the holder of a qualification certificate as a setter mechanic (glazier) before 15 May 1985, issued by an agency authorized to do so under the statutes of Québec, is exempt from the qualification examination.The qualification certificate for the setter mechanic (glazier) allows the holder the choice of obtaining either a qualification certificate in the trade of carpenter-joiner or a qualification certificate as tinsmith.However, the qualification certificate as carpenter-joiner or tinsmith found in the second paragraph allows its holder to do only the following tasks: 1° the work of mounting and installing prefabricated exterior coverings, door and window frames, doors, windows, weather stripping, curtain walls, decorative objects, eave troughs, and other similar tasks, when the metal or substitute material, other than wood, is an decrees (R.S.Q.c.D-2) Sherbrooke Hairdressers' Parity Committee \u2014 Constitution and general by-laws \u2014 Amendments Concerning the constitution and general by-laws of the Sherbrooke Hairdressers' Parity Committee Whereas section 18 of the Act respecting collective agreement decrees (R.S.Q.c.D-2) provides that the Committee shall adopt regulations for its formation, the number of its members, their admission, their replacement, the appointment of substitutes and the administration of funds; fix its corporate seat: determine the name under which it shall be designated and.generally, draw up regulations for its internal management and the exercice of the rights conferred upon it by-law; Whereas the constitution and general by-laws of the Sherbrooke Hairdressers' Parity Committee were approved by Order in Council I 153-A of 10 June 1964 and amended by Orders in Council 2932-74 of 14 August 1974, 1272-78 of 20 April 1978 and 1707-84 of I August 1984; Whereas the trustee of the Sherbrooke Hairdressers' Parity Committee adopted on 14 March 1985 the Regulation amending the Regulation respecting the constitution and general by laws of the Sherbrooke Material Agreements and Duties Payable The Régie du cinema hereby gives notice, in accordance with section 170 and under subparagraphs 6, 8 and 9 of section 167 of the Cinema Act.that it has made the Regulation respecting Certificate and Attestation of Filing of Video Material Agreements and Duties Payable, attached hereto.This Regulation will be submitted to the Government for approval sixty days after the publication of this Notice.André Guérin.President of the Régie du cinéma Regulation respecting the Attestation of Filing of an Agreement for Distribution of Video Material and Duties Payable Cinema Act (R.S.Q.c.C-18.1.ss.119 and 120 and s.167.subpars.6.8 and 9) DIVISION I CERTIFICATE OF FILING OF DISTRIBUTION AGREEMENT 1.After the filing of the distribution agreement prescribed by section 118 of the Cinema Act (R.S.Q., c.C-18.1).the Régie du cinéma shall issue the filing certificate required by section 119 of the Act to the holder of a distributor's licence.The certificate shall identify the contents of the video material covered by the agreement.2.The duties payable by the holder of a distributor's licence for obtaining the filing certificate prescribed by section 1 shall be 50.00 $.DIVISION II ATTESTATION OF FILING OF DISTRIBUTION AGREEMENT 3.For the purposes of attesting the filing of the video material distribution agreement prescribed by section 118 of the Act.the holder of a distributor's licence shall hand over to the retail dealer any video material he intends to sell, lease, lend or exchange and on which the identification label affixed by the Régie appears.4.The duties payable by the holder of a distributor's licence prescribed by section 120 of the Act shall be 0.50 $ per cassette, video-disc or other medium of a similar nature filed with the Régie.DIVISION III FINAL 5.This Regulation, adopted by the Régie and approved by the Government, comes into force on the day of its publication in the Gazette officielle du Québec or on any later date fixed therein.3023 Draft Regulation Cinema Act (R.S.Q., c.C-18.1) Definitions of \"Producer\" and \"Holder of the World Rights\" The Régie du cinéma hereby gives notice, in accordance with section 171 \"financial interests\" means the investment of money, goods or services.2.For the purposes of section 105 of the Act.\"holder of the world rights\" means any person holding the distribution rights to a film for the country of origin of the film and for the following countries: Canada, the United States.Belgium.Luxembourg, the Netherlands, Denmark.France, the Federal Republic of Germany, Ireland.Italy.Great Britain.Greece, Spain and Portugal.3.This Regulation, adopted by the Régie and approved by the Government, comes into force on the date of its publication in the Gazette officielle du Québec or on any later date fixed therein.3023 Draft Regulation Cinema Act (R.S.Q.c.C-18.1) Filing of Video Material Agreements The Régie du cinéma hereby gives notice, in accordance with section 171 and under subparagraph 14 of the first paragraph of section 168 of the Cinema Act, that it has made the Regulation respecting the Filing of Video Material Agreements, attached hereto.Upon the expiry of thirty days following the publication of this Notice, public hearings on the Regulation will be held if.during that period, the Régie du cinéma receives any written and reasoned request to that end.The Regulation, with or without amendment, will thereafter be submitted to the Government for approval.André Guérin, President of the Régie du cinéma__ Regulation respecting the Filing of (R.S.Q., c.C-18.1) shall meet the following conditions: (1) he shall attach to the agreement an affidavit attesting the signatures of the parties and the content of the agreement; (2) he shall file with the Régie du cinéma any video material he intends to sell, lease, lend to or exchange with a retail dealer and for which a distribution agreement has been made.2.This Regulation, adopted by the Régie and approved by the Government, comes into force on the date of its publication in the Gazette officielle du Québec or on any later date fixed therein.3023 Draft Regulation Cinema Act (R.S.Q., c.C-18.1) Film Exhibitor's Licence The Régie du cinéma hereby gives notice, in accordance with section 171, under subparagraphs 1, 2, 3, 5 and 13 of the first paragraph and under the second paragraph of section 168 of the Cinema Act, that it has made the Regulation respecting Exhibitor's Licences for Premises where Films are Shown to the Public, attached hereto.Upon the expiry of thirty days following the publication of this Notice, public hearings on the Regulation will be held if, during that period, the Régie du cinéma receives any written and reasoned request to that end. Part 2 GAZETTE OFFICIELLE DU QUÉBEC.May 15.1985.Vol.117.No.21 1649 The Regulation, with or without amendment, will thereafter be submitted to the Government for approval.André Guérin, President of the Régie du cinéma Regulation respecting Exhibitor's Licences for Premises where Films are Shown to the Public Cinema Act (R.S.Q., c.C-18.1, s.168.I- par., subpar.I, 2, 3, 5 and 13, and 2* par.) DIVISION I CATEGORIES OF FILM EXHIBITOR'S LICENCES 1.The categories of exhibitor's licences for premises where films are shonw to the public issued under this Regulation are the: (1) motion picture theatre licence; (2) multi-purpose hall licenc^! (3) unestablished theatre licence; (4) outdoor theatre licence; (5) community hall licence: (6) recognized film library licence; and (7) the licence for premises covered by the Act respecting liquor permits (R.S.Q., c.P-9.1).DIVISION II CONDITIONS FOR OBTAINING A FILM EXHIBITOR'S LICENCE 2.A person wishing to obtain a film exibitor's licence shall: (1) pay to the Régie du cinéma the fee for the examination of his application prescribed by regulation of the Régie under paragraph I of section 167 of the Cinema Act (R.S.Q.c.C-18.1); (2) provide the Régie with proof that he is the owner, lessee, holder of an agreement to sell or of an agreement to lease premises for showing films or the holder of the owner's written authorization to use premises for the purposes of showing films to the public; (3) provide to the Régie a copy of the certificate prescribed .by subsection 4 of section 6 of the Public Buildings Safety Act (R.S.Q., c.S-3), where so required by the Act, and a copy of any permit issued under a municipal by-law for fitting out premises for showing films to the public.3.A person wishing to obtain a motion picture theatre licence, multi-purpose hall licence or unestablished theatre licence shall, in addition to the conditions prescribed by section 2, provide the following documents to the Régie: (1) detailed plans and specifications and an estimate of the cost of fitting out premises for showing films to the public: (2) a detailed list and a complete description of technical equipment for showing films to the public; (3) a copy of the last annual report submitted to the Inspector General of Financial Institutions if he has been incorporated for more than one year.4.A person wishing to obtain an unestablished theatre licence shall, in addition to the conditions prescribed by sections 2 and 3, provide the Régie with a copy of the documents of incorporation and the names of members of its board of directors and members of the non-profit corporation or cooperative association.5.A person wishing to obtain an outdoor theatre licence shall, in addition to the conditions prescribed by section 2, provide the Régie with the following documents: (1) a plan and cadastral description of the land on which he intends to locate the outdoor theatre; (2) a copy of the title deed, agreement to lease or lease to the land; (3) detailed plans and specifications for the layout of the outdoor theatre; (4) a detailed list and complete description of technical equipment for showing films to the public.6.In addition to the conditions prescribed by sections 2 and 5, a corporation wishing to obtain an outdoor theatre licence shall provide the Régie with the following documents: (1) a list of its shareholders and the number and class of shares each holds; (2) a document indicating the terms and sources of its financing; (3) a copy of the last annual report submitted to the Inspector General of Financial Institutions if it has been incorporated for more than one year. 1650 GAZETTE OFFICIELLE DU QUÉBEC.May 15.1985.Vol.117.No.21 Part 2 A person applying for an outdoor theatre licence on behalf of a corporation to be set up shall provide the Régie with the documents covered by subparagraphs I and 2 of the first paragraph.7.A person wishing to obtain a community hall licence shall, in addition to the conditions prescribed by section 2: ( I ) indicate to the Régie the address and main use of the premises where he intends to show films to the public and the expected frequency of such showings; (2) submit his application to the Régie at least five working days before the date of the first showing.8.A person wishing to obtain a licence for premises covered by the Act respecting liquor permits shall, in addition to the conditions prescribed by section 2, provide the following documents: ( I ) a copy of the permit issued under the Act respecting liquor permits; (2) a preliminary sketch of the premises where he intends to use his licence.9.A person wishing to obtain a recognized film library licence shall, in addition to the conditions prescribed by section 2, provide a copy of the recognition granted by the Minister under section 5 of the Act.except for the Cinémathèque quécécoise covered by section 8 of the Act.DIVISION III RIGHTS AND OBLIGATIONS OF FILM EXHIBITORS LICENCE HOLDERS 10.The holder of a motion picture theatre licence, multi-purpose hall licence or unestablished theatre licence may show films to the public only in a place fitted out for this purpose, permanently fitted with the necessary equipment, and complying with the technical standards prescribed by regulation of the Régie under subparagraph 4 of the first paragraph of section 168 of the Act.11.The holder of a motion picture theatre licence, multi-purpose hall licence, unestablished theatre licence or outdoor theatre licence shall begin to use his licence within twelve months of the date the licence is issued by the Régie.12.A motion picture theatre licence authorizes its holder to show films to the public, for gain, in a place whose main use is showing films to the public.13.A multi-purpose hall licence authorizes its holder to show films to the public, for gain, in a place where showing films to the public is a secondary use.14.The holder of a multi-purpose hall licence shall be the person responsible for all of the activities in the place where he uses his licence.15.An unestablished theatre licence authorizes its holder to show films to the public in a place therefor without intending to realize a gain for himself or for its members.16.The holder of an unestablished theatre licence shall: (1) to promote cinematographic training, education and culture, devote all of his programming to films with at least one of the following characteristics: (a) films deemed to be motion picture classics; fb) films with undisputed cinematographic qualities; (c) films with recognized artistic or historical interest: id) works contributing to renewing film creation and language; le) films reflecting the life of countries whose cinematographic production is little known in Québec; (2) show to the public only a film for which the Régie issued a stamp not less than one year previously, except where the film is not being shown concurrently in motion picture theatres, multi-purpose halls or outdoor theatres.17.An outdoor theatre licence authorizes its holder to show films to the public, for gain, on land fitted out to allow occupants of motor vehicles to be present at such a showing.18.A community hall licence authorizes its holder to show films to the public in a place where a secondary use is showing films to the public, at least once a month, with or without payment for admission.19.A recognized film library licence authorizes its holder to show films to the public, without gain, on a single screen in premises specifically fitted out for this purpose and located at its main place of business.20.A licence for premises covered by the Act respecting liquor permits authorizes its holder to show films to the public in a place for which a permit has been issued under the said Act and which is used secondarily for showing films to the public, except for Part 2 GAZETTE OFFICIELLE DU QUÉBEC.May 15.1985.Vol.117.No.21 1651 feature fiction films or any other fiction film running more than thirty minutes.DIVISION IV RENEWAL OF FILM EXHIBITORS LICENCE 21.The holder of a film exhibitor's licence wishing to renew his licence shall submit to the Régie a sworn statement certifying that he continues to meet the conditions for obtaining a licence prescribed by Division II and that he abides by the rights and obligations prescribed by Division III.DIVISION V STANDARDS FOR LAYING OUT OR REDEVELOPING AN OUTDOOR THEATRE 22.An engineer who is a member of the Ordre des ingénieurs du Québec shall certify that the outdoor theatre screen can withstand a minimum stress of 1,44 kilopascals.The structure supporting the screen shall be made of reinforced concrete or steel.23.Where an outdoor theatre is built beside a divided highway, the picture must not be visible therefrom.In any other case, the screen shall be not less than 61 metres from a public highway.Where the picture is visible from a public highway, the distance between the highway and the screen shall be not less than 305 metres.24.The projection booth shall be not less than 5.5 metres long.4.8 metres wide and 2.4 metres high.It shall be fireproof and have a toilet and wash-basin.25.Parking ramps shall be one-way.26.Posts holding loudspeakers shall be not less than 6 metres from any other post in the same ramp and not less than 11,5 metres from any post in another ramp.27.Sound shall be transmitted to each motor vehicle by an autonomous loudspeaker or by radio.28.Outdoor theatre entrances and exits shall be lighted over their entire length and paved for not less than 38,5 metres from a public highway.29.An outdoor theatre exit shall be at right angles to the public highway and may allow only two motor vehicles to reach the highway simultaneously.30.Outdoor theatre entrances shall be capable of absorbing at least 15 % of the total vehicle capacity of the drive-in theatre.31.The peripheral road of an outdoor theatre shall be lighted every 38.5 metres or less and over its entire length.32.The minimum sanitary facilities required in an outdoor theatre are the following: Number of vehicles Facilities for men Less than 400 2
