payable under Title V of the Automobile Insurance Act (Amendment) Automobile Insurance Act (R.S.Q., c.A-25, s.195, subpar.n) 1.The Regulation respecting the reimbursement of \u2022 amounts payable under Title V of the Automobile Insurance Act approved by Order in Council 615-84 dated 14 March 1984 is amended by substituting the following for the definition of the expression \"fiscal year\": which reimbursement was applied for was due to be renewed, and by multiplying the result by the number of complete months remaining between the day on which the Régie receives the licence and the last day of the month preceding that in which the licence was due to expire.4.Notwithstanding section 3, where a licence issued before I January 1986 is renewed not later than in the month following the date of its expiry, reimbursement is calculated by dividing by 12 the contribution payable for the year of contribution for which renewal was made and by multiplying the result by the number of complete months remaining between the date on which the Régie receives the licence and the last day of the year of contribution preceding that in which the licence was due to expire.5.The Régie must jurisdiction This Decree applies to: 1° the washing and dry cleaning, for others, of linen and working clothes used by a business, an industry or an establishment: 2° the renting of linen and working clothes to a business, an industry or an establishment.2.03 Occupational jurisdiction This Decree applies to professional employers, employers, skilled tradesman and employees: (a) who have their place of business in the territorial jurisdiction of this Decree; (b) who perform or have others perform work covered by this Decree within the territorial jurisdiction of this Decree; provided that part of the work is carried out within the territorial jurisdiction or that linen and clothes that are washed or cleaned are used in the territorial jurisdiction of this Decree.2.04 Exclusions This Decree does not apply to: 1° office employees; 2° the picking up and delivery of linen and working clothes, when they are entirely performed outside of the territorial jurisdiction; 3° to the Standard workweek The standard week consists of 40 hours.Hours of work are scheduled from Monday to Friday.For the employees whose standard workday may consist of 10 hours, as stipulated in section period.Any employee who is required to work more than one hour but less than 3 hours after his standard workday is entitled to a 10-minute rest period with pay, at time and a half his regular hourly rate.This rest period is taken immediately before the beginning of overtime hours.3.04 Meal period Meal periods consist of not less than 30 minutes and not more than 60 minutes and are taken between 11 hours and 13 hours or, as the case may be, towards the middle of the employee's standard workday.Any employee who is required to work 3 hours or more after his standard workday is entitled to a meal period of one half-hour with pay.This period is taken immediately before the beginning of the overtime hours and is not included in the 3-hour work period.The meal is at the employer's expense.3.05 Minimum call-in pay Except for a fortuitous event, an employee is entitled to a minimum compensation equal to 4 times his minimum hourly rate, for each day on which he reports to work according to his regular work schedule, provided that he agrees to perform during that time any work required by the employer and that he has not been previously advised not to report to work.3.06 Work period An employee receives his regular wages from the moment he reports to work at his employer's request within his work schedule.For the purposes of this section, hours of work may not be divided into less than 12 parts.3.07 Work schedule For permanent employees, the beginning and the end of the standard workdays are established by the employer, according to a regular work schedule, which must be posted on the work premises and copy of which must be forwarded to the parity committee.This schedule must be valid for at least 2 weeks and may not be changed unless an advance notice hall'rale Hours worked over and above ihe standard workday, workweek or work schedule of an employee are overtime hours and are paid at time and a half.5.02 Double time rale An employee is paid at double time for the hours worked on the following days: 1° the first day of his weekly rest period: for Ihe hours worked over and above the first lO hours, for the employees whose standard workweek consists of 4 days; 2\" the second day of his weekly rest period; 3° Saturday: for the hours worked over and above the first 8 hours, for the employees whose standard workweek is scheduled from Monday to Friday; 4° Sunday; 5° a holiday.5.03 The employer may not hire a temporary employee unless all his available permanent employees are at work, proof of which lies with the employer.6.00 General holidays with pay 6.01 St.John the Baptist Day is a general holiday with pay in accordance with the National Holiday Act (R.S.Q.c.F-I.l).6.02 The following days are general holidays with pay: New Year's Day.2 January, the Queen's Birthday or Dollard's Day.1 July, Labour Day.Good Friday or Easter Monday.Thanksgiving Day.Christmas Day.26 December and the employee's birthday.6.03 Holiday pay For each general holiday with pay listed in section 6.02, the employee receives an indemnity equal to 20 '/< ol his minimum weekly wages.6.01 II an employee is required to work on one of the holidays listed in section 6.1)2.the employer must give him.in addition to the wages corresponding to the number of hours worked, the indemnity provided for in section 6.03 or grant him one compensatory holiday.6.05 If one of the holidays listed in section 6.02 falls during an employee's annual vacation, the employer must give the employee the indemnity provided for in section 6.03 or grant him an extra day of vacation which will be taken on a date agreed upon between the employer and the employee.6.06 Eligibility To be entitled to the holiday pay stipulated in section 6.03, the employee must: 1° have been in his employer's service for the 60 days preceding the holiday; 2° have worked on his standard workday immediately preceding and immediately following the holiday, unless he was absent for a serious reason, proof of which lies with him; 3° have worked at least 10 days during the month preceding the holiday.6.07 Substitution for Easter Monday On account of the customer's needs, Easter Monday may be replaced by Good Friday, for all or pan of the employees, provided that the employer gives a written prior notice of at least 3 weeks to the employees concerned and to the parity committee.6.08 Substitution for the employee's birthday The observance of an employee's birthday may.on his request, be postponed to the following Monday or Friday, provided that this does not affect the regular operations of the employer.When the birthdays of two or more employees fall on the same day.priority if given to the employee who has the higher number of years of service with the employer.6.09 Transferal of observance date of year-end holidays For all or part of the employees.26 December and 2 January may be celebrated on any other date, upon agreement between the employer and the employees concerned, in order to satisfy the customer's needs.6.10 Transferal of observance date of other holidays When one of the general holidays, except for New Years's Day.2 January.Christmas Day and 26 December, falls on a Saturday or a Sunday, it may be observed on the preceding Friday or on the following Monday, after agreement between the employer and a majority of his employees.Copy of this agreement must be previously forwarded to the parity committee.In no event shall this substitution of holidays force the employer to cease his operations for a period of 4 consecutive days. Part 2 GAZETTE OFFICIELLE DU QUÉBEC.January 15.1986.Vol.118.No.3 91 6.11 For the employees whose standard workweek may be scheduled over 4 standard workdays in accordance with section 3.02, the standard day off provided for in their work schedule is automatically postponed to the holiday provided for in this division.7.00 Annual vacation with pay 7.01 Vacation duration and vacation pay (a) The employee who, on 1 May, has less than one year of continuous service with the same employer is entitled to a continuous vacation whose duration is determined at the rate of one working day per month of continuous service, without the total duration of the vacation exceeding 2 weeks.Vacation pay is 4 % of the employee's wages earned during the period between his first date of service and 30 April of the current year: (b) The employee who.on 1 May, has one year of continuous service with the same employer is entitled to an annual vacation of a maximum duration of 2 weeks.Vacation pay is 4 % of the employee's wages earned during the qualifying period; (c) The employee who.on I May.has 4 years of continuous service with the same employer is entitled to an annual vacation of a minimum duration of 3 weeks.Vacation pay is 6 % of the employee's wages earned during the qualifying period: (d) The employee who, on 1 May.has 12 years of continuous service with the same employer is entitled to an annual vacation of a minimum duration of 4 weeks.Vacation pay is 8 % of the employee's wages earned during the qualifying period; (e) The employee who, on I May.has 23 years of continuous service with the same employer is entitled to an annual vacation of a minimum duration of 5 weeks.Vacation pay is 10 % of the employee's wages earned during the qualifying period.7.02 Qualifying period The qualifying period extends from 1 May of the preceding year to 30 April of the current year.7.03 Annual vacation period During the months of June, July, August and September, an employee is entitled to take two consecutive weeks of vacation.During the other months, the employee may take all of his weeks of vacation consecutively.An employee may not take his annual vacation during the weeks including Christmas Day and New Year's Day.unless the employer agrees to it.7.04 Vacation pay Vacation pay is given to the employee, in one payment, on the payday which precedes the day he leaves on vacation.Vacation pay is that which corresponds to the duration of the employee's annual vacation.7.05 When the work contract is cancelled before the employee has taken the total annual vacation to which he was entitled, the employee receives in addition to the monetary compensation determined under section 7.01 for the unused portion of his vacation, an indemnity equal to 4 %, 6 %.8 % of 10 %.as the case may be, of his gross wages earned during the current qualifying period.8.00 Social leaves 8.01 Bereavement leave 1° On the occasion of the death of his spouse or of a child still living at home, an employee may be absent from work for 5 consecutive calendar days, starting the day of decease; 2° On the occasion of the death of a child not living at the employee's home, of his father, mother, father-in-law, mother-in-law, brother or sister, an employee may be absent from work for 3 consecutive calendar days, the last of these 3 days being the day of the funeral; 3° On the occasion of the death of his grand-father, grand-mother, brother-in-law, sister-in-law, daughter-in-law or son-in-law, an employee may be absent form work for one calendar day, that is the day of the funeral; 4° The employee is paid for every working day included in the periods of leave mentioned in paragraphs 1°, 2° and 3° of this section.The indemnity is equal to the employee's regular hourly rate multiplied by the number of hours he would have normally worked; 5° On the occasion of a death mentioned in paragraph 3°, the employer may grant the employee, on the hater's request, two more working days of leave, without pay, provided that those days immediately precede the day of the funeral.8.02 Wedding leave On the day of his wedding, an employee is entitled to one day of leave, if that day falls on a working day.If the wedding falls on a Saturday, the employee is entitled to one day of leave on the preceding Friday. 92 GAZETTE OFFICIELLE DU QUEBEC.January 15.1986.Vol.118.No.3 Part 2 The employee receives an indemnity if the day of leave mentioned in the preceding paragraph is included in his work schedule.This indemnity is equal to his minimum hourly rate multiplied by the number of hours specified in his work schedule.8.03 Birth leave The emptoyee whose wife gives birth to a child is entitled to one day of leave on the day of birth and on the day his wife leaves the hospital.If those days fall on a working day.the employee receives an indemnity which is equal to his minimum hourly rate multiplied by the number of hours specified in his work schedule.8.04 Maternity leave A female employee is entitled to a maternity leave in accordance with the Regulation respecting labour standards (R.R.Q.1981.c.N-I.l, r.I) or with any further regulation that could amend or replace it.8.05 Employee summoned as a witness Any employee who is summoned to testify in court in a case involving his employer receives his regular wage for the period he spent in court during his standard workday provided that he would normally have worked during that period, except for cases involving labour relations between the employer and the employee's union, grievance and arbitration procedures, and unless the employee was summoned by the employer.8.06 Employee acting as a juror Any employee required to perform the duties of a juror receives from his employer an amount equal to his minimum hourly wage rate multiplied by the number of hours he would normally have worked during this absence, less the indemnity he received from the Government as a juror (R.S.Q.c.J-2).In order to be entitled to the indemnities provided for in this section, an employee must: fa) have been in the service of his employer for 60 calendar days; lb) have advised his employer as soon as he received his summons; (c) supply proof of the indemnity received as a juror: Id) have returned to work as soon as he was released from his duties.8.07 The employee receives the indemnity provided for in the Election Act (R.S.Q.c.E-3.1) and in the Act respecting the franchise of electors and the election of members to the House of Commons (R.S.C.1970, c.14, 1° Supplement).9.00 Payment of wages 9.01 Payday Each week, wages are paid by cheque on the Thursday.When payday falls on a holiday, wages are paid on the Friday morning.When the employer neglects to pay an employee by cheque on the day stipulated in this section because of major reasons or important mistakes in the amount owed to the employee, he must give the employee an advance cash amount equal to the wages due to him.9.02 Deductions on the employee's wages The employer shall not make any deductions from the employee's wages unless he is obliged to do so under a law.a Decree or a collective agreement.9.03 Punching clock The employer must keep a punching clock in his place of business and each employee must punch his own card.The employer shall not make any change on an employee's card without having previously contacted the employee concerned, and in that case, the employee must initial the changes made.Even if an employee puts his initials at the bottom of his card, he still holds his rights and recourses.9.04 Particulars Wages are paid completely at each pay period in a sealed envelope and the following particulars must appear on the envelope, the cheque stub or on a separate earnings statement: (a) the employer's name: lb) the employee's full name; lj) the amount of gross wages; (k) the nature and amount of deductions made; (7) the amount of net take-home pay.9.05 When the employee receives his wages, no signature is required other than that establishing that the amount paid to the employee corresponds to the amount of net wages indicated on the earnings statement.9.00 Acceptance by the employee of an earnings statement does not mean that he renounces complete or partial payment of the wages owing to him.9.07 Dismissed employee The employer gives to any employee who terminates his employment the total wages, vacation pay and sick leave compensation owing to him.within the 10 working days following the date his employment was terminated.10.00 Prior notice 10.01 An employee who has at least 3 months of continuous service with his employer is entitled to a written prior notice before he is dismissed or layed off for at least 6 months.This prior notice consists of one week if the employee has less than one year of continuous service; 2 weeks if he has from one to 5 years of continuous service; 4 weeks if he has from 5 to 10 years of continuous service and 8 weeks if he has 10 years or more of continuous service.The employer who neglects to give this prior notice must give the employee, at the time of departure, an indemnity equal to the latter's regular weekly wages.During the period covered by this notice, the employee continues to work as usual and the employer gives him his regular weekly wages.i 11.00 Uniforms 11.01 When an employer requires an employee to wear a uniform, he shall not make any deduction from the employee's minimum wages stipulated in sections 4.01 and 4.02 for the purchase, use or cleaning of the uniform.12.00 Welfare plan 12.01 Reference period Any employee who has completed 60 days of continuous service with his employer cumulates days of paid sick leave from I December to 30 November of the following year.12.02 Computation During the reference period.Ihe employee cumulates a sick leave credit of hall a day per month of work up to a maximum of 6 days per year.In addition, on I December of each year, the employee receives a credit of I day of sick leave.The employee who has been layed off or absent for any reason for two complete months is not entitled, during this period, to the credit mentioned above.12.03 Conditions for using the sick leave credit The use his sick leave credit, an employee must meet every one of the following conditions: 1° suffer from a sickness other than an occupational disease or accident, which renders him unable to work; 2° report his absence from work to the employer before the beginning of his standard workday, indicating the nature of his sickness and the approximative duration of his absence; 3° supply a medical certificate if the employer so requires in cases of abuse.12.04 Payment of sick leave days Any unused day of sick leave in excess of 5 days during the reference period is reimbursed to the employee within the 15 days following 30 November.Any day of sick leave unused during the reference period and not reimbursed is kept in the employee's sick leave credit for the next year.12.05 Indemnity The indemnity to which an employee is entitled for one day of sick leave credited is equal to his minimum wage rate multiplied by the number of hours of his standard workday, up to a maximum of 8 hours.For the employees mentioned in paragraphs 3, 6.7 and 9 of section 1.01.Whose standard work schedule is spreaded over 4 days, this maximum is 10 hours per day and 48 hours per year.12.06 Termination of employment An employee who voluntarily terminates his employment or who is dismissed or layed off before I December is entitled to the indemnity provided for in the 94 GAZETTE OFFICIELLE DU QUÉBEC, January 15.1986, Vol.118.No.3 Part 2 above sections for all sick leave days credited and unused.This amount is payable to the employee on the date his employment is terminated, in accordance with section 9.07.13.00 Group insurance 13.01 Each month, the employer collects from each insurable employee an amount of 21.58 $ plus the sales tax, as the employee's contribution to a compulsory insurance premium, for all employees except those mentioned in paragraphs 3, 6, 7, 9, 14, 16, 17 and 18 of section 1.01, for whom this amount is 26.16 $ plus the sales tax.Each month, the employer pays for each insurable employee an amount of 32 $ plus the sales tax, as a contribution to a compulsory insurance premium.The group insurance plan mentioned above is that adopted by the contracting parties and administered by the parity committee.It includes life-insurance, insurance in case of accidental death or bodily injury, weekly benefit insurance, hospitalization insurance and major health-insurance plans.13.02 The employer must: (a) have employees complete membership cards: (b) notify the parity committee of any change in the employee's wages, civil status or beneficiary; (c) supply the employee with the necessary claim forms; (d) immediately notify the parity committee of an employee's absence or return to work; (e) collaborate to obtain medical certificates that might be required; (2) the following is substituted for the definition of \"Authority having jurisdiction,\" in Subsection 1.3.2: \"Authority having jurisdiction means an inspector entrusted with the enforcement of the Public Buildings Safety Act (R.S.Q., c.S-3).\"; (3) the following is substituted for the definition of \"Building\", in Subsection 1.3.2 of the Code: \"Building means any structure used or intended for supporting or sheltering any use or occupancy and which constitutes a public building as defined in the Public Building Safety Act (R.S.Q., c.S-3) or, where safety of the public must be ensured, an establishment as defined in the Act respecting occupational health and safety (R.S.Q., c.S-2.1).\"; (4) in Table 3.1.14A: (a) the words \"libraries, museums and skating rinks\" are added at the bottom of the list headed \"Assembly uses\" in Columm I headed \"Type of use of Floor Area or Part Thereof \"; and (b) the number \"3.0\" is added opposite the words \"libraries, museums and skating rinks\", in the column headed \"Area per Person m;\".(5) the following Sentence is added to Article 3.2.2.8: \"(3) The requirements in Articles 3.2.2.12 and 3.2.2.20 for roof assemblies to have a fire-resistance rating may be waived provided that: (a) the building or part thereof is used exclusively for non-spectator sports and has a light fire load, such as indoor swimming pools, tennis courts and skating rinks: (b) the roof is of noncombustible construction; and (c) the roof structure is at least 6 m above the floor.\"; (6) the following is substituted for Clause c of Sentence I of Article 3.3.1.4: \"(c) except for a shooting gallery where the occupant load is under 10, or for a dwelling unit where the area of the room or suite or the distance measured from any point within the room or suite to the nearest door opening onto a public corridor, a corridor used by the public or a corridor serving classrooms or patients' bedrooms or opening directly to an exit exceeds the values given in Table 3.3.1 A\"; (7) the following article is added after Article 3.3.7.9: \"3.3.7.10 Helicopter landing areas on roofs shall conform to the provisions of Section 2.13 of the national Fire Code of Canada 1 985 (NRCC No.23175) issued by the National Reasearch Council of Canada.\"; (8) the following is substituted for Subsection 3.5.5: 98 GAZETTE OFFICIELLE DU QUÉBEC, January 15.1986.Vol.118.No.3 Part 2 \"SUBSECTION 3.5.5 ELEVATORS, WHEELCHAIR PLATFORM LIFTS.DUMBWAITERS.SMALL DUMBWAITERS.ESCALATORS AND MOVING WALKS 3.5.5.1 (1) Every elevator, wheelchair platform lift, dumbwaiter, small dumbwaiter, escalator and moving walk shall conform to the Regulation respecting elevators, dumbwaiters, escalators and moving walks (R.R.Q., 1981, c.S-3, r.I) and to any subsequent amendments thereto.(2) Elevators in buildings referred to in Subsection 3.2.6 shall conform to Articles 3.2.6.3 and 3.2.6.4.(3) Arabic numerals indicating the assigned floor (storey) number shall be mounted permanently on both jambs of passenger elevator hoistway entrances in accordance with Appendix E of Supplement No.3-1982 to CSA Standard B44, \"Safety Code for Elevators.Dumbwaiters.Escalators and Moving Walks.\"; or (b) they have similar commodities.\"; (11) the following is substituted for Sentence 2 of Article 3.7.3.5: \"(2) The elevating devices in Article 3.7.2.1 shall conform to the Regulation respecting elevators, dumbwaiters, escalators and moving walks (R.R.Q.1981, c.S-3, r.1) and to any amendments subsequent thereto.\"; (12) the following is substituted for Sentence 2 of Article 4.1.1.2: \"(2) In cases covered by the Architects Act (R.S.Q., c.A-21), the designer shall be an architect, and in cases covered by the Engineers Act (R.S.Q., c.1-9), the designer shall be an engineer.\";
