Conseil supérieur de l'éducation (R.S.Q., c.C-60) Recognition of elementary and secondary schools of the public school system as Catholic and their confessional character \u2014 Amendments Regulation respecting the recognition of elementary and secondary schools of the public school system as Catholic and their confessional character (Amendment) Whereas the Regulation respecting the recognition of elementary and secondary schools of the public school system as Catholic and their confessional character was approved by Order in Council 1857-87 dated 9 December 1987 and amended by the Regulation approved by Order in Council 112-88 dated 27 January 1988; Whereas it is expedient to further amend the Regulation to make it consistent with the Education Act (R.S.Q., c.1-13.3); Whereas at its 268* meeting, held on 15 and 16 March 1990, the Catholic committee of the Conseil supérieur de l'éducation adopted the Regulation respecting the recognition of elementary and secondary schools of the public school system as Catholic and their confessional character (Amendment); Whereas in accordance with sections 10 and II of the Regulations Act (R.S.Q., c.R-18.1).the draft regulation was published in Part 2 of the Gazelle officielle du Québec of 15 August 1990.with a notice that it could be approved by the Government upon the expiry of 45 days following that publication; Whereas it is expedieni to approve the Regulation without amendment; It is ordered, therefore, upon the recommendation of the Minister of Education: That the Regulation respecting the recognition of elementary and secondary schools of the public school system as Catholic and their confessional character (Amendment), attached hereto, be approbed.Benoît Morin, Clerk of the Conseil exécutif Regulation respecting the recognition of elementary and secondary schools of the public school system as Catholic and their confessional character (Amendment) An Act respecting the Conseil supérieur de l'éducation (R.S.Q.c.C-60.s.22.subpars.a.c.d and e) 1.The Regulation respecting the recognition of elementary and secondary schools of the public school system as Catholic and their confessional character, approved by Order in Council 1857-87 dated 9 December 1987 and amended by the Regulation approved by Order in Council 112-88 dated 27 January 1988.is further amended by substituting the following for section 2: « 2.A school board applying for recognition must: (1) consult with the orientation committee and the scholl committee, in accordance with section 218 of the Education Act (R.S.Q., c.1-13.3); (2) consult with the parents of the students attending the school, in accordance with section 218 of the Education Act (R.S.Q.c.1-13.3); (3) send the Catholic committee the results of ihe consultation with the orientation committee, the school committee and the parents.».2.Section 5 is revoked.3.Section 6 is amended by substituting the following for paragraph I; \"(1) the implementation and evaluation of the educational project of the school, in accordance with sections 45 and 46 of the Education Act (R.S.Q., c.1-13.3);\".4.Section 7 is amended by inserting the words \"the orientation committee\", after the words \"participation of.5.The following is substituted for the title of Subdivison 2: \"§2.Catholic moral and religious instruction\".6.The following is substituted for section 8: \"8.In each year of elementary and secondary school, a public school recognized as Catholic shall offer a Catholic moral and religious instruction course.8.1 A public school recognized as Catholic shall follow the Catholic moral and religious instruction programs approved by the Catholic committee.It shall also follow the local programs of studies in Catholic moral and religious instruction approved by that committee.It shall use the text-books and the teaching material approved by the Catholic committee for that type of instruction.\".7.Section 9 is revoked.8.The following is substituted for section 10: \"10.In each year of elementary school, not less than 60 hours shall be devoted to Catholic moral and religious instruction.\".ft.The following is substituted for section 11 : \" 11.In each year of secondary school, nol less than 50 hours shall be devoted to Catholic moral and religious instruction\".10.The following is substituted for section 12: \"12.The provisions of section 11 do not apply to a program of studies leading to a Secondary School Vocational Certificate, to a Secondary School Vocational Diploma or to an Attestation of Vocational Specialization, in accordance with the Regulation made under section 447 of the Education Act (R.S.Q.c.1-13.3).\".11.The following is substituted for section 14: \"14.A public school recognized as Catholic must ensure that a pupil following a Catholic moral and religious instruction program is evaluated in order to determine whether he has achieved the objectives of the program.\".12.Paragraph time.\".!\u2022\u2022 The following is substituted for section 21: \"21.The person in charge of pastoral animation in an elementary school and the pastoral animator in a secondary school shall conduct Catholic pastoral animation activities in accordance with the handbooks of objectives approved by the Catholic committee.\".17.This Regulation comes into force on the 15\" day following the date of Regulation amending the Regulation respecting gas and public safety Whereas under section 2 of the Gas Distribution Act (R.S.Q.c D-10).the Régie du gaz naturel may make regulations respecting public safety and the prevention of accidents resulting from the conveyance, possession, distribution and use of gas in Québec; Whereas under section 3 of the Act.the Board may also, by regulation, adopt and render obligatory, in whole or in part, with such changes as it deems expedient, any code or technical standard which it may deem appropriate and consistent with the public interest, respecting gas apparatus and gas conveyance systems or distribution networks; Whereas under section 4 of the Act.the regulations made by the Board shall come into force only after they are authorized, with or without amendments, by the government, and from their publication in the Gazelle officielle du Québec, unless another date, specified in such publication, has been fixed for such purpose by the government; Whereas the Regulation respecting gas and public safety ik k i.i 1981.c.I1 m r.4) was adopted by the Régie de l'électricité et du gaz and whereas this Regulation was authorized by the government; Whereas under section 2 of the Regulation, the Régie de l'électricité et du gaz adopted and rendered obligatory the standards for the tests of gas appliances, listed in Appendix I of this Regulation, as in force on 28 June 1984; Whereas under section 86 of the Act respecting the Régie du gaz naturel (1988.c.23).the Régie de l'électricité et du gaz is replaced by the Régie du gaz naturel, as of 17 June 1988; Whereas the Régie du gaz naturel deems it appropriate and consistent with the public interest to adopt and render obligatory these standards as amended since 28 June 1984; Whereas under subsections I and 2 of section 3 of this Regulation, the Régie de l'électricité el du gaz has adopted and rendered obligatory, with changes, Code CANI-BI49.1-M80 entitled \"Installation Code for Natural Gas Burning Appliances and Equipment\" and amendment I to this Code; Whereas the Régie du gaz naturel deems it appropriate and consistent with the public interest to adopt and render obligatory, with changes.Code CAN/CGA-B149.1-M86.published in January 1986 by the Canadian Gas Association under the title \"Natural Gas Installation Code\"; Whereas the Régie du gaz naturel deems it expedient, therefore, to replace any reference, in this Regulation, and in any code and in any standard adopted under the Gas Distribution Act.in the above-mentioned Code CAN-BI49.I-M80; Whereas under subsections I and 2 of section 25 and section 26 of this Regulation, the Régie de lélectricilé et du gaz has adopted and rendered obligatory, with changes.Code CANI-B149.2-M80 entitled \"Installation Code for Propane Burning Appliances and Equipment\" and amendment I to this Code; Whereas the Régie du gaz naturel deems it appropriate and consistent with the public interest to adopt and render obligatory, with changes.Code CAN/CGA-B149.2-M86.published in July 1986 by the Canadian Gas Association under the title \"Propane Installation Code\"; Whereas the Régie du gaz naturel deems it expedient, therefore, to replace any reference, in this Regulation, in any code and in any standard adopted under the Gas Distribution Act.in the above-mentioned Code CANI-BI49 2-M80: Whereas for these purposes, the Régie du gaz naturel, by its Order D-89-04 of 8 May 1989.has adopted a Regulation amending the Regulation respecting gas and public safety; Whereas, in accordance with sections 10 and 11 of the Regulations Act (R.S.Q.c.R-I8.I).the Regulation adopted by Order D-89-04 of the Régie du gaz naturel was published in Part 2 of the Gazelle officielle du Québec of 27 December 1989 with a notice stating thai it might be submitted to the government for authorization at the expiry of a 45-day time limit from this publication: Whereas it is expedient to approve the attached Regulation with amendments; It is ordered, therefore, upon the recommendation of the Minister of Energy and Resources: That the Regulation amending the Regulation respecting gas and public safety, attached hereto, be approved BenoIt Morin.Clerk of the Conseil exécutif Regulation amending the Regulation respecting gas and public safety Gas Distribution Act (R.S.Q.c D-10.s 2 and 3) I.The Regulation respecting gas and public safely (R.R.Q.1981.c D-10.r 4|.amended by the regulations authorized by Orders in Council 708-83 of 13 April 1983.1240-84 of 30 May 1984.1282-85 of 26 June 1985.945-86 and 946-86 of 25 June 1986, 1491-87 of 30 September 1987 and 870-89 of 7 June 1989.is further amended by replacing section 2 by the following: \"2.No person shall install a gas appliance unless it is approved by the Régie du gaz naturel (Board) or tested, according to the standards accepted by the Board and listed in Appendix 1 as in force on (insert here the date of the coming into force of this Regulation), by one of the following organizations: (a) the Canadian Gas Association (CGA); Part 2 GAZETTE OFFICIELLE DU QUÉBEC.November 28.1990.Vol.122.No.48 2849 (b) the Canadian Standards Association (CSA); le) the Underwriters' Laboratories of Canada (ULC).The organization will vouch for such test by affixing its seal of approval to the appliance.2.Subsections I and 2 of section 3 of the Regulation are replaced by the following: \"3.(I) The inslallation, replacement and removal of any gas appliance shall be made in accordance with Code CAN/CGA-B149.1-M86, published by the Canadian Gas Association, in January 1986, entitled \"Natural Gas Installation Code\", which Code is adopted and rendered obligatory, with the changes indicated in Appendix II.(2) The construction, installation, repair, maintenance, replacement, removal and inspection of any gas piping, in whole or in part, shall be made in accordance with Code CAN/CGA-B 149.1 -M86.as adopted and rendered obligatory, with changes, in subsection I.\".3.Subsection I of section 6 of the Regulation is replaced by the following: \"6.(II Before supplying gas to any installation, the distributor shall ascertain that it complies with the Gas Distribution Act (R.S.Q.c.D-10).the present Regulation and Code CAN/CGA-BI49.1-M86.as adopted and rendered obligatory, with changes, in section 3.\".4.Section 21.1 of the Regulation is replaced by the following: \"21.1 The design, installation, modification, repair, maintenance, replacement, removal and inspection of a compressed natural gas refuelling station for road vehicles as defined in the Highway Safety Code (R.S.Q., c.C-24.2).and the warehousing, storage, packing and handling of compressed natural gas shall be made in accordance with Code CAN/CGA-B149.1-M86, as adopted and rendered obligatory, with changes, in section 3\".5.Section 21.4 of the Regulation is replaced by the following: \"21.4 The design, installation, repair, maintenance, replacement, removal and testing of the compressed natural gas motor-fuel system and container of a road vehicle as defined in the Highway Safety Code and the use of compressed natural gas as motor-fuel for such vehicle shall be made in accordance with Code CAN/CGA-B 149.1-M86.as adopted and rendered obligatory, with changes, in section 3.\".8.Section 24 of the Regulation is replaced by the following: \"24.No person shall install a gas appliance unless it is approved by the Régie du gaz naturel (Board) or tested, according to standards accepted by the Board and listed in Appendix I as in force on 13 December 1990.by one of the following organizations: la) the Canadian Gas Association (CGA), lb) the Canadian Standards Association (CSA): (c) the Underwriters' Laboratories of Canada (ULC).The organization will vouch for such test by affixing its seal of approval to the appliance.7.Subsections 1 and 2 of section 25 of the Regulation are replaced by the following: \"25.(1) The installation, replacement and removal of any gas appliance shall be made in accordance with Code CAN/CGA-BI49.2-M86.published by the Canadian Gas Association, in July 1986.entitled \"Propane Installation Code\", which Code is adopted and rendered obligatory, with the changes indicated in Appendix III.(2) The construction, installation, repair, maintenance, replacement, removal and inspection of any gas piping, in whole or in part, shall be made in accordance with Code CAN/CGA-B149.2-M86.as adopted and rendered obligatory, with changes, in subsection I.\".8.Section 26 of the Regulation is replaced by the following: \"26.The warehousing, storage, packing, transportation and handling of gases shall be made in accordance with the requirements of Code CAN/CGA-B 149.2-M86, as adopted and rendered obligatory, with changes, in section 25.\".9.Subsection I of section 28 of the Regulation is replaced by the following: \"28.(I) Before supplying gas to any installation, the distributor shall ascertain that it complies with the Gas Distribution Act (R.S.Q.c.D-10).the present Regulation and Code CAN/CGA-B149.2-M86, as adopted and rendered obligatory, with changes, in section 25\".10.Section 37.2 of the Regulation is replaced by the following: \"37.2 The design, installation, repair, maintenance, replacement, removal and testing of propane gas motor-fuel system and tank of a road vehicle as defined in the Highway Safety Code, the use of propane gas as motor-fuel for such vehicle and the parking of such vehicle fit to use propane gas as motor-fuel shall be made in accordance with Code CAN/CGA-B 149.2-M86.as adopted and rendered obligatory, with changes, in section 25.\".11.Section 40 of the Regulation is replaced by the following: \"40.Any reference made, in any code and in any standard adopted under the Gas Distribution Act, to Code CAN1-B149.I-M80 entitled \"Installation Code for Natural Gas Burning Appliances and Equipment\" and to amendment 1 to this Code, entitled \"Amendment #1 to CAN1-BI49.1-M80.Installation Code for Natural Gas Burning Appliances and Equipment.Installation of Compressed Natural Gas Fuel Systems and Containers on Highway Vehicles and Requirements for Refuelling Stations\", is replaced by a reference to Code CAN/CGA-B 149.1-M86.as adopted and rendered obligatory, with changes, in section 3\".12.Section 41 of the Regulation is replaced by the following: \"41.Any reference made, in any code and in any standard adopted under the Gas Distribution Act, to Code CANI-B149.2-M80 entitled \"Installation Code for Propane Burning Appliances and Equipment\" and to amendment I to this Code, entitled \"Amendment #1 to CANI-B149.2-M80, Installation Code for Propane Burning Appliances and Equipment, Installation of Propane Fuel Systems and Tanks on Highway Vehicles\", is replaced by a reference to Code CAN/CGA-B 149.2-M86, as adopted and rendered obligatory, with changes, in section the Code is deleted.8.Part 3 of the Code is amended by adding, after Division 3.19, the following: \"3.20 APPLIANCE REGULATOR \"3.20.1 An appliance regulator shall be installed in accordance with the requirements prescribed in Division 6.1.\".9.Subsection 4.1.3 of the Code is replaced by the following: \"4.1.3 A boiler having an input up to and including 400 000 Btuh (120 kW) and certified for installation on noncombustible flooring may be installed on a floor constructed of combustible material provided that (a) the floor is protected with at least two continuous courses of 4 inch (90 mm) thick hollow masonry units covered with sheet metal at least 0.0195 inch (0,56 mm) thick; (b) the masonry units are arranged so that the hollow cores will permit air circulation through them; and (c) the base as specified in a and b extends not less than 6 inches (150 mm) beyond the sides of the boiler.\".10.Division 4.3 of the Code is replaced by the following: \"4.3 CARBON DIOXIDE GENERATORS 4.3.1 A generator used in a greenhouse shall conform to one of the following requirements: (a) be approved for use in a greenhouse or (b) be an approved burner or, if it is permitted by the authority having jurisdiction, be a heating appliance equipped with safety controls.4.3.2 A generator used in a produce storage area shall take its combustion air from outside this storage area.4.3.3 A generator installed in a greenhouse to produce carbon dioxide may take its combustion air from inside the greenhouse if the input does not exceed 20 Btuh per ft' (0,2 kW per mJ) of greenhouse volume and if the concentration of carbon dioxide does not exceed 5000 ppm and that of carbon monoxide produced in the atmosphere of the greenhouse does not exceed 35 ppm.Concentrations shall be checked upon initial starting of the generator.\".11.Subsection 4.19.1 of the Code is replaced by the following: \"4.19.1 A direct-fired door air heater shall only be installed in a doorway as a barrier against cold outside air.\".12.Subsection 4.22.2 of the Code is replaced by the following: \"4.22.2 Either a room heater, or a decorative appliance, designed and marked \"FOR USE IN NONCOMBUSTIBLE FIREPLACES\"' shall be installed in a fireplace conforming to the National Building Code of Canada 1985.as amended and rendered obligatory by the Orders in Council mentioned in Division mechanical air supply inlet to a building: (b) above a meter/regulator assembly within 3 ft (900 mm) horizontally of the vertical centre-line of the regulator; (c) within 6 ft (1.8 m) of any propane service regulator vent outlet; (d) less than I ft (300 mm) above grade level; and (e) within 3 ft ( 1 m) of a building opening or combustion air inlet of another appliance, except that for the vent from a direct vent room heater, the following reduced clearances may be used: i.9 inches (225 mm) for inputs up to and including 50 000 Btuh (15 kW); and ii.12 inches (300 mm) for inputs exceeding 50 000 Btuh (15 kW) but not exceeding 100 000 Btuh (30 kW).\".18.Subsection 5.14.11 of the Code is amended: 1° by adding, at the end of subparagraph ii of paragraph c.the word \"or\"; 2° by adding, after paragraph c.the following: \"(d) the venting system of an appliance certified with a draft hood is equipped with a power venter and: l.the power venting system is approved; ii.the power venter is neither connected to a masonry chimney nor a Type B Vent; iii.a horizontal vent is used; iv.all joints of the vent are sealed with a high temperature >ealant.v.a means is incorporated in the system to prevent the flow of gas to the main burner in the event of failure of the power venter; vi.the design, operation, and capacity of the power venter is compatible with the appliance; and vii.The system is equipped with a vent terminal supplied by the power venter manufacturer.\".19.Subsection 5.22.8 of the Code is replaced by the following: \"5.22.8 The draft hood of a certified appliance shall not be replaced by a draft regulator\".20.Subsection 6.8.2 of the Code is amended by replacing paragraph c by the following: \"(c) The ignition transformer secondary is rated at not less than 6 000 V and 20 mA or at an approved voltage and amperage ensuring safe ignition during use;\".21.Subsection 6.14.1 of the Code is replaced by the following: \"6.14.1 An appliance shall have a clearly legible
