Wednesday and had agreed to third reading today. But it got snagged in a procedural Richmond couple awarded $49,594 in car accident SHERBROOKE — The court of appeal recently confirmed the responsibility of the Tow n of Richmond and the Attorney General of Quebec in an accident which occurred on the road from Trenholm to Richmond when a car plunged into a crevice in the road caused by torrential rains The court named Mr.and Mrs.Euclide Rivard of Richmond as the recipients of $49,594.the compensation which will be paid to them by the two parties responsible.Judges G H Montgomery, Francois Lajoie and Marcel Crete sanctioned the opinion of St.Francis Superior Court Judge William Mitchell, which concluded that the town workers and Attorney General did not provide necessary measures to warn of the dangerous situation CHRONOLOGY — A violent thunder storm struck the Richmond area on the evening of June 30, 1969.— Water in a brook flowing into two ditches, overflowed onto the road between Trenholm and Richmond and eventually washed out the culvert, leaving the road with a sunken gap seven feet deep, 30 feet long and 40 feet wide in it.— About 9:30 pm.the vehicle of Mr William Sullivan was swallowed up by the deep water at the scene.— Richmond employees and the Attorney General went to the scene of the washout and placed barricades to block the route on the edge of Richmond.— The culvert in question was situated in the Richmond limits but it was constructed and maintained by the provincial Ministry of Roads.— The employees left the damage site shortly before midnight — Moments after, the car of Mr.Rivard fell into the gaping hole.— Mr and Mrs.Rivard were seriously injured in the accident. The town of Richmond and the Attorney General gave as their defence that the storm was of such violent nature that it was caused by an act of God.Notes made by Judge Crete at the hearing stated that the town and provincial crews had been at the scene for two and a half hours before the accident occurred to Mr.Rivard and they had ample time to act accordingly. The accident could have been anticipated and was invited by the uncareful nature of the workers. The possibility of the eventual accident didn’t escape the minds of Richmond police officers Marcel Duchesne and Jacques Lefebvre, Gerard Langlois of the provincial roads dept , agent Alain Belley of the QPF or Jean-Paul Beaudoin, a Town of Richmond employee. The workers left the scene of the damage, leaving the road in a known dangerous condition. The original judgment in favor of the Rivards was handed down by the local Superior Court, in 1972 and the Court of Appeals upheld the decision in February, 1975.Quebec in focus Strippers legal MONTREAL (CP' Quebec Superior Court ruled Wednesday that 25 years, “and we don’t know where the manpower is going to come from,” the annual meeting of the Canadian Institute of Mining and Metallurgy was told Tuesday John Frey, dean of the Haileybury School of Mines, said continuing labor shortages in remote areas might become “such a critical factor” that many vital mineral development projects would have to be delayed He said the problem arose because the Canadian population is not increasing as fast as the resource in dustries, which are experiencing a stiff com petition for engineers and technical graduates, he said At the same time, demand for operating personnel, tradesmen and technicians is increasing which might slow projects such as development of the Alberta oil sands, expansion of the coal industry and construction of oil and gas pipelines C ITES ESTIMATES Otto Fisher, a federal government economist, cited estimates by the Mining Association of Canada that labor shortages caused a $320-million loss in production last year and that hiring and training new employees cost at least $48 million A forecast from the federal department of energy, mines and resources indicates that labor requirements in mining will likely rise at an annual average rate of about 2 5 per cent until the vear 2000, compared with an average 15 to 2 0 per cent during the last 25 years A R Walsh of J S Redpath Ltd., North Bay.Ont , an Arctic project engineer, said mining projects in the high Arctic have low labor turnover rates and almost no absenteeism despite long working hours. As well, Mr.Walsh said, the number of accidents per man hour worked is “considerably lower” than on the company’s southern projects He agreed with other speakers that companies must offer strong financial incentives and good living conditions to attract the required by one dealer late in the day at $163 50 U S an ounce bid, down from $165.75 bid Friday Monday’s quote was the lowest since October 1974 A dealer said the dollar’s weakness appeared to stem from The U S dollar declined to 2 3708 West German marks from 2 3830 Friday, against the Swiss franc to 2.5485 from 2 5605, to a new 1974 75 low against the French franc at 4 1265 compared with 4 1375 housing. The rate for mortgages on existing housing will rise to 11 per cent for both National Housing Act (NHA) mort gages and conventional mortgages. The maximum mortgage granted on existing housing will be cut to $25,000 from $60,000.The rates on new housing will not change.NHA to face charges A government com munique Tuesday night said that if United States-owned Gulf fails to clarify the Co., Venezuela’s third largest producer International Petroleum Co., a subsidiary of Exxon, and a subsidiary of Royal Dutch Shell share the remaining 50 per cent Gulf executives were not immediately available for comment.Rafael Macia-Jerez, assistant to the president of Mene Grande, said last week that the company “has been in Venezuela 52 years and we have never made any contributions to any political campaign nor have we paid bribes or made any illegal payment to any government official.” The decision to demand clarification from Gulf was taken at a meeting of President Carlos Andres Perez with his cabinet •STUDIED INFORMATION’ They “analysed and studied the information divulged by the international press during the last few days, according to which Gulf Oil Corp has stated that between the years 1966 and 1972 it was obliged to pay certain sums of money in order to continue operating in a country whose name was omitted.” the communique said New York’s Wall Street Journal published a story saying Gulf executives told US Securities and Exchange Commission investigators that politicians in a foreign country compelled the company to pay the bribes in cash contributions in order to stay in business there The country was not named, but the newspaper said it might be a Latin American country Venezuelan political parties have been advised of the government’s decision and have given their support.the communique said, and the US government also has been asked to conduct an investigation of the bribery statements The Venezuelan congress opened its own investigation Tuesday and agreed to take up a proposal by one deputy calling for a review of Gulf's operations in Venezuela mortgages will remain at 10.5 per cent and conventional mortgages at 10.75 per cent.“The move has been made necessary by the unprecedented demand for mortgage funds which, if unchecked, would have exhausted our year’s allocation in short order,” said Rowland Frazee, Royal’s executive vice-president and general manager.“The $25,000 ceiling on mortgages on existing housing is intended to ensure that funds which continue to flow into this sector will be spread over the largest number of housing units and, in fact, will flow to the lower-priced sector of the markets,” he said A number of trust companies, including Canada Permanent Trust Co.of Toronto, have reported they are out of funds and are not accepting new mortgage applications.Annual Income on 5 year Guaranteed Investment Receipts.Fully guaranteed by Royal Trust for term of deposit. No fee or handling charge.Rates subject Coach Ernie McLean wasn’t surprised at the way his New Westminster Bruins out-skated, out-hit and forechecked Toronto Marlboros in Wednesday night’s Memorial Cup hockey game “That’s the way we always play,” McLean said moments after the Bruins, champions of the Western Canada Hockey League, scored four goals in the final period to defeat the Marlboros 6-2 in the third game of the first round of the Canadian major junior championship The win gives the Bruins a bye into Sunday’s 1:30 p m EDT final, while the Ontario Hockey Association Major Junior A winners from Toronto must play Sherbrooke Beavers in a sudden-death game Friday night to determine New Westminster’s opponent Sherbrooke, representing the Quebec Major Junior Hockey League, lost both its games in the first round, a 5-4 overtime decision to the Marlboros on Saturday night, and a 7-5 Monday night loss to the Bruins FORM REVERSED Wednesday’s game was supposed to feature the hard hitting often brutal tactics of the Bruins and the freewheeling Toronto attack The reverse was almost true The New Westminster penalty killing unit continually stymied the Marlboros on their power plays, directing the play and allowing Toronto few shots on goalie Cord Laxton And when the Marlboros did manage to get a shot away at Laxton—29 in all— the Bruins goaltender handled them easily McLean sees penalty killing as the key to his team’s win “Toronto is supposed to have the best power play in the East,’* McLean said.“But we’ve got a fine bunch of penalty killers ourselves The Bruins had to kill off seven minor penalties assessed by QMJHL referee Marcelle Vaillancourt Toronto had five minor penalties called in the first fight free game of the tournament New Westminster took a 2- 0 first period lead on goals by Brian Shmyr and Clayton Pachal Mark Napier scored the only goal of the second penod and Lynn Jorgenson scored at 1.54 of the third to tie the game Steve Clippingdale put the Bruins ahead 3-2 at 5:06 of the final period and Mike Sleep, Fred Berry and Richard Shinske added insurance goals later in the period CARR UNSTEADY Toronto goaltender Gary Carr appeared unsteady at times, stopping 17 of 23 shots directed his way Laxton was forced to make several outstanding saves during the game, including a breakaway skate save on Napier when the Marlboros were shorthanded near the end of the second period Laxton said after the game he doesn’t care which team he plays in the final—“we beat them both”—but rates Sherbrooke as the tougher team The attendance of 4,536 was a marked improvement over the first two games when 3,162 and 3,156 fans respectively showed up Many of the fans at Kitchener Memorial Arena opted for the cheaper standing-room-only positions at the goal ends of the arena, not wishing to pay the $5.$6 and $7 price for seats which cost $1 more than at last year’s tournament at Calgary All games at the Calgary tournament were sellouts The Canadian Amateur Hockey Association sets the price for the tournament and allows advance tickets to be sold only in five-game sets before the tournament Meanwhile, officials from the three leagues with teams in the tournament announced Wednesday a news conference for today at which they are expected to announce agreement on a constitution for the Canadian Major Junior Hockey League Supporters of the new league says it will unify major junior hockey across the country and give it a better bargaining position with the pros Toronto lawyer Joe Kane met with the league officials for almost four hours Wednesday to iron out final details of the constitution Clarence Results ednesda y Cincinnati 10 San Diego 2 Boston 4 Cleveland 2 San Francisco 6 Atlanta 2 Baltimore 4 Ne* York 3 Chicago 7 Montreal 0 Ne* York 6 Pittsburgh l Philadelphia 4 St at Detroit N time, the Flyers had a 38-28 edge in shots. But the Islanders needed just one shot in overtime to win.Drouin was alone when he beat goalie Bernie Parent at 1:53 to end Philadelphia’s unbeaten string at 21 games going back to March 8 n the regular season.“It was me and the Flyers,” said Drouin.“If I had missed it I would have shot myself.” STARTED BY CAPTAIN It was captain Ed Westfall, who had scored New York’s first goal, who started the play that put the Islanders back in the series. He carried the puck over the blueline himself, then flipped a pass to Drouin that bounced over his stick.J P Parise picked up the loose puck and passed it to Drouin, who was by then alone in front of the net “I noticed Bernie Parent was more on the lefthand side of the net, so I had to go to my backhand, which I did,” said Drouin The 10-foot backhander rose over Parent’s outstretched right leg Coach A1 Arbour of the Islanders said there was “no doubt” in his mind that the period was over when Leach scored “I don’t think there was too much argument about that, but the Flyers argued,” he said TURNED OFF LIGHT Islander general manager Bill Torrey said the timekeeper caused the confusion by turning off the green light indicating the end of the period too quickly. He said a videotape of the game confirmed that the green light flashed before Leach scored. After Westfall’s power-play goal early in the first period, defenceman Gerry Hart made it 2-0 when he shot a 25-foot after taking a pass from Andre St.Laurent behind the net early in the second period Ralph Stewart gave the Islanders a three-goal lead on another power play but Lonsberry and MacLeish cut that lead to one goal, scoring before the period ended. At 4:48 of the third period, MacLeish pulled Resch out of the net on a breakaway and flipped a wrist shot into a wideopen net.Barber got his penalty shot at 13:24 of the first period after the Islanders’ Billy Harris, trying to catch him on a breakaway, pulled him down from behind Resch said that Barber almost had him beat on the penalty shot “I just kinda went with his deke and threw my legs out and he had me but he didn’t shoot the puck up,” he said.Bulwer-Lennoxville shooting scores BULWER — On April 29, the Lennoxville Rifle Club met in a return match with the Bulwer Rifle Club at the Bulwer Community Centre The four top scores were
