Sherbrooke Thursday, November 16,1989 Victor Davis threw bottle at windshield, lawyer says By Don Macdonald MONTREAL (CP) — The fog thickened Wednesday around just what happened the night Olympic swimming champion Victor Davis was mortally injured by a car as two lawyers gave contradictory stories of the tragedy.The only thing that is sure so far is that Davis was hit by a car carrying three men early Saturday morning as the swimmer’s girlfriend, Donna Clavel, and another woman looked on in horror.Davis, 25, died Monday after suffering massive head and spinal injuries in the mishap, which occurred on the main drag of suburban Ste Anne-de-Bellevue, minutes after Davis and his companions had left a bar.The lawyer for the three men in the car suggested the accident occurred when the driver of the car lost control and struck Davis after the retired swimmer hurled a bottle at the windshield.“If something is thrown through the windshield of a car, you’re not going to look straight forward as glass comes flying at you.” lawyer Jeffrey Boro said.Raphael Schachter, lawyer for Davis's family, refused comment Wednesday on whether the swimmer had thrown a bottle at the car.But he said the police description of the tragedy as a traffic accident continues to be at odds with what he has been told by his clients.Boro said the three men he represents, who were also at the bar before the mishap, left the scene of the accident because they were afraid of Davis.They weren’t sure they had hit him, Boro said.Instead, two of the men reported the incident to the district police station after dropping off one man at his home.The 19-year-old man who was behind the wheel that night was the designated driver for the evening and had not been drinking, Boro said, adding there are two witnesses who can substantiate the men’s story.He refused to identify the witnesses.Police administered no breathalyser test to the driver and no charges have been laid in the case.Police spokesman Danielle Sau-vageau said Wednesday police are waiting until next week to interview Davis's girlfriend Clavel and her friend, Jennifer Watt, about what they saw.Schachter has asked the police to hold off interviewing the women until Monday after Davis’s funeral in Guelph, Ont., on Saturday.In the meantime, police are interviewing other people and carrying out tests, said Sauvageau who said she couldn’t elaborate.Clavel and Watt have said the driver deliberately ran down Da- vis after a quarrel.Schachter, echoing the sentiments of many of the Olympic gold-medallist's friends and relatives, has said criminal charges should be “a definite possiblity at least.” A police investigator showed up at the bar in Ste-Anne-de-Bellevue for the first time Tuesday and police have yet to interview the owner or cashier of the convenience store where Davis bought a bottle of orange juice moments before he was struck down.TAPE ERASED Jean Gervais, owner of the store, said Wednesday a security video camera would have recorded Davis’s purchase but the tape had been routinely erased for re-use.The juice bottle could have been the one witnesses said was thrown by Davis at the car.One man in the car, Frank Dres, has said Davis was drunk, which is denied by his friends and the owner of the bar Police have said no breathalyser test was performed on the driver of the car because he showed no signs of impairment when he reported the accident about 35 minutes after it occurred.The man already faces a drunk driving charge.He is to stand trial in Quebec Court on Dec.15 to face charges of impaired driving.Those charges would not have shown up on a police computer the night of the accident, police say.because there has been no convie tion.The man pleaded not guilty to the charges at an arraignment in October last year.Boro also said the driver of the car is shaken because this is the second fatal accident he’s been in volved in this year.The lawyer said the man tried
