The Record newsroom@sherbrookerecord.com Friday, December 21, 2012 Page 5 Neptune rejects U.S.class action lawsuit from shareholders over deadly explosion The Canadian Press Neptune Technologies & Bioressources Inc.says it will fight a U.S.class-action lawsuit from shareholders over a powerful explosion and fire at its industrial plant in Sherbrooke, that killed three and injured 18 last month. The Quebec-based company said Thursday that the lawsuit is “completely without merit” and that it has “substantial and meritorious legal and factual defences, which Neptune intends to pursue vigorously.” The law firm representing shareholders claims, among other things, that Neptune had installed larger acetone storage tanks at the Sherbrooke production plant that facilitated “dangerously high levels” of the chemical at the site.Neptune said Thursday the amount of acetone levels stored on-site or used in the production of its krill oil products never exceeded levels permitted by the province. It also obtained the required construction permits for the plant expansion and was in the process of obtaining the required environmental permits for the expansion. It repeated that a Quebec Ministry of Environment notice received on Nov.16 alleging environmental non-compliance related to equipment acquisitions and the plant expansion, not acetone levels. The incident occurred at a facility which produces health products derived from marine life. The lawsuit filed Wednesday in the United States District Court for the Southern District of New York alleges violations of the Securities Exchange Act.The complaint was filed on behalf of the purchasers of Neptune stock between Dec.12, 2011 and Nov.18, 2012.The period included a public offering of Neptune shares on Sept.25, 2012, at $4.10.The stock is now worth about half that, trading at about $2.05 on the Toronto Stock Exchange. The firm representing shareholders, Robbins Geller Rud-man & Dowd LLP, that throughout the relevant period Neptune “lauded the future benefits” of an expansion at the production plant and failed to disclose several adverse facts.Neptune says it continues to work on its plan to resume its neutraceutical operations and certain levels of sales of its products to customers in the short term, while reconstructing a plant using the expansion facility and equipment that doesn’t appear to have suffered significant damage in the explosion. The company has said it expects insurance coverage would likely be enough to fund most of the costs for construction of a new plant that could be operational in six to nine months.Holiday slowdown at CHUS At the end of this week, hospitals of the CHUS will begin a slowdown of activity relative to the holiday season, closing a total of 45 beds at its two Sherbrooke hospitals.Normal activity will recommence Jan.8.At CHUS Fleurimont, 14 beds will close, while the Hôtel-Dieu will close 31.The surgical wing’s activities will also be cut back during the holiday, with nine of 19 operating rooms performing surgery between Christmas and New Year’s, although the hospital maintains that emergency service will not be affected. The holiday season schedule could be altered, should an unexpected event, a flu outbreak for example, become apparent.Dec.24, 25, 26, and 31 are holidays at the institution, as are Jan.1 and 2.As a result, administrative offices, appointments, sampling centres, and outpatient clinics will be closed on those days.Sherbrooke woman admits harassing pop star Sherbrooke A Sherbrooke woman, obsessed with Quebec pop star Daniel Bigras, pleaded guilty to charges of harassment in Sherbrooke Wednesday.Just as she was about to face trial, Nadia Fortin, 32, chose to forego the process and entered a guilty plea, thereby freeing the singer-songwriter from having to testify.Expected as a complainant and witness in this case, Bigras will not need to appear. He can, however, send a victim impact statement to Judge Conrad Chapdelaine of the Court of Quebec.Fortier had communicated with the singer many times, but at one point, Bigras let her know that he did not intend to maintain contact.Rather than respect his wishes, Fortin admitted having sent an email to Dan Bigras describing a sexual assault she experienced by an 11-year old.Later in the message, she claimed that she was in fact an 11-year old girl and not the 30-something woman she really is.Based on this message, Bigras contacted Montreal police who tracked her down and discovered that she was in fact an adult woman from Sherbrooke who had ignored Bigras’ request that she stop communicating with him.Fortin also admitted to contacting Dan Bigras knowing he did not want to communicate with her, leading to the harassment charges.Fortin will appear for her sentence hearing on Jan.11.St-Elie drag course collects huge fines f-| ¦jhe owner of the former Drags race track in St-Élie has been fined a total of $62,500 be-JL cause of the noise caused by drag racing. For the third time, the City of Sherbrooke has issued a batch of fines against Complexe St-Élie Motorsports. In July and September, the company received fines for noise caused by drag racing from the beginning of March. This time, nine new infractions have been cited, each carrying a $2,500 fine plus costs for the races held from late August to the end of October. So far, the race track has received a total of 25 citations for excessive noise in 2012 alone.Earlier this year, Judge François Toth upheld the right of neighbours to the reasonable enjoyment of their properties, particularly during the summer; a right he said was infringed by the drag race noise. The Record, the Address: Phone Number: ertoce£ Anglican GEORGEVILLE St.George’s Anglican
