Authorities.Sabeas Corpus Ease Called This Morning.Effort to Get Adjournment Fails.Argument in Chambers.General Public Excluded.JUDGMENT DEFERRED TILL WEONESDAV OR THURSDAY A new sensation was sprung in the case of Harry K.Thaw this morning, end the lawyers for the famous Mat-tcawan refugee admitted that it came as a bolt from the blue.They urged upon the Court the necessity of adjournment to meet the new situation.This the Court, for reasons stated below, denied.Intervention of the Attorney-General was the new emergency which the attorneys for Thaw were called upon to face.Mr.A.Geoffrion, K.C., presented himself as the special embassy of the Attorney-General.The first request of the Attorney- » *¦ » \u2022 SIR TOMER GOUIN, Premier and Attorney-General of the Province, who has intervened in Thaw case.General to the Court of St.Francis District was that the case be dealt with expeditiously; that there be no unnecessary delay in bringing it to a conclusion.Mr.Geoffrion further stated to the Court the desire of the Attorney-General that if it appeared to the Court that the prisoner, Harry K.Thaw, was held in the district jail illegally, that he should be set at liberty as soon as possible.\"The Attorney-General desires me to point out,\u2019\u2019 said Mr.Geoffrion in bis statement to the Court, \"that be does not desire the district jail to be made use of, either as a -boarding house or as a refuge from the working of Federal Statutes.\u201d Mr.Geoffrion further set forth that the Attorney-General was only concerned With the question of the legal- MR.JUSTICE HUTCHINSON, who heard habeas corpus proceedings.ity of the prisoner\u2019s present incarceration.If he was in jail illegally, he wanted him set free as speedily as possible.With any subsequent action which might be taken under Federal law he had nothing to do, and was not concerned in this direction.So intervention of Attorney-General is the big issue which the counsel cf Harry K; Thaw found themselves up against this morning.HABEAS CORPUS PROBLAM FIRST.The habeas corpus problem was however f'rst before the Court.As Mr.Geoffren stated the attorney general would prefer that he requests his speedy release by the Court if it appears that he is illegally held.So the battle in the habeas corpus case comes on first.\"We contend that that grand old institution, the Magna Oharta, is being violated by this writ, taken out by Constable Boudreau, pretending to act in interests of th-a prisoner, while it is well known that the action is really taken on behalf of the foreign state.Harry K.Thaw is an alien, but is just as much entitled to the protection of the British Flag as Mr.Jerome or any other American in the city.He should be delivered over to bis enemies under this writ, pretended to be in his interests, but actually on behalf of the State of New York which seeks to return him to Matteawan Asylum.The above is the gist of the pretensions of the counsel for Thaw.PROCEEDINGS AT COURT HOUSE At 10 o\u2019clock this morning Harry K.Thaw was brought before Mr.Justice Hutchinson, in chambers.Only the attorneys and officials connected with the case and the newspapermen were present.A large crowd gathered in the vicinity of the Court House and the large court room was filled with interested spectators.They were, however, doomed to disappointment.Thaw was brought to the Court House at 10 a.m.and conducted, not to the large court room, but to the judge\u2019s chambers.This morning's proceedings, therefore, were without the spectacular features which marked the hearing the other day.JAILER\u2019S AUTHORITY.The proceedings opened with the reading by Prothonotary Broderick of the famous commitment under which Harry K.Thaw is held.ATTORNEYS DECLARE THEMSELVES.The attorneys in the case then declared to His Lordship their stand in the case.Attorney Geoffreon, representing the Attorney-General.Attorney F.Campbell representing the Minister of Interior.Attorney H.Verrett representing Petitioner Boudreau.Attorneys Nicol and Jacobs as counsel for Petitioner Boudreau.Attorneys Shurtleff, Fraser, White and McKeown renresenting the prisoner, Harry K.Thaw.SEEK ADJOURNMENT.The lawyers for Thaw made a big effort to secure adjournment till next Friday morning.The reasons offered were : 1\u2014\tThat J.N.Greenshields, K.C., leading lawyer for Harry K.Thaw, could not be present, being obliged to be in Montreal to attend a meeting of the Quebec Railway bondholders, a matter in which he was heavily interested.2\u2014\tThat Boudreau, petitioner in the habeas corpus proceedings, was not present, though they bad had assurances that he would be.Yesterday being a legal holiday they were unable to serve a summons on him in this connection.They regarded his presence as essential.3^\u2014That the intervention of the Attorney-General, through Mr.Geoffreon, had taken therm absolutely by surprise, and they desired time to consult authorities and prepare to meet the new situation.The opposing counsel, including Mr.Geoffreon, opposed the request for adjournment.The argument in this connection occupied an hour.Mr.Geoffreon stated only two points involved.1\u2014\tIs the prisoner detained in jaii illegally.2\u2014\tHas Boudreau a right to petition iq habeas corpus proceedings for his release.His Lordship called for argument on the count' of habeas corpus.THAW DENIES BOUDREAU\u2019S INTEREST.Dr.Shurtleff fyled declarations on behalf of Harry K.Thaw, denying the interests of Constable Boudreau, of Coaticook, the petitioner for habeas corpus.COURT PROMISES JUDGMENT IN , day or two.At the conclusion of the argument, Mr.Justice Hutchinson said he was not prepared to deliver judgment immediately.He would have to take time to consider the matter and would prepare his judgment on the habeas corpus writ in writing.He would deliver judgment perhaps to-morrow, perhaps on Thursday.In any event, he would notify the interested attorneys of the hour and place.The court then adjourned and Thaw was returned to jail, where he will remain at least for another night.Should the writ of habeas corpus be denied, even on the Attorney-General\u2019s intervention, a delay of some days would be necessary before the matter could come up on another form.EVENTFUL DAY* FOR THAW.There was little time for rest ini the rival legal camps, or in the newspapermen\u2019s reserve last night.Keyed up to the highest pitch over the prospect of a most important break in the Thaw case the reporters dared not go to sleep.Starting at eignt o\u2019clock the lawyers for the prosecut- j ion paid a visit to the Court House Library, where they labored over the I scores of leather bound books containing authorities that might prove 1 useful in today\u2019s argument.The con- j ference lasted until ten fifteen, after ; which the lawyers returned to the i Magog House.Thaw's lawyers were also active, j In a mnaU room in the Magog House, 1 J.N.Greenshields, K.O., W.H.Me- j Keown and O.I).White, K.0., labored on, and when seen about midnight, Mr.McKeown stated that the defence were as certain of victory as it was possible for mortal man to he.STILL ANOTHER LAWYER HAS ARRIVED.The midnight brought ri a large number of prominent people, all connected with the Thaw case.Ferhaps the most important was Mr.A.Geoffrion, K.of Montreal, who is here, as the representative of the Attorney General of Quebec province.It is understood he will he present and take part in the hearing this morning.His mission here ig to have all trifling stopped, and if Thaw is illegally incarcerated to see that he is liberated at once.AND MORE IMMIGRATION OFFICIALS TOO.The same train brought E.Blake Robertson, Assistant Superintendent of Immigration, back to Sherbrooke.He was accompanied by Dr.Douglas, the department\u2019s alienist; Inspectors David Reynolds, W.R.LitOe and M.Beauchamp.R.J.Little, an official stenographer from the House of Commons was also a member of the party.Here they were joined by Mr.Williams, another inspector, who has been here all week.JEROME THREATENED.It was brought to the attention of Mr.Jerome, last night, that several threats had been heard against him.He laughed, but admitted that he did not appear to be popular up here.Captain John Lanyon, who ac companied the former district attorney here, is not so ready to discredit these rumors as is Mr.Jerome, and has a number of men guarding Thaw\u2019s prosecutor.These threats, if such ever were made, are mere idle boasting and no citizen of Hherbrooke expects any COMMITMENT HARRY K.THAW AT COATICOOK.I note in your issue of the 30th., the petition of John Boudreau for (Continued, on Page 8) Sopt.Scott of Canadian Immigration Says He Must Be Sent Out of Canada WILL BE SENT BACK TO WHERE DOMINION AUTHORITIES KNOW HE CROSSED.Chicago, Sept.2\u2014(Special)\u2014\u201cThaw lias no legal right in Canada, and 1 see absolutely nothing else to do but send him back to the United States,\u201d declared W.D.Scott, Superintendent of Canadian Immigration, before he left here this morning for Ottawa.He said he would take up the case immediately upon his arrival.\"I am not in touch with the details of the case, but my mind is practically made up that I have but one duty to perform,\u201d he asserted.\"The question of whether Thaw is insane or had committed a crime need not be considered by me.He did not come into the country at a recognized port of entry, and must be sent back.\u201d Asked if the New York authorities would be permitted to take charge of Thaw, the superintendent replied that \u201cit would seem most obvious that he should be sent back where the Domin ion authorities knew he crossed the line.\u201d CITY OFFICE EMPLOYEES Resolution by Council Suspending Them Cams Into Eifeci To-Day SEVERAL GO TO WORK AT REQUEST OF MAYOR, PENDING ACTION OF COUNCIL.The resolution of the (\u2019ity Council, suspending all the employees in the various departments, came into force today.When Mayor Hebert paid a visit to the City Offices this morning he found a few of the employees at their desks.This was in response to the request made on Saturday by Mayor Hebert to the employees that they report for duty on Tuesday morning and continue with their woik as usual, pending further action by the Council.They were not, however, to consider this as constituting an engagement.Among those who were not at their positions, were Mr.F.J.Griffith and Mr.B.A.Du gal.MR.GATIEN IN CHARGE.Mr.E.C.Gatien, the newly appointed Treasurer of the City was on hand forenoon and was accompanied by several distinguished guests.He was met at the station by the Mayor, Mr.Boivin, M.P., and the Superior of the Catholic College, which institution ho will formally open friends at Lake Megantic, and will return again for the hunting season.Mr.Carl Covey, of Woburn, has moved his family into the new house that he has had built this spring.It is quite a large two-storey building that will accommodate a number of guests, which he expects as soon as the hunting season opens.Several new buildings have gone up in the Woburn district since a recent visit there, showing that it is prospering and is a growing place.It was also noticed the only modern reapers and binders are to be seen around Lake Megantic, cutting the grain.The Rev.J.S.Michaud, the cure of Woburn, St.Augustine Church, is to be moved in a short time to St.Romaine.He will be replaced by the Rev.J.V.Lafontaine, from Windsor Mills.Dr.O.C.Ramsey, of New Haven, Conn., is at present occupying his camp at Arnold Pond, which he purchased from Mr.Draper.There are several guests at the camps of the Megantic Fish and Game Club at Arnold Pond which are this year under the care of Mr.and Mrs.Purcll, of Euttis, Me.The new dining camp is a nice, large building, with a wide verandah around three sides, which, with the old dining camp and several private camps, forms quite a village on a prominent point jutting out into the lake, and witli the majestic pines overshading them and the mountain on the north side of the lake for a back ground, it forms quite a picturesque scene.Mr.Leopold Girard has finished, his new home near the Three Lakes wharf, and it is quite an improvement to the district.It is a large, square, two-storey building, nicely painted in white, with dark facings, and primary.All welcomed the homecoming of our esteemed friend and neighbor, Mr.F.G.Goodenough, after a month\u2019s tour through the Western States, touching Michigan, Indiana, Illinois, Wisconsin and Minnesota.He did not find the grain and corn crops very good.Corn, especially, Was very poor and not a 50 per cent yield.Continuing his tour through Winnipeg, Crow\u2019s Nest Pass, Kootenay Lake, arriving at Kaslo, B.C., he remained there two weeks and spent a most enjoyable visit with his son, Mr.James Goodenough, and family.Continuing his route to Nelson, up Arrow Lake to Revelstoke, and then home through parts of the Canadian North-West, where the wheat crop yield is extra, hut seems to he somewhat late.On the whole he had a most enjoyable trip, hut would advise middle-aged people to locate in the Eastern Townships, as there is certainly more comfort here.Next Sunday, September 7th, will be children's day at the Methodist Church.The Sunday school, under the direction of Mrs.Moore,
