[" r/ Sherbrooke Daily Record.BE Established 1897 SHERBROOKE, QUE., WEDNESDAY SEPTEMBER 3 1913 ONE CENT THAW SET FREE BY \u201c \u201d JUDGMENT; RE-ARRESTED BY IMMIGRATION MEN HARRY KENDALL THAW whom Jero\u201co aVuelwan^ to return 'JÎ WILLIAM TRAVERS JEROME Who is specially commissioned by New York State to return Harry K.Thaw to Matteawan.Photo taken since his arrival in Sherbrooke, and published in the Record by special arrangement with the Boston Journal.(Copyright by Journal Publishing Co.) ¦ ¦ ifli Thaw Sends For His Mother to Come to Sherbrooke.N.K.\u2019 \"\t.K.C\u201e Enters Case on Thaw\u2019s Behalf.Looks like \" to Test Im-itcl.Thompson Jhaw\u2019s Chauffeur, Before Court To-Day.His Case Adjourned Jor One Week.Shortly after 2 o'clock this afternoon Harry K.Thaw was set free through judgment rendered hy Mr.Justice Hutchinson granting the writ of habeas corpus applied for by Constable Boudreau, of Coaticnok.His Lordship granted the writ, absolutely in a judgment which appears below.Thaw was present when the judgment was rendered and.for a brief space was once more a free man.A warrant in behalf of the Immigration authorities, however, was served and he was again placed under arrest.The next step is a board of inquiry, probably at Coaticook.Thaw will have right of appeal and there may be considerable delay before he can be taken across the border into Vermont.If the lawyers for the defence are permitted to test the constitutionality of the Immigration Act, the delay will be almost indefinite.Thaw, however, is no longer a provincial prisoner.He is now a federal prisoner, charged with having entered Canada by stealth at other than a regular port of entry.Mm ¦ 1 THE JUDGMENT \u2018\u2018The undersigned judge having heard the petitioner by his counsel on the merits of his petition for a writ of habeas corpus for the release of Harry K.Thaw, and having also heard the said Harry K.Thaw by his counsel in opposition to the said petition, and having examined the proof and proceedings of record and deliberated.\t1 \u201cConsidering that it is evident from the return of the jailer of the common jail of the district of St.Francis, in which the said Harry K.Thaw is imprisoned, that the said Harry K.Thaw is illegally detained in the said jail of this district, inasmuch as the otfence against him, namely, \u201chaving broken out and escaped from an insane asylum in a foreign country,\u201d is an offence not known to our law.\u201cConsidering that the further question presents itself, and which is to be determined, is the petitioner legally entitled to make the said petition, and is he acting on behalf of the said Harry K.Thaw.\u201cConsidering that the petitioner, Boudreau, laid the information and complaint herein against the said Harry K.Thaw, and swore to the same, and was the primary cause of his arrest and detention in the said common jail of this district.Considering that the said petitioner, Bondreau, in causing the arrest and detention of the said Harry K.Thaw, as- aforesaid, acted illegally, and did a great wrong to the said Thaw and violated his personal rights.\u201cConsidering that the said petitioner now recognizes that he acted illegally and did a great wrong to the said Thaw in causing his arrest and detention in the said jail, and now desires, so far as he is able, to retract and undo the wrong he has done to the said Thaw, and to restore him to his personal liberty he had before his said arrest and detention.\"Considering that the said petitioner, in making the present petition for a writ of habeas corpus has acted not only on his own behalf, but, presumably, on behalf of the : aid Harry K.Thaw, but the latter denies that the petitioner is acting in his interests and on his (Thaw\u2019s) behalf ; and it may be mentioned here that when the term \u2018on behalf of another\u2019 is used in a legal proceeding it means, according to the law dictionary, in the name of, on account of, j for the advantage of, or in the interest of.- \u201cConsidering that the said writ of habeas corpus is issued under the authority of the Statute No.95 of the Consolidated Statutes of Lower Canada, and that the said statute provides : \u2018That the common laws and statutes of England shall be applicable thereto,\u2019 hence the English judicial decisions are entitled to great weight.\u201cConsidering that under the English law no legal relation is required to exist between the prisoner and the person making the application for the said writ.\u201cConsidering that it may he made, of course, by the prisoner himself, but also by third persons, for example, by a husband on behalf of his wife ; by a wife on behalf of her husband ; by a father on behalf of a ton ; by a sister on behalf of her sister ; by an agent or friend on behalf of the prisoner ; by a guardian on behalf of children.These persons may apply for a writ of habeas corpus in certain cases without authority, without the consent, and even without the knowledge of the person or persons imprisoned.It is true that generally it is required that the petitioner should produce an affidavit of the prisoner, but if reasons are shown, or it appears from the record that this affidavit cannot be had, it is dispensed with.\u201cConsidering that the English law goes further, and in the 10th vol.of Halsbury's Laws of England, page 57, it is stated by the learned author, who was for many vears Lord j High Chancellor of Great Britain, that : \u2018Any person is entitled to institute proceedings to obtain a writ of habeas corpus for the purpose of liberating another from an illegal imprisonment.\u2019 And he specially cites as his authority for the statement a judgment reported in 13 East, page 195, known as the Hottentot Venus case.\u2018In this case there was no affidavit of the prisoner, but the court pointed out that in that case a reason was assigned for not producing the affidavit, and it may be added that the W'rit of habeas corpus in the said case was granted upon the allegation that an ignorant and helpless foreigner had been brought into the country (England) and exhibited against her consent by those in whose keeping she was, (this ignorant foreigner evidently had neither authorized, consented to, and was even without a knowledge of the application for the writ of habeas corpus on her behalf), and it was pointed\u2018out in that case that the authoritu of the court is the guardian of the liberty of the subject.The said author also cites two other cases to the Janie effect, namely, re.Elizabeth Daley, 2 F.F., page 253, and re.Thompson, 3 L.J., page 19.Considering, further, in the case of re Gootoo and Inyokwana, a writ of Habeas Corpus was obtained at tire instance of the Secretary of the British and Foreign Anti-Slavery Society, upon the allegation that two boys, of the age of 12, natives of Switzerland, or some adjacent country outside of British territory, had been brought to England by a British subject, who was about to take them back with him to Swaziland to he placed there in a state of slavery.Two other similar cases are also cited by the said author, namely: Sominersett\u2019s case and Slave G'race\u2019s case.It would appear, therefore, that the statement mentioned of Lord Halsbury\u2019s is well authenticated, and the American author, Hurd, on Habeas Corpus, at page 21)4, after remarking that a stranger who shows no interest has no right to come out and ask for this writ of Habeas Corpus on behalf of another, hut, finally he adds: \u201cThat it is enough when the application b\u2019- whomsoever presented shows probable ground to suspect that the person on whose behalf it is made is suffering an involuntary and wrongful restraint or imprisonment.\u2019\u2019 This author also repeats the above statement mentioned by Lord Hals-bury, namely, \u201cThat the application for the writ of Habeas Corpus can be made by anyone,\u201d and he also cites i in support of his statement the said I Hottentot Venus case reported in 13 ! East, page 195.1 Considering that the said Harry K.Thaw is held in the said common jail of this district, undoubtedly under wrongful restraint, and it is an involuntary restraint'; inasmuch as he did not come theie of his own free will, but against his will, and he is not at liberty to leave the said jail, but must wait until he gets the authority of a Court or Judge to leave, his coming and going to prison is certainly not subject to his will, and, therefore, according to Hurd, the condition mentioned hy him for the application is satisfied.Considering, further, that in view of the above authorities, the conclusion is that, although the petitioner himself is interested in the present petition, he has acted in this matter in making the present petition in the interest and on behalf of the prisoner, Thaw.Considering that the Attorney-General of this Province, by his representative specially authorized to appear in the present cause, has stated that it is tlie desire of the Attorney-General that this case shall be disposed of ¦ speedily as possible, and that if \u2018 je prisoner is legally imprisoned he be returned to jail to await his trial, but if he is under wrongful restraint he should be liberated at once, and that the desire of Abe prisoner to remain in the jail to avoid proceedings that may be taken against him under a Federal statute by the Dominion Government must not be considered, and that the jail of this district is not to be used as a house of refuge for such purpose.And the following case was cited by him as in point, namely: Re Mineau, reported in Segar\u2019s Convictions and Certiorari, page 51, when it was held that: \u201cA writ of habeas corpus may be applied for by an officer holding a warrant for the prisoner's arrest in another proceeding.\u201d This seems to be almost a parallel case to the present one.There is no doubt that a considerable difficulty lias been met with in determining the rights of parties in this case, but in doubtful cases the Court always inclines in favor of liberty.In numerous cases it has been held that \u201cIt is the dutv of a Judge hearing an application for discharge under a writ of Habeas Corpus when a prisoner is restrained of his liberty under a statute, to discharge him unless satisfied by unequivocal words in the statute that the imprisonment is warranted by statute.\u201d (See Clark\u2019s Criminal Law of Canada, page 555.) Doth, therefore, grant the said petition, maintain the said writ of Habeas Corpus, and ¦declare the same absolute: and doth further declare that the Jailer has no authority to detain tire said Harry K.Thaw In ¦\t(Continued on Page 8) RETIREMENT OF F.J._ Council ~ \" to Meet His Conditions KYLE HIS LETTER AND APPOINT TEMPORARY CITY CLERK.A meeting of the City Council was held last night.Mayor Hebert presided and all the aldermen were present.The meeting was called to decide what action should be taken in reference to the City Clerkship, Mr.F.J.Griffith, who was appointed to that office on August 22nd at an annual salary of $2,000, having intimated by letter that owing to the growth in the population and the consequent increase in the work, his engagement with the City would terminate on Sept.1st unless he was granted a three years\u2019 contract with a salary of $3,000 per annum.Mr.E.(\u2019.Gatien, the City Treasurer, was requested by the Mayor to take the minutes.The Mayor stated that Mr.Grif fith\u2019s letter was handed to him on Saturday, and Monday being a legal holiday, no action could be taken.He thouglit all that was necessary was to file the letter and appoint someone else.On motion of Aid, Jenckes, the resolution of August 22nd was rescinded.Aid.Jenckes then suggested that, according to ordinary procedure, the letter from Mr.Griffith should be considered.The Mayor asked for a resolution to be moved for filing the letter.This was done by Aid.Simoneau.Aid.Ewing seconded, saying they could not give a three years\u2019 contract if they wished to.The motion was adopted.On the motion of Aid.Brault, seconded by Aid.Simoneaiu, Mr.E.(\u2019.Gatien was appointed temporary City Clerk.He will therefore act as Treasurer and Secretary until a permanent secretary is appointed.No reference whatever was made to the office staff.OTHER BUSINESS.The («Witter of Improvement in the City Engineer\u2019s office was referred to the City Hall Department.The Council adjourned until Monday, the 8th inst.THAW TO C0ÂTIC00K After his re-arrest, this afternoon.Thaw was placed in an automobile and rushed to Coaticook, where the Board of Enquiry will be held.THOMPSON CASE AGAIN ADJOURNED Attorneys Consent to Have it Put Over For One Week THAW\u2019S CHAUFFEUR WAS WELL TREATED IN JAIL HERE.By mutual consent of the attorneys representing Roger Thompson and the Canadian Immigration Department, the case against Thaw\u2019s chauffeur was adjourned until next Wednesday.No reasons for the delay were given by Mr.St.Laurent who made the request, beyond the fact that certain conditions had arisen which made it advisable to have the case delayed.Mr.F.Campbell, representing the Minister of the Interior, stated that he was personally ready to go on with the case, but his orders were '.o consent to the delay.THOMPSON HAD PLEASANT TRIP.Thompson returned to the city ye.s-terday noon, after having enjoyed a pleasant trip to Quebec and Montreal.Many predicted that he would not show up and would forfeit his bail.By his presence this morning he showed that he was willing to stand his trial, and also showed his determination to stand by Thaw.PRAISES JAIL OFFICIALS.In conversation with the Record last night, Mr.Thompson stated that if ever he had to do time he would choose the Sherbrooke jail.He paid a compliment to the excellent manner in which the Governor and officials treated not only himself but all the other prisoners.THE WEATHER LOCAL FOROABT.A few local thunderstorms, but generally fair;
