[" ¦\t^ n Sherbrooke Daily Record.,lrt\u2014 \t, \u2014 ., , \u201e ¦\u201e .Eatablished 1897\tSHEKBROOKE, QUE., WEDNESDAY SEPTEMBER 24 1913.\tONE CENT LOOKS BAD FOR HARRY K.TO Jerome Reports Secret lo-dictmeot For Conspiracy Id New York GOVERNOR FELKER RESERVES DECISION TILL MONDAY.SUMMARY OF ARGUMENT.Conçois.N.H., Sept.24.\u2014(Special)\u2014Th>.big development in the Thaw hearing before Governor Felk-er was the announcement by Jerome that Harry Thaw had been secretly indicted by the Grand Jury at Poughkeepsie, New York.Jerome\u2019s statement came as an utter surprise to the Thaw array of counsel and Caused a sensation.This 'proved to be Jerome\u2019s trump care, and, according to the opinion of lawyers who heard the arguments, makes the case very black for Thaw.DECISION MONDAY.Shortly after Jerome finished his argument, Governor Felker adjourned the hearing and announced that he would give counsel until next Monday to fyle supplementary briefs.Harry had been keyed up to the highest nervous pitch all through the hearing.As his counsel pleaded for his freedom, he burst into tears and wept copiously.His white-haired n,other, who sat next tc him, pressed his hand again and again, and only at such times did he appear to grow less excited and fidgety.When Jerome mentioned the indictment Thaw simply stared in the special New York attorney's direction.A moment later Harry had lost much of bis confident hearing and appeared a bit depressed.The Jerome declaration had a similar effect on the others in the State Chamber where the hearing was held.It came like a bolt from the blue.Hardly had Jerome made the announcement than he followed it up with the statement that the name of a man \"vastly more important than yet mentioned has been drawn into the investigation of the charges of bribery and conspiracy in the escape }f Thaw from Matteawan.WILL ATTEND TO THOMPSON \"As far as Roger K.Thompson was concerned,\" Jerome assured the Thaw lawyers, \"he will to attended to.\"From the hour Stanford White lay-dead it has been said that the Thaw millions would defeat the ends of justice, and the State of New York will not interrupt its justice by the corrupt influence of money.That, Your Excellency, is the reason, and the only reason, New York wants Harry Thaw hack.\"If Thaw is returned he will be tried and convicted on the charge of conspiracy, and neither am I employed by anyone who would consent to the use of subterfuge.Nor would I use it myself.\" Jerome then sat down amid a hum of comment.The Governor's face was implacable throughout the trial.JEROME ATTACKS STONE.Referring to the Poughkeepsie proceedings, Jerome turned toward former Governor Stone of Thaw\u2019s counsel and said: \"1 am surprised to hear such words from your lips.They sound strange.No evidence, it is true, has been shown here that an indictment has been found.Ï, as special district attorney for New York, have a right to make known what I do know of the transactions of the Grand Jury, and I say that an indictment was found.The investigation of the Grand Jury was held up until I could return from New Hampshire.Myself and a member of the Grand Jury were made a special committee to investigate the conspiracy and bribery charges with the result that the name of a man vastly more important than any yet mentioned has been drawn in.You (still looking at Governor Stone) are trying to tie the hands of a sister State which is trying to secure the return of an escaped criminal.ATTACK ON MORRIS.Jerome opened his argument at 2.4S o\u2019clock.His address took up fifty-five minutes.In icy tones Jerome characterized Attorney Morris' argument that there was \"an excuse for wide discretion on the part of the Governor to be found in public sentiment,\u201d as the most remarkable statement he had ever heard.He continued: \"Contrary to what Mr.Morris stated there is not one scintilla of diecrc-tion left tho,Governor in extradition proceedings.The Governor\u2019s functions arc purely ministerial,\u201d and he produced numerous opinions of the United States Supreme Court to support ids statement.\u201cTiie governor is merely in the position of a marshal or sheriff when a procès is handed him for service.When the requisite evidence is presented, the Governor must yield up the fugitive, \"It is not a matter of grace but one of duty.\u201d He mentioned a specific case in which New Hampshire claimed a fugitive from New Jersey.The Governor of New Jersey had no other discretion other than to violcl to demands of New Hampshire attorneys and in an opinion the United States Supreme Court referred to the discre tionary power of the Governor as unimportant, declared Jerome.RIGHTS OF A CITIZEN.Attorney O.F.Morris of Thaw's (Continued on Pago 6.) threatening to the peace of Europe.Italy may take strong measures, even to the extent of a blockade of Piraeus should Greece continue to encroach on southern Albania, while it is rumored Austria will form an alliance with Bulgaria to prevent Servian aggression in northern Albania.Late advices from Belgrade say that Servia intends to mobilize a whole devision to deal with the Albania situation, because Albania respects only force, and any delay in the negotiations would he fatal to Servian interests.CAPTURE OF D1BRA.Belgrade, Sept.24.\u2014The official account of the capture of Dibra by the Albanians says that a large force attacked two companies of Servians in the vicinity of that town Monday morning.After a fierce battle of two hours, the Servians withdrew towards Retchevo, and the Albanians entered Dibra.They numbered 0,000 and were commanded by foreign officers the nationality of whom has not bean established.Servian reinforcements have been despatched to Dibra.ESSAD PASHA\u2019S ACTIVITIES.Saloniki, Sept.24.\u2014 It is reported from Beiret, which is thirty miles from Avlona, that Eusad Pasha proclaimed Albanian autonomy under the suzerainty of the Sultan, and \u201cMount Temple,\u201d commanded by J.H.Moore, and one of the best known vessels in the Canadian trade, ran ashore off Maisonneuve this morning.The reports received state that she is badly damaged and is taking in water.The vessel left her wharf at 5.20 this morning to begin her voyage to London.The mernin- was foggy with smoke hanging over the river.A pilot was on hoard and in the absence of the winter port business was taken by the longshoremen's union, numbering all the harbor workers in St.John, who drew up a new schedule of rates and presented it to the shipping companies with the notice that the union would move to put the new schedule into effect on November 16.Local shipping men declined to discuss the demand or the probable action of the shipping companies, beyond saying that the matter demanded serious consideration, and that a meeting of shipping men would probably be held iu a few days to consider a line of action.If the shipping companies refuse to grant the demands of the men, there is likelihood.of a struggle, as the union men have been preparing to move for higher pay for some years, and they are backed by the International Longshoreman's workmen.Rubinoqitz was recently retained by the miners defence committee to handle their cases arising out of the recent strike riots and went to Nanaimo Monday to acquaint himself with the local that the frequency with which politicians have been visiting Balmoral Castle bears out the inference that it was the King who instigated the attempt to bring the parties together.He adds that very serious attention is being paid the proposal to exclude northeastern Ulster from the immediate scheme of the Irish Government.The proposal, he continues, would involve the remodelling of present plans so as to convert the Irish Government scheme into a mere Liberal endowment of the Irish Parliament, and he adds that there is reason to believe that Unionist Ulster would accept such a solution of the difficulty.The Daily Express, repeating former utterances on the subject, emphasises its conviction that the present Home Rule Bill is as dead as Julius Caesar.Premier Asquith is now attacked within N.B.THE CAUSE OF THE ACCIDENT DUE TO ONE CONDUCTOR MISCONSTRUING ORDERS.Moncton, Sept.24.\u2014Four engine-men killed and two brakemen injured, at least a damage of $40,000 to the I.C.R., line between Moncton and Halifax tied up for hours, which necessitated the transference of passengers, mail and baggage from one side of the wreck to the other, were the results of a wreck on the I.C.R., in which two trains came together in a head-on collision at a point known as Siddalls Cut, about one mile east of Aulac, or about six miles east oi Sackville, yesterday afternoon.The dead arc : Enoch Rushton, driver on No.231, Dufferin street, Moncton.Byron Colpitts, fireman on No.231, Moncton.Frank Lyons, driver on No.234, Truro.Hingley, fireman on No.234, Stewi-acke.The injured : R.H.Sharpe, forward brakeman on No.231, Moncton.Banks, forward brakeman on No.234, Truro.The bodies of the three others, too, presented a gruesome sight.They were taken out of the wreckage, placed on the side of the track and covered by blankets.Dr.J.V.Calkin, of Sackville, was summoned and he went to the scene.After the two injured men had been attended to, Dr.Calkin who is a coroner, empanneled a jury, who, after viewing the remains adjourned until to-day.The two forward brakemen on each train were riding in the engines with their respective drivers and how they escaped death along with the other occupants of the two engines is unexplained.Brakeman Robert H.Sharpe, of Moncton, was badly injured.He was picked up in a critical condition and taken to the Amherst hospital.He will recover.Banks, the other brakeman, who was in the cab of Driver Lyons' train was also badly injured, but it is thought that he will recover.MISCONSTRUED ORDERS.The cause of the collision was due to Conductor George physical health or educational development it is his duty to report same to the teacher who in turn reports to the pupil\u2019s parents.It is also the medical inspector\u2019s duty to report any
