Supreme Court.QUEBEC MARRIAGE LAWS The Most Important Session of the Hearing Yet Held\u2014Cruicial Point of the Argument.Ottawa.May 28\u2014What is consider- td to he the crucial point in the argument of the learied counsel oppos- Ing the right of the Dominion Parliament to enact the Lancaster Marriage Bill was reached in the Supreme Court this afternoon.when Mr.P.B.Mignault, K.C.of Montreal, asserted that the general public misunderstood and many legal lights seemingly deliberately misconstrued the marriage law of the Province of Quebec, In referring to the fact that under the law in Quebec a marriage is null and no marriage 2t all, even though the parties contracting lived together à number of years, unless, they being Roman Catholics of course, it was solemnized by a priest.\u201cThe children are always protected,\u201d exclaimed Mi.Mignault with earnestness.\u201cThis point is atsolute- ly misconceived and misconstrued by people who are responsible for the agitation.They have no right to misconstrue the law in this way and impute that the chiidren are thrown on the world as natural children, It is not the law of the Province of Quebec and never was.\u201d By far the most interesting discussion took place this afternoon that has ensued since the hearing started.Mr.Mignault showed his full mastery of the Quebec marriage laws on which he is a recognized authority.All the justices of the court joined in the animated discussion that took place at times, Messrs Justices Idington and Duff being particularly anx- lous to go into the matter deeply and surely.Mr.Mignault is expected to complete his argument to-morrow when he will be followed by Mr, I.B.Hellmuth, K.C., Toronto, who will take up the matter from another aspect and reply to Hon.Wallace Nesbitt, K.C., who opened the case for the promoters of the bill.Then the two Quebec counsels, Messrs.R.C.Smith, K.C., and Aime Geoffrion, K.C., are expected to present the case from the side of their province, and later Hon.Mr.Nesbitt and Mr, Lafleur will have an opportunity of repsying.Tt is thought the case will consume the whole week.Continuing after luncheon, Mr.Mignault took up the phare of opposition to marriage in connection with the Quehec laws.\u201cMarriage may be prevented by means of the opposition of the father, mother, tutor or prior consort of one of the parties,\u201d he said.\u201cIn this event, there must be some officer\u2014 priest or minister\u2014who by legislation is charged with the solemnization.Take the city of Montreal for instance.There are fifty Roman Catholic parishes in that city and æbout three times as many of other denominations.The law requires that to stay a marriage, notice must be serv~ ed on some officer.It is set forth in the act that the articles of marriage must say there is no opposition.This shows the status of the parties\u201d The Chief Justice\u2014\"What argue ment is there for danns?\u201d EVENT London Papers Make Caustic Comment on Senator Smith's Speech on Titanic Disaster.London, May 29.\u2014The Senate committee's report and Senator Smith's speech are given prominence in the London morning papers, hut only a few make editorial comments.The Daily Mail likens the speech to Martin Chuzzlewitz's programme oration, and says that Senator Smith has buried a grave and terrible event beneath a mountain of foolish fustian, and has managed to discount and discredit the work of the Senate committee, when he descends to technical questions.\u201cHis notorious want of knowledge of the sea.\u201d says the paper, \u201crenders his opinions absclutely worthless.\u201d The Express says: \u201cAlthough the report sounds sensible, Senator Smith's grotesque oration deprives it of much of its value.\u201d The Daily Chronicle says: \u201cThe report does wot benefit by Senator Smith's association with it.The Chronicle recommends the British public to withhold judgment until Lord Mersey's report is published.The Daily News admits that some of the conclusions are irresistible and very disturbing.rer rt EE party with special qualifications to solemnize marriage.\u201d Justice residence was held to be a member of the parish in which he had been baptized.Justice Idington\u2014\u201cSupposing a man of no church and a woman of no church were married and lived together for some years, what would be their status under the Quebec laws?\u201d Mr.Mignault\u2014\"The marriage would be null.I would say there never had been a marriage.\u201d Justice Tdington\u2014\u201cThen the children would he illegitimate?\u201d Mr.Mignault\u2014\u201cNot under our laws in Quebec, Article sixty4hree clearly says that if the marriage is contracted in good faith in this way, but through ignorance of the parties as to the law, the children are protected.The children are always protected.This point is absolutely nuseonceived and misconstrued by the people who are responsible for the Commissioners Are Expected to Meet to Consider tha Rasult Within a Week.Montreal, May 28.\u2014The open sessions of the commission which has been investigating the United Shoe Machinery Company of Canada, under the Anti-Combines Act, came to an end this afternoon.Mr.T.Chase Casgrain, K.C., concluded his presentation of the company\u2019s case and Mr.A, Falconer, K.C., summed up on behalf of the shoe manufacturers.The hearing then adjourned.It is expected that the commissioners will hold a private meeting in about a week, when they will make arrangements for the preparation of their finding.The work of the commission has extended over several months.Their meetings were held at Montreal, Torcuto.Oucbec and in other cities.At each place many manufacturers were examined.In addition officials of the United Shoe Machinery Company, both the Canadian concern and the parent American company, were examined at length.The commissioners also went to various factories and were shown the machines at work, buth those of the United Company and those of other makes.This having been the first case of the kind taken under the Anti-Com- bines Act, much importance is attached to it.The investigation was started at the petition of shoe manufacturers of Quebec City, who complained that the methods of the United Shoe Machinery Company constituted a monopoly in restraint of trade.Particular objection was made to the practice of the company in leasing rather than selling its machines.and al«o to what was known as the \u201ctying\u201d clause in the leases.binding the lessees to use the machines for twenty years.and also providing that they should use only the machines of the company in their factories in connection with those leased.EDMONTON'S ASSESSOR DROPPED done.There was five feet of water in the streets and conditions were growing serious when workmen were able to close the gates above the canal, shutting off the flow of water.No lives were lost, but he received in the game at New Westminster last Friday, Newsy\u201d Lalonde was unable to turn out to practice with the Vancouver lacrosse team today, and will not be in the daily workout until Thursday.Lalonde was checked hard by Johuny Howard all through the holiday game, and he is in bad shape as a result.However, he will be back on the team at inside- home next Saturday, when the rivals stack up for the second game of the champuionship series.Don Cameron was another absentee from practice.The sturdy defence man will be out of the game for a week or so with his injured shoulder and will not play on Saturday, his place being taken by Billy West.The rest of the team for Saturday's game will be the same.Just who will act as referee for the game on Saturday will not be announced until later in the week, and then it is likely that the commission will make an announcement in addition that will tend to cuch the rough work that was in evidence on the holiday.It is understood that Andalusian fines, who went on strike at Malaga May 25.have agreed to submit their differences to arbitration by the Governor of Malaga.The Governor has already prepared and submitted to both parties a scheme of settlement based upon the suppression of the obligatory Mutual Aid Society, to which the men are Torced to contribute a percentage of their wages, and the distribution of the funds of the Commission this morning reopened the adjourned meeting into the administration of the affairs 1 the Montreal harbor, having reached the city from Ottawa last evening.This morning's session was occupied with a further hearing of President Geo.W, Stephens, of the Harbor Commission, and, as was the case previously, the sitting was more of a conference with the chief executive of the port than an examination.Hon.A.B.Morine, the chairman, presided at the hearing, the two other memhers, Messrs.G.N.Ducharme and R.S.Lake, being also present.The sesions are of à private nature and will continue during the week.BOY MADE ATTACK UPON AGED LADY Ottawa, Ont, May 28\u2014Beause, it is believed, he thought the act might result in his being deported to England, Henry Bowling, 16 years old, at noon to-day committed a brutal attack on the wife of his employer, Mrs.James Brady, by striking her on the head with a club while she fay nn a sofa in her hnme at Eardley.Bowling is now in Hull jail, facing a charge off attempted murder, Mis victim, a woman nearly 50 years old, although for a time in a serious condition, will probably recover.She is under the care of Dr.Dowd of Quyon, who way and Employers Requested tb Meet! the acquisition of colonies at the expense of other nations, and requests her to show the world that armies are more useful in peace than in war, and that the appetite for territorial expansion ix a 1776, they carefully cultivated the affection of their emigrants, and did everything possible to build up newer Britains in every quarter of the globe.That is the example which Germany, even at this stage, fain would emulate.She sees nothing of \u201ca worn- out tradition\u201d in territorial expansion, but a wige and shrewd policy which she fain would imitate.It is true that most of the lands where new Ger manies might be built up have alrealy been acquired, but there still remain vast, unpeopled regions in South Americy, where the seeds of a new empire might be planted.She has sounded the rulers of these lands, and understands that a mutuaiiy beneiicial understanding might soon he reached if only the Monroe Doctrine might be ignored or evaded.And so, Germany may have two alternatives in view in lier swollen naval estimates.One may he the downfall of England and the ultimate acquisition of the English colonies, That is the more likely of the two.It is quite possible that the
