with his promise late last night to meet them soon after midnight and to counsel with them for final determination of a programme. The appointed hour had long passed ‘and there was no sign of the V.Marsh, a steward of the Allan Liner Victoripn. While walking along by the river front at Dominion Park he, with several others, noticed that a small motor launch had capsized some distance from the shore, and two men were hanging on to her.A gentleman ran to the water, jumped in and started swimming out to them, but befork he got half way he collapsed and began to sink.Marsh, seeing this, went down to the water and swam out tn him, bringing him back.Taking to the water again, Marsh went to the capsized boat, took one of the men off and brought him to shore.By this time the other man had become exhausted and dropped off the boat, so Marsh again went to his assistance and brought him ashore.Marsh has already received three medals from the Royal Humane Sociefy in England. He has now resumed hearing of the charges against Dr.Beattie Nesbitt, of sign ing false returns for the government, Magistrate Denison stated he had heard enough evidence to warrant his committing the former Farmers’ Bank resident for trial.Today's session fisted about two hours and a half.Ex-Manager Travers was the only witness.George T.Blackstock, K.C., crown counsel, said that he proposed to call no more evidence, but H.H.Dewart, K.C, Nesbitt's counsel, declared he was entitled to have the evi- deuce of F.C.Fitzgibbon-the former chief accountaint.Out of courtesy Magistrate Denison adjourned the hearing until tomorrow, when Fitzgibbon will testify. It is expected this will conmlude the preliminary hearing. The hearing was marled by a keen contest between Mr.Blackstock and Mr.Dewart as to whether the copies prepared for the crown by Travers of the bank's real finances when the returns were asked Ly the Finance Der partment, should be allowed to be put in as exhibits.that these, which should have been forwarded instead of the fictitioun ones which resulted against Nesbitt, must he ruled out, as nothing which was not shown In the hank's books could be put in.The magistrate finally In the three other returns. He added that Nesbitt had been sware that in dividing the $80,000 among the subscribers’ names to decieve the government, certain names had been left nut.though he was not sure that iWeshitt knew which names.Nesbitt Rad slst known this was being done to cover up the real transaction regarding the $80,000.Nesbitt had had two conversations with him as to who thy $80,000 should be divided up on the Hst of subscribers.Travers declared that individual hanks as well as the Bankers'y Association had fouglit the young banks tooth and nail.Me.Dewart cross-examined the Supreme Court has to 9 degree clegred the sir on 4 question “concerning which there has been much tangled argument during the last year.Until the final decision Is given by Privy Council there is bound to remain some uncertainty.and the government dots wisely, therefore, in submitting the questien at once to the highest tribungl within the Empite.} There will be little surprise that the Sunrame Const declares Parliament without the power to enact, in whole or in part, sueh legislation ay the Laaegster bill.Such was the opinion expressed op the floor af Parligment bx the best legal minds in the cauntry and by hoth the present Minister of Justice and big predecessor in office. The geastest populac interest in the judgment will attach to that portion of it which desley with the law of this province, over the Interpretation of which bqs erisen the contraversy of months past.It declares unanimously that 8 mined marviage performed by 1 Protestant clergyman Is legal sod therefore in the | line with the decision rendered te- coatly in the famous Hebert case, Leaving aside the legal side of the Question, we have always centended that every Protestant clergymas should consider it a moral éuty to refuse to perform thy marriage of two Catholics. The very fact thet they should make application to kim to marry them must argue that there is somthing w Tba decision of the Supreme Court is à strong affirmation of the rights claimed by the province in this matter. It points out, accordingly, that to make marriages heretofore solemnized legal and binding, and to ensure the same with respect to future marrisges, there would have to be concurrent legislation by the prov- tnces The finding in this appeal to Canada’s highest tribunal will, doubtless, become a historical judgment.Degling, as it does, with one of the basic institutions of society and the state, it is well that at this stage there has been as great unzrimity as exists in the finding of the judges. There was # general feeling at the time when reference was made to the Supreme Court that the goverament was teking the wisest course. The outcome jugti- fies it In its action.A prompt appeal to organized to-night by electing former Vice-President Chas.Warren Fairbanks, of Indiana, chairman.Senator La Folette's representatives submitted a complete draft of a platform.Samuel Gompers, of the American Federation of Labor, was among the first to ask a hearing. The Taft forces controlled the committee. The tentative draft of.the Taft platform was submitted. After protesting allegiance to the Republican party principles, recalling with veneration the name of Abraham Lincoln, and praising Republican achievements in government, the platform continues : ° _ “The principles of constitutional government which make provision for orderly and effective expression of the popular will, for the protection of civil liberty and the essential rights of men, and for the intenprétation of the law by An untrammeled and independent judiciary, have proved themselves capable of sustaining the structure of a government, which after more than a century of development, embraces one hundred millions of people, scattered over à wide and diverse territory, but bound dy common purpose, common ideals and common affection to the constitution of the United .:ates.” The platform then binds the party to solve the problems which social, economic and political development have brought to the forefront. It promises to enact in the nation and encourage in the various states laws to THURSDAY, safeguard public health, to lit ohill labor, to protect workingmen jo dangerous occnpatiohs, to substitute workmen's compensation for actions at law, to retain public ownership and control ef naturdl resources that are still public property. It continues : “The social and political structure of the United States rests upon the civil liberty of the individual and for the protestion of that liberty the people have wisely, in the national and late constitutions, put, definite limitations upon their governmental officers and agencies. To enforce these Jimitations, to secure the orderly and coherent exercises of governmental powèré and to protect the righta of even the humblest and least favored individual, are the function of independent courts of justice.“The Republican party re-affires its contention to uphold at all times the authority and.integrity of the courts, both state and federal, and it will ever insist that their powers to enforce their process and protect life, liberty and property shall de preserved inviolate.Apr orderly method is provided under our system of government.” BIG CRASH HAS COME.The long expected crash in the Republican ranks came tonight. The Roosevelt forces, acting, they said, under the personal direction of the colonel himself, began to Jay their plans for independent action in the Nationa! last towns some undoubtedly were faunded in good faith, but meeting with a sequence of misfortune were compelled to give up the struggle fur existence, ornadoes, drought, plagues of grasshappers and similar forms of ill-luck have ge- counted for their disappearance. But the large majority of the lost towns never hud the faintest prospect of permanency. Most of them were speculative towns, the quick crumbling monuments of the greed of land boomers, from whose operations Kansas in its day suffered mose than most states, The Kansas land boomer built towns overnight and then, also overnight, he left them to their fate, They were largely built upon paper, but had just enough actual existence to attract the unwary investor and the unfortunate settler, who generally arrived on the scene in time to witness the bursting of the bubble.f the history of the lost towns is êvez written it will probably be discovered that the greater number of them were founded in deceit and avarice and never had the slightest chance of becoming real.Kansas, es a State, bas no reason to regret that they have gone, but a great many individuals, poorer in pocket-book, have the best of reasons for regretting that they ever came at all—Cincinnati Times-Star.’ oe ——— TIT FOR TAT.“The late John Arbuckle, “Coffee King Arbuckle,” said a coffe broker, “was very charitable, but he administered his charity with rare delicacy” ‘Coffee King Arbuckle’ used to as sert that the poor were as sensitive as the rich, and he would illustrate this assertion with an apt anecdote.“One of his anecdotes was about a rich woman who, while calling on « poor woman in a slum, said; New York, June 19.—The stock market opened to-day with some show of activity and strength, but these promises were not fulfilled, although the undertone remained moderately strong.Dealings in the first hour were fairly large, but they petered out to minor proportions in the succeeding hours, with a small total of net gains.Coal shares, which were under considerable pressure yesterday, supplied the bulk of the early business at higher prices.Wall street evidently chose to ignore the possible effects of the proposed investigation into those properties by the Interstate Commerce Commission, and buying of Reading and Lehigh Valley soon wiped out recent recessions.Later both reacted from their best prices, the upward movement switching to New York Central which more than recovered its dividend, and Chesapeake & Ohio, which rose as a result of the recent dividend on Hocking Valley. In the early afternoon the market became extremely dull, with spasmodic movements in some of the obscure issues and’ Amalgamated Copper, the latter being assisted by rumors of another advance in the price of copper mental, the second in two days.Another helpful factor in the copper stocks was the strength of those securities abroad. In the final: hour, when trading hecame a trifle more animated, Interbore-Metropoli- tan preferred was advanced on announcement that the Interboro Rapid Transit Company had declared an extra dividend of § per cent, part of which accrues to the benefit of the first named security. The tone of the market at thé close ranged from steady to irregular.Among the low-priced sgcurities Wabash common and preferred were prominent for their acute weskness, the one selling at the lowest price in its history and the other touching the lowest quotation in some years, Denver & Rio Grande preferred slso reflected moderate liquidation. The reorganization plan of the Wabash road is likely to he issued shortly, and it is a foregone conclusion that both classes of stock will be heavily ss.sessed.’ In the way of general news the proceedings of the convention at Chicago overshadowed ail else, but they seemed to exercise no especial influence marketwise. The general rush to sell wheat and other foodstuffs in the Chicago mmgket was another factor of passing influence.Wry European markets, particularly In THE _| less, aside from the failure of another UEBEC Bank of Englund received over $1,000,000 gold, but shipped almost double that amount to Berlin, where financial pressure shows but slight relaxation.Time money was a bit firmer here, some of the larger institutions placing 90-day Joans at 3% per cent compared with bids of 3 per cent the day before. There was some lending of 60-day money at 3 per cent, with no demand for shorter periods.July interest and dividend disbursements are estimated at $256,810,564 as compared with 4224,559,243 in the middle of last year.A considerable part of the increase is due to the larger financial
