Today's Weather sesessgecesc22 Ib «++20c pint T0 PROBE GRAND TRUNK AGREEMENT CONGRESS MAY INVESTIGATE ITS RELATIONS WITH THE NEW HAVEN SYSTEM.Washington, Dec.2,-\u2014An investigation of possible violations of the Sherman Anti-Trust Law by the Grand Trunk Railway Company and the New York, New Haven & Hartford Railroad Company in connection with the building of a projected New England branch of the Grand Trunk, is authorized by a resolution introduced in the House to-day by Representative D'Shaunessy, of Rhode Island.The tesolution would provide for the election by the House of a special committee of seven members to inquire Into the circumstances surrounding the suspension of work on the Grand Trank line through Southern New England.\u201c The matter is now under investigation by the Department of Justice, following complaints by citizens of Providence, R.I, and other towns along the line of the proposed branch.REFUSE TO HEAR JAE WITNESS id gis WHOLE EVIDENCE IN ALIENATION SUIT WAS TO COME FROM INMATE OF ASYLUM.Toronto, Dec.2\u2014The prosecution of Hon.A.GC.McKay, former Libera! leader in Ontario.and now of Edmonton, by W.H.Haines, for alleged alienation of his wife's affections, was dropped when the case was reached before Justice Leitch at the Milton Assizes to-day.Mrs.Haines, an inmate of Toronto Asylum, had been subpoenaed to give evidence, but the asylum authorities would not consent to her doing so.Dr.Bruce Smith, inspector of prisons and asylums, and Dr.Forster, superintendent of Toronto Asylum, testified that Mr.Haines was laboring under hallucinations and had been in that condition for some time.They maintained that it would be utterly wrong for her to give evidence in the case.Dr.Bruce Smith insisted that it would be monstrous to allow any gatient to be brought from an asylum to the witness box.The court, after hearing Dr.Smith, Dr.Forster and Dr.H, Clare, agreed that it would not be right to ask for Mrs, Haines' testimony under such circumstances.The prosecution was then abandoned, as the whole case was based upon what the experts state were Mrs.Haines\u2019 hallucinations.THREE TIMES CONDEMNED, STILL FIGHTING FOR LIFE Montreal, Dec.2\u2014Although Sylvio Yacovloff has been three times cen- tenced to hang for the murder of his sister-in-law, Marie Louise Tremblay, and unless commutation is granted will go to the scaffold on Friday, Jan.17, his counsel are making a determined fight to save their client from the rope, Yacovlofl was sentenced at the June term of the Court of King's Bench to hang on Sept.20, and his counsel, Messrs.J.O.Fournier and Arthur Geoffrion, obtained a reprieve until Nov.13, and a few days before that time a further reprieve was obtained until January next.His counsel have tried to get the consent of the court to the formation of a commission of alienists to observe the Joung man as to his sanity, and Dr.Villeveune has made a report, which, it is understond, is to the effert that white Yacovioff is not a lunatic that there are times ; when he is hardly responsible for his actions.MONTREAL-LEVIS ROUTE FOR CHR WOULD EXTEND ITS SYSTEM BY RUNNING ALONG THE SOUTH SHORE OF RIVER.Moutreal, Dec.2\u2014There has been much speculation in railway circles of late as to fhe Canadian Northern Railway's intention in applying to the Dominion Government for authorization to cross the St.Lawrence from a point in the city of Montreal.No definite informvation can be gleaned as to what point in the city at which the crossing will be made.It was stated to-day by a Canadian Northern official that the application to the Government was purely a matter of foresight, as it is the company\u2019s intention at some future date to connect with the Intercolonial Railway and some of the leading Americen roads.There have heen suggestions made that the Canadian Nerthern lave in view the taking up of the extension of | the Delaware & Hvdson, formerly the Quebec Southern Railway.This extension runs to within 50 miles of Point Levis along the south shore of the St.Lawrence from St.Lambert, but this rumor was officially denied.Tt was pointed out that the company\u2019s service is now running through the Kreatest traffic district in the province and there would be little advantage in runniug a line along the | south shored af the river whère traffic | is more less dormant.The road the | company will build in the future on} the opposite side of the river, it was | stated, will be a direct route to Levis, and will connect with the Intercolonial Railway.MUST RAISE RATE OR BE BANKRUPT ANCIENT ORDER OF UNITED! before the Railway Commission, and while the reduction ordered is material, and will be a great help to Quebec interests, it is nof- wholly satisfactory.President E.T.Nesbitt of the Quebec branch 6f the Canadian Manufacturers\u2019 Association said last night that the order should be made retroactive, and critigized especialiy the due set for jo intone December 9, whew the car ferry is like ly to discotinue its\u2019 service, so that the actus! date when the new rate will go into effect is really at the opening of navigation next spring.After Three Year Fight.The manufacturers and merchants of Quebec have for some three years past been complaining of the high charges they have had to pay to the C.P.R.for the shunting of cars consigned to their firms from the Point- a-Carcy ferry landing to their place of business, which they have contended not only eat up their profits, but made it impossible for them to compete with dealers, especially in the lumber trade, who received their stock over the C.P.R.The matter was taken up by the Board of Trade nearly three years ago, and after continual appeals for the interference of the Canadian Board of Railway Commissioners, have at last achieved a result that goes to show the usefulness of the Quebec Board of Trade.The petition of the Quebec Board of Trade and several of the Quebec merchants to the Railway Commission were against the C.P.R.for exorbitant charges for switching car loads originating or destined to points on the Grand Trunk, Quebec Central and Intercolonial Railways, between the ferry dock and tracks and sidings in the city of Quebec.C.P.R.Resisted Change.The case was argued before the: Railway Commission, and the C, P.Rcontended that the question of inter- switching couid not he entertained, from the fact that the Quebce car ferry service was a separate independent company, with no connection he- tween railways, and consequently did not come within the meaning of the term \u201cinterswitching.over which the Railway Commission had jurisdiction A decision was reserved and in the meantime the merchants were obliged to pay the high charges of 3 cents per hundred weight, or $18 for a rar- load weighing 60.000 pounds, and $12 for a car with 40.000 pounds, which was a great drawback to Quebec interests.The order from the Railway Commission has been finally turned down, and reduces the damage by two- thirds, and now instead of the Quebec merchant being obliged to pay $18 for 6.000 pounds of freight, he is only called on to pay $6.and instead of $12 for 40,000 pounds, $4, which is a great gain, though the Quebec mer- | chants still contend it is a higher rate than the charges imposed at Montreal, Text of the Order.The following are the particulars of the order signed by Messrs, D'Arcy Scott, Assistant Chief Ottawa, Dec.2\u2014The debate on the address in reply to the Speech from the Throne has now entered upon its second week and, though there have been reports in plenty that it will be over by Wednesday, there is no cer- winty of this.Both sides have plenty of speakers ready and willing to go on, and the Government has as yet! shown no disposition to curb the flood | of oratory by letting the Opposition | go it alone and wear itself out.It; was freely stated to-night, however, that an all-night sitting mighe be tried out on Tuesday night and the Opposition be sllowed to go ahead to its heart's content.VARIOUS AMENDMENTS, The debate on the Address is made up of ali the speeches on all the amendments that may be offered.An agreement is said to exist for a vote on the first amendment, SUPREME COURT FORBIDS RAILROAD TO ACQUIRE STOCK CONTROL OF COMPETING LINE, Washington, Dec.2\u2014The great Harriman merger, created when the Union Pacific Railroad Co.bought 46 per cant of the stock of the Souther Pacific Railway system was split asunder to-day by the Supreme Court of the United States as a violation of the Sherman Anti-Trust Law, Then, with the end of the merger before it, the court sent forth its portentows declaration that \u201cwhile the law may not be able to enforce competition, it can reach combinations which rendes competition impracticable.\u201d COURT IS UNANIMOUS Justice Day announced the unanimous opinion of the court.Justice Van Devanter took nu part in the consid, eration of the case to-day, but his principal finding when he was a judge of the Utah Circuit Court, to the effect that the two roads were not was reverse: Instead of following the reasoning of Justice Van Devanter and Judges Sanborn and Adams, the court in sub stance approved the minority holding of Judge Hook that the roads were competitors and it was just as much 2 violation of the law for one road to buy the controlling stock of a competitor as it was for a holding company, as in the Northern Securities case, to buy the controlling stock of two competing companies.As the Northern Securities plan failed nearly ten years ago, so the Harriman plan fell to-day.It is the gemeral belief here that the application of the decision to the railroad situation of the country will be widespread, placing a powerful precedent in the hands of the attorney general to prevent the last night after his trip to Ottawa, where he succeeded in signing up Tommy Smith, of last year» Moncton team, and also in inducing Bruce SStuart, the famous former Ottawa captain, to handle the Quebec players during the coming season.It is also possible that Stuart might turn out on the -ice at a pinch.Quinn was in Ottawa on Saturday and after a long discussion with Stuart, the matter was closed up.Stuart, who is engaged in an extensive boot and shoe business in the Capital, is now endeavoring to make arrangements so that he can spend the winter in the Capital.Stuart played with the Quebecs several years ago and it was at that point he left Canada to break into the International League.He successfully piloted the famous Houghton team to the championship in 1906 and brought out it.INCREASE DEMURRAGE.Railway Commission Grants Petition of Roads and Authorize Charge of 2 and $3 a Day Instead of $1.Ottawa, Dec.2\u2014The Dominion Railway Commission this afternoon jasued an order, pronounced by H.L.Drayton, chairman, granting the application of the Canarian Pacific Railway, Grand Trunk Railway, Canadtan Northrn Railway and Michiaan Central Railroad to increase their de.murrage charges mn freight cars from $1 per day to $2 and $3.The increased rates, however, will he al- towed only from Dec.15 of this year to March 31 of next, after which the old charge of $1 a day will be restored.The railways asked for $2.$3 and &4 for the first, second and third day, respectively, after the free time allowed, but the $4 charge was not sanction:d by the hoard.Henceforth $2 will be assessed by the railways for the first 24 hours after free time and $3 for each succeeding day.The order, however.is not to apply to cars held in transit at stop-over points under puhlishel tariffs which have been filed with the board.Car 8hortage Imminent.\u201cTt cannot be denied that a car shortage equal to, if not greater than, that of last year is imminent: and, unless some steps are teken to secure an adequate supply of cars, traffic will be seriously handicapped during the approaching winter and spring, until the opening of navigation.Evidence was submitted to the hoard hy the applicants, showing an unreasonable detention of a large number of cars at many of the principal traffic centres of the country.\u201cIt is urged by the railway companies that the unnecessary detention of cars by shippers and consignees, not only handicaps the railway companies by depriving them of cars which would otherwise be available for traffic, but also- causes congestion by blocking team tracks and private sidings in terminals.It is also contended that at least 50 per cent of what is called railway detentions, that is, the unnecessary holding of cars in terminals by the railway companies.is due to the blocking of these terminals by the unnecessary detention of cars by shippers and consignees, Railroads Making Honest Effort.\u201cThe board is fully alive to the very unsatisfactory methads adopted by some of the railway companies for the handling of freight traffic.It has had its expert officials examine the report on .the terminal and transportation facilities of
