Coal Miners Ratified Agreement Of Their Officials Scranton, Pa., Sept.17.—Anthra- cite miners, representing union workers throughout the Penasylvania hard coal fields today ratified the new two-year wage agreement draft- od by their officers and operators representatives in Harrisburg, September 8.They voted to return to work Wednesday and plans were made at once for the signing of the new contract on the same day.James A.Gorman, Secretary of the joint conference which negotiated the agreement announced tonight the operators’ and miners’ representatives would go to Governor Pinchot's home at Milford.Pa., for the signing.Thin is scheduled for one p.m.Wednesday.The fact that the contract will not be signed until the afterndon.however, will not affect the resumption vf operstons Wednesday morning.More than 600 delegates representing local unions fn the three U.M.W.'s districts took part in the convention.Their action, ratifying the new agreement, came with comparatively little opposition, although several voiced objections to the fact that under the ten per cent.flat wage increase provided for all workers, day laborers, now receiving the lowest rates of pay, will be given a emaller increase than contract minora. The agreement embraces the four major pointe of the settlement plan submitted by Governor Pinchot when he called the miners and operators to mest in Harrisburé.These are the ten per cent.wage increase, the eight hour day, recognition of the union and recognition.of the principle of collective bargaining.Outside of the effect of the wage increase the operation of the sight hour day formed the principle sub- Ject of discussion.— Guide: “This te the room which Mary Stuart slept.” American Tourist; “Is it, In not a single case, where later developments have revealed unsoynduess, Las the sharsholders audit given, in time, the warning that might have been effective. If (nu shareholders’ audit rendered the service which those who advocated it have claimed would it have been possible for the management of the Merchants Bank and the Home Bank to give out, through their annual statements and their reports to the governments, information wilich disguised the real state.thelr affairs? This feeling that the bank's own showing or the statement of its position tv be found in the government reports may not bs accurate, operates to the detriment of the smaller bunks. The depositor, or the prospective investor In bank shares not being able to get information upon which he can absolutely rely Is apt to assume that the big bank is the best bank to do business with; and this sccelerates the tendency towards the amalgamation of banks and the consolidation of the control of credit and capital in fewer and fewer hands. It is quite clear that the process of bank consolidation is agreeable to our financial and business magnates: and they are prepared to encourage and promote it in every possible y.Thus the Nontreal Gazette, which pretty well reflects the mind of theme people, uheerves In à recent {ssue: “The lesson of recent ‘experience points to the desirability of large banks, such as they have In England, where half a dozen institutions serve the trade and commerce of the country, and the absorption of the Bank of Hamfiton hy the Bank of Commerce can be recommended for this reason. The potion that the concentration of hank capital in a few hands implies monopoly is pure fallacy, as it should be obvious to the simplest mind that bank capital muet ‘be made to work In however few or many hands it is held." The objection of the people to the concentration of capital cantrol in a few banks is rooted not in a fallacy but in an apprehension that |s well-founded and amply justified, Bankers err in supposing that conditions here ace.or can be made, aanlagous to those which prevail in England.England is territorislly a email, compact country and a concentration of capital in Landon may not have the undesirable con- seqdencea that would certainly fallow the cencentration of capital In one or two centres in Canada.Cansda is à huge country territorially; it has at least four divisions each with well-marked and distinctive characteristics, each with its own problems and ambitions.Centralisation fn such a country cannot be carried mafely beyond a certain point. There must be facilities | avaliable for each of these districts enabling ft to develop in keeping with {ts own genius; and banking facilitien are of course essential. If it becomes clear to the people that our banking system prevents the sgtahlishment of territorial and district banka there will be a resuit- ing agitation taking nolitical term, for effective remedies. Our big bankers may nooh-pook this state- mens, but they will find out within the next’ten years that it is true.if muttera continue to develop slong the foreshadowed lines. The conditions outlined above ss giving rise to publie unrest suggest some needed modifications. There ought to be government Inspection of bynke The smaller banks ought to wee that thia a necesmry for thelr own protection and join vigorously in the movement to bring !t about. When they oan produce & government statement confirming their own statements they will be in a arongey pesition fa compete for business with the big banka. Then there should be checke appiled to the present Movement towards oen- ot M CCORMICKS Fer A “ TUESDAY, ° Leaves |.TREAL OO Third DAILY [fourth + credits would, with respect to certain important branches ot Canadian industry, tend to deecentralize creâit control; Sister To Her Feet OUTSIDE INSPECTION Suggested That Provinoes Should Start Saving Banks, Guaranteeing Security (By Canadian Press) Montreal, Sept.17—Between eixty and ssventy depositors in the Montreal branches of the Home Bank of Canada gathered here today in reply to a request’ made by I.A.Weldon, Advocate of Lindsay, Ont, who has been named Ueneral Becrelary of the depositors of the bank in Canada.A number of resolutions were passed by the meeting bringing the position of the Montreal depositors into line with that adopted by Ontario depositors at meetings held at Toronto.M.M.Sperber, Advocate of Mont: was chosen by the mesting to represent the local depositors at general meetings of Te of various localities in Canada to be held at Toronto from time to time.Mr.Weldon sald a meeting of this kind would be held in Toronto this week. The sentiment of the meeting heartily approved of statements that it was for the other banks to come to the aid of the depositors and a threat was added by Bernard Rowse, K.C., representing the Verdun Great War Veterans .Assoclation and a New York fAnancial institution, that unless this was done æ movement would soon commence in Canada for .he formation of provincial savings banka. The first resolution passed was that the depositors present constitute themselves into a province of Quebec Home Bank Depositors Committée “and that this organization continue in existence until such time as the depositors yet 100 cents on the dollar”.Other resolutions opposed any winding up order until the curator has made his report and until such time thereafter as the depositors have had time te conal euch report; and that the Government of Canada should at once appoint & Royal Commission to investigate the causes of the failure of the Home Bank and also investigate in the most comprehensive manner the present condition of all the Canadian banks so that depositors may be in « position 10 judge as between banks".M.Albert, a local depositor, who acted as Chairman, said all the banka should be investigated since the Canadian Bankers’ Association was, in a etnse the father of them all and the culprit in this case, and ali banke were members of the Assoc:ation.Objectione were raised by & large depositor present that such a course would entall great delay and the resolution wag amended to the Investigation of other banka only when the Royal Commiesion was the investigation of other banks only when the Royal Commission was through with the afaire vf the Home Bank.Another resolution protested against a preference being given to deposits of the Federal and Provinclal Governments.Mr.Weldon explained that it was desired to have the Governments waive the!r rights under the Bank Act for preference over private depo- sitore. He added that In the case of the Home Bank !t was found that ‘the depositors’ money had been taken to New Orleans and put into a raliway. While the sharelhividers had put money into the Home Bank for the purpose of making profits, the depositors had done so for the purpose of getling security, “What we have seen of other banke that have failed’, said Mr.Weldon, “is that the heads of the bank.have used the money (of depositors) for undertakings In which they had f- nancial Interest, that is, they have not worked for the shareholders, the depositors or to help the community but for thur own private affairs”.He addad tha: he expected both the Government and the Canadian Bankers’ Association to take an interest in the Home Bank and he de- inred thut had lt not been for an association urging the Government not to have outside inspection, this failure would not have occurred.“We would have known before, and this bank wousd not have got into this position.but the | Association has always opposed outside inspection’, Since, he sald, the Canadian Bankers’ Asnocistion had taken the attitude that they were willing to look after members of their own family.the depositors of the Home Bank should say to the Assoclation.“Here is a weak sister and you should do the best you can to try and put her on her own feet again’.Bernard Rose, X.C., sald that the fact that the Canadian Bankers’ Association had put à curator in charge of Home Bank affaire was proof of responsibility by the Amociation.Hs insisted on depositors getting 100 per cent of their claims, claiming that their funds were in the same position ae trust funds. He declared that the Information that the Home Bank affaire were not sound, was known at Ottawa manthe before the crash. He suggested thar « committee wait on Premier Tas.{Jordanie are to the effect that re- REVOLUTIONISTS QUEBEC, Mr.E.8.Johnston, local manager of the; Home Bank, stated th morning that in his opinion the Home Rank depositors will receive a very high percentage on the dollar of their.savings if they do not receive 100 cents or the total amount.Mr.Johneton told the Journal that in his branch 70 per cent of the notes payable had been coliected, and that the remainder would be paid promptly within the next two monthe.Mr.Johnston asserted thar he was positive that the situation was practically the eame in other branches of the Home Bank and with the assistance of Canadian churtered banks the gituation would not eeem s» bad as many Home Bank depositors think.Contrary to articles published by Toronto newspapers, Mr.Johnston said that Mr.H.J.Daly, the Home Bank's President, was deeply concsrnsd over the suspension. That the revising of the Canadian Bank Act in Parliament last session had something to do with the suspension, was Mr.Johnston's opln- lon.He pointed out various new clauses with regard to liabilities.My.Johnston thought that deposi tors of the Home Bank would not suffer because If they did the chartered banks of Canada would jose | wavings bank depositors.Mr.Johnston thought that the Canadian Bankers’ Association would stand behind the Home Bank. The recent action of speculators in Montreal | and Toronto In offering depositors of the Home Bank seventy cents on the dollar the most far-reaching resolutions passed at the recomt Casadian Bur Awcciation convention aé Moatreal had te de with the system of “trial by jury" it is rather curious that it should have provoked so little public comment: particiiurly when the controversy between those who urge the abolition of that system and those who champion its merits is recalled.Of latter ycats there has been an increasing tendency to hold trial by Jury responsible fur miscarriages of justice while thore are many who soutly maintain that it is incorporated in the sutuiés tu cnrure an sccused person of a fair trial by bis peers and that one of the greatest mafe- guards of justice would be removed if it were dune away with. The resolution moved at Montreal by Judge J.RR.Armstrong and seconded by Hon.J.B.M.Baxter, both of St.John, N.B., suggests a middle course, being in the nature of a compromise between the extremists who would abolish trial by jury in criminal cases and those who Insist that one charged with a crime must be pronounced guilty by “twelve good men and true.” It reads as follows: “Resolved that the Commitice on Administration of Criminal Justice be requested to make enquiry, from trial judges of criminal cases with juries, .+ as to whether greater justice would not be secured by enacting, say, ten out of twelve jurors In capital punishment cases and.say.nine jurors in other indictable offences, to bring In 8 verdict after the lapse of say threo hours.” The above proposal is unreservedly supported by the St.John Tulegraph-Journal which argues in this wise: “It is paid (hut à man Is not gulity until be is proved guilty but at present be must be proved guilty by an unanimous votc of the jury. That there have been miscarriages of justice because of the necessity of this unanimity is u generally acknowledged fact.In our own Province the machinery of justice has been badly handicapped by the need of an unanimous verdict. There arc men living today who might have hanged had the propoml of this resolution been the law of the country and moreover, the Province would be saved a Jot of money which is spent today In the holding of new trials A man’s title to & house is good until the contrary is proved, for possession is nine points of the law.but ft does not take an unanimous verdict to prove it fauity. The necessity for an unanimous decision hy twelve jurors in the Delorme case bas cost the Proviime of Quebec about $50.000 in an endeavor to satisfactorily prove the defendant's guiit of innocence. It Is difficult to get an entire jury of unprejudiced men because of the limited number of challenges allowed and the more trials held, the greater the number of mens Influenced by previous trials.“Looking at the question from all angles it seems that the resofution in question suggests a method of preventing miscarriages of justice while at the same time preserving the safeguard of the trial by jury sys- em.” * Or.the other hand.while everyone must admit thet miscarriages of justice occur under the peesent system.it is difficult to are how they are going to be minimisod by substituting s majority verdict or, indeed.and other nude of decision for it.To err is human.but who Is capable of saying with any assur ance that a miscarringe has occurred or who will prove that the jury system does not serve the ends of justice in an overwhelming majority of cases? That the dimgreement in the Delorme cane should have cost this Province $30,000~-if the figure is cor- rect—Iis unfortunate, but that does not necessarily point 10 a miscarriage of justice. The St.John paper in tta exposition of jurisprudence omits two fundamental principles of British justice; one, that it is het ter for the guilty 10 escape than that the innocent should be punished unjustly, and the other that the guilt of an accused person must be proven beyond “reasonable doubt.” If such a doubt exists he is entitled to the benefit of lt.The fact that a jury dis- ugrces, therefore, would seem to point to the existence of a doubt nnd, even 4! it were not so, the criminal law in already sufficiently rigorous and the probable effect of substituting a majority verdict would be to increase the diffideaco of jurors in voting to send a fellow creature to a shameful death. If jury reform is needed, it might rather be directed cowards increasing the general standard of iutcillgence.education and experience and towards reducing the number of cx- emptions under which a large percentage of the very citizens who are the best qualified to serve as jurors are permitted to cvade their duty to the State.TRE DAY OF ATONEMENT.Beginning Wednoeday cvening nest and continu- .ing through Thurwixy until sunset, the Day of Atosement, called In Hebrew, Yom Kippur, will be observed by ali the Jowish people of ithe world as the hoilest day of the Synagogue.Everywhere on this day the Jews will assemble in thelr houses of worship, And there, forgetful of the bustling world outside, in meditation and in prayer, by fasting and abstaining from all worldly thoughts they will seek to cleanse their hearts of sin and by true repentance, become one with God that they may better fulfill thelr duties and discharge their respumsibilitics toward humanity .The Day of Atogemont is mentioned in the Bible im à number of places. In leviticus XVI the claborate priestly ceremonial of atonement Is described. In Leviticas 93:38-32, Yom Kippur is represented as a sort of Sabbath of Solemn Hest whereon the people shall affiict their rouls.Une of the traditional ob- sorvances of this day, namely, fasting, is traced to early times wher: the high-pricst was the central figure of the ricual.in the Pentateuch the Day of Atonement was particulariy pet asido ns à day when the high-priest cxplated the sins of the people. He fire sought tor- tivencss for his own sins, and those of his household and then songht t¢ withoot inter- ost as throwing lizht on one of the great difficulties In the way of reaching a solution of the labor problem.Again and again it has been shown that when times are good organized labor insists wpon sharing in the employer's prosperity, but, whem times are bad, it is extremely reluctant to accept any part of the employer's losars.Few Inbormen, in fact, appear to realize that if the nationalization of industry urged by some of them were actually put into effect, the buffer between adverse economic conditions and themselves would be removed and they would have to accept the consequences of commercial and industrial depression whether they wished to or not, and however much they might strike, Since 1980, it appears, the wage of the British dockers has been.controlled by the terms of an agreement, according to which the amount of 16 shillings a day, established at that time, was to be the minimum, but subject to a rednction in proportion to the fall in the cost of living, (he standard for calculation of the latter to de the index figure worked out by the Ministry of Labor. It was labor iteelf that first insisted upon the use of the index figure several years ago.when It desired & busis for its claim for advance in wages in order to meet the increasing cost of living in the period immediately following the close of the war.As is 100 often the case, this system worked well while the wage scale was on the rise, but when the turn came and 1cductions were in order, at once there was dissatisfaction and restlessness among the rank and file of the working men. This almost invariable course of action may be only human, but nt toast it Is & strong argument against the current demands of altruistic enthusinsis for à rigid snd easily determined minimum wage law as the practical and sufficient solution of all social and economic Ille of the present day.The dockers were keenly aware of their wage reductions, and also suw the index figures were on the down grade.but they began to suspect the rellabliity of the latter, and thus gave fair opportunity for labor politicians of a demagogic stripe to charge that there had been officiel iuxgling with arithmetic, or at least a change in the official method of computing the cost of living. This view was repudiated by the labor leaders, but the men went on strike anyway and.although without the full support of their confreres in cither a moral or material sense, the trouble dragged on for the length of Ume necensary to wear out the resistance of the dissatisfied elements.Added to their cause for resistance was the fact that in the case of the ralirond employees, whose wages also are on s sliding scale agreement.there is placed an arbitrary point below which the wage cannot fall.no matter how low may go the cost of living.J — Japan weems riated (0 be the Job among nations jum now.e © «© À Lord Renfrew ls reported to have acted for a time the engineer of his own train. Now if all else no such objects as these pigmented cells had dreds of mosquitoes examined me; the objects lay not In the stomach cavity of the insect but in the 1hiokness of the stomach wall precisely similar In appearance to those contained by the parasites of malaria and quite unlike anything which 1 had ever seen in any mon.quitoss previously.Thess two mosquitoes were the first of the kind which 1 had ever tested; these two vbsérvations solved the malarial problem: what remained for me and others to do was merely a work for children.” Proud of Poetryday he éxpreseed his feslings In the tuliowing verses: — This day designed dy God Hath put into my hand A wonderful thing. And Qod Be praiséd.At His command.1 have found thy secret deeds Ohl mililes-murdoriig Death.I wow that thie little thing A million men will abve- Oh! if they are to remain In the game, for baseball has had enough scandai in the past two or threes years. The game appears not to have lost as a result cf the White Box revelations, but the reason fa that the crooks have been driven out of baseball. An owner having gone through a criminal trial might be considered an asset to the © even should he not be convicted.Baseball is ja rather a nervous condition at present.Bad Advice.Stoneham has had a spectacular career. It Is only a few years ago since he was a board boy for a brokerage firm, and thus acquired a knowledge of stocks which enabled him to become a stock salesman. He proved a success, maved his money, and in 1918 was able to es- tublish his own firm which, as It Erew, opened branch offices in sev- oral large cities. The business prospered, and in 1921 Stoneham announced that he was retiring. It watt supposed that he had made all the money he needed and would thersafter devote his attention’ to sport. In notifying his customers of his Intentions he ed the pri- vilexe of recommengjng other firma to carry thejr accounts. One of them was the firm of E.D.Dier, another was E.H.Clarke and Co., another was Dillon and Co.and another was E.H.Fuller and Co.By a strange fatality ail theses firms have alnce failed.a couple of them In rather disgraceful circumstances, and naturally the former customers of Mr.Stoneham, nearly all ot wiom suffered in one fallure or another, wonder what he meant by giving them such advice. He might at least -have picked one winner out of four. The Secret Partner?Stoneham has been a witness in the bankruptcy proceedings of all these concerns. He swore that when he recommended his customers fo transfer their accounts he had not the slightest idea that there was anything weak with any of them.It developed in the Clarke hearing that Stoneham's advice to his c tomers was not wholly disintère: of the accounts. The mom serious charges were made as à result of the collapse of the Fuller firm, which was due to bucketing.and which entalled à loss of perhaps $6,000.000.When pressure var put on Edward M.Fuller and William F.McGee it Is said that they admitted that Stoneham was a silent partner in the firm.An examination of the books showed that shortly before the collapses he had advanced the firm about $170,000, tut he swore that this was a personal loan, made at the instance of a friend and that he had no interest whatever In the firm. There was testimony to show that he had ar- ru.sged to pay the brokers $20,000 for a quarter interest In the profits.May Have to Disgorge. It was as a result of his testim- ons before the Grand Jury followed by the confession of McGee and Fuller that a charge of perjury has been laid against Stoneham. He was prepared for it and was speedily re.lexsed on bail.If it should be found that he was a partner in this firm he will become proportionately responsible for ite debts, and should it be disclosed that he was also a silent partner In the, other firms that collapsed soon after he had induced his former clients to deposit sume millions of dollars with them, his own fortune, which is mid to amount to about $10,000,000, wil probably be swept away. Some of that fortune in now invested in the New York Giants, of whoes stock he owns 61 per cent, for which he pald $1,900,000.The others owners ar anager John McGraw and Magistrate Francis X.McQuade.Since becoming owner of the Giants, Stoneham has spent a lot of money to increase the seat- Hong Kong, Sept.11—Grace Dol- ing capacity of the field, and the investment has been a most profitable one. But, as noted.it might ensily prove the reverse If the chlef owner should become unfavorably known through a criminal prosecution.; A Cuban Magnate. For a time Stoneham was the sport king of Cuba.He bought the race track, which he developed at an immense cost.He also purchased the Casino, where gambling devices operate, and which has in the past few years drawn tens of thousands of Americans and other visitors to Havana every winter, It was a most sumptuous layout, ard is said to have no rivals, except the famous gambling resorts of Europe. Then, for
