and although admitting the responsibility of the Sheriff for errors committed either by himself or his Deputy, the manner in which he is responsible is expressly laid down in the Btatuto iteelf; 1 refer the Court to the 42nd seetion of the statute ahove-mentioned, by whieh the penalty for the wilful neglect, or negligent performance, of the duties prescribed by the said Act, is specially laid down : it is enacted,\u2019s Thut every Sheriff who shall wilfully \u2018\u201c or negligently offund against any of the pro- * visions of this Act, shall for the first offence, \u2018 incar a penalty not exceeding fifteen pounds \u201c eurrency, nor less thap ten pounds currency, \u201cand, for the second offence, a penalty not \u201c\u2018 escoeding twenty pounds currency, nor less \u2018 than fifteen pounds currency ; and if the court shoal fine him for contempt of \u2018court, what security would be afforded the Sheriff that he would not be a second time punished for the same offence, by the institution of a qui tam prosscution-ethe mode prescribed by the Act \u2014\u2014\u2014\u2014 performance thereof, Ft-would be setting aside the penalty imposed by the statute, and punishing the offence by « right said to be inherent in the court.If the court wore to tine the Sheriff to-day, the Attorney Geueral or à private informer might bring his qui tam action hereafter, AvLwiN, J.\u2014Suppore that an offence be committed against the common law, is an offence against the statute law a bar to the punighment of the offence against the common law Mr.Priynose.\u20141f the legislature intended that the penalty imposed by statute law should be the puvishment for a particular offence, it would supersede the punishment imposed by cummon law for that same offence.The second point is, that if the Sheriff was liable to a Bne by the court, notwithstanding the clauses of the Act abuve mentivned, it must be shewn that in consequence of his contravention oi the Act, the pauel of the Jurors was a nullity and must necessarily be quashed.But 1 conteud that the panel was not a nullity, and that there was no necessity for quashing it, I would rather defer the discussion of this point, until the court shall have decided concerning the first point, as it is an extremely delicate subject, inasmuch as it calls in question the conduct of the court, AYLWIN, J-\u2014Oh! that is nothing, proceed.If you can shew that thy decision of the court was wrong, there will only Le the greater willingness to rescind it.À Mr.Priugose.\u2014THR IW clause of the above Act 1s merely dil or; Werely to secure the retura of the jury whhowt partiality or favour.This clause embodies the object of the legislature ; and that object was merely to provide for the return of an impartial jury.It this clause were imperative, from the other clauses iu the act it would be most difficult even for the most skilful person, with the utmost diligence and attention, to act stricily vp to it.AYLwIN, J.\u2014This argument can have no effect upon the judgment of the court.Supposing your argument, that the clause is merely directory, admitted, if the Sheriff refused or neglected to.follow that direction, then you cume back to the first point, and the Sheriff is still liable tor the neglect.Mr.Prisrose.~The Sheriff cannot be fined by the common law for such a neglect.To shew that neglect on the part of the Sheriff to do what 18 not compulsory upon Lim would not be puuishable by the common law in England, 1 would refer to Bacon\u2019s abridgment, title juries, pp.732 & 733.I would particularly refer to p.733, where it is said :\u2014~ * If the array of a panel is returned by a bailiff of \u2018 a franchise, and the Sheriff return it as of himself, ** this shail be quashed ; but if the Sherif return a \u201c- jury within a liberty, this is good, and the lord of \u201c the franchise is driven to his remedy against him.\u201d *¢ If the Sheriff retnrns a panel of Jurors struck *\u201c by two strangers, that favor neither of the parties, \u2018 this is a good array, and shall not be quashed ; \u2018* and, therefore, it is common for the officers of the \u2018* court, by the direction of the judges, to give a \u2018 panel to the Sheriff, which he returns; but the ** court seems not to have the power to compel the * Sheriff to make his return, but they can fine him, ** if a sufficient does not appear according to the pre- * cept of thn writ.\u201d In page 732, it is said, \u201c after \u201cthe challenge to the array, and allowed for the * partiality of the Sheriff, the coroner may return \u2018* the very sane jury \u201d So that in England the Sheriff could not be fined unless he had returned an invalid jury.The law in England was that so long as the Sheriff had not summoned the jury through favor or partiality, or a jury that could not sit, he was not open to punishment.AYLWIN, J.\u2014I do not so read it.It is that if the Sheriff should return à jury, though not strictly in accordance with the mauner directed, the court could not fine him.Mr.Prinose.\u2014Weil, of course for the interests of my client I give it a more extensive intervretation.\u2018theta, Masui pullity.af the summonedina particular manner, it shall be null.The question is, was the jury, as summoned, qualified ?Suppose the Sheriff had packed the jury by favor, it could be quashed although legal, and could only be quashed in consequence of the favor.In the cuse cited, the jury had been quashed, in consequence of favor, but the same jury had been returned by the Coroner, and could nat be quashed, because the favor had ceased.Well, in the present case, why did not the Court ascertain whether the Sheriff had packed the jury by favor, and if it appeared that he had not, then the jury was valid.\u2014 But the court, ir: its zeal for justice, has proceeded rather hastily, and has quashed the jury piihout giving the subject sutlicient considera~ ion.The law, as it stands, is very difficult to execute, Le would be very difficult for the court even, if they were to retire into their chamber and look at the law, to tell the Sheriff where to beginand wehre to leave off in the summoning t t t itself for the sontravention thereof.AYLWIN J.\u2014That{s not the question.The question is: Doss the statute in question de~ the court of A inherant power Lo punish ers for neglect of duty ;
