setiled and thoronghly understood laws of contract, and such a proceeding is doubly dangerous at a season like the present, when from exiraordi- nary causes the burden of liability is pressing with couhl be atrested for any sum over forty shii- lings on an affidavit meraly stating an appre- heurion that he would leave the Province without paying.Debtors conld be kept in jail almost indefinitely when the greditor was dis- josed 10 exercise hie strict Nighte.The law has been gradually changed.Arrests were soon prohibited vader £10\u2014some astringent affidavits required, and at last it was provided that no ahiest côbld be Made under X25 or without an order trom & judge on a statement of such facts as would warrant the belief of an immediate fraudulent departme from the Province.Prompt redress can te obtained it such statement can be proved nnfounded.The old jail limits have been.extended to the limits of the connty, prisoners giving bail in executions need not be bound 10 remaiy even within such extended limits, but may simply, give security to appear when lawlully required to answer interrogations and obey rales of Court.The old arrests, on attachinents for contempt of court in not paying over muney are abolished.Very favorable means are provided for the prompt discharge of all debtors who can give a fair account of their means.Wearing apparel and furniture, tools and implements of trade to £15 are protected from execution, [i may be said with confidence that no truly honest man in Upper Canada\u2019 willing to pay his debts as far an his means permit, need fear the operation of the present law of arrest.Creditors may be said to suof- fer infinitely more from them than debiors.\u2014 A Bankrupt law wisely framed to svit the circumstances of this eonntry, and faithfully administered would doubiless be a great step in advance.Jt is impossible, however, to provide any very cheap machinery for working it in the one and thiny counties of Upper Cana- du.If centralized at Toronto, it might be too costly for distant suitors.The popular solution of the difficulty would, doubtless, bo the giving ol Bankruptey jurisdiction to the County Courts.But the administration of anovel and highly unportant jurisdiction of this nature\u2014 requiring the nicest appreciation of the rela tive rights of debtor and ereditor and of mercantile law\u2014would be a heavy addition to the already onerous duties of our 31 County Judges.Canadians would hardly advocate such a retrogade step as the fixing of the standard of commercial power and integrity lower than in the mother country.There, before a Bank- tupt can obtain his certifirate of discharge fus conduct as a trader\u201d is to be examined under the Statue, whether opposed by his cre- ditars or not.Every'day we find the certificate delayed for one or two years, or refused when the Bankropt has traded oracted in an unfair or disreputable manner.Amoug the common otjections to his discharge may be hastily suggested \u2014buying systematically on credit to sell under cost for cash\u2014giving an undue or fraudulent preference to a creditor on the eve of bunkruptey\u2014reckless over-trad- ing, dealing in accommodation paper, which the trader kriew he cou'd not rearunably meet \u2014 putting creditors lo unneccessary expense by vexntiously or frivolously defending ac- tiona\u2014 pretending fictitious losses in business \u2014econtracting debts fraudulently, or obtaining forbecrance from eruditors by fraud or false pretences\u2014misappropriation of trust monies \u2014losing money at play or s'ock-jobbing.These and the like grounds are often 1aken on Bankrupte asking a full discharge.\u2018The object of nay such !aw is, and of course ought to be (besides the even distribution of assets) the protection and discharge of the honest, though unfortunate trader.With euch a man every one will sympathise.As a matter of fact, it may well be doubted, whether many such persons in Upper Canada are practically in need of a Bankrupt Law.A tolerably extensive connexion with legal practice for nearly 20 years has impressed upon my mind with the strongest conviciion that no really honeat trader who, withont inisconduet or extravagance.has failed in business, finds any serious difficulty in obtaining a release from his creditors on the surrender ot ail his naxets.For one merciless creditor, I at least have generally found as many evasive or disenge- nuovs debtors, whose object wae to retain ther property and yet escape their obligations.Any law which would enable this latier class of persons to apply the sponge to their debts might benelit them, but might operate with croel injustice on those 10 wham they are in- debited.The nghts of crediturs are at least as sacred as those of debtors, and in compas.sionating the later, we are tov apt 10 forget the rain which their failure to pay or make any effort of seli-denial to pay, inflicts on creditors who may themselves be engaged in a hard struggle to maintain their own credi and eup- themselves and their families.The pos- rions of the hunest trader stru gling wiih hard times\u2014with diflicully meeting
