the part of ferry boat between the opposit shores ; it is the worst thing of the kind [hav seen this side of the Atlantic.” Such is thie, by no means flattering, description of a Point Levi ferrv boat, of the Honorable Amelia Mur- tay, who was the guest of Lord Elgin, at Spen err Wood, in 1854.The clumsiness, dirt, and -maliness of our ferry boals are not however their woist features, The fare 15 outrageously high, and the trips are not only irregular, but Ic Having made a fortune at two- uncertain.QUEBEC GAZETTE.theif charges have buen influenced by per sonal, tir political, or religious considerations. They have sometimes lent themselves to * party, sometintes to ‘power, and, with very little law, and still less learning, they have arrived al copclusjous strikingly and lamentably unjust. This is, in some degree, not so much their fgult as that of a government whiclihas condescended to suffer injustice to be practised in the Courts of Law towards those whom they suppose to be their political opponents and to the public generally by screening from punishment individuals well known to be guilty of heinous oflences. The great Frederick of Prussia, who was a despot, acted very differently. He dit not encourage the Judges, who belonged to the higher ranks, in oppressing the poor. One time, it is said, when he thought he saw an instance of such oppression, he pursued a cuurse that created quite a sensation. We take the case, as stated jo Hogg’s Instructor, verbatim :— “A miller refused to pay to a Count, tha 1ent of his mill, because as he said the water which drove his mill, had been very much diminished by the formation of a pond.‘The case was brought before the district Judges, and the miller was found liable. He managed, however, to aitract the notice of the king, who sent an oflicer to examine into the particulars of the case. This Commissioner p o- nounced in favor of the miller. On this, the kifg brought the matter before the highest law court in Berlin, bat it confirmed the sentance ot the inferior Court.Frederick suspected unfairness. He called Furst the great Chan- eellor, and three Councillors of the Ferlin law Court, before him.He then addressed them very sharply :—*¢ You must know,’ he said, “ that the meanest peasant and beggar 18 à man as well as the king.” A bench of e Judges” he added, that practices imquities, e is more dangerous and wicked than a band of thieves. From the one people can protect hemseives ; but {rom scoundrels, who use the mantle of justice to carry out their evil - passions, no one can protect himseit. They are worse than the greatest rogues in the world, wand deserve a double pumshnment.” Furst was dismissed from the Chancellorship aud the three Councillors were sent lo prison.pence per trip, for each passenger, three-pence Comment is unnecessary.and sometimes fourpence is now charged by the enterprising owners, of these clumsy and dirty, little boats, which, for the want ofa well organized Ferry Boat Association, continue to monopolize the Traverse.” The great dif ficalty in the way of establishing a line of conveniently arranged and well managed boats, lo ferry goods, passengers, horses, asd vehicles over the St.Lawrence between Quebec and Paint Levi, was that the muncipali- ties of Quebec and Point Levi could not agree upon giving a monopoly of the ferry to men of means, who would have managed it for their own advantage and for that of the public. The Point Levi authorities were and are ferrymen 1hemeelves, and, of course, thoroughly understood and understand their own interests.Unable to asseciate themselves together for the public advantage, except with respect to keeping up the price of ferriage, which is not for the publie advantage, but for their own, they were detérmined not to be driven off the track by the people of Quebec, and so be deprived of a means of obtaining money only when it was impossible to find a vessel to tow from oue part of the harbour to another. To obviate this difficalty an Act was passed in June 1853 to the effect that no person should act as a ferryman, on any water in Lower Canada, not wholly within one municipality without license from the Governor.Stull the clumsy, dirty, and lutle boats occupy the ferry. The Governor, in Council, has not made regulations : the size and description of the vessels to be used on such feNies have not been determined ; the tolls or rates at which persons and chattels shall be carried across have not been fixed and publiehed ; and no arrangement with respect to the conduct of persons having licences, nor with respect to the hours, or part of hours at which vessels ehall cross And Simply because the well understood wishes of the ferrymen must those who represent and recross, has been arrived at.why is this?be attended to by .them in Parliament, and their represen'ative in Parliament is a member ot the Government and does not wish to outrage the feelings of his constituents by causing regulations to be made which would be distasteful to them, All the influence they possess has been obtained from the ferry, as it has been, and as il is, and the influence so acquired is used to keep clumsy, dirty, little, irregular, and uasafe boats upon the ferry, so carelessly and so cheaply managed, as to defy competition, except at a loss.Leon afforded to the public by the establishment of the Grand Trunk Ferry, but not much, as the terminus of the railway 1s too high up.What the public service requires is first one good landing place for the exélusive use of the ferry boats at each side of the river, and next, aswell appointed and regularly managed line of vessels, purposely built for the ferry. But the government do not seemingly care anything about the public requirements. They cause an act to be passed which is evaded or disregarded, and the provisions of which they do not care to enforce.Clumsy; diny, and little boais are the bribes given to certain people of Point Levi for their sopport of the Government, which has other and more important concerns to attend to than the’ tégulation of a Lower Canadian ferfÿ.How onde apte of thinge may continue it is difficult to saÿ.such a natufé ag to fet rid of them for ever; it .1 L£ ionic} } CANADIÂN AND PRUSSIAN.JDSTICE, Too frequeërtl$ tHèté has been great canse of Coroner Duggan and a respectable jury, upon the body of Mr.John Hathaway, the house-steward, who poisoned himself the previous evening. The inquiry commenced shortly alter 10 o'clock, and was not brought to a close till half-past 2 p.m.After the jury had been impanelled they went to view the body, which lay in one vf the apartments appropriated to the deceased.Ite was a stout built man, about 50 years of age.He was dressed, and it appeared that, after taking the fatal dose, he reclined on his bed und expired. The phial, about one-third full, stood on the toilet table. The deceased, it was stated, has a wife and four children in London. The first witness called was— Richard Theodore Pennefather, Esq., Private Secretary to His Excellency, who said— Abont half-past eight yesterday evening, Esden, the butler, called me out of the dining- room and informed me that he and one of the servauts had made an entrancz into the deceased’s room through the window, the door of which was locked, and that they found him lying on his bed apparently dead.I hastened there and found him as they described, perfectly cold.I put my hand on his wrist and heart, and there was no pulse. He was laving just as he is now.I fastened the window and locked the door after me, that nothing migat be disturbed, I then acquainted his Excellency with what had aceurred, and sent for Dr.Boaumont.1 saw the deceased yesterday morinne, bul did not observe if he was uuder the influence of liquor. He simply came on a message, and I took no particular notice of him.Col.John George Irvine, A.D.C.—On the Sth of August I recuired an Orderly Sergeant, and thinking he might be in the deceased’s room 1 looked in at the window and asked for Sergeant Smith.Deceased replied in a gruif manner, and I at once saw he was drunk. He was reclining on lus bed.At acother time | required to see Mr.Hathaway, and was told by the servants he was not fit to be sean ; that le was drunk in his room, A number of empiy bottles were shown me, but of course | can’t say he had drank their contents. They were champagne, claret and other wine bottles.A few days before | left to joi his Excellency at Quebec, Mr.Hathaway asked me to inform lus Excellency that ail was well and that he had no complaints to make of anybody. He was sober then. His office was house-steward to his Excellency. He came into my room, ciosed the door after tim, and said.«this is an unfortunate business that happened to me some time ago, aud [ suppose you reported it 10 his Excellency.” I said | had done so, as ! could not consistently with my duty do otherwise. He then said tap." General Walker, by his policy in allow- jog the troops of the othr allied Stats to take to me, “I suppose Jou fancy 1 was drunk when you saw me, but the doctor told me it was a stn stroke that had aflected my brain.” I telieve it was Dr.O’Brien he mentioned. He acknowledged he had been drinking some whiskey, which he was not accustomed to.I saw him several times subsequently in a stale of excitement certainly produced by drink.By a Juryman—Is it your opinion that the deceased hastened his death by drink ?The Coioner did not consider that a relevant question., Juryman—I considÿy it an important question, nor is 1t an impertinent one.Coroner—I can’t be kept here two or three days by jurymen asking questions.Juryman—OQur time is as important as yours, and we have pledged ourselves™to arrive at a satisfactory conclusion as tothe cause of death, and I am oi opinion that the Colunel does not consider my question improper.Colonel Irvine—Not at all.Corouer—All questions put to wilnesses must be through me.The Coroner then abruptly closed the controversy by desiring the constuble to keep order 1 the Court, and reading over the evidence, in order that Colonel Irvine might sign it.His Excellency here entered the room, and being sworn, deposed as follows :-Mr.J.Hathaway was highly recommended by my friends in England, and | engaged him as house- steward. He arrived in Toronto about the 21h or 25th July last.Charge of the house was given him on the following Monday tporning. When L left for Kings:on with Lady ead, Hathaway had the keys of the cellar in his possession.I heard nothing of him, until ou my way up, I opened a letter addressed to Mr.Retallick, A.D.C.by Col.Irvine, in which the latter s:ated that Hathaway had been very funk, and caused a disturbance in the house nd had alarmed the servants.Col.Irvine’s letter gave other particulars, but added that, silice this excess, which had occurred immediately after I left, all hud gone on quietly and well. After I got to Toronto on Saturday | said a few words to Mr, Hathaway, tothe effect that having placed impheit reliance on his character, I left the house in his hands, and was shocked ut hearing of his misconduet— that L would not give him any final decision until the beginisgof the week.I spoke to him again on the subject. He admitted that he was very tipsy, but he said it was owing to his exertions on a very hot day, and to the aclion of tie sun—that he had taken whiskey or spirits of some kind which completely overcame him—and that he had been very ill.1 asked what medical man had seen him, and he said he thought his name was O’Brien.I observed that il I was to apprehend the same thing again, I could never venture to leave home, and that I had been grievously disappointed at its occurring as it had done.He replied that it would not happen again.said 1 was not disposed to make more of it, or institute further enquiry, relying on his good conduct hereafter, and until yesterday morning, all went on as well as usual. In the morning, he brought me the bill of fare for inner.1 looked at it, but did not observe anything particular about Hathaway—indeed, I did not lock at him.At about twelve 0’clock, it occurred to me that I should like to have a bottle of a particular wine for a friend who was to dine with me.I went into the back passage to the door of Mr.Hathaway’s room, to save time taken in ringing and sending for him.I asked him to get a candle and come down into the cellar. His manner was bluffand singular. It struck me he had been drinking.hen he got to the cellar- door, he pushed with the keys, (there are two).He could not get them into the lock, as he did not know which to begin with.He tried one, and then the other.hen the door wasopen- ed, I asked my own servant (Esden) where the particular wine was, for the cellar had been swept out, and the posijjon of the wine changed, since [ was last there.Mr.Retal- lick had been down several - times before ! left, but I had not gone there myself before Hathaway took charge of it.I found the wine, aud observed some cases unopened, which had arrived from England shortly before | left home.I remarked them, and said, “ How many are there 7” or words to that effect. We counted them, and found thirteen.Hathaway stood by, and Esden pointed out the cases.Iasked him how many there ought tobe?He said, « Fourteen.” I asked him if he was sure, because there had been some fear of a portion being lost.’ They had come by different steamers—eleven by one, and three by another. He added that Mr.Retal- GABRTTY, | lick saw tlm 1 Le romched for the missing case, which could uot be found.| thought then that It was a caseol braudy.Hathaway left rae with Esden iu the collar.1 question ed the butler further, and I then weut up to my room for the invoice, so us to be sure of the number of cases and their contents, I fouud the invoice, and returned to the cellar, where Esden still was.I told him he was correct as to the number of cases, and we as- certuined, by looking at the numbers, that the missing case was oue of champagne. When I left the cellar, I gave the list of the wines to Esden, and told hun to keep the keys for the future. Before I left the house for the council oflice, which I did about one o'clock, I saw Hathaway again in the passage.1 told him | had found the invoice, and that the case was really missing, aud that it was a case of champagne. He said, * it’s quite sure a case of wine could not go without help.” 1 said “ no, of course 1t could not dispose of itself,” or words to that effect, | added, that Esden had the keys for the present.I djd not speak angrily, but I have no doubt thatiny looks and mauner showed [ mistrusted him, I saw him no more till after death, between 8 and 9 o'clock in the evening, when I found the letter now produced, addressed to me, on his table. It was sealed, sud | made a memorandum upon it as having opened it myself.Ou leaving Taronto, I had given Hathaway a cheque ou the Bank of Upper Canada for one hundred pounds, on ny account.Mr.Pen- nefather will produce ‘a memorandum from the Bank showing how that money has been applied, and how the account now stands. The letter, which was found on deceased?s table, was as follows :—- «Sik Epmusp, “I leavo my wife and children to your mercy.lamalost sheep.God bless you and yours.* Joux HaTHaway.?Mn.STEPHEN HESKINS ATKINS, sworn :—I became acquainted with Mr.Iathaway on the steamer Cunadian, when coming out” to this country, à short time since. He was a first class passenger with myself.During the voyage, | founu him a perfectly temperate man ; we arrived together at Toronto, and became mere intimate day by day. After much conversation, ! found hum painfully dark on religious matters, and it made ine take n deeper interest in his welthee, more particularly his spiritual welhure, “which was the whole cause of my continuing bis acquaintance ; | did my duty for him before the Lord, as far as | was able.1 called wt the Government House to see him about a week after | arrived heiv, and up to the time ot His Ex- celleney leaviug for Quebec he was à pertect- ly sober man.He complained ol great loneliness, being absent from his wife aud family, aud not knowing a soul here.On ny return from St.Catharines I called on him, and was greatly pained to find him labouring under the effects of excessive drink.I found I had great power over him, and I thought it my duty to him and His Excellency to try to wean him of such courses. When he saw me, he got up from tus chair, threw his arms round me, and said I was ‘ his-guardian angel.” | remained several hours with him, and when he became more sensible, I spoke to him seriously of his state and condition. He was greatly moved at what | said, and I prevailed on him, as I saw he would do nu good while he had liquor at hand, to give me the keys of the cellar.Next day I called about noon, and I saw that he was drank, and I was surprised how he got at the liquor, and the cellar keys in my pocket. He laughed, and said + I did you.” [saw a bottle of brandy on the table.I asked a female servant how fir, Hathaway had got the brandy, and her answer was that she believed he took it out ofher store room.Upon reprimanding her for allowing him to take brandy which was under her charge, she replied that Mr.Hathaway had a key also for her store.I accompanied her to the stora, and she found that one bottle of brandy was taken away.I saw there wasa press in the room, and I asked her for the key.She saud she could not refuse giving it to Mr.Haiha- way, 50 I told her to give it to him, and I got it from him.[also locked the bottle of brandy which was in his room in a small cupboard in his room, and kept the kev.I should say that, on the pervious day, he showed symptoms of delinum, and very painful ones m- deed.I was informed he had not tasted food for four days. When endeavouring to calm him, he said two or three times ‘ Do you know, ‘Atkins, | lave a great mind to cut your throat.”” On the secoud day he said, in an incoherent manner.‘| wish, Atkins, you would take away the razors.” | watched my opportunity, as he again wouid forbid me to do so.This occurred about three weeks since.I found myself in a painful and awkward position, His Excellency absent, and I with the keys of his cellarin my pocket, and Mr.Hathaway, who was left in charge, in u state of delinum tremens. His Excellency here remarked, that Colonel Irvine, his Aide-de-Camp, was in charge.Mr.Atkins.—Being a stranger, [ wus unaware of this ; so I called on Dr.O’Brien, whom [ knew about two years and a-halt since, when | visited this country, and made him acquainted with the case.He prescribed for the deceased, and I administered the medicine, which did him a great deal ot good.J applied to one of the female domestics to sit up With him ; she refused, and upon his entreaty, saying if I left he would be Jost, I consented.Vhen he became restored, he told me that he once had an lo- tel in London, containing 40 rooms, and that he failed in business, and for three months was in a stale of continual intoxication. At the end of that time he reformed, and said that for two years he drank none.He also toldame after a night’s sleep, ¢“ My dear friend, 1 have done this morning what | have not done to my recollection before.1 have gone on my knees to ask pardon of Cod.” He made me a promise that he would not drink liquor again without my permission. From that period, up to his Excellency’s return, | am satisfied he drank nothing but ale which i agreed he might take, as 1 did not wish to be tog hard with him for a while. When I saw he was sober and all right, T returned him the keys, and placed the razors back.Either the day, or the day but one after his Excellency returned, I found he was drinking.! called at the Government House again atan early hour this morning, and finding him a little more sober I remonstrated with him on his course, and he went down on his knees and promised he wonld not ever again, and asked the grace ot God to strengthen him and enable him to fulfil his promises. The day before yesterday, the day he made the ledge, | was shocked to see he was intoxicated. When I called in the evening about a fortnight since, upon conversation with him I advised him to get out his wife and family, and he replied he had not sufficient money, aud he did not like 10 ask an advance from his Excellency ; so I lent him £20 in sovereigns, and took his acknowledgment. He ro- turned £10 sterling. His Excellency.—That is strange.I lodged £100 to his credit, and he has drawn £50 and £12 10s.the latter paid to Mr.Atkins.Mr.Atkins.—Yes, that is £10 sterling, and I gave an acknowledgment.is Excellency.—Mr.Atkins, I find got a cheque in his favour dated Monday, 25:h August, two days after my return from Quebec, The Coruner.—On the 11th August Hathaway got the cheque on England for the £35.ohn Esden.—I saw Mr.Hathaway last alive at about 10 minutes past 1 o°ciock.1 did not consider him sober nor perfectly drunk.1 did not sé him again till I saw him dead.James Hand, a servant, told me he had repeatedly knocked at Mr.Hathaway’s door after two o’clock and could get no answer, and thought he was lying on the bed taking a ÊYEDNYSDAY, KHPTEMDER 4, i806, ERE iad AY SREY sleep us usual.Ata HE after sight | said to the boy, + this will never do, we ust get at him sme way or ether.” The door was leeked, and I desired the boy to get iu at the window. He rot in and opened the door. The 103 Was in darkness and | went and got a light, after whieh | went over to him and found him looking as dead.I then went out, leaving the boy in the room, and uoquainted Mr.Pennefather ; and we returned and on examining him more closely found he was dead.In the morning he was generally sober, but in the middle of the day and towards evening he generally was tipsy.I had not many oppor- tuities of observing him, as I attended his Excellency when he left for Quebec.James Hand confirmed the testimony of the last witness.Dr.Win.R.Beaumont.—[ was called to the Goverment House yesterday evening, the messenger stating tome that he believed a person had been found dead in his bed.On my arrival his Excellency said he feared it was too late to do any good, but immediately went with me into the room where deceased was Iving, Deceased appeared to have been dead tor some time ; a little warmth of the trunk remained, but the hands were quite cold and had some livid discoloratior: ; circ = lation and respiration had of course ceased.A bottle of laudanum about one third full was on the table in deceassd’ s room, and the note addressed to his Excellency, which has just been read, was on a table in an adjoining room. This note and the bottle of laudanum leaves no doubt in my mind that the deceased had died from a poisonous dose of laudanum Dr.O’Brien.—1 was called to see Mr.Hathaway about three weeks ago.He was then labouring under extreme excitement, I was informed he had bean drinking hard for some time.I visited hum three or four times gave him some medicines and left him ap- Fa PORTMANTEAU MISSING.Murked M ù
