(MACDONNELL 78.VANKOUGHNET:) : \u2018On the 10:h June, 1857, the Logisjature\u201dof Cunada passed a,statute intituled, \u201cAn Act lament.\u201d Clause {wo disqualifies certaîn public functionaries and officers from voting at elections of members of the Legislative Council and Assembly.Clause three renders in- oligible as such, all persons holding offices of amulutment at the nomination of the Crown.\u2014 Provision one of this clase exempts from its operation members of the Executive Council, and certain public vflicers, of whom the Preei- dent of Committees of thu Executive Council is cne\u2014provided they be elected while holding such offices, and te not otherwise disquali- tied.Clause siz declares 1hat auy person disqualified from voling in the Legislative Couneil or Assembly, presuming to sit or vote therein, shall Jurfeil £500 for éuch day où which lie sits or votes.\u2018Clause seven provides thal, ¢ whenever any person holding the office of Receiver General, luspector General, Seeretury ol the Province, Commissioner of Crown Lands, Attorney General, Silicitor General, Commissioner of Public Warks, Speak- or of the Legislative Council, President of Committees of the Executive Council, Mi- nisler ol Agriculture, or Postmaster General, and betug al the same time a member of the Legislative Assembly, or an electod member of the Legislative Council, shall resign lis office, and within one mouth afler his resig- ation accept any other of the said offices, he shall uot thereby vacate his seat'in the said Assemb'y or Council.\u201d = 27 The Defeudaut on the 24h Julÿ, 1858, then being a member of the Legislative Couneil, resigned his office of President of Com mittees of the Executive Council, which he held at the tine of his election.On the 6th August following, he accepted the office of Commisrion- erof Crown Lands, deeming himself exempt from 1e-election by virtue of the said Tih clause.He was prosecuted for the recovery al the forfeiture of £500, charged to have been incurred under the 6th clause, by reason of his sitting and voting in ihe Legislative Couneil after his accoptance of his second office.The legal proposition involved.in this case is a very simple one.\u201d The Defendam was elecied while liolding one ol the enumerated officas.On the 29h July\u2014stsll holding the sume office\u2014he resigned \u201cit, and within ane month accepted auother of the said offices.Up to the period df his fesignation of'his first office, lie continued bona fide (it must be so presumed,) to (ill that offfce una to exercise the functions atlached to it.When on the 6th Aug.he accepted another ofthe said offices, thut act of acceptance is not impugned upon the ground of iraud orcoilusion, and it must thercfore be presumed 1o have béen made in good faul and with the full nténtion ol discharging the duties belonging to the office.lt seems to have been adinilied on both sides that he has continued to occupy that office, and there is no allegation or suggestion of any act on his part, subsequent to his acceptance, of a natnre to shake the good faith of that act.The case of each Delendant upon these penal prosecutions must stand or fall on its own merits, The guilt of one Defendant cannot be augravated, nor\u2014it defective\u2014ean it be rendered complete by reason of his supposed complicity with his colleagues, in perpetrating what is called the double ** shuffle.\u201d He was not prosecuted before a Criminal Court, as he and his colleagues and the Governor General might, ard ought to have been, for a conspiracy to frustrate and pervert the opera- tonot a statote, in which case the guilly acts of each might.be invoked to prove the com- won design.He was simply prosecuted for an alleged infraction of a statute by sitting and voting in the Legislative Council after his acceplauce of another office under the Crown.He is in every.particular within the protection of the statute, and was rightly absolved from all Liability.: (MACDONNELL V8.MACDONALD.)
