to public expediency ; aud it is only fair to presume that the Executive, having at command as sound \u201c legal advice\u201d as the Proprietor of Neilson\u2019s Gazette, -exercising its just and legitimate authority, and enforcing its most uncloubied right, is prepared to justify, as a necessary and expedient measure, the change that has recently taken place in the conduct of the Off.cial Gazette.As this matter, it seems,- will hereafter be judicially decided, .we should not have entered into - the subject at any length, were it not for one or two expressions: which appeared in an this time, but one of that family had ever filled that office, and there existed until now no reason so to appoint, for whether as King\u2019s Printer, or not, the Proprietor of.Neilson's Gazette has had the whole privilege of printing for Government since its first establish ment to the present moment.The same power which conferred it could also take it away, and the- preseut Executive, having reason to be dissatisfied with the conduct of the Gazette, was advised to appoint a new Editor.We trust no one will imagine that any harshness was used, or intended, in the progress of this affair.The person selected by the Government to conduct the Gazette, lost no time in applying to Mr.Neilson, wishing to coalesce with him on equal terms.The Gazette had been given to this person altogether, but he desired that no change should externally take place in the Gazette, which he wished to be printed by Mr.Neilson as before, under his ewn editorial superintendence.He had, indeed, reason to believe which had beea previously enjoyed by Neilson\u2019s Gazette ?It would be idle to argue here on the right of the Government to take this step.But it would seem that in the opinion of the writer of the Gazette.\u201d\u201d Tn answer to this somewhat tardy assertion, we are disposed to maintain that we are entitled of right to call our paper the ¢¢ Quebec Gazette, published by authority,\u201d under virtue of our Commissions set forth in the Royal Proclamation of the 23d October.We have always been in the habit of calling things by their proper names, and asit will be probably conceded that our paper is official, we lave an undoubted right to its only legal title.The Editor of the Mercury has seen the affair in the same light, and he has moreover adduced evidence that the word % Gazette\u201d means \u2018\u201c a paper of authoriiy.\u201d\u201d To this a very trifling answer is attempted to be given in Neilsons Gazette, but, not to cavil on the meaning of a word, let the writer of that article ascertain whether an \u2018instance can bé found of an official paper published, under authority, by a King's Printer in\u2019 any Biit.sh\u2019 Metropolis, which does not bear the tule of the city in which it is issued, prefixed to \u2018its usual designation of Gazeile.Does there exist ic London, Edinburgh or Dab- lin, any Gazette bearing the name-of\u201d those cities, which is not official à?The Government therefore of this Province have properly vindicated their claim: to call their own official channel of commuaication by its natural, and only proper title, that of the \u201cQuebec Gazette :\u201d no invasion of another\u2019s right, but simply the assertion of their own, was ever contem\u201d plated.It follows, then; apd from \"the course which seems likely to be taken by our opponents in this affair, we are not disposed to waive the least iota of our rights, that as the Editor of the Mercury justly observes, Mr.Neilson is himself assuming a ticle for the title; but we prefer our own ground, ready to meet him on either It is very surprising how Mr.Neilson can assert that his paper ¢ has never ceased to be possessed, *¢ printed and published by private individuals,\u201d What! when he accepled a Commission, (snd it was the second that had been given to the family) and prefixed the words, \u201c published by authority,\u201d to his sheet, does he mean to say his paper was a private paper, and he a \u201c\u2018\u2018 private individual ?*\u2014 Did the Government expect that when he condescended to accept its Commission, he would ever deny its efficacy in giving his paper an official cha- racterà To the uaprejudiced it must appear evident, that when he accepted the office of King\u2019s Printer, he cvidently acknowledged the *¢ Authority,\u201d and Lo prove that he did so, his paper sfterwards purported to be published by him as King\u2019s Printer, and not by him and by his partner, under the firm of Neilson & Cowan.In fine, the Government Advertisements and Official Communications were, as they ought 10 be, made public in the * Quebec Gazette, published by Authority,\u201d by the King\u2019s Printer\u2014.hey will continue, of right, to be so made publie, ootil there is better reason to change sheir course, than has yet been adduced.With respect to the Sheriff's Advertisements,we have reason to know that the power to appoint à new Editor and Printer of a new Quebec Gazette, with the legal right of notifying Sheriff's Sales, as directed by the Provincial Ordinance of 25th Geo, 111, c.2, is vested in the Governor in Chief.For, ibis object being connected with the administration of Justice, of which the King is the head and fountain, -and regarding the execution of the laws with which he is charged as
