to veracity; at the same time, perhaps, with the desire of appearing in print, in defence of alleged oppression.On reference to the report, or rather to the charge of the presiding Judge, (which is the only part worth referring to,) the following will be found to be the doctrine laid down, and on which he submitted they, (tbe Jury) should ground their finding.- \u201c If a creditor swears that his debtor is indebted to \u201chim in a sum of money exceeding £10 sterling, and « that he is immediately about to leave this Province, \u201che is intituled by the law of the land to attach the bo- \u201cdy of the Debtor, and hold him to bail.if he swears \u201c« false, the Debtor arrested, has but one recourse, viz.\u201c¢ by action against the creditor swearing, in which ac- + tion, the party friends in Scotland to support them.\u201d He then expressed a wish that 1 should sue his uncle on my mortgage, 1 said { would not sue, for I was sure the Plainuil must have a purse, that he was not aware of having at any time given me reason to believe Mr.Hunter was going to leave the Province.It was afterwards proved by several witnesses, carters and others, who were produced by tie Piaintill\u2019s Counsel, that at the time their client was arrested, he was removing his effects, and although the carters might have received their instructions as to where these effects were to be conveyed, their destination was unknown 10 me, nor could I be supposedto be in the contidence of the)man who had borrowed four hundred and fifty pounds frown me, and had given as security for it « mortgage on a house already mortsaged for five thousand four hundred pounds, and which was sold two weeks after the Plaintiff\u2019s arrest, for two {housand seven hundred and fifty pounds, the mother of the said Stewart, becoming the purchaser.Under such circumstances, I ask had 1 not sufficient grounds for suspecting that the movements of Mr.Hunter, were ia the direction of his money, or.rather of wy money, which according to Mr.Stewart's testimony, it might reasonably be inferred, had been remitted to Scotland, to support Mr.Hunter\u2019 relations 5 and if L did suspect that such was the in.ention of Mr.Hunter, had 1 not a right to exercise a course which the law of the country had provided ! But it may be sai-l, * take the whole of Mr.Stewart\u2019s testimony together, he never said any thing to induce the Defendantto suspect that Mr.ffunter was going to leave the coun ry.\u201d On thisitmustappear obvious to all, that Mr.Stewart could have no wish 10 sce his Uncle in Gaol, and naturally enough did not inform me precisely, that ne intended leaving the country ;
