SIE NUMBER 38.JEUDI, 6 JUILLET, 1826.DECRET VOLONTAIRE.Y virtue of an ORDER OR JUDGEMENT of the follow- No.621.Quebec to wit : ing contents to wit : Province of Lower Canada,?IN THE Krva\u2019s Brncn, District of Quebec.§ 17th day of April, 1826.No.621.Upon the Petition of the ITonorable Francis Ward Primrose, of the city of Quebec, in the county and district of Quebec, Advocate.The Court having scen and examined the Petition in this cause filed by Mr.Sewell, on the part of the HONORABLE FRANCIS WARD PRIMROSE, of the city of Quebec, in the county and district of Quebec, Advocate, setting forth that, by act or deed of sale made and passed at the city of Quebec before Scott and his confrère Notaries Public, bearing date the fifth day of April, in the present year one thousand eight hundred and twenty-six, the petitioner purchased and acquired from Peter Courtney, of the place called Waterloo, inthe seigniory of Beauport, the party of the first part to the atoresaid Deed of sale for the price and consideration and subject to the charges hereinafter mentioned, the two certain lots or pieces of land situate lying and being in the sei- guiory, of Beauport aforesaid hercinafter described, as follows, that is to say : First\u2014That certain lot or piece ofland known and distinguished by the lot No.10, of the second range oftheestablishment called Waterloo Settlement, consisting in about three arpents in front by twenty arpents in depth, bounded as follows on the south by the lake Duchesnay, on the north by the third range of the said establishinent, on the south-west by the lot No.9, belonging to James Norris or hisrepresen- tatives and on the north-east by the lot or piece of land next hereinafter described, and Secondly, the south-westerly third part of the lot No.eleven of the said establishment, consisting the said third part of the said lot of one arpent in front by twenty arpents in depth, bounded in front or towards the south by the aforesaid lake Duchesnay, inthe rear or towards the north by the third range of the said establishment on one side towards the south-west by the aforesaid lot No.10 first above described and on the other side towards the north-east by the remaining two thirds of the said lot No.11, sold by the said Peter Courtney to the late Masse, and now belonging to his heirs, together with a wood buiit dwelling house, barn and stable on the said two lots or pieces of land above described erected and built, and other the appurtenances whatsoever thereunt severally and respectively belongiag, the said twolots or pieces of land so bargained and sold being in the censive ef mouvanc: of the Domain of the scigneur of the aforesaid seigni- ory of Beauport and towards the sane charged with the cens ct rentes seigneuriules, to wit : three pence of cens aitd two dollars and two bushels of wheat of sci- gniorial rent for the whole of each of the said lots Nos.10 and 11, payable on the cleventh of November in each and every year for ever, and also subject to all and singular the other charges and conditions set forth and contained in the deed of concession of each of the said lots Nos.10 and 11, granted to him the said Peter Courtney by the Honorable Antoine Louis Juchereau Duchesnay, esqr.late scigneur of the said seigniory of Beauport deceased, severally bearing date and passed before Mr.J.Bte.Taché and his confrère notaries, the seventh day of January one thousand cight hundred and twenty-three, the said sal> and conveyance made and granted for and in consideration of the price or sum of seventy-five psands, curreut money of this Province.The said pètition further setting forth that the said two above described lots of land and premises have for the last three years and upwards, to wit: from the said seventh day of Jonuary one thousand eight hundred and twenty-three, been possessed by the said Peter Courtney, as grantee thereof from the Honorable Antoine Louis Juchereau Duchesnay, late seigneur of the seigniory of Beanport, under and by virtue of the two above-mentioned deeds of concession made and passed before Taché and confrére Notaries Public, and bearing date the seventh day of January, in | the said year one thousand eight hundred and twen- ty-three ; certified copies whereof, the said petitioner brings here into Court, that the said petitioner wishing to assure to himself, his heirs and assigns, the said above described lots of land and premises, ment in such case made and provided, of purging the same of all other and further Aypothéques,charges and servitudes(if any there be)is desirous to have the same seized, sold and adjudged upon him by décrét volontaire subject to the payment of the aforesaid sum or remainder of fifty pounds current money aforesaid, being the ballance of the aforesaid sum of seventy- five pounds, the purchase money of the said two lots of land and premises with interest on the said sum of fifty pounds, at the rate of\u2019 six per centum per annum from the first day of May next and of the aforesaid cens et rentes seigneuriales as well as to all the other above described lots of land and premises are holden as aforesaid.The said petitioner concluding that this honorable Court he pleased to direct that an order do issue from this Court to the Sherifl of this district, commanding him to proceed to the seizure, sale and adjudication by Décrêt Volontaire, of the said above described lots of land and premises, subject to the charges, clauses and conditions aforesaid, according to the laws now in force in this Province.The Court having also seen and examined the exhibits filed in support of the said petition, and on the whole maturely deliberated, doth grant the conclusion of the said petition, and in consequence doth order the Sheriff of the district of Quebec, to proceed in virtue of the Provincial Statutes in such case made and provided to the seizure, sale and adjudication by Décrét Volontaire, upon the said honorable Françis Ward Primrose ofthe said above described lands and tene- mentsand other the appurtenances and depeudencies whatsoever thereunto severally and respectively Le- longing in the mauner prescribed for every other seizure and sale of immoveable property (Décrêt d\u2019Immeubles ou Héritage) in virtue of any law now in force in the Province, subject to the charges, clauses and conditions severally and respectively above mentioned, and the Court doth further order that the said Suicriff do return to this Court, on or before the first Jurisdicial day of next October Tern, all that he may or shall have done in virtue of the premises.PERRAULT & ROSS, P.K.B.Now I do hereby give public notice, that the above described immoreable property has been scized and taken in execution by me, and will be sold and adjudged to the highest and last bidder, at the church door of the parish of Beauport, on TUESDAY, the NINETEENTII day of SEPTEMBER next, at ELEVEN o'clock in the forenoon, at which time and place the conditions of sale will be made known.W.S.SEWELL: Sherif].All and every person or persons having claims on the premises above described, by mortgage or otiter right or incumbrance, are hereby advertised to give notice thereof to the said Sheriff, at his Ofiice in the Court House of the said City of Quebec, according to law ; the other emplacement of six toises, ome Joot in length by one toise three feet in depth, with a twe stories stone house erected on the said lots of ground, in Champlain street aforcsaid, the walls whereof are common (mitoyen ) with the neighbours, such as the whole may be now found to contain and extend every ways, without any reservation nor exception whatever : That this sale was thus made subject by the suid James Gardner, his heirs, ovr - assigns to the payment for the future to his Majesty the cens ct rentes whereto the said lots of lands are liable and charged with, and further for.and in consideration of the.price and sum therein mentioned.That since the passing of the said deed of sale, the said James Gardncidias been and is still in possession and enjoyment of the said two lots of land, circumstances and dependancies, and that for and during the three years immediately preceding the suid sale, the venders were in possession of the suid lots of land, circumstances and dependancies ; I have seized and taken in execution as belonging to the said Antoine Simard and Pierre Simard, and in the hands and possession of Michel Landry of the city of Quebec, Huissier Audiencier of our said Court, Curator to the délaissement in this cause, made and filed to wit 5 \u2018\u201c An arpent of land to be taken out of a land of two arpents and three perches in front by forty arpents tn depth, situate in the parish Saint François Rivière du Sud, bounded at one end towards the north by the lands of the pari.h of Berthier, and at the other end towards the south by the Rivière du Sud, onthe south west side by Antoine Parié, and on the north cast by the minor children of Antoine Fortier, the arpent heretotore belonging to Pierre Fortier.\u201d Now [dc hereby give public notice that the above described immoveable property will be sold and adjudged to the highest and last bidder atthe church door of the aforesaid parish of St, François Rivière du Sudon TUESDAY, the NINETEENTH day of SEPTEMBER next, at TEN o'clock in the forenoon at which time and place the conditions of Sale will be made known.W.S.SEWELL, Sheriff.AN and every person or persons having claims on the above dese etibed premises, by mortgage or other right or incumbrance, aie hereby advertised to give notice thereof to the said Sheriff, at his Office in the Court House of the said City of Quebec, according to law;
