called and chosen to our Provincial Parliament of our said Province and to all our loving Snbjects, whom these presents may concern, GREETING : Whereas we have thought fitby and with the advice of our Executive Council of our suid Province of Lower-Canada, to dissolve this present Provincial Parliament of our said Province, which now stands prorogued to Tuesday, the Tenth instant, we do for that end publish this our Royal Proclamation, and do hereby dissolve the said Provincial Parliament accordingly, and the Legislative Councillors, and the Knights, Citizens and Burgesses of the House of Assembly are discharged from their meeting and attendance, on Tuesday, the Tenth Instant ; liable or subject according to the ancient tities thereof.The said several lois of land and premises above described to be sold and adjudged subject to the agreement in the said ae bove in part recited deed of sale and conveyance contained, and herein after mentioned by the said George Pozer with the said Duncan McCallum, Colin McCallum and Daniel McCallum as follows, that is to say 3 That if the said Duncan McCallum, Colin McCallum and Daniel McCallum or any or either of them shall become Adjudicataires or Adjudicataire of the said several lots of land and premises above described or of any or either of them by Décret Volontaire as aforesaid, then and in that case the said George Pozer should and would leave or cause to be left & constitut at six per centum per annum with the privilege and preference of Bailleur de fonds tohim in the hands of the said Duncan McCallum, Colin McCallum and Daniel McCila lum, being Adjudicataires and Adjudicataire as aforesaid, such part of the amount of the sale and adjudication to them or any or either of them of the said several lots of land and premises above described.or of such of them us they or any or either of them shouid become adjudicataires or adjudicataire as aforesaid as he the said George Pozer should be privileged aud have a right to be collocated for under and by virtue of the several deeds of obligation therein CANADA COMPANY.FTE CANADA Company have laid out and commenced the JL building of a Town, on an extentive scale, in the County of Halton, to which they have given the name of Guelph, in honour of the Royal Family.The, situation is one of the most desirable in the Province, being on the banks of the Speed (one of the great branches of the Grand River), at a place where for upwards of a mile and a half there is a continued succession of valuable Mill seats.A road has already been opened to the \u2018Town of Guelph from Waterloo, and others in different directions are planned ; the building lots are being cleared at the expense of the Company ; several Mill seats are engaged as well as a number of the Town lots ; and houses to accommodate settlers, until they shall have built or obtained houses for themselves, are erected, at the expense of the Company.The price of the Town lots is at present only twenty dollars and the half of the mouey arising from the sales is appropriated for the endowment of a free School.The first hundred purchasers of Town lots, when they shall bave erected a habitable house, will, at any time within twelve months from the date of their purchase, be or of the most intelligent observers out of this House.The financial situation of the Country at this time is assuredly one which requires to be louked at with a steady and seruvivizing eye 3 but in proportion as that scrutiny 1s minute and a\u201ccurate, L am happy to think that we shall find in it the justitication of sanguine hopes, that the result will be neither distant nor disheartening.(Cheers) At the end of 1826, after balancing the income and expenditure of that year, there remained a surplus of income towards the charge of the sinking fund of £ 1,000,000.The amount applicable by law to the sinking fund was however for that year £5,500,000.There was therefore an apparent deficiency of £4,500,000, 1 say apparent, because, from that deficit are to be deducted two sums which considerably reduce its amount, The first of these sums is the aggregate of the advances made from the Exchequer Fund, under several Acts of Parliament, either for public works in Great Britain and Ireland or for the purchase of beneficial interests, which are not only likely, but certain, to make a more than adequate return to the Public, It is quite vovious, that sums laid out in this manner, and for the repayment of which the claims of the Itevenue are available and outstanding, are not items from which can fairly be inferred the character of the expenditure of any particular year.\u2018Fo this balance of advances over repayments, then, is to be adde d another sum, arising out of the circumstance that in the year 1.26, there were other over-payments of this kiod ; or paymentsou account of expenses not incurred in that year, but defraycd out of its income, and which were made to the amount of other £1,200, 000.These two sums of £1,200,000 each, being deducted from the £4,500,000, that I have before stated as the deliciency of that year, upon the amount applicable by law to the Sinking I'und, decreased the amount of that deficiency to £2,100,000.Such, then, Sir, was the state of our finances at the end of the last year, (The Rt.Honble.Gentleman here shewed, from official documents, that the amount of the deficiency for the last five years amounted to about three millions, aud that sum spread over the whole five years.) Statute Law connected with this Province.On the contrary, every branch of the Legislature was instituted tosccure the legal and constitutional exercise of the functions and privileges of the other ; and if the ELecTors have a just sense of this admirable equipoise, they cought rather to throw their weight into the ExEcUTIVE scale, than seek to encrease the already disproportionate influence of the popular branch, The pretended claim to appropriate and appoint the Permanent Fund, in whatever terns it is maintained, is but the watchword of a Facrion, adopted to amuse the credulous, and to excite popular discontent against the ExEcu- TIvE, and certain other individuals.The reality of the claim cannot be believedevenby those who are most elamo- rous on the subject.The immediate object is a personal one, to effect a change in the Administration of the Province.But, addressing ourselves to the enlightened and independent part of the population of Lower CANADA, we are convinced, when the present ferment shall have subsided, and the conduct of GoyERNMENT shall be calmly and dispassionately considered, free from the mist of prejudice, the errors of misrepresented facts, and the delusion of sophistical reasoning, it will be acknowledged eminently calculated to promote the true interests and prosperity of the Province, without inthe least degree violating eitheritsown proper character of integrity, or the rights and privileges of others.The re-action has already commenced, and we dave to prophecy, that the time is not far di.lant, when, full of the most unshaken attachment to the priuciples of the Constitution, the WroLe Province will warmly approve the conduct of the Executive in opposing the dangerous pretensions above alinded to; and engage to defend the Government, by\u2019 every constitutional] means, against any attacks by which it may be assailed.In the mean time, we call upon the honest, loyal, and independent Electors generally, if they would not be thought insensible to the tried and proved blessings they derive from the British Constitution, not to omit the present occasion of showing their rooted abhorrence of every attempt to create unjust and dangerous discontents, disseminated by designing men and bad subjects, and tending te embarrass the operations of Government, We call upon them to reject the interference of agitators, be they in or out of the House of Assembly ; and never again to suffer an assumed authority on the part of one.to dictate to any other branch of the Legislature, They must perceive that the cause of order and of Government is advancing, they may be assured it will advance, and rapidly too, while every general Election will add to the discomfiture of the Faction, and demonstrate the triumph of right principles over passion, prejudice and crror, however disguised under the cloak of patriotism, Re \u201c\u201c Offices of State, and situations of public authority, being intended for the maintenance and support of the established Government, ought not to be placed in the Lands of any persons who arc not WELL AFFECTED TO TAT GOVERNMENT, SIN ALL ITS ESSENTIAL PARTS.\u201d (See Pitt\u2019s Specches, 28th March, 1787.) We like to see things done completely when done at all.We are, therefore, gratified in being able, by a General Order of Militia, which we publish to day, to supply an omission which, it appears, occurred in that of the 12th instant, respecting the Officers of St.EuUsTAcuE.Mr.NemsonN finds fault with that General Order, for reducing Dr.Lannie and Messrs.BArcELo and RAIZEN- NE to the ranks, and depriving them of the exemption allowed them by the revived Ordinances.No exemption is by that Ordinance allowed to Dr, La- BRIE, as a Physician, or to Messrs, Barcero and Raiz EN- NE, as Justices of the Peace, except an exemption from Militia Services.The General Order merely directs, that they be \u2018\u201c enrolled as private Militia-men\u2019\u2019 ; and the second clause of the Ordinance (27th Gre, 111.ce.2,) says, that a list must he kept by Captains of Militia, of every per.\u201c son residing within their precincts, notwitistanding they 6 may not be liable to SERVE in the Militia.\u201d What will the Oracle say to this?Will he say, he did not know it ?With respect to the two Justices of the Peace, aforesaid, there is an easy way of making the matter sure and clear as to them, by an instrument culled a supersedeas, of which peshaps, the Oracls has had, or may have some knowledge.\u20ac & cc THE QUEBEC GAZETTE.Itis an invention for putting out of the Commission of the l\u2019eace persons who, for the reason stated in the text above, ought not to bein it.\u2014 came We have seen, but not read with any attention, a letter in a MONTREAL paper signed \u2018 Jas.LABRIE,\u201d and addressed to us.The first glance was sufficient to convince us it was just the kind of letter we should Have expected from that quarter, The abuse contained in the latter part touches us not.If it were merited, we should be callous to the effect ; ifthe contrary, we are undefiled by it.Abuse must be more effective than that found in the columns ofthe Spectator to move us from our course, or from our temper.Such as it is, we trust we shall live long to experience it : for as a classical punster observes, Laudamur ab his ! I THE GREEK CAUSE.In the last Nonru AmEnicAN Review there isa powerful appeal in its favor, which concludes with this extraordinary sentence aud recommendation :\u2014 * Let then the public mind be disabused of the prejudices which mislead it on this question.Let it not be operated upon by tales of piracies at s#a, aad factions on land 5 evils, which belong not to Greeks.but to bunan nature.Let the means of propagating authentic intelligence of the progress of the revolution be muliiplied.Let its well wis'ers and i 8 well hopers declare themselves in theeause, Let the tide of pious and Christian charity be turned in this broad and thirsty channel, Let every ardent and high spirited young man,who has an independent subsistence of two or three hundred dollars a year, embark personally in the cause, and aspire to that crown of glory, never Yet worn except by him, who so lately triumphed in the hearts of entire millions of Americans.Let this be done, and Greece is safe.\u201d We doubt whether this advice will be followed, even in the Untrep STATES.In this Province, there are many hotheaded persons, with \u2018\u2018liberty,\u201d \u201cslavery,\u201d and \u201crights, eternally in their mouths.How much more advantageously would they be employed, if they would follow the advice ofthe North American Review, and relieve the Province of their presence until Greek independence is fully and permanently established ! Era A - To the Editor of the Quebec Gazelle.Sir,\u2014As an Elector ofthe Province, 1 wish to offer a few remarks on Mr.NerLson\u2019s Manifesto published in English, July 12th, in which he endeavors to blind us to the consequences of his own Parliamentary conduct, by a deal of verbiage in crimination of the Executive.As I cannot expect you will devote a large portion of your Gazette to the re-publication of the long article I allude to, I shall endeavor to direct the attention of the Reader to cach paragraph, according to the numbers which he has prefixed to them.1°.IIs ExceELLENCY\u2019s first speech, to the Parliament, was at the period subsequent to the accession of His PRESENT MasEsry ; and His Lorpsair demanded, ly instructions, what in ENGLAND is considered so necessary to the Constitution, that it has even been declared, that any deviation from it would be unconstitutional! ; namely, a permanent Civil List, during the King\u2019s life.\u2014If there is \u2018\u201c\u201c no sufficient legal responsibility within the Colony for \u201c\u201c high public officers,\u201d it must clearly be the fault of the Assembly, and not of the GovERNOR.As representatives of the people, whose rights they say they are so anxions to protect, let them look to it, but let it not be said that the EXECUTIVE has thrown any impediment on the way.\u2014 The Judges would have been rendered independent of the Crown, if the House would allow them a retirement ; and would permit them to receive a Salary independent of the annual appropriations of the House.\u2014The rest of this paragraph, respecting the ¢* Legislative Council having high \u2018\u201c salaries paid out of the public Revenues\u201d is ad captandos the Freeholders of the County of Quebec.2°.The House of Assembly does in fact ¢ refuse the supplies,\u201d when it declines granting them in a constitutional manner.Ilis EXCELLENCY asked for a permanent Civil List, the House replies by voting an annual appropriation,\u2014what is that but a virtual \u2018* refusal\u2019\u201d 2\u2014 With respect to the Union Birr, it would have been much better if it had been passed in the same manner as the CANADA TRADE Âcr.The mistaken lenity of Lord CAsTLEREAGH alone prevented it, and its necessity is every day more and more perceived.3°.The Law officers of the Crown in ENGLAND have settled this point, namely, the \u2018 pretence\u2019\u2019 on the part of the Executive to the permanent fund, (see Lord BATHURST'S despatch, 23d Nov.1824.) \u2014The insinuation thatthe Go- VERNOR selected ¢ his own Salary\u2019\u2019 as being thus ¢¢ provi- \u201c ded for,\u2019 is false and malicious.4°.and 5°, With respect to the Receiver General's affairs, it has been proved over and over again by facts incontrovertible, that the neglect was on the part of the Assembly, who were actually required to look into the state of the Chest, and neglected or refused so to do.6°.With respect to the charge against the Executive \u201c* for going home with his Civil Secretary as a confidential \u201c*_ person to transact business relative to the province,\u2019 in consequence of which, it is said, the Canada Tenures Act was passed, it need only be observed, that to perpetuate the feudal tenures under the present circumstances of the Province would be absurd and finjurious and, in fact, that Bill compelled no one to commute his Tenure.It merely empowered those to do so, who were themselves desirous of exchanging the feudal for the free, or common soccage tenure, 7°.is EXCELLENCY, it is to be presumed, gave the best ¢¢ information to the Colonial Minister,\u201d founded on his own personal experience and conviction.8°, The \u2018letter of the Colonial Minister\u2019 in reference to the despatch of 4th June 182); acquitted Sir Francis BurTon of blame, on the ground of not having seen the ** positive instructions 3° but the despatch was never cancelled, or retracted, as to its views on the \u2018\u2018 arrangement\u2019 accepted by the LiEuTENANT GOVERNOR in 1825.It remains still on record, and in force.9%.The whole of this itis unnecessary to answer.It is merely ad crptundos the Frecholders, Having thus, according to their numbers in NErLson\u2019s \u201ce Gazette, shown up a few ofthe misrepresentations contain- July 19, edin these paragraphs, I' shall conclude with a remark of two on the deductions drawn from them.Mr.NEILsoN continues to assert, that the ¢ House did not \u201c* refuse the supplies,\u201d although ¢ His ExceLLency\u2019sad.\u2018 ministration of the Government would probably have fully *¢ justified them, in refusing to confide them to him in the same \u201c* manner as they had granted them under Sir F.BurTon.\u201d The miserable evasion which he is guilty of, when he says that the House did not refuse the supplies, because they offered them on terms which could not be accepted, is only matched by the hardihood, injustice and indecency of the whole of this and the following sentence in the original.Facts, well known facts can alone contradict such misrepresentations ; and this one is of à piece with the quality of the infamous Report, adopted by the Assembly on the subject ofthe LIEUTENANT GovVERNOR, Which I agree with yon in denominating of the most * flagrant\u2019 description.Mr.N., talks of \u201c some minor sacrifices of rights\u2019\u2019 in 1825, on the part of the Assembly ; but there are those who consider the sacrifices, \u2018\u201c for the sake of peace,\u201d to have been greater on the part of ornErs.He then goes on to intro duce a comparison with the state of NEw York ; but, I trust the Electors of this Province will be cautious how they listen to such designing suggestions.Our neighbours muy manage their affairs on a cheaper system, perhaps ; but the same argument would apply to the MoTHER COUNTRY, and the UNITED STATEs, generally, more correctly than to this Province and any single State.At all events, the question is not to be judged at present by the relative cheapness of the two Governments, nor how a given number of inhabitants can be ruled by the smallest possible expenditure of pounds, shillings and pence.Mr.N., says, the Assembly have ¢ continued to adhere to \u2018\u2018the arrangement\u201d made in 1825: I adinit it; they have done so from sheer obstinacy ; because tliey know that there exist positive instructions why it cannot he accepted.They know also, that a similar ¢\u2018 arrangement\u201d was forbidden a¢ home, not here.Lastly, Mr.NErLsoN\u2019s assertion, so usual with they who write only, I repeat it, ad captandum vulgus, re-pecting *¢ the ** absolute rights of British Subjects, to dispose of their own \u2018\u201c property,\u201d is totidem verbis, if appliedin a legislative sense, absolute nonsense, mere clap-trap stuff.No \u201c violation of * any stch rights,\u201d has been attempted, or thonght of;
