county of Warwick, in that part of the United Kingdom of Great Britein and Ireland, called lngland, merchant; against LOUIS DELAGRAVE, heretofore of the city, county and district of Quebec, and now of the city, county and district of Montreal, merchant, to wit ~*\u2018An emplacemnt situate in the upper town of the city of Quebec, Ste.Fumille street, containing thirty feet in front more or less, the partition wall on each side of the said emplacement therein comprised, by sixty-nine feet in depth or thereabouts, the whole English measure, bounded in front by the said Ste.Famille street, in rear by the ground of Hypolite Dubord, esquire, joining on one side towards the north to Charles Turgeon, esquire, on the other side towards the south to Thomas Baillargé, esquire, with a three story stone house thereon erected, hangard, stables, circumstances and dependencies.The said immoveables subject towards the domain of the gentlemen of the Seminary of Quebec, to onze suis et quatre deniers of yearly rent.The said immoveable to be sold subject by the purchaser to the repairs aud keeping in repairs of the same, and to clear at common costs with Charles Turgeon, esquire, neighbour to the north of said emplacement, their heirs and assigns, the ditch and privies of the said house, which are construeted for the use of the above described lot of ground, and that of the said Charles Turgeon, esquire, to the north of the same ; and that the said privies will remain where they are, without any of the parties, their heirs and assigns, may build any wall of separation between the in the said district of Quebec, bailiff of our court of King\u2019s Bench, fur the said district of Quebec, to wit: \u20141, ¢¢ A certain extent of ground commonly called Ance, situate in the aforesaid parish of St.Nicholas, on the aout level of the river St.Lawrence, on the south west side, and near the mouth of the river Lruyante, beginning at a land-mark on the ceutral part or the higuestofa rock or cape projecting towards the river St.Lawrcuce, and forms the side avd north west live of the said Ance, and from that land mark messuriog eight perches in front, running towards the south east, at high water-mark, going to abut at the extremity or south east side of the said Ance to another cape or rock, and bounded in depth towards the sonth by the beights of the cape which bords the said river St.Lawrence ; together, with the shores which may be found in front of the said Ance, between the two lines, starting from the said two extremities of the said ÆAnce, and ruvuing north sixty degrees east, until it reaches the south side of the bed ot the river Bruyante.2.A certain piece of ground situate inthe same place above the cape which bords the said Ance, making part of the langue er portion of ground formed by the said river Bruyante, and containing the said piece of ground in what may be found from the point where the now existing road terminates, which the said 4nce lends to the top of the cape, and thence, on a south line, running five arpents aud - a quarter, until it reaches another line dividiug the said piece of gronud from that conceded or sold to the plaintiff, being the remainder of the said langue or portion of grouud.And thence, on a new line runuivg southseventy two degrees west, until it reaches a land now possessed by Bazile De- mers, the piece of ground being of thirteen arpents ; and thence, on another line runniug north forty five degrees wesr, along the land possessed as aforesaid, the said piece of grouud has about ten arpents to the top of the cape ; and lastly, all that may be fouud from this last point, along the top of the cape, to the point of departure, forming in all ove hundred and thirteen arpents and a half in said city of Quebec, esquire, curator duly appointed to the vacant estate and succession of the late Thomas Hunt, in his lifetime of the place called the Little River St.Charles, in the county and district of Quebec, architect, to wit :\u2014*\u2018 The undivided third part of the following properties, viz: Firstly\u2014Of a lot of ground situated and being in St.Peter street, in the lower town of the city of Quebee, containing forty six feet six inches English measure, in front, on St, Peter street aforesaid, which is gradually widened to fifty one feet six inches English measure in rear, by one huv- dred and six feet nine inches English measure in depth, inclosing an area of five thousaud two hundred aod thirty English feet in superficies, bounded in front to the west by St.Peter street atoresaid, in rear to the eust by the lot number three hereafter described, on one side to the north by St.Antoine street, and on the other side to the south partly by the said lot number three, and partly by the lut number two hereinafter described, together with a stone built house three stories high, fronting oun St.Peter street aforesaid, a stone store in rear of said house, and another stone house in St.Antoine street atoresaid, thereon erected, circumstances and dependencies, the whole as the said lot number one is designated, and vow held in free and common soccage, under letters patent, bearing date at the Castle of >t.Lewis, in the city of Quebec aforesaid, on the twenty seventh day of June, in the year of our Lord one thousand eight hundred and thirty five, Secondly\u2014Of another lot of ground situated and being in St.Peter- street aforesaid, containing fifty five feet eight inches English measure in front, on dt.Peter street aforesaid, fifty four feet six inches I-nglish measure in re«r, by seventy four feet eight inches english measure in depth, inclosing an area of tour thousand one buudred and sixteen english feet in superficies, bounded in front to the west by st.Peter street aforesaid, in rear to the east by lot number three hereinafter described, on one side to the south by the property of Messrs.Gillespie, Finlay and company, and on the other side to the north by lot number one hereinberore described, with various old wooden buildings and one small brick building thereon erected, circumstances and dependencies; the whole as the said lot number two is designated, and now held in free and common soccage, under the aforesaid letters patent, bearing daie the tweuty seventh day of Jue, one thousand eight hundred and thirty five.Thirdly\u2014Of all that extensive property known as Hunt's wharf, situated in the said lower town of Quebec, bounded on one side towards the north by St.Antoine street aforesaid.and its continuation into deep water, on the other side towards the soath partly by thc propertyof Messrs, Giliespie, Finlayand & Co.aforesaid, and partly by the river St.Lawrence, at one end towauds the west by the lots numbers cne and two herein- before described, an& at the other end by the river St.Lawrence, exteuding that is to say, ON St.Antoine street, and its continuation as aforesaid, four hundred and ninety eight fect English measure, on the south side five hundred and forty feet English measure, on the west end one hundred and two teet knglish measure, and on the east end one hundred and eleven feet Knglish measure, containing in all an area of about fifty six thousand six bundred and eighty feet English wielsure, together with a stone built dwelling house fronting *t.Antoine street aforesaid, also, à large stone built store also fronting said last mentioned street, a small wooden store, and a range of stone built offices aud various wooden buildings on the south side of said lot, and a large wharf, circumstances and dependencies; the whole as the lot is designated, and now held in free and common soccage under various letters patent, bearing date at the Castle of St.Lewis atoresaid, viz.: on the fourteenth day of Jun , one thousand seven hundred and sixty five, in favour of Stephen Moore and Hugh Fin.lay, for the wester.y portion of said lot number three, on the twenty ninth day of A pril, one thousand eight hundred, in favour of John Chillas for anuther portion of said lot number three ; by the atoresaid letters patent, bearing date the twenty seventh day of June, one thousand eight hundred and thirty five, in favour of Thomas liunt and Elizabeth Chillas, for a third portion of the said lot number three, and lastly by letters patent bearing date the twenty fourth day of August, une thousand eight hundred and thirty six, in favour of the said Thomas Hunt and Elizabeth Chil.as for the easterly portion of the said lot number three, said lot being charged with an annual rent of ten pounds eight shillings currency, payable to our Sovereign Lord the King, and to the ercction of a public wharfor wharves within three years from and after the date of the 463 rm eres 464 last recited letters pateut, and all other stipulations and conditions in any or all of the aforementioned letters patent set forth and described.Fourthly\u2014Of a lot of gronnd situate and being in Saint Peter street aforesaid, described in the deed of sale trom James Sheppard, sheriff of the district of Quebec, to John Chillas, bearing date at Quebec aforesaid, the twenty seventh day of July, one thousand eight hundred and seven, as follows :\u2014an emplacement situate in the lower town of Quebec, St.Peter street, of forty one feet in front, French measure, by fifty seven feetin depth, bonded in front by St.Peter street, and in rear by Sault-au-Matelot street, on one side by the representatives of John William Woolsey, esquire, and the beirs Pellerin, and on the other side by the lane leading from Sault-au- Matelot street to St.Peter street, with a two stories stone honse thereon erected, and a small paved yard.Fifthly\u2014Of a lot of land situated in the banlieue of the city of Quebec, on the westerly side of the river Saint ( harles, known by the appellation of ¢* Competence Farm,\u201d the said farm or land having three arpents nine perches fifteen feet in front, ou the shores of the said little river St.Charles, near Quebec, with more or less in front if more oc less in front is to be found, by forty nine arpeats in depth, or more or less if so to be found ; Joining and abutting to the live called St, Bonaventure, bounded on the south west side by the Honorable Jonathan Sewell, to the north east by the road (route) leading from the little river St.Charles to Charlesbourg, called voute Sainclair, in front by the north shore of the litile river St.Charles, and in the rear to the end of the said depth, joining the said line called St, Bonaventure, together with all the buildings which will be found erected oun the said land or farm, circumstances and dependencies.Sixthly\u2014Of a Rente Constituée or coustituted rent of the sum of twelve pounds current money of this province, on à Capital of two hundred pounds like current money at six per cent, per annum, created and assigned by John Tough, late of the city of Quebec, cooper, deceased, to and in favour of the said late John Chillas, to be taken and levied on that certain lot of ground situated and being in Sauit-au-Matelot street, in the lower town of the city of Quebec, bouuded on one side by the said street, on the other side by the cape, at one end by Pierre Pelletier, and at the other end by Monseigneur the Roman Catholic Bishop of Quebec, and upon the house and other dependencies erccted and being on the said lot.Also, the following immoveable properties which belong in the ;entire to the estate of the said Thomas Hunt, viz, :\u2014Se- venthly\u2014A certain lot of gronod or emplacement situated, lying aud being in Champlain street, in the lower town of this city, containing about tweaty four feet in front on the said street, and forty six fect more or less in depth, bounded to front by the said street, in rear by the Cape, on one side tuwards the south by the property of Mr.George Pozer, aud on the other side towards the north by the property of Mr.James Thom, together with the stone dwelliog house thereon erected, of about twenty four feet in front and tweaty eight feet in depth.Eighthly\u2014A certain lot or emplacement situate, lying and being in the suburbs of St.Roch of the city of Quebec, consisting of fifty two feet in front and fifty feet ip depth, bounded in front towards the south by des Fossés street, in rear towards the north by one Audry and others, on one side towards the north east by Alexavder Bruneau, and oo the other side towards the south west by Augustin Blais, together with a wooden house and workshop thereon erected.'Ninthly\u2014A lot of ground or emplacement situated, lying and being in the aforesaid suburb of Saint Roch, containing sixteen feet în front on the line on St.Roch street, by seventy oue feet in depth, between the lots belonging to Cureux St.Germain, and that belonging to the beirs of Frangois Bélanger, at the end of the depth of the lot belouging tu the said Cureux St.Germain, the said lot is _ sixty six feet in front, to be measured from the line of the lot belonging to Antoine Huot dit St.Laurent, on the north side, and running south until it reaches the lot belonging to Jean Baptiste Beaulieu, by one hundred and nine feet in -Jength, où the south side, beginniug from the lot belonging to the said Antoine Cureux St.Germain, and running west until it reaches the south eastwardly corner of the lot belonging to Pierre Morenu, and one hundred and eleven feet also in length, on the north side, begiuning in a live with the depth of the lot belonging to the said Antoine Cureux St.Germain, and running west until it reaches the south westerly corner of a lot belunziug to one Joseph Dussault, thirty three feet six inches in front alongside of the lot belonging to the said Pierre Moreau, until it reaches the north eastwardly corner of the lot belouging to the said Pierre Moreau, thence from said corner running west five feet nine inches, until it reaches a bouse in the possession of one Lacombe, thence twenty one feet alongside of the house accupied by the said Lacombe putil it reaches tbe north east corner of the said house, thence seventeen feet in front of the said house, until it reaches auother part of the lot belonging to Pierve Moreau, thence sixteen feet alongside of the lot belonging to the said Pierre Moreau, running north until it reaches a lot belonging to Augustin Bornais, thence three feet runuing exst until it reaches the corner of the lot belonging to the said Augustin Bornais, together with the passage between the lot belonging to toe said Augustin Bornais, and the lot belonging to Joseph Dussault, which passage is eighteen feet wide by sixty fect long, leading from the said lot to St.Joseph street, the said Jot containing io the whole nine thousand six hundred and eight fect superficial measure, and is bounded ou the north side by the heirs of François Bélanger, Antoine Huot dit St.Laurent, Joseph Girgras and Juseph Dussault, on the south side by Autoine Cureux St, Germain, Jean Baptiste Beau- lieu, Louis Latouche and Joseph Juiien, ns the whole is laid down in the figurative plan of the said lot betwecn the numbers one, two, three, four, five, six, seven, eight, nine, ten, eleven, twelve, thirteen and fourteen 3 which plan was drawn from actual measurement by Benjamin Ecuyer, sworn land Surveyor, on the fifth day of Jeune, ove thousand eight hundred, and nine, and remnins anuexed to the deed of sale of the said premises, grauted by Matthew Lymburner, as the nttor- ney of the honorable John Richardsou, curator to the estate of the late William Grant to the said late Thomas Huut, bearing date aud passed before Mire.J.Bélauger and his colleague, notaries, at Quebec, on the twenty third October, one thousand eight huudred and nine.Tenthly\u2014A lot of ground situated und being in Grisons street, in the upper tuwn of Quebec, designated and described on the figurative plan hereinafter mentioued, as the lot number oae, bounded in front by Grisons street aforesaid, iu rear partly by lot pumber four, hereinafter described and partly by the passage hereivafer mentioned, on one side towards the north by John Bryson, aod on the other side towards the south by the Jot number two, hereinafter mentioned, with the right of suitoyennetté in the division or separation with the lot pumber TOR QUEBEC GAZRTIE.two, bereinafter next described, extending io front twenty two feet three inches, which width is continued to the depth of seventy four feet six inches, and thence to its rear the said lot is only fifteen feet wide, measuring in depth on the north side eighty tour feet six inches, and on the south side se- vepty four feet six inches, aud containing one thousand eight hundred and sixteen ruperficial feet, English measure, the whole as represented on a certain plan drawn by Harry Ball, deputy provincial surveyor of the province of Lower Canada, and deposited of record in the office of L.T.Mac- plierson, notary public, Quebec, together with a stone built dwelling house, and a range of wooden buildings thereon erected, circomstances and dependencies, also the right of passage through the passage hereinafter described, to La Porte street.Eleventhly\u2014Another lot of ground situated io Grisons street aforesaid, designated and described on the said plan as the lot pumber two, bounded in front by the said street, in rear by a continuation of the aforesaid passage, with the right of passage there through to La Porte street, on one side to the north by lot number one, bereinbefore described, and on the other side to the south by \u2018lot sumber three, extending in front on Grisons street aforesaid, twenty four feet, which front or width is continued to the depth of twenty two feet, and thence to the rear of the lot, its width is only twenty one feet by the depth of seventy four feet, and containing one thousaad six hundred and twenty supe ficial feet, English measure, the whole as represented io the aforesaid plan, together with a sione built dwelling house and other buildings thereon erected, circumstances and dependencies, also the right of miloyenneté in the aforesaid division or separation with the said lot number one, and also with the sume right in the division or separation with the Jot number three, hereinafter next described.Twelfth\u2014Another lot of ground situated and being io Grisous street aforesaid, and in St Denis street, designated and described oo the said plan as the lot number three, bounded on the west by Grisous street, on the east by lot number four, bereivafter described, on the vorth by lvt vumber two in part and in part by the aforesaid passage, with the right of passage there through to La Porte streut, and on the south by the said Grisons street, extending on Saint Denis street afor-said, cighty five feet, which width is continued to the depth of thirty seven feet, and thence to its rear the said lot 18 sixty two feet six inches wide, in frout on Grisons street, the said lot extends thirty seven feet, aud in rear it extends forty two feet, aud contains three thousand four buudred and fifty seven superficial English fect, the whole as represented on the aforesaid plan, together with two stone built dwelling bouses snd other buildings thereon erected, circumstances and dependencies, nlso the right of mitqyenneté in the division or separation with the aforesaid lot number two, and as the aforesaid last described three lots are actually divided, according to the said plan, and which division shall be common between the said three lots respectively.T'hirteenthly \u2014Auothier lot situate in and fronting on St.Denis street aforesaid, designated aud described on the said plan as the lot number tour, Canal into the St.Lawrence.2.That no scow, raft or crib of timber, firewood or lumber, loaded or unloaded, shall be anchored or\u2019secured in the stream or on shore, within any part of the said limits assigned to vessels with cargoes, under a penalty against the owner or conductor of such scow.raft or crib, of not more than ten pounds currency, and a like further penalty for every period of twenty-four hours during which such scow, raft or cribshall remain so anchored or secured, provided always that nothing herein contained shall extend to prevent cribs of timber being secured alongside of any vessel, lying within the limits above described for the purpose of loading or un- Joading such vessel ; it being however understood that the Harbour Master shall point out the position which such vessel and crib shall take in the said Harbour, and shall regulate the size of the crib, and the number of days during which such crib shall l:e secured alongside such vessel, under the above mentioned penalties against any person refusing obe- 'dience to any of the orders of the Harbour master issued for that purpose.3.That all scows, rafts or cribs of timber in the harbour shall be anchored or otherwise secured, below the limits already assigned to vessels with cargoes, and shall be placed and arranged in such a manner as the Harbour Master shall order and direct ; and any person having the charge or care of any scow, raft or crib, so being within the said Harbour, who shall refuse to obey the orders or directions of the Harbour Master in the premises, shall incur a penalty not exceeding ten pounds currency.4.That all ships, \u2018vessels, steamboats or river craft lying -and being in the harbour, or at the wharves thereof, shall be placed and arranged in such a manner as the Harbour Master shall order and direct, and the Harbour Master shall also regulate the mooring or shifting of such ships, vessels, steamboats or river craft, and shall determine how far and in what instances it is the duty of masters and other persons having charge of such ships, vessels, steamboats or river craft, to accommodate each other in their respective situations and he shall decide all disputes that may arise touching or concerning the premises, and any master or person having such charge, refusing or neglecting to obey the Harbour Master, to resist or oppose him, in the execution of any order or direction in the premises, shall incur a penalty not exceeding ten pounds currency.5.That any person having charge of a ship, vessel, steamboat or river craft, who shall refuse to relinquish and give up the birth or mooring at which such ship, vessel, steamboat or river craft may be lying, when ordered and directed so to do by the Harbour Master verbally, or in writing left with a grown person on board, belonging to the said ship, shall incur a penalty not exceeding ten pounds currency for every such refusal, and not more than ten pounds like money for every day they shall remain in such births or moorings from which they shall have been so ordered.6.That all ships or vessels having cribs of timber secured alongside for the purpose of loading or unloading, shall be subject at all times to be removed.by order of the Harbour Master, from the births or moorings which they may occupy to any other birth or mooring, or to any part of the harbour, that may be especially appointed for the landing of vessels with timber, as circumstances and the public convenience may require, and any master or person in charge of such ship or vessel refusing or neglecting to comply with the orders of the Harbour Master in that respect, shall incur a penalty not exceeding ten ponds currency for such neglect or refusal, and a further penalty not exceeding ten pounds currency for every period of twenty.four hours, during which such ship or vessel shall remain in the birth or mooring from which it shall have been so ordered by the Harbour Master.7.\u2018That vessels loading with timber of any description from the water or from cribs, shall take an outside birth, if thereunto required by the Harbour Master, in writing or verbally, left with a grown person on board.belonging to the said ship, so as to make way for other vessels trom sea or river craft, to unload or load, under the penalty of not more than ten pounds currency against every person in charge of such vessel for every such refusal, and a like penalty for every day it shall remain in the birth or mooring from which it shall be so ordered.8.That the master or person having the charge of all ships or vessels, river craft or from sea, laden fully or in part, shall be at liberty to take, (in the order as they arrive inthe harbour,) such births or inoorings, as have not been destined for other purposes by the Harbour Master,or as are not already occupied by other vessels, actually unloading or tak: ing in cargo, and shall be allowed to retain such births or moorings for such time as in the opinion of the Harbour Master may be suff cient for discharging their cargo, and may also remain in the same births or moorings tor the purpose of reloading, if the cargo to be taken in be in readiness, which time for reloading and unloading, shail in either case be in proportton to the tonnage.if for a vessel from sea.or not more than four working days, if for à river craft, 9.That in the selection of births or moorings in any part of the harbour, a ship or vessel, loaded fully or in parc, shall take the preference to a vessel, light or in ballast ; and river crafts not loading or unloading, shall yicld the preference to vessels from sea, or river craft arriving in the harbour ; and when two or nore vessels arrive in the harbour in tow of any steamboat, the preference shall be given to the vessels according as they are entered on the lists of the steamboat, and any person.in charge of any vessel, wuo shall disobey the directions of the Harbour Master, shall incur a penalty of not more than ten pounds currency, and a further penalty of ten pounds currency for every twenty four hours during which the person in charge shall neglect to comply with the said directions.10.That when two or more vessels shall lie in the same tier at any of the wharves of the harbour, a free and unencumbered passage over the deck or decks of such ships or vessels lying next or nearer to the said wharves shall be allowed to all persons, as well for the purpose of loaling or unloading, as for all and any purpose of communicati n between the shore and the ship or vessel lying without, and any master or other person having charge of such ship or vessel within or nearer to the wharf, who shall refuse such passage as aforesaid, or shall wilfully impede such passage, shall incur a penalty not exceeding ten pounds currency.11.fhat it shall be lawful, when necessary in the opinion of the Harbour Master.for ships, vessels.steamboats, and river craft of all descriptions, to load or unload over the decks of each other respectively, and any person having the charge of such ship, ve-sel, steamboat, or river craft, who being thereunt» required by the Harbour Master, shall refuse to permit the person having the charge of any other ship, vessel, steamboat, or craft, so to load or uuload, shall incur a penalty not exceeding ten pounds currency for every such refusal.: 12, That the shore fastenings of any ship, vessel, steam boat, or river craft within the harbour, shall be attached to the rings placed on the face or outer edge of the wharves, and shall not in any manner cross or traverse the said wharves, and the person having the charge of any ship, vessel, steamboat, or river craft, who-e shore fastening shall be placed contrary to the tenor hercof, shall incur a penalty not exceeding ten pounds currency.13.That no master or person having cliarge of any ship.vessel, steamboat, or river cratt, or other person whatscever,shall fasten any hawser or other rope across the harbour, otherwise thau tor the express purpose of hauling in or out immediately, or for the purpose of heaving their vessel off the ground, in which case they shall slack their hawser or rope.in order to give a free and uninterrupted passage to any other vessel that may require to pass during that time, and all persons offending shall incur a penalty not exc: eding ten pounds currency, without prejudice to any claim for damages that may be done thereby.14.Thatany master or person in charge of any ship, vessel, steamboat, or river craft, made fast by any rope or hawser to any other ship, vess 1.steamboat, or river craft, lying within the limits of the harbour, who shall cast off or cause to be cast off, such rope or hawser, without giving notice to the master or person in charge of the ship or ve.- sel so made fast, shall incur a penalty not exceeding ten pounds currency.15.That all masters of ships or other vessels arriving in the night time, shall hoist thesr colours the next moruing at sunrise, and continue to keep them flying until boarded by the Harbour Master, under a penalty of not more than ten pounds currency.16.That all ships, vessels, or craft, (steamboats excepted, which are already provided for by law,) atanchor iu any part of the Port of Montieal, in the jurisdiction of the Corporation, shall, during the nights when the moon does not shine, show a light at the bowsprit end and at the stern, and any persoa having the charge of such ship, vessel or craft, who shall neglect the same, shall incur a penalty not exceeding ten pounds currency for each and every neglect.17.That no ship, vessel, steamboat, or craft, lying at any wharf, or in a tier, within the limits of the said Harbour shall have an anchor out, except by the advice and direction of the Harbour Master, or when in charge of a pilot, and for the im mediate purpose of bauling in,or out, or of moving the said ship or vessel to some other part of the harbour : and the master or person in charge of such ship or vessel > who shall neglect the above or refuse to obey the Harbour Master in this respect, shall incur a penalty not exceeding ten pounds currency for every such refusal, besides paying all damages that may be caused thereby.18.That all ships or vessels lying at the wharves within the harbour, shall have their yards topped up.booms and out-riggers rigged in, the jib-boom not to be more than three feet without the cap, spritsail yard to be laid fore and aft, and anchor secured, so as to avuid doing damage to other ships or vessels ; the master or commander of any ship or vessel, who shall neglect or refuse the same, or to obey the Harbour Master in this respect, shall incur a pen - alty not exceeding ten pounds currency.19.\u2018That any master or commander of any ship or vessel, or any person whatsoever, boiling or heating tar.pitch, turpentine, rosin, or grease, or causing the same to be boiled or heated for the graving or breaminz vessels or any other purpose, at a less distance than twenty feet from all ships, or vessels, or buildings, shall, for each: offence, incur a penalty of not more than ten pounds currency, and the like penalty, if a proper person does not attend the pot or kettl +, while heating or boiling, prepared with a shovel and a sufficient cover for instantly extinguish - ing Lie same in case the combustible matter takes fire, and for putting out completely the original fire, when the \u2018purpose tor which it is k-ndled is accomplished ; and in all cases when a ship or Z0.Ihatall mastersor jersons in charge of vessels lying within the linuts of the harbour.may have fire for cooking their provisions, on board their respective vessels trom sunrise to sundown only, and at no other time, on the deck of such vessels, provided that such fire be made in one or more ciose cabooses of iron or metal, or of brick or stone ; and the master or persons in charge of decked vessels may also have a fire in a stove under deck, of metal, brick, or stone, that can be closely shut up and easily attended to ; and each and every offender against any part of this article will be iiable to a fine not exceeding ten pounds currency, without waiver of any claim for damages that may thereby acerue ; it being nevertheless provided that nothing herein contained shall extend to prevent steamboat proprietors, within the said ha-bour, from making the necessary fires for the purpose of generating steam, zl.That the master of any vessel or the person having carge of the same, lying alongside of any of the wharves or adjoining to any other vessel, shall cause her hatchways lo be securely and completely covered over with hatches or gratings, imme.liately after the work of loading or discharg- Ing, as the case may be, shall Le finished for the day, until the time when the work may commence in the morning undera penalty not exceeding ten pounds currency, ' 22 \u2018That any master or person in charge of any ship vessel, steamboat.or river craft, or other person whatsoever, who shall throw into any navigable part of the said harbour any ballast or other thing whatsoever, by which the harbour may be injured or the navigation impeded or rendered diflicuit or dangerous, shall incur a penalty not exceeding ten pounds currency for every such offence, and any person sv offending, who being thereunto required by the Harbour Master, shall neglect or refuse to remove or cause to be removed, such obstruction, for the space of forty -eight hours, sha.l incur a further penalty, not exceeding ten pounds currency for each ad every such ueglect or refusal, 23.Thatall ships or vessels arriving in the said harbour with coals or in ballast, may discharge their coa's or ballast upon any otf the wharves (o which they may be secured subject, however, to be removed by the person in charge of such ship or vessel, within twenty.fours hours, under a penalty not exceeding ten pouuds currency.24.That all ships or vessels discharging coals or hallast whether on the wharves or into lighters, shall have a good tight stage or spout.in order to prevent such ballast er coals trom falling into the water, and all persons having charge of such ships or vessels, who shall neglect the same or refuse to obey the directions of the Harbour Master in this respect, shall incur a penalty not exceeding ten pounds tor each and every refusal.25.That no cargo, nor part of any cargo landed from any ship.vessel, steamboat, or river craft, shall be allowed to remain on any of the wharves in the harbour, longer than twenty four hours after being landed, and the proprietor of such goods or the agent of such proprietor, who being thereunto required by the Harbour Master; shall negiect or refuse to remove or cause to be removed, such gouds, shall incur a penalty not exceeding ten pounds currency, and a further penaity not exceeding ten pounds currency for every day during which he shall neglect or retuse to comp.y with the orders and directions of the (Harbour Master in the premises.26.lhat no persou shall place, lay or pile upon any of the wharves in the harbour, any timber, water casks, boats, canoes, firewood, coals, boards, planks, masts and staves, or any other article, under a penalty not exceeding ten pounds currency, and every such person shall remove the same at his expense, as soon as ordered to do so by the Harbour Master, and it such order shall not be npeved within the space of four hours, such person fur such disobedience, shall incur a penalty not exceeding teu pounds currency, and a like pevalty for every four hours thereafter, until such articles above enumerated shall be removed, and in case the proprietor or agent of such wood.water casks, boats, fire-wood, coals, or other articles, should not be fo.nd, or should retuse to give his name, the Harbour Master is hereby authorized to seize, detain, and keep the same in his possession during the space of twenty.four hours, and if after thie expiration of that time, tue proprietor or agent of the articles abuve mentioned, shonl t not present bimselt, or should again refuse to give lis name, in that case the said woou, water casks.boats, ise wood, coals, or other articles, shall by the said Harbour 470 THE QUELEC GAZGATTR Master, be sold and adjudged on the spot to the highest bidder, notice being however given the day preceeding, by the public crier and by the sound of the bell, on the markets and other public places, and also at the spot where the said articies shall lave been seized ; and the proceeds of the sale shall be immediately paid by the purchaser, to the Harbour Master, and in defalt of immediate payment, the said articles so scized, shall be re-sold and re adjudged and the judgment made as above, the proceeds ot which atter deducting the costs and fine incurred by th: se presents, shall.ty the Harbour Master be paid into the hands ot the Registrar of the I'ripity House, who is authorized to keep the amount during the space of three munths, to be by him paid over to the Proprietor or Propriet rs, should he or they in the interval present themselves, and on producing an affidavit given before a Justice of thie Peace, stating that at the time the articles were so seized and sold, he or they were the bond fide proprietors thercof ; and if during the above period the proceeds of the articles so sold are not claimed, the amount shall be then given over to the | reasurer of the Corporation of the \"lrinity House, to be appropriated according to law.27.That if any floating light, light house, buoy, beacon, or other mark placed or to be placed in any part of the Port of Moutreal, or on the land, within the jurisdiction and under the authority of the Corporation, shall be by accident removed, carried away or destroyed by any ship, steamboat, river craft, or any other vessel, or by any vehicle whatsoever, the master or person in charge of such vessel or vehicle, shall within forty-eight hours replace the same, at his her, or their proper cost and charges, and in defanit thereof, shall incur a penalty not exceeding ten pounds currercy, without affecting any claim for damages which the Corporation or any other person may have upon him, her or them, by reason of such removal or carrying away, ¢8.That the master or person in charge of ashipor square-rigged vessel, not being a lighter, river craft o1 steamboat, navigating the River St.Lawrence, within the jurisdiction of this Corporation, and mot having on board any Branch Pilot, shall keep a Union suck flying at the fore-topmast head, from daylight to dark, and until a Branch Pilct be obtained, under a penalty not exceeding ten pounds currency, and if the master or other oiticerin charge of such ship or vessel, hall refuse to take a branch Pilot as soon as he may offer, he shall forfeit the like penalty.i 29.\u201cI'hat all firewood that may be landed on any of the wharves of this harbour, slall be carted and conveyed away, by the proprietor or agent thereof, as fast as the same shall be landed from any vessel, bringing the same to the said harbour, under a penalty not exceeding ten pounds currency for every contravention of the reguiation ; and in case the proprietorof the said firewood being not known or if he should refuse to give his name, then tue said five- wood may be seized in the manner provided in the twenty-sixth article above.30.\u2018That all cribs, boards, planks, oars, staves, firewood, or any other lumber.landed on any part of the beach of the said harbour, below the wharves, shail not on any account be piled up, but shall be carted away within forty- cight hours atter they shall be so &c.shall be scized and sold in the manner prescribed in the twenty-sixth article above.31.\u2018That all raits, or cribs arriving in the harbour loaded with boards, planks, firewocd, or other description of lumber, shall be entitled to their births in the crder in which they arrive, and shall only be permi.ted to remain in the same during tive working days aiter such arrival without lend or in any manner dispossess himself of his brauch to any person, on any account whatever, under a penalty not exceeding ten pounds currency.That no Pilot shall tuke charge of any ship or vessel as a Pilot, otherwise than as his branch empowers him, under a penalty not exceeding ten pounds currency.35.That no Pilot shall refuse or disobey any summons of this Corporation, requiring his attendance, under a penalty not exceeding ten pounds currency.36.hat every Pilot then in Montreal, and not engaged tu pilot any vessel from theuce, who shall receive an order trom the Harbour Master of Montreal, or from the Master, Deputy Master, or any Wardens of this Corporation, direc- ing him to repair on board and take charge of any ship or vessl requiring a l'ilot, shall repair on board and take charge of such ship or vessel so requiring a Pilot, and shall continue such charge according to the tenor of such order, under a penalty not exceeding ten pounds currency.37.That when any Pilot shall receive any order, signed by the Master, Deputy Master, or Registrar of the Corporation, to conduct any of His Majesty's ship, or ships of any demomination in His Majesty\u2019s service, or in the Provincial service, he shall repair on board of her, and take charge of her and continue such charge raccording to the tenor of the said order, under a penalty not exceeding ten pounds currency.88.That wben any Pilot shall have gone on board, or shall have agreed with the owner or commander of any other ship or vessel, not on His Majesty's or in the Provincial service, or with any agent on behalf of such ow:.er and commander, to take charge of such ship as a Pilot, he shall go on board or continue on board, as the case may be, such ship or vessel, to take charge of her, and continue such charge according to his engagement, subject nevertheless to such orders as he shall receive from, the Corporation, for His Majesty's or the Provincial service, under a penalty not exceeding ten pounds currency, 39.That every Filot who engages to pilot any ship or vessel from the Harbour of Montreal to Quebec, or to any intermediate place, shall give notice thereof, personally or in writing, to the Registrar of the Corporation, or, in his absence, to the Harbour Master, before his \u2018departure, and a like notice on his arrival in Montreal, after having piloted any ship or vessel bound upwards, under a penalty not exceeding ten pounds.40.That any Pilot who shall have taken charge of any ship from Quebec to Montreal, or from Montreal to Quebec, shall remain on board the said ship for the space of torty eight hours, while such ship may be detained in harbour, for want of seamen, or any other casualty or unavoidable cause, and shall not at the end of the said period le at liberty to quit such ship, provided the sum of five shillings currency per day be paid to him for such further detention, over and above his pilotage, under a penalty not exceeding ten pounds currency.41, That a Pilot shall in all cases behave himself civilly, and be strictly temperate and sober in the exercise of his oflice, and shail use his utmost care and di.igence for the sate conduct of every ship or vessel (whether in tow of a steamboat or not) while under his charge, and shall also be careful that such ship or vessel does no damage to others, under a penalty not exceeding ten pounds currency.42.That every Pilot luving charge of a ship or vessel navigating the rivers within the jurisdiction of this Corporation.and seeing any other vessel approaching shoals or any other cause of danger, shall immediately inform the othcer commanding tlie vessel under his charge of the same, under a penalty not exceeding ten pounds currency.43 lhat every Pilot who observes any alterations insand banks or channels, or that any bucys, beacons or floating lights are driven away, broken down, or out ¢f place.shall forthwith give nctice thereof,eitl.er personally or i.writing to the Registrar of the Corporation, under a penalty not exceeding ten pounds currency.44.That no l'ilot in charge of any ship or vessel pilot- ted by him into the Harbourof Montreal, shall be held or bound to remain on board after the expiration of forty- cight hours from the time at which such vessel shall have arrived in the stream opposite the said tiarbour, or suc vessel be secured within the said furiy-ciglit hours alo: g- side of any whart thereof, under a penaity not exceeding ten pounds currency, for leaving the said ship or vessel at an carlier period, unless discharged by a writing to that effect trom the captain, owier, or person in charge ot such ship or vessel 45.\u2018hat any Pilot who shail demand or receive any higher or greater sun for the piiotage of uny :hip or vessel than is by raw a:lowed, shall incur a penaity not exceeding ten pounds currency tor each aud every onence, ana shail further refund to the person or persons, the fail aud entire amount of the sum, which such Pilot shail have received for such pilotage over aud above tie sum allowed tiereter by law, 46.That every Pilot who shall be employed to remove any vessel from one wharf to another, within the liuits of the Haroour, shall for such service be entitled to dzimand and receive the sum ot twelve shillings and sixpeunce currency ; and it fiom any of the wharves aforesaid to the ** Cross\u201d\u201d or \u2018\u201c fout vf the current,\u201d the sum of one pound five shillings currency.47.\u2018That any Pilot or apprentice found aiding or assisting in secreting any seaman or apprentice legally bound to any ship or ship master, or facilitating in any way the desettion of any seaman or apprentice legally tound to any ship or ship master, from his vessel, shall incur a penalty not exceed ng ten pounds currency.4%.\u2018That no waster or other person having charge of any ship or vessel, at anchor within any part ol the jurisdiction of this Corporation, shall so anchor his ship or vessel as to prevent a free and uninterrupted passage for ull other ships or vessels, and also a free and safe access to any wharf at which such ships or vessels are accustomed to stop, under a penalty not exceeding ten pounds currency.49.That every Captain or officer in charge cf any ship or vessel, on being notitied by the Pilot oa beard, that an othier ship or vessel then in sight, is approaching any siioal or any other cause of danger, who shall refuse or neglect immediately to make the necessary signals to the saiu vessel, shall incu a penalty of not less than ten pounds currency.50, That every steamboat resorting to any of the wharves in the Harbour of Montreal, shail be provided with a good and suflicient gangway for the use of persons going and coming from on board such steamboat ; and on dark nights, a light shall be placed in the said bout near the gangway, s0 that the same may be seen clearly from the whart and boat, under a penalty against the master, or person having charge of such boat tor neglect of this regulation, not exceeding ten pounds currency.51.That any person or persons that shall in future be convicted of having laid, placed, piled or deposited any stone, dirt, rubbish, snow, ice or other matter whatsoever, upon the revetment wallor upon any part of the wharves or beach opposite the harbour, or upon the ice in the winter, above a line of pickets or branches, (balises) to be placed by the Harbour Master on the ice, on a line with the Lane commonly called Walker's Lane, and below such Lane, outside of picketsor branches, (balises) to be placed by the Harbour Master at such distance from the wharves or beach as the I'rinity Board may deem necessary, shall incur a penalty not exceeding ten pounds currency, and further, persons so convicted shall remove all such snow, ice, filth, rubbish, &c.in twenty-four hours, and in default thereof shall incur a like penalty for every twenty-four hours, till such snow, ice, filth, rubbish, &c.is removed, 52.That each and every time that any person shall cone travene the preceding Regulation, or shall refuse to give bis name, or the name of the proprietor of the carriage and horse or horses, by the means of which the etfects before named,have beeu transported and depusited at the place meu- tioned in the foregoing article, tbe Harbour Master is here- Avavusr 31 Te) by authorized to seize and arrest on the spot, and keep in bis possession, the said horse or horses and carriages, until the name of the driver or proprietor of the same shall be known, and the fine imposed fur contravention to the preceding article shall have been paid, as well the costs of prosecution, seizing and keeping in possession.53.That any person canying away, destroyiog, or injuring any of the pickets or branches to be annually placed upon the ice for the purpase of desigunting the limits beyond which all snow and ice are to be deposited, shall incur a penalty not exceeding ten pounds currency, and shall within twenty-four bours at his own proper cost, replace the same, or iu default thereof, be subject to another penalty not exceeding ten ponnds currency.54.That po vessels or craft, (except steamboats with wood on board for their use.) loaded in whole or in part with firewood, tanner\u2019s bark, hay or straw, be permitted, without the special leave of the Trinity Baard, 10 come to the jetty below the inner basing or to any part of the wharves or beach above, including the wharf at the outlet of the canal commonly called Cringan\u2019s Wharf, under penalty against the owuer or person in charge, on conviction, not exceeding ten pounds currency, aud further, a like penalty for every twenty four hours, that such vessels shall remain within such limits, after being ordered by the Harbour Master to remove therefrom.55.That no vessels or craft with oysters in bulk on board, be permitted, on auy pretence whatever, to come within the inver basin, or to or above the islaud cross wharf, but shall take births on the outside of the island wharf, under a peu- alty against the owuer or person in charge, on conviction, pot exceeding ten pounds currency, nud further, be liable to alike penalty for every twenty-four hours that
