MONDAY, JUNE 8, 1840.SUPLLEMENW À LA Gasette De Quebec, PUBLIE'E PAR AUTORITE\u2019.LUNDI, JUIN 8, 1840.THE QUEBEC GAZETTE.PUBLIC NOTICE.PF WHE following Draughts of Ordinances, about to be sub- 4 mitted by His EXCELLENCY THE GOVERNOR GENERAL, for the concurrence of the Special Council, at a session thereof summoned to meet at the Government House, in the City of Montreal, on the TWENTIETH day of APRIL last, and adjourned from the thirteenth to the twenty eighth day of May, instant, are published in conformity with the 5th Section of the Act of the Imperial Parliament, 2d.and 3d.Victoria, Chapter 53.By Command, T.W.C.MURDOCH, Chief Secretary, Government House, Montreal, 26th May, 1840.Draught of An Ordinance to provide for the better prevention of accidents by the storing or keeping of Gunpowder within or near the City of Montreal.HEREAS in and by a certain Ordinance of the Captain General and Governor in Chief, of this Province and of the Legislative Council thereof,fpassedin the seventeenth year of the reign of His Majesty King George the third, and intituled, An | ¢ Ordinance for preventing accidents by fire,\u201d it is among other | things in effect enacted, that it shall be unlawful for any person in the City or Town of Montreal, or the Suburbs thereof, to keep or have at any time more than twenty five pounds of gunpowder in his house or lodging, orin any outhouse thereunto belonging, under certain penalties in the saidO rdinance mentioned ; and whereas by a certain Act of the Legislature of this Province, passed in the thirty third year of the same reign, intituled, * An ¢ Act to prevent the bringing of Gunpowder in ships or other \u201c vessels into the Harbour of Montreal, and to guard against the \u201c careless transporting of the same into the Powder Magazines,\u201d divers enactments and regulations are made with regard to the transport and storing of gunpowder within the said City of Montreal; and whereas the provisions so made in the said Act and Ordinance, or by any other law in force in this Province, have been found insufficient, and for the safety and security of the lives and property of Her Majesty\u2019s subjects in the said City and the neighbourhood thereof, and by reason of the great danger in which they might otherwise be placed, it is expedient and necessary to make further provision with regard to the storing of gunpowder in or near the said City; Be it therefore ordained und enacted by His Excellency the Governor of this Province, of Lower Canada, by and with the advice and consent of the Special Council for the affairs of this said Province, constituted and assembled by virtue of and under the authority of An Act of the Parliament of the United Kingdom of Great Britain and Ireland, passed in the first year of the reign of Her present Majesty, in- tituled, \u201cAn Act to make temporary provision for the Govern- ¢ ment of Lower Canada,\u201d and also by virtue and under the authority of a certain other Act of the same Parliament passed in the Session held in the second and third years of the Reign of Her present Majesty, intituled.\u201cAn Act to amend \u201cAn Act of the last Session of Parliament, for mak- \u201c ing temporary Provision for the Government of Lower \u201c Canada,\u2019 and it is hereby ordained and enacted by the authority of the said Acts of Parliament, that it it shall not be lawful for any person or persons whomsoever, to have, keep or store any quantity of gunpowder, exceeding in weight one hundred pounds avoirdupoise, in any place or building of any kind whatsoever within the said city of Montreal or within one league of the boundaries thereof, except in à building or buildings constructea of stone, covered with etal, made fire proof, furnished with proper lightning rods or con- ductros and isolated and separated from any other building whatever by a clear space of at least two hundred feet on cach and every side, nor unless such building shall have been approved by the Governor, Lieutenant Governor or person administering the Government of this Province, on a report made to him in writing by such person or persons us he shall have directed to inspect the building ; such approval being signified by his signature aflixed to such report : and all gunpowder whatever, stored or kept within the limits aforesaid, contrary to the provisions of this Ordinance, at any time after the passing thereof, shall be forfeited to Her Majesty, Her Heirs and Successors, and shall be sold, and the proceeds of such sale shall be applied to the public uses of the Province; and such forfeiture and sale may, in a summary manner, be declared, adjudged and enforced, with costs to Her Majesty by any two or more Justices of the Peace for the district of Montreal, on the evidence of any one competent witness ;
