enterprise charaoteristié of the feliow-countrymen of Demosthenes, had bargained with Mr.Btiles that they, and mone but they, should have the right to suppiy the wants of such visitors to the British iZmpire ix- position and International Display of all Nations as craved for mourishment in the form of the common but not-to-be-despised peanut.Im consideration of being tnus guaranteed a monopo.y of tue peanut nar- ket within the grounds, they willingy agree to pay a thousand dollars, for wouid wot the nations of the eautli be represented at tire great fair, and would not all who came hunger and thirst for tne delectable peanut?The following doou- nient was drawn up fortivwith:— Canada’s Great Exposition.Montreal, 1896.To whom it may concern.Be it known.That I, Joseph Stiles, have granted an exclusive right to Messrs.Magna and La- prestie, 479 St.James street, for exclusive exhibit and sale of peanuts, with ten free apaces in the exposition of thirty square feet, and one large space of one hundred and fifty square feet, for the sum of one thousand dollars.(Signed) JOS.STILES, Director-General.M.Magna.Jos.Laprestie.Witness—Rodolphe Lemieux.To clinch the bargain, Messrs.Magna and Laprestie paid Mr.Stiles two hundred and fifty dollars down, and Mr.Stiles departed hence in the fulness of timenvith- out, it is said, refunding this sum.For à time the merchants of peanuts gave way to utter despair.Then a ray of hope illumined their hearts.Stiles, indeed, was .gone; but his fellow-members of the executive committee of the British Empire Exposition and International Display of all Nations were still here.Senator Ogilvie, Judge Dugas and Mr.L.À.Wilson were good, whether singly or collectively, jointly or gemerally, for two hundred and fifty dollars.These gentlemen refused, however, to accapt the responsibility of Mr.Stiles’ aets.The machinery of the law vas then put in force, and the case came vitimately for trial before Mr.Justice Tellier, who hos now decided that Messrs.Ogilvie, Nugas and Wilson Lad not been proved to heve bean partners of Stiles; they had never pa-ticipated in any profits, and could not ba held responsible for the obligations of Stiles.Judgmant accord- irgly, and now no hope is left for Messrs, Msgna and Leprestie, unless Mr.Stiles returns, which no doubt he will do when reminded of this INCOXICATES, Judge Desnoyers' Gives an Interesting Dec sion It is Practically a Reversal of Judge Dugas Decision.Beer, or any liquor, containing two per cent.alcohol is an intoxicating bevurage.Such was the decision rendered by Judge Desnoyers, in the Police Court, this morning in condemning Mary McDonald, Jean ite.Savage and Alphonse Bonneau to $150 or three months on chwmges of selling liquor without licenses.The defence maintained that the beer which defendants sold, term- od “Jubilee Beer,” was a non-intoxicating drink, amd put Mr.Fafard, a chemist, in the witness box to prove that the beverage contained only two per cent.alcohol.What lends particular interest io the decision 48 the fact that not long ago.Judge Dugas, sitting in the same court, upheld a simi/air defence and dismissed the case on the strength of Mr.Fafard’s testimony that the beer only contained two per cent, | alcohol.His Honor Judge Desmoyers based his judgmemt «un the paragraph in the Quebec License Act which holds that “Temperance liquors ave all kinds of syrups and similar liquids or beverages, simple or mixed, in which there is no intoxicating prnciple.”” that a committee of the Cabinet should gather information on the subject and ascertain whether it is possible to combine the efforts of the Government, the transportation companies and the busi- reds commumity, so as to produce the bene fits contemplated, public opinion will endorse the action.The late Government spent $120,000 on a commission patented to stave off the necessity of dealing with received by Mr.Galiery in other divisions.lt was reported that in sub-division No.1 none of the ballots büre the initials of the deputy-returning officer, but the re jection of them would only increase Mr.Gullery’s majority.The returns began to come in a few minutes after five o'clock.The first to reach The Herald office were froma sup- division in the upper part of St.Antoine Ward, where Mr.Aunes poiled 66 votes, and his opponent, Mr.Sufiivan, got none.This was the beginning, and from the receipt of that until 7.30 the crowd watcnh- ing The Herald bulletins in St.James street rapidly amcreased.At 6.30 p.m.it was known who was elected in nearly all the wards.A large crowd gathered at the City Hall, but the newspaper bulletins were mre popular, and the usual speeches in the Council chamber were declared off for the want of an audience.Ald.Stevenson’s Victory, Ald.Stevenson received the West Ward returns at his committee rooms on Notre Dame street.He was very confident of success before the polls closed, and when the returns from the first polling subdivision came in, his friends gathered around ‘and congratulated him heartily.Wihen three sub-divisions had been reported, it was seen that Mr.Thompson's deposit ‘was gome, and Mr.Mann's likewise.Ald.McBride: came in while the returns were being received, and he and this ool- league exchanged congratulations.No speech-making was indulged in.Speech by Ald.Ames.At Ald.Ames committee rooms, 2364 St.Caitherine street, there was great enthusiasm, as the early returns began to come in, giving overwhelming majorities for the popular candidate.It was soon evident that there was no doubt about his victory, but it was not till halfpast six, when there were omly four, polls to hear from, dirait he consented to make a speech.Wien he did rise, he was greeted with hearty cheering, Mr.Ames expressed his thanks to those who have been giving their voluntary services for many years in the cause of good government.Having referred to the circumstances of his nomination, he said that his great majority was a protest which would clear the decks in future cases, ana prevent the same clique which put up the opposition, doing so again.He hag ths promise of many prominent and influential] men that if he would lead the way, they would become candidates at the next election.He did not expect to bring about any great or wonderful reform in civic circles in the coming two years, but should set to work quietly to master the details of departmental business.Criticism vas to be expected, but he asked that anyone who bad any criticism to make, should write to him or see him about the matter.In the coming two years there was tne city charter to be revised, in which charter there was the opportunity for good and evil, and he wanted to have a ‘hand in it.He would be animated by an earnest and honest desire to do his duty faithfully, and should make a profession of his duties, devoting to them the bulk of his time and his best attention.i ed by young men, he would feel the representative of young men, and would do all in his power to see that the younger generation should a minority, he mounted a chair and thanked his friends, for the handsome support they had given him during the campaign.He was especially pleased at the support given to him by the working classes and this was a conculsive refutation of the slanders heaped upon him as an employer of labor.He did not intend to allow the slanderous statements niade about him to pass unnoticed, but would appeal to the courts of law to vindicate his reputation as an honest man.(Applause).- Notes.If Ald.Ouimet has not been a success as an aldermam, lre knows how to make himself solid with his ward.The great majority he had over his opponent, ex-Ald.Leclerc, was one of the features of the election.Through the failure of six candidates to get 50 per cent.of the number of votes polled for their successinl opponent, the city is $1,200 richer.The cost of the ; election, over $7.000, will be reduced by their first innings made 328 runs, and tho | ‘ that amount.The #ix who lose their deposits of $200 each ave morning, City Clerk David remarked ihat if the city held an election every three months the civic debt might be considerably reduced.Ald.Beausoleil was at the City Hall bright and early this morning.He re ceived the congratulations of many friends.City Clerk David will make the officia: declaration on Friday, and the new Council will meet on Monday, February 14th.It was the busiest election day since Villeneuve whipped McShane in the mayoralty fight.Last year there was little or no interest; this year there was a great deal.An interesting feature of the fight wu the fact that those candidates who said, “I am willing; if the people want me, let them vote for me; I will not go and ask them,” are the very ones who worked the hardest.Mr.Mann, in West Ward, is a good sample.He and his friends left no stone unturned to defeat Ald.MoBr:de.The battle-cry in St.Jean Baptiste was “Grothe for chairman of the Police Committee, defeat him and the ward loses a dhairmanship.” The cry did not bear good fruit.“It doesn’t seem like an election without Jimmy McShane in it,” said a St.Anne’ voter.And othems thought the same.“Don’t.mention my name said a candidate to ;a Herald reporter, “bul some of my friends have got a brass band.The band doesn’t know who it is playing for.If [ win they are to band marched through St.Lanvrence playing ‘“Massa's in the Cold, Cold Ground.” There was not a great deal of betting, but what there was, was chiefly as follows: Even on Cochrane and.Clearthue.Ten to exht on Ekers.Four to one on Ames.Five to four on Beausoleil.Five to four on Brunet.Even on MeBride and Mann.Six to five on Stevenson.“My bill for cabs,” said a master lenneuve, Desjardins fights.Ald.Stevenson has been warmly congratulated by hosts of admirers.Some people thought the fight would be as dlose as that of "93, when the Colonel defeated the late Mr.George Waite by only half a tlozen votes.Four hundred and ninety- seven out of a toltal of 644 votes cast is, hewever, a pretty good showing." Ald.Connaughton has quite decided on asking for a recount.An announced majority of fifty-two seems to pretty nearly settle the matter, however.Ald.Grothe is probably the most disappointed man of the many contestants.His four brothevs worked night and day to elect him, and one of them remarked: — “We will drive Roy so far that he will never oppose my brother again.” Before the elzetion Aïd.-elest Gallery said:-—“I have been organizing for two years, and I shall] win.” Ald.Beausoleil’s friends are very indignant ait the published reports that polities hore a part in the Bast Ward fight.- They say there is absolutely no truth in the statements; that it was a municipal fight, pure and simple.A St.Lawrence voter was entered on the list in some unaccountable manner as “City Auditor.” It was some time be- fcre he could persuade the returning officer that he was not one of “those fellows,” and that he had a right to vote.Ald.-elect Paquette said to his friends: — “In English they say; ‘If at first you don’t succeed, try again.It is just as good in ‘ French.You see, I win after the third tight.” ; There was wild rejoicing in St.Louis (No.1) last night, and it was ns: among the followers of Mr.Roy or Mr.Couture, At 2 in the morning small crowds were : favorable location of the block.still shouting “Paquette.” If Ald.Connaughton meant what hey said, and carried out his intention, he hais no one to blame for ‘his defeat but himself.Two weeks before his election he said to a Herald reporter:—“I am not going to work or say anything in favor of my election.If the ward wants me, it must vote for me.That’s all.” With very few exceptions the results are as the most people predicted.This, of course, is quite natural, seeing that the people had the power to elect whom they liked.The Herald led its contemporaries in the matter of builetining the returns of the elections by fully twenty minutes.Great crowds gathered at the office and cheered as the news of their favorites’ success Was posted up.Ex-Ald: Thompgeôn’s friends think he would have made a better fight in St.Gabriel Ward, the ward he formerly represented.cere Despite defeat, the band of workers who | endeavored to place Dr.Stanley Weir at the head of the poll in St.Lawrence Ward, indulged in some speechmaking be- | fcre going home.RAA, Harper said , wf > 5 PF |! White; Alfred Dupuis that Mr, Weir had been brought out by the best elements in the ward.The fight for thim was on beha.r of principles which 1t wus their duty to champion, and he had the satisfaction oË feeling that, although bexten, they were in the right.Mr.Weir echoed the sentiments expiessed by Mr.Harper, and said his chief regret was for the men who had worked energetically on his behalf.He wowd return to his daily avocations with the sense that the had done his duty by the ward.Several of Mr.Weir's supporters expressed the opinion that if their man had been in the field as early as the other candidates lie would have been successful.POLL 29 TACTICS.Returning Officer Acted as Though He Wished to Hurt Mr.Ames.Editor of The Herald: Sir,—As a citizen and a voter, I must protest against the ciass of men appointed as Returning Officers and the scandalous treatment we are subjected to.At poll 29, corner of Bishop and St.Catherine streets, we were each detained from ten to fifteen minutes outside, which in the face of such a storm as was then raging is an outrage and disgrace.And the galling part of it is that the Returning Officer was to blame and acted as if he were attempting to disgust voters for Mr.Ames | by wasting the time of the person inside the poll until those wditing outeide were half frozen.And fancy a Returning Officer putting the question, “Do you object to this gentleman voting?” I think such a man is not fit to hold any such position over his fellow citizens.And men who were well known were sworn.Such tactics are contemptible and only resorted to by mean, low creatures, Why not get the City Hall employees to act?And if some other method cannot be devised in this 19th century than to keep people waiting in the street; hold the elections in summer.But, in any case, partisan returning officers are gentry that the voters of Poll 29 will resent every time, and the majority for Mr.Ames ought to prove an object lesson to those who cannot fight fairly, but resort to all sorts of questionable methods.JOHN MeD.HAINS.Ta Elecors of St.Lawrence ward and Friends: Allow me to return my sincere thamks for yor efforts on my behalf, and I assure all that my endeavors while a member of the City Council will be such as to hone for a continuation of that friendship.To those who sw kindly volunteered their services and furnished vehicles on the polling day, all I can say is that their kindness and interest on my behalf will not be fcrgotten, Yours, vtry truly, H.A.EKERS.THE WINNIPEG FIRE See also page one, The Building.The McIntyre Block was the.hub of the business district af Winnipeg.It was a very handsome building, but on account ci the great width of Main street, did not appear high.Its tenants were in all walks oi life.A number of Montreal houses carried full lines of samples in offices in the building.The Mock was built over ten years ago by Alex.Melntyre, one of Winnipeg's pioneers, wha commenced as a lgivor dealer, and amassed a large fortune.His widow is now the sole owner of the pro- rerty.The interior of the building wus not as modern as an office building, and it was often prophesied that if ever a fire : broke out nathing would save the building.For this reason attempts to have Indgers in the other flats werle unsuccessful.However, every store and office has been leased for years on account of the The McIntyre Block was the largest business black in western Canada.THE “TELEGRAPHING” CASES.There were four names down on the Recorder’s list this morning of men who had been arrested for impersonating at the polls yesterday, Tut in only one did the prosecutors appeaf.In this case, Godfrou Bennett, agent, Ste.Cunegonde, who is charged with impersonating J oseph Lang lois and Joseph Boyer at Poll 46, St.Antoine division, the prisoner was remanded.He was arrested by Constables Hackett and Ferguson.The other acoused, who were let LH on bail, were Andreas Brouillette, laborer Iberville street, reported by L Landry and arrested by Special Constable J., Berri stret, report- RECEONOROEONS ed by E.Lebel, and arrested by Special and Joseph Cantin, reported by B.Bour- Special Constable La- ‘ Constable B.Lemay, carter, Wolfe street, goin, and arrested by franchise.GONE TO THE JURY, St.Saholastique, Feb.2.—(Special.)— | The Poirier murder cage has been ven io.‘the jury.—— The Convent of St.Jean d Matha, recently purchased a Pratte ane po po use of its advanced pupils.no *® 3 i$ If There is upwards.RCCCCCEKCECCEECEEEE | OR In this world outside a disagreeable mother-in-law that will make a map wish he had never been born, it is ap ill-fitting shirt, Our shirts fit, $100 Anything, es à MUNROE BROS.= - .& as \\s3223333233332233323235 — 2246 St.Catherine Stree BA TE D 23 SA PP > >> >> t o # \\ Ze.a= J cé BIRTHS, DEATHS ~~ and MARRIAGES.BIRTH iis : the {ERR—At 411 Bourgeois Street, on he Rt of January, the wife of H.S.Kerr, of a son.9.30 JOLDENSTEIN—On February 1st, at 2.20 6 no a son to Mr.and Mis, I, 8.Golden stein, of 93 Durocher Street.LAPRAIRIT—At 170 Grand Trunk Street, on January 29th, 1898, the wife of R.LaPraitle, of a son.‘ BERNARD )n Friday, January 28th, the wife of L, E, Bernard;
