afternoon, Mr.J.P.Cooke, counsel for the accused man Charles Kernick, moved to have the case withdrawn from the jury, on the ground that no crime had been proved against his client, but Judge Tren- holme replied that he did not see cause to interrupt the evidence, and ordered the defence to proceed.Læeocadie Legault, wife of accused, was then called to the stand, and evidently suffering much Mitchell remaining on Ma- dore Island, and at day break they.saw him standing there.Mitchell asked them to come and take him.across, but' on being told (Mrs.Girard had gone off with the boat, he waded over and had some refreshinents and breakfast.\u2019 After breakfast here husband went to sleep and Mitchell and herself crossed to Madore to look for a boat.They subsequently separated, each going In .opposite \u2018directions with the intention of meeting in thelr search along the shore, for a rowboat.Before parting, Mitchell sald that in the \u2018event of their being unsuccessful, he would swim to Dowker, and on approaching the point at which it had been arranged, to meet, she saw him In the water on the way to that island.Just after she sighted him, Mitchell threw up his hands and disappeared.ATTRACTED MAN IN BOAT.On resuming her evidence this morn- Ing, Mrs.Kernick, in reply to Mr.- Cooke, sald she afterwards attracted the attention of Johh Beauvais, who was in a boat.He came to Madore Island, and she told him they had no boat to get off, and wished to go to Pointe Claire.She Informed him about Mitchell, and that he had been drown- èd *while- swimminz from Madore to Dowker, and showed Beauvais and a boy in the boat along with him the spot where the deceased had gone out of sight.Witness explained to those in the boat that her husband was asleep on Ile Ronde when she left along with Mitchell to look for a boat.They tried to find the body, but were not successful.Beauvais afterwards row-, ed to Ile Ronde to her husband, who gave her some money to go to Ste.\u2018Anne\u2019s for a boat, he remaining on the island to watch the baggage until her return.\u2018 Beauvais returned to the island about the same time, shortly after which two riving at Pointe Claire about half-past four or five o'clock.After reaching home she informed Mitchell's nephew of the circumstances attending the drowning of his uncle, adding that she had advised Mitchell not to attempt to swim if he did not feel able for it, as they had sufficient food for several days.Witness denied telling young Mitchell that she at first thought the head she saw in the water was that of her husband.She saw her sister in the evening at Pointe Claire.Her sister remained over night with them and they talked of the drowning, her husband remarking there would be an inquest.Her husband further sald he could not yet believe Mitchell was dead, and would not until he saw the body.Nothing else was sald further than that if they were witnesses each would tell what they saw.EVIDENCE CONTRADICTORY.Her husband did not say that the three must tell the same story, nor did he, as was alleged, s\\y he looked like getting in a hole, but that if he had to go to the scaffold his legs would not tremble.: .Brought back to the occurrences of the Friday morning, witness testified that Mitchell took qff his stockings and put them into his pocket, and also took off his coat.which witness brought to Pointe Claire along with the other things.On her oath .he affirmed that her husband did nothing to Mitchell at any time while they were on the island, and that they were on the best of terms all the time.DID NOT GO INTO THE BUSH.By Mr.Guerin\u2014Deceased and her husband were drunk before leaving on the picnic, but could walk and knew what they were doing.She did not leave the cooking at any time to go into the bush.The cooking took more than two hours.Mitchell was away by himself nearly all of that time, witness remaining by the fire.On his return he made no remark as to why he had gone away.She positively denied having gone into the bush.Her husband did not swear at her, neither was \u2018there any feeling of jealousy towards Mitchell.\u201c She had seen no mark on Mitchell's neck, and if anyone struck him, or he fell and hurt himself, it was after she parted with him on Madore when they went to look for a boat.He was then in good health and with no injury.At the time her sister left the island she said nothing to witness about going.although at the time she was only about thirty feet from the fire.\u201cMY HANDS ARE CLEAN.\u201d In \u2018the course of his testimony today, Napoleon Parent, who rowed Mrs.Girard to Pointe Claire after she had drifted from Ile Ronde, said Kernick\u2019s words to him on arrival were, \u201cWell, I don't give a damn; my hands are clean anyway; that did not prevent me from sleeping last night.\u201d Crown Prosecutor Guerin intimated.yesterday afternoon that John Beau- vals, one of the Crown witnesses, had not been found, and .that it was stated he had gone to the United States.This witnese is alleged to have seen the Kernicks at the island after the departure of Mrs.Girard, and Mr.Cooke made.a motion for his appearance in other men arrived on the scene.Her husband and herself rowed home, ar- court, which was taken on reserve.WHOLESALE KIDNAPPING IS TOLD TO THE POLICE A sensational stoy was told by Mr.Napoleon Bigras, of 1762 St.\u2018Hubert Street, Boulevard St.Denis, to the authorities of the Recorder's Court this afternoon.\", Mr.Bigras entered the office of the Recorder's Court in a very excited state and informed the clerk in charge that twelve children, belonging to Boulevard St.Denis had mysteriously disappeared on Wednesday last and had not been seen or heard of since.The parents of the children feard that thy had been kidnapped, according to his statement.His own son, Joseph Bigras, eleven years of age, is oné of issing twelve.the appears that the children attended the Boulevard St.Denis School as usual on Wednesday, and at four o'clock \u2018were dismissed and started for their homes.That was the last either the teacher or their parents saw »f them.Among the he had become a director of the Equitable Soclety in the latter part of 1893 or the first part of 1894.His firm had had dealings with the -society for a quarter of a century prior to that \u2018time.- The question of the propriety \u2018of the firm of Kuhn, Loeb & Co., dealing with the Equitable Society, occurred to him and he took counsel upon the matter and was advised that there was nothing to
