GAS FIGHT.ARGUMENT IN THE INJUNCTION TINUED THIS MORNING.The argument in the injunction case cf the Montreal Gas Co.vs.th& Consumors’ Gas Co, was continued before Judge De- lorimier, this morning, when Mr.J.N.Greenshields followed Mr.Geoffrion on behalf of the defence.Speaking on the merits of the case, he argiued that the cou- tract between the cliy and the Montreal Gas Co.contained no provision conferring an exclusive right to supply the citizens and the amendment made in the terms of said contract when the resoluticn granting it was passed, clearly showed that the Council did not want to glve suoh exciu- sive privileges. The court was now ask- oi to create a monopoly by mere inference from the terms of the contraot, while in reality such inf-rence should rather be in favor of the defemdant, since the permission to lay pipes muat necessarily imply permission to use them for the purpose for which they were laid.If it had CASE CON- ipaiie ra demi to.Unitus time when they should commence to furnish gas, it would have been stipulated in as many words, but nothing appeared to that effect. The date of May, 1895, mentioned in the Consumers’ contract was simply a time limit beyond which the company could not go before commencing to furnish gas.On the whole an injunction could not be asked on the strength of mere inference.Mr.Greenshields concluded by arguing that his clients were in legal possession of the rights of the St.Henri Light & Power Co., and that their charter allowed them to furnish gas. This, coupled with the city's permission to lay pipes, renderel their position perfectly legal.CIVIC EXPROPRIATIONS.OF:ERS OF PRUPRIETURS TO BE ACCEPTED.At the Council mesting to-morrow the Finsnce Conumittee will recommend ac- coprance of the offers of six for this fast and popular steamor. It 1s two hours and twenty minutes earlier than her fastest trip of last year, when she made a record of seven days and thirteen minutes, from Moville to Quebec.Barring accidents she should reach Quebec to-morrow about two o'clock and Montreal at noon on Saturday. As the record counts from Moville to Quebec it cannot yet be stated that the old record will be wiped out, but with two hours and a half to spare at Heath Point, there is no reason to doubt that the present trip of the ‘Labrador ’ will prove the fastest yet.The following !x the THE STRIKE.IT WAS A FAILURE, NIE MAYBE, AND TEACHES A VALUABLE OBJKCT LESSON.Chicago, Ill, Aug.2.— Mr.Eugene V.Debs arrived here from Terre Haute to-! day.He returned to Chicago to preside at a convention of the A.R.U., which will be held to-morrow, at Uhlich Hall, to decide whether the railway strike will bo officially declared off, or, if it be continued, to formulate a new plan of operation. If the delegates think as Mr.Debs does to-day, and there is little doubt but that they will defer to his judgment, to-morrow’s convention will probably con- cluae that there is nothing to be gained in continuing a strike in which they are beaten.I will never again have any official connectior with a strike,’ said Mr.Debs to-day, and in what followed he admitted, lor the.firet time, that the American Railway Union strike had resulted tn failure.‘The organized elements of soclety are opposed to strikes,” he continued, ‘and so long as strikes are repugnant to society, it is useless to inaugurate them.We might start it now and organize a strike on a more extensive plan, but it would end inevitably as this one has.We had the rallway managers whipped—everyono knows that— until they tied our hands with injunctions and brought out the troops.Gen.Miles came here for the express purpose of beating the strikers, not to preserve order. He immediately went into consultation with the managers. He did not try to get our side of the question, and two days later he announced triumphantly that he had broken the back-bone of the strike.Under these circumstances it is vain to hope that anything can be done by striking. We must vote out of office those men who seem to think labor ts entirely wrong and capital always in the right, when there is a dispute between the two interests. The strike hae served a good purpose in that it has been an object lesson to everyone.I do not say that the American Railway Urn- ion will become a political organization, but I think there will be an awakening of organized labor to the necessity for unified action at the polls.’ ape CHIEF MALOBACH SURRENDERS.Pretoria, Transvaal, (Ansonia (Ct.) Corr.‘New York ‘Sun.’) The long dry spell has had a very bad effect on the huckleberry crop, and, where in most sections, hundreds of busb- els have been gathered, this year there are but a few quarts. The berries have dried up on the bushes and the shrubs have turned brown as though by fire.Once in a while a particularly sheltered spot will be found where the berries arc ripe and full of juice, but it doesn't do any good for pickers to go after them, as they find them pre-empted by the bees and wasps.Mr.F.O.Hills went out on Newfield Hill.to pick berries and had a novel experience. He found a place where the ground was moist and the berries wero large and seemed almost bursting with juice. His surprise when he stopped to pick the fruit was great, and his flight was greater. The first handful consisted not of berries, but of bees.He looked at them, and immediately drew in his breath and held it, for it is an old Connecticut saying that if you draw in your breath when handling bees they can't poison you with their sting. The bees offered no harm to Mr.Hills and he threw them away. Then he reached over to the other side of the bush and picked off another handful of bees, wasps and hornets. They were all alive and all moving, but it is a fact that they were 80 drunk on buckleberry Juice that they could not sting, or, at least, would not.Mr.Hills, who is something of an investigator, gathered a lot of the insects and had some fun with them.He tormented them, set them on each other, and tried to make them sting, but they were so riotously happy under the influence of tho berry juice that they merely sat on their tails and leered at him with a drunken grin, and refused to fight.Mr.Hills brought several bees and wasps homo with him to see how long their berry exaltation would last, but they flew away during an interval of the watch, so an interesting fact in natural history could not be ascertalned.k ANOTHER SOUTHERN REBELLION.New York, Aug.2.-A Colon, Colombia, special says Chief C'iarence, of the Mosquito Indians, claims he has no fear of the Nicaraguan troops sent to attack him.He has sent out men to awalt them in ambush.Clarence explains that the reason ho was driven out of here first was because the British cousui, who had in- This great influence over the Jarngdcaus, duced them to abandon the natives.the Jamaicans did vitheut warning.12av- | ing some most important points under their charge undefended, thus allowing General Cabezas to surprise the natives, take their posttions on the bluff and turn tholr cannons agalnst them.Tint theo natlves re-organized, and, with the aid of a few foreigners as officers, sneadils re-took posession, receiving accessions from the best of the Jamaicans.(Chief Clarence says he has fortified the binfi. An epidemic of disease prevails and even if the Nicaraguans reach Blufilelds, they are likely, he thinks, to die off like flies.ree MORE ONTARIO ELECTION PROTESTS Toronto, Aug.2.—-Six more election pro- AT-! Bonaven- The Rev.Dr.Hunter, : Stewart, Jas.Wm.John .DEBS AND STRIKES.| leaders before him, to the conclusion that strikes are bound to fall because the organized elements of co- ciety are against them.He asserts that General Miles did not go to Chi- the strike. We can easily suppose that the soldier did not perceive much distinction between the strike and its inseparable results. When we want to drive a pestilence out of a country we seek for the cause of the melady and assail that, and possibly tho General thought that as a matter of tactics if he stopped the strike he would be taking the straightest way to remove the crimes which were its necessary results. It is to be remembered, however, that the General had no means whatever of attacking the strike except by preventing crime and unlawful conduct. If the strike could have existed without unlawful ‘results General Miles, whatever his “notions with regard to it, would have had to let it alone. He used his forces to prevent people from breaking the law, and if the stoppage of lawlessness necessarily stopped the strike Mr.Debs's conclusion is clear- "lv proved that the organized forces of "society are against strikes.A rela- glorify lawlessness and those which glorify Mr.Debs is suggzgesiad by the fact that it was the same town of Brazil, in Indiana, which cut with its sheriff to give a banquet to two man-slaying prison- which turned out a week or two later to hear an enthusiastic address from Mr.Debs.Mr.Debs does well to ‘commend his followers to turn to the .ballot box.It would many lives and many million dollars if he had done so sooner. If the majority think with him they can make the laws their own way ; but we do not think the majority in any country will ever glve to any Debs or any irresponsible organization the right to tie up the traffic of the csun- ‘try whenever they shall regard the "workmen in any shop as having a grievance. They will at least find some more just and intelligent way -to deal with grievances than this.i ———————————— THE EVICTED TENANTS BILL.The withdrawal of the numerous amendments to the Evicted Tenants bill by the members who put them on the order paper abdsenting thern- selves from the House when they were tyro core up iz a confession of weakness, of the debate on the second reading of the bili, bat that is an ex- cage which will avail little. The closure invention of their own, and was administered with considerable rigor on their behalf when obstruction was offered to the Irish Crimes Dbiil. When the obstructors of that bill grew sulky about it ard withdrew farther amendment they simply jeercd at them. They are ; going through the same process now “with a like experience. They cannot very well claim that the closure is being more rigorously exercised than it was by them. The Speaker, who is supreme in the matter of closure, though a very just man, is à Unionist, and not likely to grant more points against the Unionists | than in their favor. When the government first this bill the 8Bpeaker refused on the ground that he did not think it had been sufficiently devated. It is presumable, thercfore, that when he did | grant closure he did think It suffi- wos an ciently debated. The presumption is that the opponents of the bill have some deeper reason for withdrawing their opposition to it.The Liberal | | Mr.Debs has come, like other labor | | | cago to restore order but to put down ' tionship between the elements which .turned ! ers on their way to the state prison, : have saved: It is ostensibly a protest against the : demanded closure of | THE MONTREAL DAILY WITNESS.Unionists, like Mr.Chamberlain, for instance, have Radicals and Socialists among their backers, and may be feeling pressure from them.At all events the Opposition in the House of Commons has shown weakness, and the House of Lords, which js counted on as certain to throw out this bill, will do so not with more courage but with less. The Lords may say, and will say, that their reason for throwing it out is because debate upon it was gagged in the House of Commons, but this asser- lon will be greatly weakened by *he fact that the Onpasition did not use the opportunities they had.The Lords have thrown out about all the bills they like to, ag they know that every bill they throw out is a nail in their coffin. They would have greatly preferred that the present bi]! had been so amended in the Commons that they could have avoided a conflict.By sending it to the Lords in its original form the Opposition in the Commons practically say to the Lords : Here, this is your quarrel. You have no electors to reckon with. The English people will not be captivated by sulking tactics. They like to see men once they are in a race or a fight carry it through whether they are gaining or losing.————e TARIFF REFORM IN AUSTRALIA.The defeat and resignation of the Pro- toctionist Government of Sir George | Dibbs in New South Wales is of more than passing interest, inasmuch as it marks an advance in the cause of | tariff reform in Australasia. It is | true that the Dibbs Government was not defeated in the Assembly on the | question of protection, but on a question of the composition of the standing committees which have to be struck at the beginning of every new parliament. The government insists upon having a majority of its own supportars on each committee so that it can control their proceedings and reports, but in this case the government did not control a majority of the members of the Assembly, so that it could not have a majority of its own supporters on every commit- | ! | | | | | | | tee without impairing the repre- i sentation on them of the cther: parties. It insisted, however, and | ; the free trade party, reinforced by | the free trade labor party, defeated | the government, backed by the pro- 'tectionist labor party. That was an almost inevitable consequence of the victory of the free trade party over the protectionists at the polls, though the straight free traders did not se- renre a clear majority of the seats in “the Assembly. The election contest in New South Wales was not unlixe in Ontario, there being three or four parties, with cross mixtures, beforo the electors, and although the regult was somewhat different in Ontario, where the government had an immense majority over the Opposition, and probably a small majority over all parties in the Assembly, Sir Oliver Mowat may find the same difficulty in apportioning to each party fair representaticn on the different committees while keeping the control of them the government.(Certainly the experienese of Sir George Dibbs is exactly that which Mr.Meredith might expect supposing he tried to form a government and control the Assembly under the : present condition of things in the for : Ontario Assembly. In the recent South Wales dred and twenty-five members to be elected in as many, almost, equal electoral districts »y manhcod suffrage voters, one man one vote. The number of members in former Assemblies of New South Wales was a hundred and forty-seven, but a reduction had been made, a reform which, it seems to us, might very well be followed in most Canadian provinces, For though Ontario, with an Assembly of ninety-one members, or Quebec, with a legislature of ninety-seven, do not seem over- governed, yet it must be remembered that Ontario has a hundred and sixteen and Quebec elghty-nine representatives in the Dominion Parliament, whereas there is no federal parliament in Australia to relieve the different colonies there of so much of the legislation and administration of affairs of the country. In the New South Wales election one member was elected by acclamation, and there were flve hundred and twenty- seven candidates for the remaining hundred and twenty-four seats.Of election there were in New a hun- that which took place shortly before : these, two hundred and four were for free trade ; one hundred and eighty- ‘nine were for protection ; seventy- one were Labor League candidates; thirty-two independent labor candidates ; eight were free trade labor ; six were protectionist labor ; ten were independents; three fair traders ; one Liberal, and three ‘doubtful.’ The issues were free trade and labor reform, and the election was fought out under great political heat and excitement.the premier, wag the chief of the protectionists, while the veteran Sir ! Henry Parkes and Mr.G.H.Reed ernment and its protection policy, which had been tried and found wanting.Sir George Dibbs himself was returned, but two of his ministry, besides many of his most prominent supporters, were defeated. On the other hand, Sir Henry Parkes, Mr.Reed and other candidates who were members in Sir Henry Parkes's last government were triumphantly returned by a large majority in nearly every casc.most successful by far, having captured fifty-eight seats, while the protectionists were reduced to thirty- essful in twenty-eight seats. While there are more free traders by conviction than protectionists in the labor party, yet it appears that the labor party of Australia is for the ; most part indifferent upon this issue.; The last free trade government was | overthrown by the labor party joining the protectionist party, though not upon a protection issue, and the ‘labor party seemed willing to give ‘its assent to protection so long as ‘the protectionist government served: the labor party in regard to labor ‘issues. It is said party will support the new free trade government on the same conditions. It is most probable that Sir Henry ; Parkes, who is ‘an old hand, will try to form a coalition government, and thus bind the labor party to the frec trade party. The revolt which 'is now going on in the United States, Canada and Australasia against protection and its works is significant and hopeful to a degree.— o- TIIE OUTREMONT RAILWAY.AN AUSPICIOUS OPENING.The Montreal and Island Park Railway ine to Outremont was formally opened yesterday afternoon. At two o'clock two special cars left Cote street station. On board were the Hon.J.A.Chanleau, Lieutenant-Governor of Quebec; the Hon.| | | | the Hon.Louis Beaublen, Minister of AE- riculture and Colonization; Judge Mathieu, Senator Desjardins, Mr.J.Israel Tarte, M.P., Mayor Villeneuve, Mayor Swall, Cote des Neiges; Mayor Dunlop, Outre- mont; Mayor Dezarie, Notre Dame de Grace; Messrs.Henry Ilogan, E.Lusher, A.J.Corriveau, Joseph R.Roy, chief engineer; Lucius E.Marple, C.Gravel, HA.A.Brault, G.Lejole, and the councillors of the various municipaiities through which the line passes.Arriving at Coie des Neiges refreshments were served on the grounds adjoining Mr.Swall’s residence. The usual congratulatory and com- ; plimentary speeches were delivered and all reemed pleased with the success of the undertaking.Everyone was loud in the praise of the thorough manner in which the work bad been done and the celerity with which it had been pushed to completion. The road was remarkably smooth for a new one and ihe bed had an appearance of solidity which speaks well for the thoroughness with which the construction hds been made. The greatest credlt is dve {95 all who had anything to do with this enterprise which will no doubt preve of inestimable benefit to the municipalities through which the raiiway PRISES.The return trip was made in less than twenty-five minutes. The line was immediately declared open to the public and last evening the first car of the rerular half-hourly service was run over the line._— THE FENDER ON THE WRONG END.The fender was on the back of the car and thus Mr.J.Donald Morrison was probalsy saved from a serious accident last night. He was crossing St.James street at the corner of McGill, when a cor suddenly backed up, and he was thrown down.He succeeded in getting out of the way of further danger and es- caned with a few bruises. Thus the ef- ficlency of the fender on the back of the car is demonstrated, as had Mr.Morrison boen struck by the car instead of the fonder, his injuries might have been much more serious.pi PERSONAT, Dr.Elle Asselin, leaves to-day for Paris.where he will complete his studies in the large hospitals of the French capital. The Rev.James Pedley, of Vancouver, B.C., arrived in Montreal on Monday.per 83.Mongollan,” Mr.Pedley is a former student of the Capada Congregational College, here grid, during a year's absence from his work in Vancouver, has bezn taking a special course nt Oxford, under Dr.Fairbairn.He will preach at Emmanuel Church on Sunday rext, and will leave for his home in Van- couver on Monday.Sir George Dibbs, were the leaders of the frce traders. The result was a defeat for the gov-.The free traders were: nine, the labor candidates being suc-: that the labor.G.A.Nantel, Minister of Public Works; | THURSPAY.Aver.oo OFF A TRAIN AT MiDMIGHT.UNIQUE EXPERIENCES OF TRAVELLING MONTREALERS.MONOTONY OF A RAILWAY JOURNEY SOMEWHAT VARIED—CHILLY RIDE IN THE SHAKY HAYCARTS, OVER A ROUGH ROALI— A CONDUCTOR KNEW THIS LUSINESS-— ANOTHER WERECK AND MORE DELAYS.Jt was a unique piece of railway trane- | ferrimg that took place =arly yesterdar ! unconstituticnal, The petitioners hold that the law now complained of annuls previous rights acquired by them in virtue of a former act of the Leogis- ;ature, whereby.in consideration of their giving up to the eplscopal corporation of Nicolet all the assets of the Fabrique ot the parish of St.Jean Baptiste, said episcopal corporation accepted the charge of meeting alone the expenses connected with tho reconstruction of places of wor- skin.ACT OF DISALLOWED.THE -———e TO READERS GOING OUT OF TOWN.‘Witness’ readers going out of town can bave the daily edition malied to Sol was at Lis hottest. They were very up-to-date young people, with not a trace of provinclalism ahout them, yet ono could tell that they were not New York residents, but probably killing time, waiting for a train or a boat. When they camo to the fountain the young woman stopped and watched the water trickling from the linn’'s mouth as though the cool sight alone did her lots of good. Then she picked up the tin cup to be used by the connnon herd, and, scanning it ruefully, shook her head at her companton and laid It quickly down again. The next thing was to slip off a small suede glove, and placing tho pretty hand it fitted under the stream she filled its palm full of water and drank from it three times full. And the next thing was to see the young man bend over the same palm, while he held her wrist to balance the novel cup, and five times full it tock to satisfy him, and right willingly did the pretty young woman fill it and place it to his lips. That was the queaintest picture ever on view in front of that old iron fountain. It was the poetry of drinking in public places. Both actors were perfectly unconcerned, and after the young man had dried the young wcman's hand in his pocket handkerchief they sauntered forward to a Broadway car and boarded it in a downtown direction.—New York ‘Herald.’ COMMERCIAL Witness Orrics, Thursday, August 2, 1894 A GENERAL ADVANCE, WHEAT AND CORN MAKE GOOD GAINS.— CROP CONDITIONS NOT SO ROSY AS THEY WERB.The feature of the grain market to-day was.as yesterday, the advance In corn.Corn continued In its onward course and within two hours after the opening had added nearly two cents to the highest price of yesterday.Wheat could not resist this influence and it also made an advance on yesterday's prices, but not to such an extent as corn. Then it was not so firm in tone and when corn was at its highest point wheat was feeling a little weal.Still there was an improvement and at noon the figures were 54%c Sopt.and 57%c Dec, being % of a cent higher than the closing prices of yesterday.Corn, at noon, was quoted at 49%c Sept.and 46l4c May, being only a shade over four cents lower than wheat in the Chicago market.Foreign ad- vices were little improved on yesterday and the tone was generally weak. The corn crop conditions appear to ba in a nervous state all over the world. The ‘Corn Trade News' says that the Danubian corn crew has suffered seriously for want of rain and the more recent telegraph despatches predict not more than half a crop. From South Russia similar reports are being re- celved. The wheat crop seems also to be suffering from drought in certain Jocallties.Advices from Russia ure that the prolonged drought has seriously injured all crops. The London ‘Daily Telegraph’ says that the prospects arg now not for such a bountiful harvest in England as was expected a short time ago.All the conditions are in favor of higher prices, but the wheat market is slow In responding to them.Perhaps the strength of corn will give the bulls of the wheat market new courage.Wheat held steadily during the afternoon and cleged firm.In Chicago the closing prices of wheat were 53c Aug., 54l6c Sept.and &73;c Der.belng 4 of a cont higher than yesterday's closing prices.Corn closed at 49%c Aug.and Sept., 4R%c Dec.and 46% c May, belng 1% cent higher than yns-
