that a difficulty in this matter of Munday observance in Montreal is greatly accentuated by the fact of our mixed iopulation. This argument, 1f there 13 ilythng 1n it, tells against the English- which will most certainly tollow if we l'are recreant to our high resp n-.bility.’ | REV.DR.GORDON | AT FIRST BAPTIST.[ In accordance with the suggestion of the Lord's Duy Alliance La setmens should be’ preached with a special reference to Sunday newspapers, the Rev.Dr.+ A.Gordon treated the subject on Sunday morning at the First Baptist Church.; The reverend gentleman introduced lis theme by discus-ing the general question | of Sabbath observance, and proceeded to deal with the Sunday newspaper as follows: "Whatever defeats or antagonizes the objects of the Sabbath desecrates ii.ihe prives many cf their Sabbath rest. The fact that those who work do not care does not mitigate the hurtful effect vf unnecessary labor in the community. The Sunday newspaper is positively antagonistic to the right observance of the l.ord’s day.It thrusts upon the attention of the people things that belong exclusively to the six days of labor and work, thus directing their attention from the true object of the day, viz, worship of God and meditation upon his word.It kills the spirit of devotion reflecting the worst side of life, and by finishing reports of questionable sports, very often scandal and such gossip has failed to make for that which is highest and best in life and character. The plea for existence that it supplants unworthy literature, and that it meets public need can hardly be sustained. If by the latest news they mean market quotations sr kindred subjects, these are the thrds from which strenuous business men arc entitled to a day’s rest.‘The experience of other communities, where the Sunday new~spaper obtains, has so far as we have been able to learn, not supplanted unworthy or corrupting: literature, but paved the way and ereatdd-ijre thirst for that very thing.tig is a public want or neew may or nay Tot be true, but it should not be forgotten that there js a public and_g public. That {there is a public that has very little re- ; spect for law, order, morals or -ighteous- | ness gencrally; a public that would like | to have the open saloon every day and ; night of the week.A public that would ! eliminate every lay from our statute "books which would keep evil-doers in check. At any rate, we have yet to learn that the corporations issuing the Sunday newspaper have embarked on these enterprises from a missionary or philan- | {hropic standpoint, wut, on the other hand, for the orofit that they can derive from it.What are we to do about it?There are at least one or two things that we can and ought to do.I think that no member at least of my cburch should subscribe for or advertise in these papers that desecrate the day without which it is hard to see how our churcnes | or our Christianity with all its beneficent | institutions should continue to exist. If | auch a campaign were started against the | Sunday newspaper as the ‘Star’ maugut- i ated against the usurers and the searchlight of enquiry turned upon the whole problem it would soon vanish from cur midst as did the contemptible usurer and his business.’ REV.DR.FLECK AT KNOX CHURCH.The Rev.Dr.James Fleck, of Knox Presbyterian Church, preached un the subject of Sabbath abservance at both the morning and evening services on Sun- | day.His treatment was for the most part general, but he denounced the Sunday newspaper in particular for secular izing the Lords Day.At both services he read the circular of the Lord's Day Alliance, after which he briefly referred to newspapers, mentioning the ‘Standard.’ He stated that this newspaper bad at first been published and delivered on Saturday, but he had heard many complaints in regard to the alleged practice of the publishérs in having them delivered at Christian homes on Sunday morn- nz nz.DEMORALIZING EFFECT OF SUNDAY PAPERS.The Rev.John Mackay, of Crescent Street Church, in a sermon from the text ‘Remember the Sabbath Day to keep it holy,’ referred to the recent introduction of the Sunday newspaper Into Montreal. He figst showed the reasonableness of such « command as the fourth in the decalogue.AH these commandments, said he are but formal expressions of laws inherent in human nature.Man is made for a destiny like the Divine himself, to be realized by constant fellowship with him.God has shown his earnest desire for man’s fellowship in all ages.ls it too much that he should ask for one day out of seven to be given up to that fellowship.unbroken by the distractions of our every-day life. But furthermore, the command has claims upon us because of its justificatien in experience.Fellowship demands knowledge, and knowledge of the Divine is not easily won.We may drift into many things but never into knowledge of aught worth knowing. The best products of the world’s greatest Sunday paper or seven-day journalism de-' aa MONTREAL, TUESD THE EMPEROR AND EMPRESS OF GERMANY.Who to-day celebrated FEBRUARY 27, 1906.their silver wedding.minds are ours to enable us to come into living fellowship with the highest.Could anything be more beneficent for us than that we should be asked to spend cne day in seven under such cireum- stances as best to enable us to get thah knowledge. The Sabbath kept holy not only gives us an opportunity for thought and study of the best things, but through! that experience which it makes possible becomes a bulwark to strengthen every other good thing in our individual and national life.Whe can spend six days 1 dishonesty or uncleanneas, and bear t face his own conscience and the all-search- ing presence of the Divine Spirit, far a ole day, on the seventh? In such a day well spent we have the sure pro vision made that we shall not heedlessly fall into careless and unworthy living and that the spiritual things, the things which really matter, nay have a chance. The introduction of the Sunday newspaper into our midst is a menace to the spirit and the purposes of the day. What chance is there for national or individual greatness of ideal or of spirit, when the children in our homes have the most sacred part of their lives filled by such stuff as is supplied by the ‘Buster Brown and similar supplements of American Sunday newspapers’ There may be a place in our lives for such things, but surely not on the one day set apart for the quest of the highest. The deplorable conditions which are every day bey revealed in the United States are in large measure due to the influence of the Sunday newspapers. The Sabbath as our fathers knew and loved st is responsible more than any other institution for the place occupied by the British Empire amongst the nations of the world to-day.and no agency is better calculated to destroy all that has made it a source «f righteousness and national strength, thun the Sunday newspaper. Our lives are already too hurried and superficial. Are we going to bring the feverish activities and thronging pleasures of the week into the one day which has enabled us in some little measure to pause and think and really live? When a similar atlempt was made mn London some years ago the Christian business men said "We will have nothing to do with the papers thai issue Sunday editions,” and the Sunday edition stopped. The Sunday paper has been attempted in Montreal because of the belief tha: the Christian people do not care enough to take such a course 1m defence of the Sabbath. But if every Christian reader and advertiser lets the publishers know that he will have nothing to do with papers that issue Sunday editions, this it tempt will go no further and we will be saved from the crying evils ol seven-day journalism.—_————— KINGSTON CIVIC Council last night, which declared that no permanent officer or servant of the corporation shall be a candidate for municipal or legislative positions or shall take part in elections except to vote, 1f qualified to do so.The resolution was held over for consideration, the aldermen not desiring to act hastily. Some thought the resolution was aimed at the city so- ficitor, Mr.D.M.Mclntyre, the late Conservative candidate for the Ontario Legislature, and Ald.W.F.Nickle thought the resolution should only apply to those who gave their entire time to the city.‘the city solicitor did not do that. The mover said he found firemen busy in municipal elections, and he did not wish that sort of thing to continue.ES PRE PES A FAST TRAIN C.P.R.SAID TO BE CONTEMPLATING A NEW BERVICE BETWEEN MONTREAL AND DETROIT.According to a Toronto despatch, the Canadian Pacific Railway authorities contemplate putting on a fast express between Mentreal and Detroit, which would have only about ten stops between the two points, and would break the record: not only on the C.P.R., but on any other Canadian railway.Between Mont: real amd Toronto the speed would average about sixty-six miles an hour. This would enable the distance between Montreal and Toronto to he covered in a little over five hours.‘The best time now made between these two cities is by the Grand Trunk’s, International Limited, which leaves here at 9 a.m., and reaches Toronto at 4.30 p.m.TOOK PARIS GREEN PAINTER TAKEN TO HOSPITAL DIES AFTER STRANGE EXPERIENCE.Frederick Ridley, à painter, thirty-tive years of age, and unmarried, took Paris green on Sunday, and died at the General Hospital yesterday afternovn, atler being in the hospital but a few hours. He was in too weak a condition to talk when taken to the hospital, and the pby- sicians could find out nothing from him about his case.Although Ridley lived on St.Hubert street, north of the Canadian Pacttic Railway tracks, he was taken to the hospital from 576 De Gaspé street, in the town of St.Louis, the home of a family named Gibbons.Dr.J.D.Vezina, of 1816 St.Hubert street, was called there to see Ridley at four o'clock yesterday morning, and had the man sent to the hospital when he saw that he was suf-| fering from poison. When Dr.Vezina asked Ridley what his reason for taking the poison was, he tried to explain, but could not, as he was too weak.Dr.‘ Vezina savs that Ridley had called at! his office on Sunday afternoon.when he: was away, and had told his wife that he had taken Paris green, and she sent lim to Dr.Lauzon, 407 Mount Royal avenue.Dr.Lauzon says that Ridley called at his office and told him he had swallowed Paris green, but he had apparently not- taken much, and he gave him a prescrip-| tion to have filled and he left the office.Ridley, who frequently visited the Gib- bens family, called on Sunday night and asked to be allowed to stay all night as he was not feehng well Early m the morning Gibbons heard Ridley groaning, and on going into his room Ridley said he had taken Paris green.Dr, Ve- zina was then called.Ridley is said to have been drinking heavily but beyond this no reason can be given ‘er his wanting to end his life.An inquest will be held at the hospital to-day by Coroner McMahon.WHITAKER WRIGHT CREDITORS WILL LOSE TWELVE MILLION DOLLARS.London, Feb.26.—The report of ihe official liquidator of the J.Whitaker Wright Companies contains some startling figures. The assets, which were es timated to produce $14,505,100, realized $2.575.070.To realize this cost more than $1,500,000.The unsecured creditors, whose claims aggregated $12,958.375, received $921,585.There was nothing to BIG REAL ESTATE DEAL —— Senator Cox Buys Block on St.James Street, Opposite Pest Office RUMOR THAT GOVERNMENT MAY SECURE SITE FOR NEW POST- OFFICE BUILDING.Senator Cox, of Toronto, according to well-informed authowty, bas purchased that valuable prop:rty ‘on the south side of St.James street, between St.Francois Xavier street and the Liverpool & London and Glove building. The property extends through from St.James street to Notre Dane street, taking in all the frontage on the east side of St.Francois Xavier street, between St.James and Notre Dame str:ets.Rumor had it last week that this site had beun secured by thz government, but this has been denied from Ottawa. It is claimed in political circles, however, that the Federal aushor:ties have in contemplation the “rection of à hancsome and commodious new post-office building on this site, and that there is a possibility that the government may make a deal whereby i.will cbtain possession of the proper*y report:d to have been purchased by Senator Cox.The price paid for this site is said to have been exceedingly large, as the property, for business purpos.s, is considered one of exceptional value.lt is also rumored that if the goverment should erect a new post office the present post- offic building may be used by the customs cepartment, and accommodation might also be provided for the officials of the local Inland Revenue offices.MISSIONARICS MURDERED A Later Cablz .rom Mr.Rogers at Shanghai MTTLE APPREHENSION THAT TROUBLE WILL SPREAD.Washington, Feb.26.—A later cablegram from Mr.Rodgers, United States reports of the Nanchang trouble are conflicting. It is now reported to have originated in a dispuie between the French Jesuits and Chinese officials.A Chinese magistrate was at first reported to have been stabbed by a Catnolic missionary, but it is now alasmed that th: mag strate stabbed himself."In the riot which + peeurred.yasterday, six Jesuits and two | Members of the Kingman family were killed by Chinese. The refugees are going to Kukiang. The American mission building is understood to have been saved, and order is now restored.Mr.Rodgers adds that all is quiet in Shang- ai.The officials here accept Consul-Gemeral Rodgers's suggestion that the trouble at Nanchang is local, as has bzen the case with the two preced.ng attacks upon foreign missions in China.The.efore, there is little apprehension that the trouble will spread. However, it is realized that the incident iteelf appears to justify such preparations as are now 2] way from a military point of view. The report that English subjects have been killed is the most serious phase of the affair, for it is said that this fact may be made the basis of forcible measures on the part of the British Government that might inflame the entire Chinese population.Nanchang, where the missions wer: destroyed, lies upon the shores of Lake Poyang, in the northern portion of the province of Kiangs:, and the Yangts: river is navigable up to that point, as well as the lake itself, for warships ot oonsiderable size.BOYCOTT RESPONSIBLE.Manilla, Feb, 27.—A leading American firm in this city has received the following cable from Canton : “The boycott has greatly encouraged the anti-foreign feeling.Twvachers, reformers, agitators and the native newspapers now have the power of that association behind them, causing a remarkable growth in thre reform party and secret societies, while the of each man, THE MONTREAL THE BRITISH ELECTIONS Mr.D.A.Watt Discusses Many Matters of Interest CHAMBERLAIN AND HIS PLACE IN THE EMPIRE.MR.Mr.D.A.Watt, interviewed by a ‘Witness’ renresentat:yc, being asked whether he had anything to say respecting the English elections, and of Mr.Chamberlain's new position, said in ef- feet: — Most certainly 1 have, in common with large numbers of Canadians, taken a very deep interest in the British elections, and have read much of the election lit- erature—newspaper, magazine and pam- phlet—that has poured from the London and provincial press in great profusion.Very few persons, whether participants or spectators, could have foreseen the avalanche that has overtaken the self- named 'Unionist’ party.Mr.Chamberlain, in his fiscal diatribes, is accustomed to claim for himself the gift of prophecy, coupled even with omniscience. But in this, as in many other cases, his second sight has played him false to his own undoing and to the ruin of the party to which he has recently attached himself. The chief honors of the astounding victory undoubtedly rest and remain with Sir Henry Campbell-Bannerman, the courageous, cannie Scot, who accepted party when its position was almost as ow as the so-called Unionists now are.Since then he has held the even tenor of his way amid obloquy, simulated scorn, vituperation, and falsehood galore. His steadfast course throughout the jingo de- lirum, with its little wars, raids and bloodshed, and more particularly his denunciations of the South African war, with its ‘methods of barbariem,” were undoubtedly chief factors in bringing him votes. His sturdy opposition, aided by many of his present colleagues, to the jingo South African policy, from the Jameson raid down to the licensing of the last batch of Chinese serfs, has been continuous, and it did and has done much to mitigate the horrors of the situation, and in a sense to save the honor of the nation.Of course, the lying tongue is not silenced nor has the slanderous pen ceased to write, but Sir Henry is now prime minister, with an unexampled majority at his back, and will doubtless continue to pursue the even tenor of his way for some years to come.Ot course, there are other and potent reasons to account for the landslide.Mr.Balfour's volte-face in Irish affairs, when his colleague, Mr.Wyndham, was thrown to the wolves, at the bidding of a noisy coterie of Ulster bigots, dis- ed numerous Tories of the more en- ightened sort. Two pieces of class legislation for which he was more directly responsible were potent factors against him. These are commonly termed ‘endowing the parsons and endowing the publicans.” In short, beer and the Bible, so to speak.Mr.Balfour took the votes of both beneficiaries and also delivered the goods, in which respect he differed from Mr.Chamberlain.But the number of votes he lost thereby is now seen. The destruction of the efficient and popular school boards and the importation of sectarian bigotry into national education revolted the conscience of large numbers even of Tories. To apply Baptist taxes towards the teaching of Baptist children, that not having been ‘christened’ they are on the road to perdition, savors of middle- age persecution. And the bigots who administered the law were like unto the bigots who made it.I read the other day of a conscientious objector—a sturdy Baptist, doubtless—who was sent to prison for thirty days in default of paying a few shillings of school taxes. This may be a good way to maintain a ‘church atmosphere’ (sic) in schools; it has also proved to be a good way to lose votes. The endowment of drink was effected by, so to speak, declaring that all existing annual licenses were the personal property of the holder authorizing him and his representatives to sell drink forever. This turned a yearly holding into a fee-simple without compensation to the state, and turned a mere annual license into a valuable piece of property which can be bought, sold or hypothecated like lands or goods. The blessings of these two pieces of class legislation are contined to England. The acts do not extend to Scotland or Ireland. There were, of course, a number of other issues not so directly personal to Mr.Balfour which contributed largely to the debacle, chief of which was Mr.Chamberlain’s fiscal resurrection of protection. To a few of its advocates this became a sort of obcession, and to a much larger number it was graft pure and simple. But as regards the politicians, it was the red herring intended to ohscure and cover up the inefliciency.imbecility, dishonesty and unparalleled wastefulnees which has characterized every department of the now defunct administration.Protection and retaliation are buried for the time being without hope of resurrection. The voters have declined to ‘gamble with the people's food,” as Lord Goschen termed the dishonest propaganda which was at one and the same time to increase work, increase wages, and reduce the cost of living to the workers. The absence of rioting and violence was a distinguishing feature of the election.Even Mr.Chamberlain's Birmingham lambs were quiescent and some content to baah. This is indeed a marvellous chauge from the davs of zhe Aston riots, when these same roughs were Radicals, so-called.and attempted, if not to murder, certainly to hammer Lord Randolph Churchill and his supporters, and broke up his meetings with brutal violence.A few years ago they did the same to Mr.Lloyd George, when he and his friends attempted to hold a peace meeting at Birmingham.By that time they had with their master changed sides politically, and had become Tory jingoes. On that occasion, also, they broke up the meeting with violence, wrecked the town hall, killed and Mr.Lloyd George ‘es- one man, | { caped their murderous intent in the clothes of a policeman.Mr.Chamberlain’s opponent was given hearings in the forlorn hope of leader of the Liberal ! remind you of some of them.DAILY WITNESS re his own constituency, and no harm came to him.The usual amount of boohings, interruption and heckling of candidates, chiefly apparently at ticket meetings, but little else.Women who attended some meetings and asked candidates questions respecting equal electoral r ghts irrespective of sex, sometimes met with scurvy ‘eatment. The worst offenders in this ion were, rhaps, Mr.uith and Sir Edward Grey, who.however are Whig jingoes rather than Liberals.course there was abusive talk galore, chiefly, perhaps, by ex-ministers.Mr.Arnold-Forster, the gious, replying to criticisms of his failures and worse in army administration, termed his Liberal critics ‘rebels,’ ‘scallywags’ and rats.’ Mr.Balfour calls Mr.Burns a bargee, and Mr.Chamberlain a ‘hack official. It will be remembered that the latter's term fer the Nationalists when angling for i ‘ pot, neling, their votes, was ‘the MR.CHAMBERLAIN.The effusiveness with which certain coteries of Canadians have hailed Mr.hamberlain as par excellence the greatest of colonial secretaries, is a singular obcession, considering the numerous kicks he has inflicted on us.We have taken his kicks lying down and have not kicked back—at least not yet.He continues to prate about the Canadian offer, ignoring the fact that our offer has long ago been embodied in legislation.Respecting this legislation, Sir Wilfrid said it was intended as a free gift to the Mother Country and that no return was asked therefor, in which respect he has not been diea pointed.Yes, when I say kicks, I mean Ts, Let me The most serious of these kicks, perhaps, was the Alaska bounda award, when Canada’s rights were de iberately sacrificed.Mr.C erlain’s apologists say he was not personally responsible, but "being colonial minister and remaining as he did in the cabinet, his respon- gibility was direot, and neither he nor his ministry have done anything to mitigate the injury.wonder why Sir Wilfrid does not continue to press Canada’s right to make her own treaties.Perhaps he has been waiting the advent of the new British cabinet.I have, of course noted the ‘inseparable objections’ urged by gpeakers and writers, but which are really trivial. One is that the treaty making power must forsooth also be a treaty compelling power, just ar if all treaties required to be enforced by war.The average Jingo looks on a treaty as a means to justify a raid, which he calls a just war in the interests of freedom and of the Empire.Such was the opium war against China and numerous others since that date.Such also was the invasion of Tibet, and of Somaliland a short time ago.Canada has not, or at least should not have, any desire to make treaties involving rapine and bloodshed.Another objeotion is that treaties require to be made by the King and ratified by the Privy Council, which procedure cannot be followed in Canada.Whysnot? His Excellency signs for the King by procuration, and Sir Wilfrid is as much a member of the Privy Council as efther Mr.Balfour or Mr.Campbell Bantrerman himself, if, indeed, there be question.his point.Mr.Chamberlain ignored Canada when his ministry came to deal with the question of a swift steamship service.sacrifices she was willing to make in order to obtain it, but when the time came to deal with the question an enormous subsidy was given to facilitate trade with the United States, and to build up the port of New York, without giving Canedian interests a single thought.Fifty years ago Do British ministry would have dared to thus ignore the North American colonies. At that time a headquarters of the Cunard Line was at Halifax and Sir Samuel Cunard, one of its founders, and aîter whom it is named, lived there.I'he subsidy amounts to $750,000 a year for twenty years, making $15,000,000, besides a Joan of $13,000,000 to build the two flyers to be in commission next year.Ob, no, } do not believe that the Cunard Company have any soft snap In this contract. They are probably giving full value, of a kind, for the money they are to get.The truth is that the rush for greit speed is a passing craze.Commercially, it is a wild-cat, pure and simple. All the greit Atlantic hners have abandoned the competition.Lhe ‘Amerikas,’” ‘Balties,” ‘Celtics,’ *Caonias,’ ‘Cedrics’ are all of moderate speed— eighteen knots and under.‘The only line which has a fleet of fiyers is the Hamburg-American, and, if reports be true, they honxl to unload their white elephants on the unfortunate Russians during the late war. Then there js the cattle embargo, about wlieh so much has been written. Before Mr.Chamberlain's day, locah- tien were, in case of need, scheduled by proclamation, to be afterwards relieved by order-in-council.But his government changed that system and went one better against Canada by passing a law permanently scheduling Canadian animals.Relief can now only be obtained by passing through parliament a repealing or amending act, a well-n'gh impossible effort, as Mr.Chamberlain well knew.Even if the new House of Commons could be induced to pass such un act the Lords would certainly refuse assent. No, I think the new British ministry wil] have quite enough on :ts hands without attempting to deal with this enotty question, k In petober, 1903, Mr.Chamberlun’s Minister of Agriculture received a large deputation at Glasgow to urge that the embargo on Canadian animals be removed. One part of his reply was : “1 would like to know what Canada would give in return if we repealed this act.- 1f.Mr.Henderson re peats his visit (to Canada) and tells us what Canada will give in return for the reconsideration of this question, then perhaps I shall go into it.” Canada’s gift of fifty percent less duty vas again ignored."on ote of the last House of Ucm- mons not more than twenty members, if I remember aright, could be mustered in favor of repaal.; On Peel street, St.Catherine street and Dominion square was threatened with destruction by a fire which occurred early this morning at No.2362 St.Catherine street, and caused a loss estimated at $10,000.The building, which is a three-story brick structure faced with stone, contained, on the first floor, the music store of Mr.J.H.Superior, and the establishment of the Novi Modi Costume Co., Limited, of which Mr.G.EK.Hunter is the manager. On the second story was Kam Hall, and the studio of Mr.Cal.H.Corey, professor of voice culture.Lhe third floor was occupied by the Syllabic Shorthand Institute and Business‘ College of Prof.W.1.Moon.Adjoining these establishments of the east side is Messrs.Alexander's Café, and on the west Messrs.C.W.Lindsay & Co., piano dealers. These escaped without any damage. How the fire originated is a mystery. It was discovered shortly before four o'clock, but at that time the lames had made their way from their starting point under a stairway in the first floor to the roof.A company of firemen, under Captain Gilmour of No.10 station, were the first to arrive, Others from stations Nos.3, 4 and 5, under Sub-chiefs Briere and Mitchell, followed soon after.Captain Gilmour had already entered the build, ing with his men, and three streams from St.Catherine street were playing upon the flames. As quickly as a passage could be cleared to the third floor a number of men with a line of hose climbed to the top, and fought the fire as best they could amid blinding and suffocating smoke.Another stream was thrown upon the building from the rear with goed effect. For nearly two hours the firemen labored incessantly at their task, and succeeded in preventing the flames from spreading.Half an hour later they had the satisfaction of seeing the fire under control. The fire occurred at an hour when most citizens were in bed, and only a small number witnessed it.The stairway under which the lire is supposed to have originated is in the music store of Mr.J.H.Superior, who estimated his damage to-day at considerably over two thousand dotiars. His establishment is almost a total wreck, as the salvage corps could do little towards | protecting his goods, seeing that the fire bad made such progress before it was discovered.Beyond the damage due to water the Novi Modi Costume Company sustained no serious Joss, and will be able to resume business Tuesday, and that means something more than pancakes for the bairnies. It means that to-morrow Lent will begin.Consequently there has been today quite a rush of weddings among those who do not wish to postpone the happy event for another forty days.A Both Bonaventure and the Windsor street stations there bas been an unusually large number of touching scenes, as young couples set out on their honeymoon, or arrived to spend it in the city.It is quite amusing to notiez what a keen interest the station sparrows take in wedding parties. They seem to know instinctively when a wedding party arrives, and ag soon as the ride begins to fly they swoop down by the score for a bounteous Feed. The newer custom of throwing confetti is viewed with much disgust by the sparrows.Years of observation have taught them that weddings mean rice, and they cannot yet believe their own eyes when they see tiny bits of paper being thrown. So at each new shower of confetti, down they drop from the roof, and only after repeatedly sampling the discs of paper does the truth dawn upon them, and then they fly back disgustedly to the roof to cogitate upon the growing meanness of the travelling public.DEATH OF CROWN LANDS?, The Privy Council to-day rendered judgment in the case of the Attorney- General of British Columbia versus the Capadian Pacific Railway, This is the famous Street Ends case, which has been fought out in the courts from time to time ever since Decesaber of 1902 between the city of Vancouver, j on the one hand, and the C.P.R.on the other, the case ultimately being car- vied to the Privy Council,” which has now given judgment in favor of the rail way., À cablegram from London announcing the decision, states that Sir Arthur Wilson, in delivering the judgment, said: :It is expugh to say that the language of Co Po KR.Act must prevail over that of the Consolidated Railway Act (which applies only so far as it 1s not inconms- tent with the special act), and it is clear in their Lordships’ opinion that the power given to the company io appropriate the foreshore for the purposes of their railway, of necessity includes the right to obstruct any rights of passage previously existing across that foreshore, and the appeal should be dismissed.’ The appellant will pay the costs.Mr.À.R.Creelman, general solicitor of the C.P.R., stated in an interview with a ‘Witness’ representative this morning that the action was brought by the Attorney-General of British (olum- bia, at the relation of the city of Vancouver, the form of the action being for obstructing highways.Under their original contract, the C.P.R.obtained the water rights and land rights known as foreshore rights on all lakes, oceans and bays, at which the railway established terminals. The action arose through the city of Vancouver claiming the right to continue certain streets to the water's edge.As these streets would run right through the C.P.R.works, the railway contested tye claim. The C.P.R.has been occupying the property ever since 1886.The courts of British Columbia unanimously pronounced in favor of the railway, holding that the water fronts in Vancouver formed part of the harbor of Vancouver, and therefore were vested in the Crown, as representing the Dominion.Chief Justice Hunter and Mr.Justice Martin, who constituted the full court of British Colum-! bia, not only confirmed the decision that the Federal Government had the power to grant there foreshore rights, but went so far as to say that the Dominion Government had the right to grant to the railway rights on the provincial Crown lands.Whether the Privy Uouncil upheld this contention the cablegram- did not soy, but if they did it will easily be seen how important their pronouncement is.Mr.Creelman added that the railway argued (1) that this was harbor frontage, and as such belonged to the Dominion, who had the power to grant the railway right to close it to streets; (2) that if the court should find it was not a harbor within the meaning of the British North America Act, then the land was provincial Crown lands, and could be granted the railway as such; (3) that the city agreed with the C.P.R.to cxpend a lot of money on these works, and it was inconsistent with the agreement to run streets through the works and render the rights valueless.BOY KILLED BY CAR SIEPPED spend their honeymoon at Kylemore Castle, the Duke of Manchester's Irish property. The King has been taking a prominent part in the carnival. He drove through the streets wearing a lounging suit and a itself. After the long period of neglect which this instrument has suffered at the hands of local concert goers, the extraordinary demand for seats which has been evidenced ever since the rale opened its début, has a first-class concert hall, and has been provided with a special platform in front of the curtain, and is expected to prove an ideal place for euch purposes.Appeal Case Ends in Judgment | for Brewing Company MAJORITY OF COURT REFUSE TO ALLOW DAMAGES.Judgment was rndered by the Court of Appeal, this morning, in th= case of the Montreal Brewing Company ant Ald.Vallieres.It will be remembered that having been served with a protest on the part of the Brewing Company against his voting at the City Council meeting of May 30, 1904, on the report of the special committee concerning the transfer of certain east end streets to the Canadian Pacific Railway Company, Ald.Vallieres took out the present action claiming $10,000 damages, on the ground that this protest, in which he was charged with having accepted favors, and more especially a 1-gular pass from the company, thereby being unable to give a free and unbiased vote, vonstitut- ed a serious injury to him.The Superior Court granted Alderman Vallieres $200 damages, and.heace the present ap- real.: In rendering the judgment of the majority of the Court of Appeal, reversing the decision of the Superior Court and dismissing the action, Mr.Justice La- vergne held that the protest referred to constituted a privilegzd communicadion.that it was served in the exercise of a right and without malice, and that the company could not be lreld responsible for the publicity given to the event.Chief Justice Sir Alexandre Lacoste dissented: from the majority.MOTORMAN EXONERATED THE CASE IN WHICH JOHN DEVLIN WAS KILLED.IN At the inquest held by Loroner Mc- Mahon this morning into the death of John Devlin, who was run over and killed by an electric car at the corner of St.Catherine and Poupart streets yesterday morning, the jury decided that no blame could be attributed to the motorman or the Street Railway Company.‘There was nothing to contradict the motorman's story that the young man was Iving across the track in a pool of water in such a way that he could not see him in time to stop the car.The man was lying in the shadow thrown by the electric lamp, and the fender did not lift him, but allowed the wheels to pass over im.INDECENT PICTURES.Osias Berenson, a laborer, living on St.Lawrence street, was charged before Mr.Lafontaine this morning with selling and having for sale
