said that he was principaîly concerned with answering the arguments of Quebec counsel.Quebec's attitude is consistent, he said, with its stand on the companies legislation, ‘But these arguments have been conclusively and finally overruled by the courts,” Mr.Newcombe stated.‘The contention of the province is broadly to deny entirely the legislative authority of the Crown to require the court to answer any sort of question at all, whether it related to the B.N.A.Act or not.1 contend that the Dominion has the right to submit every one of these questions and to require Your only one question, and this in view of the variety of judicial opinions, it seemed necessary to submit the question. It may be said there are five or three questions, but in my view there is really only one. What exists is an interrogation of the court. It is an important subject, and | when the bill came up, it was stated on high authority the matter was doubtful, so the government concluded to let it stand over.No one says that question one is not proper. It la the main point of interrogation.‘Is the bill one which the Parliament has the authority to enact?’ It cannot be foreseen of others who will be affected by the decision, vet they would not be represented here.‘Public and private interests are affected. If the conclusion is that parliament has Jurisdiction, the court I submit should not fail to advise upon every interrogation. If an opposite determination is reached, a different situation is before us.I submit that questions one and three should be grouped.’ question two, and to know whether it is necessary to legislate to correct a grievance which is dissatisfying the people, or, if we are legislating into the void.Is there anything to correct is what is asked. On the other hand if questions one and three are answered in the negative then question two remains.’ Sir Louis Davies—‘Would you withdraw question two if one is answered in the
