TABLEAU \u201cA\u201d Loi modifiant la Loi des droits sur les divertissements.17 George V, chapitre 36.(Sanctionnée le ler avril 1927.) SA MAJESTE, de l\u2019avis et du consentement du Conseil législatif et de l\u2019Assemblée législative de Québec, décrète ce qui suit: 1.L'article 4 de la Loi des droits sur les divertissements (Statuts refondus, 1925, chapitre 125), est remplacé par le suivant: \u20184, Le droit est exigible dans tous les cas, excepté lorsqu\u2019il s\u2019agit de représentations données par des amateurs résidant dans la province, ne recevant aucune rémunération pour leurs services à cette occasion, et données dans des salles ouvrières, ou paroissiales ou privées, pour des fins patriotiques, agricoles, sociales ou religieuses, pourvu que la personne, société ou association donnant telles représentations, en ait au préalable donné avis par écrit au chef du service de l\u2019Assistance publique de Québec.\u201d | 2.L'article 5 de ladite loi est remplacé par le suivant: \u201c6.Le porteur d\u2019un billet de faveur ou de saison et celui qui est admis gratuitement dans un lieu d\u2019amusements pour assister ou prendre part à un amusement doivent payer le droit basé sur le prix d\u2019entrée qu\u2019ils paieraient s\u2019ils ne possédaient pas ce billet ou n\u2019étaient pas admis gratuitement.\u201d : 3.L'article 6 de ladite loi est modifié en y ajoutant l\u2019alinéa suivant: \u2018Le secrétaire de la province peut prescrire par écrit à toute municipalité d\u2019adopter l\u2019usage, pour tout autre que le porteur d\u2019un billet de faveur ou de saison ou pour celui qui est admis gratuitement, d\u2019un billet comprenant à la fois le prix d\u2019entrée et celui du droit exigible.\u201d 4.Ladite loi est modifiée en y insérant, après l\u2019article 8, les suivants: \u201c8a.Celui qui tient ou exploite un lieu d\u2019amusements peut être poursuivi personnellement pour toute infraction aux dispositions du paragraphe 2° de l\u2019article 8, commise par une personne à son emploi, à moins qu'il ne prouve que l\u2019infraction a été commise hors sa connaissance et sans son autorisation.Au cas d\u2019une troisième condamnation, pour une infraction aux dispositions du paragraphe 2° de l\u2019article 8 contre celui qui tient ou exploite le lieu d\u2019amusements, la licence doit être cancellée.\\\\ es & 2 PEREIRA EIA: cts SL AEU SEL MES LATE EL FEDLA à LATIN ICI NC NE A LA CAES ADSL EC ES CHR TABLE \u201cA\u201d An Act to amend the Amusement Tax Act.17 George V, chapter 36.(Assented to on the 1st April, 1927.) HIS MAJESTY, with the advice and consent of the Legislative Council and of the Legislative Assembly of Quebec, enacts as follows: 1.Section 4 of the Amusement Tax Act (Revised Statutes, 1925, chapter 125), is replaced by the following: \u201c4, The duty shall be exigible in all cases, except in the case of entertainments given by amateurs residing in the Province, who receive no remuneration for their services on such occasions, and given in workmen\u2019s or parish or private halls, for patriotic, agricultural, social or religious purposes, provided that the person, society or association, giving such entertainments, shall have previously given notice thereof in writing to the director of the Quebec Bureau of Public Charities.\u201d 2.Section 5 of the said act is replaced by the following: \u201c5.The holder of a complimentary or season ticket, and every person who is admitted free into a place of amusement to attend or take part in an amusement shall pay the duty based on the price of admission that \u2018he would pay if he did not- hold such ticket or was not admitted free.\u201d 3.Section 6 of the said act is amended by adding thereto the following paragraph: \u201cThe Provincial Secretary may, in writing, prescribe the adoption, by any municipality, of the use, for any person other than the holder of a complimentary or season ticket or one who is admitted free, of a ticket including both the price of admission and that of the duty exigible.\u201d 4.The said act is amended by inserting therein, after section 8 thereof, the following section: \u201c8a.Every person who keeps or operates a place of amusement may be sued personally for any infringement of the provisions of paragraph 2 of section 8, committed by anyone in his employ, unless he prove that such infringement was committed without his knowledge and authorization.In the event of a third condemnation for an infringement of the provisions of paragraph 2 of section 8, rendered against the person keeping or operating the place of amusement, the license shall be cancelled.\u201d Ce TET EE TT SR EB UL TY LON ETRE LI SO Pa Duper De ene ee eee de uel es adatea telat siete ee by ISSR CAC EMRENCE 14: EHR tit TABLEAU \u201cA\u201d (suite).\u201c8h.Quand une infraction aux dispositions de la présente loi est commise par une société ou une corporation, ayant ou non une licence en vertu de la Loi des licences, et quand un jugement est rendu en vertu de la présente loi contre une société ou corporation, ce jugement peut, a défaut de paiement de l\u2019amende et des frais par cette société ou corporation, être exécuté: dans le cas d\u2019une société, contre chaque membre de la société: dans le cas d\u2019yne corporation, contre son président, si celui-ci est dans la province, sinon contre son gérant ou représentant dans la province, et la sentence d\u2019emprisonnement peut être portée contre ce membre ou cet officier, selon le cas.\u201d \u2019 5.Ladite loi est modifiée en y insérant, après l\u2019article 9, le suivant: \u201c9a.Les amendes imposées en vertu des dispositions de la présente loi appartiennent à la couronne, pour faire partie du fonds de l\u2019Assistance publique.\u201d 6.L\u2019article 10 de ladite loi est modifié en y insérant après le mot: \u201centrer\u201d, dans la troisième ligne, les mots: \u201cgratuitement sans payer de droits d\u2019entrée.\u201d 7.Llarticle 12 de ladite loi est modifié: \u201ca.En y remplacant le mot: \u201ctrésorier\u201d\u2019, dans la troisiéme ligne du deuxième alinéa, par le mot: \u201csecrétaire\u201d; \u201cpb.En y remplaçant le mot \u201ctrésorier\u201d, dans la troisième ligne du quatrième alinéa, par le mot \u201csecrétaire\u201d.8.Ladite loi est modifiée en y insérant, après l\u2019article 13, le suivant: \u201c14.Le lieutenant-gouverneur en conseil peut, par proclamation, | décréter qu\u2019à compter de la date mentionnée dans cette proclamation, la municipalité y désignée, située dans le voisinage d\u2019un territoire non organisé, dans lequel est établi et exploité un lieu d\u2019amusements, a juridiction relativement à la perception des droits d\u2019entrée dans ce lieu d\u2019amuse- \u2018ments et que les dispositions de la présente loi s'appliquent, mutatis mutandis, à leur perception.9.La présente loi entrera en vigueur le jour de sa sanction, XX I il de TABLE \u201cA\u201d (continued).\u201cQh.Whenever any infringement of the provisions of this act has been committed by a firm or corporation, whether having a license or not under the Quebec License Act, and when judgment has been rendered under this act against a firm or corporation, such judgment may, on failure of such firm or corporation to pay the fine and costs, be executed, in the case of a firm, against each member of the firm; in the case of a corporation, against its president if he is in the Province, and if not, against its manager or representative in the Province, and the sentence of imprisonment may be rendered against such member or officer, as the case may be.\u201d 5.The said act is amended by inserting therein, after section 9 thereof, the following section: \u201c9g.The fines imposed under the provisions of this act belong to the Crown, to form part of the Public Charities\u2019 Fund.\u201d 6.Section 10 of the said act is amended by inserting therein, after the word: \u201center\u201d, in the third line thereof, the words: \u201cfree and without paying any entry duty\u201d.- 7.Section 12 of the said act is amended: a.By replacing the word: \u201cTreasurer\u201d, in the third line of the second paragraph thereof, by the word: \u201cSecretary\u201d; b.By replacing the word: \u201cTreasurer\u201d, in the third line of the fourth paragraph thereof, by the following word: \u201cSecretary\u201d.~~ 8 The said act is amended by inserting therein, after section 13 thereof, the following section: \u201c14, The Lieutenant-Governor in Council may, by proclamation, order that from the date mentioned in such proclamation, the municipality therein designated, situated in the vicinity of an unorganized territory, in which a place of amusement is established and operated, shall have jurisdiction with respect to the collection of the entry duty in such place of amusement, and that the provisions of this act shall apply, mutatis mutandis, to such collection.9.This act shall come into force on the day of its sanction.COST ILE ATLAS CMH NSM LE LU LIES EC IE TABLEAU \u201cA\u201d (suite).Loi modifiant la Loi de I'assistance publique de Québec.| 17 George V, chapitre 54.(Sanctionnée le ler avril 1927.)
