closing by-law for druggists which infringe upon Westmount druggists\u2019 rigats to sell artitles permitted to them as defined by the Quebec Pharmacy Act wat decided by Mr.Justice Tyndale, in the Superior Court, on Tuesday, to, be illegal and ultra vires, and were accordingly struck from the by-law by the court.The action to upset the by-law which requires drug stores in Westmount to close daily at 7 p.m, except for the sale of prescriptions, medical supplies and other specified articles, was taken by the owners of Macy's Drug Stores Reg'd.They contended that the early closing bylaw was ulira vires of the powers of the Westmount City Council and was further illegal because it came in conflict with the right given to pharmacists by the Quebec Pharmacy Act, because it conflicted with the Federal Lord's Day At, because it was oppressive and discriminatory, ard because it benefitted no one in Westmount and caused pre- Judices to the plaintiffs.With regard to the conflict with the Quebec His Lordship came to the conclusion that a municipal by-law could not legally restrict the professional activities of the members of a duly constituted profession, which Is regulated by a special statute.Outside their professional activities, however, such members of a profession are not entitled to any special privi- Pharmacy Act, i lege, he declared.Under the Pharmacy Act, Lordship pointed out, the professional activities of pharmacists are concerned with the retailing, dispensing.and compounding of drugs or poisons.In this particular field, governed by the Pharmacy Act, the Act.Penfield Praises Mission Hospital Appointed by the Canadian Government to study medical institutions in Russia and China, Dr.Wilder Penfield, of Montrose Avenue, and Director of the Montreal hospital has two hundred and twenty beds and is under the direction of Dr.A.Stewart Allen, a graduate of McGill University.On the staff are twelve Chinese doctors, twenty-eight graduate Chinese nurses
