system of Po administration can be traced back over the course of the province history, according to Westmount city councillor Tom Thompson.During a presentation, entitled Civic Power in Quebec: Myth or Reality, made to members of the Westmount Municipal @®.last week, Thompson traced the historical roots and some of the influences he maintains have contributed to Quebec's current political system.He suggested the province's old seigneurial system, which was not abolished until the mid- 19th century.left an indelible imprint.\u201cIn that time, you didn't have citizen representation, you had the interest of the seigneur and the interests of the militia, and the interests of the Church and the interests of the magistrates of the government,\u201d said Thompson.\u201cIn fact, the habitants, they didn't care.They knew how to live off the land and survive, | guess, better than most.\u201d Thompson noted that Lord Durham, author of the famous report recommending the assimilation of French Canadians, had also made some of the first suggestions for establishing municipalities.About threc decades later, Westmount became a city.\u201cSo the municipalities act was a very good code standards that were in force è.the building was erected in the late 1950s.But the condo owners are being saddled with the cost of meeting current code standards.\u201cMy understanding is that the building was built at a certain period in time under the code as it was then,\u201d said Marks.\u201cIf a building is damaged more than a certain amount and is rebuilt, it has to be rebuilt according to the code as it stands now \u2014 not according to the code as it was when it was first built.They are insured for the replacement value.not replacement to a higher standard \u2014 which is the standard of the City.Or they're saying that it's not to a higher standard, which is the standard that the City now requires.\u201cI think where the problem lies is that they say the tenants are saying, \u2018well, replacement has to be to the standard that\u2019s in force, because you have to meet the current bylaws,\u201d added Marks.\u201cSo they're saying the insurance company should pay for it because that is replacement value.You're replacing what they had before, but according to what the City requires now.\u201cThe insurance company, | understand, is saying no, \u2018replacement is replacement of exactly what was there and what we're now being asked to do is a higher quality\u2019 and therefore theyre not agreeing to pay for it .But I believe that what happened is the bylaws when the building was built are different from the bylaws today.\u201d government decided that you don\u2019t have to worry,\u201d he said.\u201cAll you do is borrow against the future.And if you're a government, you can borrow more money.\u201cSo we got into some borrowing problems there.The City of Montreal got into some borrowing problems.But there was the answer \u2014 the simple and charming Tremblay proposes dropping the ludicrously undemocratic system which enabled him to nominate the Montreal members rather than allowing voters\u2019 to be represented.He has not vet apologized for pushing Jean Charest into it, nor has Charest acknowledged his folly in supporting it! The Liberal government has put a high priority on reform of all the aggloms.The ADQ, as official opposition, requires it and is committed to abolishing them.Before accepting any compromise, the ADQ has undertaken again to consult the mayors.The PQ, as the second opposition party, has made a backroom deal to support the Liberals: they claim credit for the forced-mergers, but not Charest\u2019s imperfect demerger solution! So the players have lined up \u2014 Charest, Dumont, Tremblay.The omens seem good for at least major reforms of the Montreal council.Quebec calls again At the Union of Quebec Municipalities conference at the end of last month, the Island mayors were represented by Bill Tierney (Sainte-Anne-de-Bellevue) and John Meaney @\".Premier Jean Charest and his RE/MAX WESTMOUNT INC.1330 Greene Ave.PS TIR à 4933-6781 Civic Alert Jan WEDGE Municipal Affairs Minister Nathalie Normandeau went out of their way to promise them reforms.Then last Wednesday, a delegation of nine mayors, who made a 12-hour drive to Quebec City, got a rewarding welcome from Raymond Bachand, the Minister responsible for Montreal who is leading the reform plans.There, too, were Normandeau and the Montreal Liberal caucus.Their evening meeting took place in the cabinet offices, although Charest was not present.Nearly all the local MNAs took part.\u201c] have never come away so convinced that the Liberals were listening to us,\u201d enthused Beaconsfield\u2019s Bob Benedetti.The situation was confirmed with a separate meeting with the ADQ and a group of MNAs led by Martin Camirand, a former member of the St Jérome executive who is now opposition spokesman for municipal affairs.\u201cThey were also very understanding of our position,\u201d Benedetti added.\u201cIt was 3 a.m.when we got back, but all felt optimistic about what we were told.\u201d Intensive negotiations between the mayors ant the minister have been going on ever since, both by phone and e-mail.In the demerger years, the mayors and other activists fought for the council to have such a composition.But it does not transform it.With the hindsight gained from attempting to unravel Montreal\u2019s inside workings \u2014 particularly the domination by the central functionaries rather than the elected \u2014 the mayors want something more.It could be good for Montrealers, too.Corporate model One possibility, inspired by the unanimous report of the Pichette Commission of 1993, is a series of municipal corporations.They would be similar to the established STM, which operates the Metro and bus services with its 7,500 workers.Its management is at arms length from the political control, although the agglom is responsible for the funding and major decisions.Many regional services could be operated in the same way.Tremblay is, in fact, suggesting that water provision should be one of them.This is complicated under the present agglom because Pointe Claire operates its own system.Citizens there are paying the debt of building the plant, but because of agglom rules must also pay a share of Montreal's water costs, even though they do not use it.Liberal votes on the West Island are threatened if the double-pay method is not changed, hence Tremblay's eagerness to alter it, Other departments that could be operated similarly include police, fire, evaluation, regional parks and even the local Arts Council.In a sense this is turning back the clock to the old MUC, which controlled most of these services before 2002.The big difference: there is no likelihood of the suburbs having any veto as with the MUC.Waste reform Other tasks that might qualify for regional supervision are the disposal of garbage and recycling.These have become Montreal\u2019s liability although door-to-door collection are local responsibilities.With the need to decrease the garbage and increase recycling, local direction is in the best position to promote these goals.If huge \u2018OGILVY, + you monsieur » LS landfills are to be managed, or \u2014 very unlikely \u2014 a new incinerator is to be built, only then is it possibly a regional matter.More feasible Island-wide might be the operation of composting facilities.However, we may need multiple plants once we take Kitchen waste seriously, so perhaps this should be à local service rather an Island-wide one.In the longer term, Mayor Karin Marks is thinking that treatment methods could become very local and responsive to those creating waste rather than giving the problem to someone else.The idea of these separate companies is very promising.In the business world such organizational models are common.Sprawling corporations make sure that operating divisions have the freedom to work efficiently to meet their goals.Why not with Montreal?(Continued on page 16) & ARK RALPORCAGREN TED larsenw@transcontinental.ca It is a sick, sorry tale of legal bickering that once bordered on the mildly absurd but has now transcended all vestiges of common sense and entered into the dubious realm of sheer bureaucratic stupidity.A year and a half ago, neighbours in a condo building overlooking Westmount Park \u2014 yes, the very same playing fields currently being viciously defended by anti-synthetic turf advocates \u2014 were suddenly forced from their homes when a major fire tore through the building.Windows and doors in the most heavily damaged units were boarded up as stunned residents went off to live in borrowed, rented or otherwise procured temporary accommodations while waiting for the high sign to return.That sign never came.From the bone-chilling days of late- November 2005 to the oppressive heat of mid-June 2007, these people have yet to be able to go home all because of a legal hiccup that precludes adequate payment from the insurance company to cover the cost of renovating the damaged units.It is said to be a question of codes \u2014 the need to rebuild to meet the standards of a municipal code that was considerably modified since the building was first erected.The insurance will cover the replacement of the original features, but not the improvements now required by the updated code.This may sound simple, but it amounts to a horrible catch-22 for the victims, who have been betrayed by the system.Not only have they been out of a home for all this time, but what about their investment?Even the savviest real estate agent in Westmount would have a hard time selling a condo unit in a burned-out building, despite its view of the park and proximity to the bike path.There are no real villains in this case.The insurance company is conducting itself according to standard procedure, while the innocent condo owners continue to be victimized by circumstances beyond their control.Any lawyer will tell you there are plenty of cracks and loopholes in our complex legal system, but this is one big crack that must be filled immediately.Whether this will happen is anyone\u2019s guess, and in the meantime all we can do is follow this terrible stalemate with mounting disgust and the bitter realization that yes, this kind of thing can happen in Westmount.?Garage sale fever get you over the weekend Father's Day à to the editor Don't blame the City To the editor: The Westmount City Council announced last October, that in order to accommodate the increased demand for soccer-playing facilities in Westmount, they were considering replacing the natural grass of two soccer fields with a durable synthetic surface, south of Westmount park.There was a skirmish against this idea instituted by some residents of Melville Avenue, whose homes face the park.This has developed into a \u201cturf war.\u201d At several recent city council meetings, practically all the question periods have been taken up by questions and comments opposing \u201cWe are equal now,\u201d he bellowed at the suspect, who immediately responded with a shot directed at the officer.It missed.Both darted behind trees, and thence began a shootout worthy of an old-fashioned American western.The Montreal Star proclaimed in its familiar histrionic, Tory fashion: \u201cOn the one side there was the desperado anxious only to get away, and in the death of the man before him seemed his only chance.On the other side was the watchman entrusted with the important duty of protecting the property of the town which employed him, and he meant to get his man dead or alive.\u201d In all, nine shots were fired\u2014five from the gun of the miscreant and four from Vickers\u2019s service revolver.Only the latter had success, striking the felon in the right arm, whereupon, according to The Gazette, \u201che quickly dropped out of business.\u201d Now wounded and, for all intents and purposes, captured, the individual in question (later identified as one Frank Mooney) agreed, albeit reluctantly, to allow himself to be escorted to the nearby police station.The Gazette picked up the story: \u201cFor a while he went along quietly, merely attempting to drop things from his pockets, which the constable made him replace.At the corner of Metcalfe Avenue and Sherbrooke Street the man made a most determined effort to escape, after trying in vain to hit the constable over the head with a hammer he had in his possession.\u201d When the pair arrived at the station, Mooney was systematically searched and discovered to have had in his possession a litany of burglars tools\u2014from a jimmy to several picklocks, \u201cthe articles he had been attempting to distribute along the road.\u201d As he was near fainting from loss of blood, he was brought to the Western Hospital (today the Children\u2019s) where his elbow wound was dressed by Dr.Galletly.He was later transferred to the infirmary of the Montreal jail where he awaited court proceedings.Later, in the afternoon of that same day.Mooney was brought before the Hon.Judge Ulric Lafontaine of the Police Court, Court of King's Bench, then located in the old Justice Building adjacent to the Montreal City Hall.Showing no remorse or pain (\u201cthough his Photo courtesy of the Westmount Historical Association right hand was almost black with blood driven to it by the tight bandage round the wound\u201d), Frank Mooney, aka Frank Malloy, pleaded not guilty to the charge of attempted murder and demanded a lawyer.He made no attempt to hide his face but, at the same time, glared ominously at the sketch artist who had been sent to cover the story for The Montreal Star.Mooney did eventually retain legal counsel - Maitre J.P.Cooke of the law firm Cooke and Mullin\u2014and all appeared before Judge Matthias C.Desnoyers on Oct.25 of that same year.During the proceedings, Cooke aggressively tried to shake Constable Vickers version of the events to such an extent that Desnoyers cautioned the legal practitioner, later interrupting him with the exclamation: \u201cYou might be able to bluff a jury of ignorant men, but you can\u2019t bluff me!\u201d Time ultimately established that Mooney.42, an American from Cleveland, had just completed serving a four year sentence in Buffalo, NY, for having shot a policeman in that city and whose own police superintendent described him as \u201can all round crook.\u201d On Nov.10, Mooney, testifying on his own behalf before a Montreal jury, casually explained away the existence of a black mask found in his pocket as belonging to his little daughter \u201cafter a party at his home\u201d in Ohio.However, he failed to comment on the presence of other assorted and dubious items which were found in his possession at the time of the encounter with Constable Vickers.The jury took all of 15 minutes to find Mooney guilty of attempted murder and he was eventually sentenced accordingly.As for Constable Charles Vickers, his Westmount excitement was not exclusive to the incident in question.On Oct.20, 1905 (only three days after his adventure with Mooney in the city green), he made the macabre discovery of the dead body of one George Wilkinson, cabman, living at 135 Nazareth Street, Griffintown.Vickers had spotted the horse drawn cab sauntering along on Western Avenue (today de Maisonneuv, riderless, and he decided to investigate.Tht officer, who only days earlier had courageously engaged a harden criminal in a gun fight in a tenebrous Westmount Park, jumped back in horror when he opened the cab door and saw the corpse of its late driver!
