Montreal is considering a six- lane, limited-access service road for the Trans-Canada highway, to run accross the southern edge of Westmount between Atwater avenue and Glen road.The plans threaten homes on Greene avenue that were rescued from demolition for the elevated highway and park land now under development by Westmount.Though technically still on the drawing boards at the Montreal planning department.the highway plans have been debated with several groups affected by the proposal.but never with Westmount.A source at the planning department told The Examiner Tuesday \u2018discussions\u2019 have already been held with the Montreal Urban Community Transportation Commission, which would lose a repair shop if the road is build.and Bell Canada, which might lose considerable parking space.The City of Westmount, through whose territory much of the proposed new highway runs, only learned of the plans \u2018accidentally'' last week.Newsof the suggested highway came out at Monday night's city council meeting, when Ald.Douglas Robertson announced that the city will try to find out everything they could about it.The highway plans, he said, were discovered by end of the site following issuance of an excavation permit by the city on Friday.A steam shovel unceremoniously dipped its claw into the ground with only construction workers on hand to mark the occasion.As with the contract-signing for the project, the city organized no ceremony for the event.While excavation went on as planned, the on-again.off-again rail strike forced cancellation of plans made available three weeks ago by the Montreal Urban Community police department, still sits in the police garage on Stanton street while officials consider how it can be put into service.Meanwhile, an ambulance was called from station 10 in downtown Montreal yesterday to transport an injured man to the Reddy Memorial Hospital.The call is the second in as many weeks for a Montreal police ambulance to come into Westmount.At Monday night's city council meeting public safety commissioner James Thom took note of last week\u2019s letter to the editor of The Examiner, as well as a similar one being the foreign investment review bill and the other being tax incentives.Two areas of clarification have presented themselves, which I would like to discuss in detail.The first is the question of significant benefit.What is it?We believe that it is necessary to ensure that future foreign take-overs and the establishment of new - foreign controlled businesses will be of significant benefit to Canada.How?By encouraging such enterprises to put greater efforts into: exporting and innovating.processing raw materials in Canada, procuring supplies in Canada, doubling Canadian managerial and technical talent, decision making, and risk taking.In considering whether the foreign investors' proposed investment in the Canadian business will bring significant benefit to Canada five factors will be taken into account: 1) The effect of the proposed investment on the level and nature of economic activity in Canada.including employment; 2) The degree and significance of participation by Canadians in business enterprises and in any industry or industries in Canada of which it forms a part; 3) The effect of the proposed investment on productivity, industrial efficiency.technological development, product innovation and product variety in Canada; 4) The effect of the proposed investment on competition within any industry or industries in Canada; and 5) The compatibility of the investment with national industrial and economical policies, including those enunciated by the provinces.Minister's role In reviewing the proposed investment, the Minister may not be convinced it will bring significant benefit to Canada\u2014or may wish to have more information with which to assess it.The Minister could discuss the matter with the foreign investors, with persons the foreign investor requests be consulted, and with the government of the province concerned.Those consulted would have the opportunity to make representations and to provide additional information.The investors may also offer additional undertakings.tearing it down to make room for a more modern building.It is reported that the land has been purchased by Harry Bronfman.another Westmounter.\" Fifteen Years Ago August 8, 1958 \u2018Miss Alice N.S.Lighthall, daughter of the late W.D.Lighthall, has offered to the City as a gift a portrait of her father who was Mayor of Westmount from 1900 to 1902.The Council at its meeting on August 4th accepted the gift on behalf of the City.It would appear that the late Mrs.LightHall expressed the wish that the portrait of her husband be offered to the City.\u201d Five Years Ago August 8, 1968 \u201cThe City of Westmount has signed an agreement with the Rubin Corporation Limited to prepare a feasibility study and a program for the eventual redevelopment of the urban renewal area in the south eastern section of the city.Mayor Tucker said that, under the terms of the agreement, the Rubin Corporation has the exclusive right to work on the development program until July 15, 1969.\u201d The bill recognizes that foreign direct investment often brings benefits to Canada and has a role to play in development of the Canadian economy.Frequently the benefits can be improved and the Bill provides opportunities to improve them.It rules out discrimination among countries or retroactive discrimination against firms already located in Canada; but rather.is future oriented.The bill envisages a policy within the range of reasonable foreign investment policies being adopted by other countries.The second point for clarification is the question of Canadian control and the \u2018presumption of non-eligibility.\" The non- eligible person is defined precisely in the bill and includes a citizen of a foreign country who is not a landed immigrant in Canada; a landed immigrant who has been here for six years and has not become a Canadian citizen; or a Canadian citizen who is not ordinarily resident in Canada.Whether a person is ordinarily resident in Canada will, of course, depend on the facts of the case.The intention is that persons who do not have their main place of residence in Canada should be considered to be non-eligible.The \u2018group\u2019 concept can be explained as follows: A corporation is presumed to be non-eligible if it is controlled by a group of persons any member of which is non- eligible.The concept is used because of the difficulty of penetrating the group to determine the degree of control exercised by any particular person, such as the non- eligible person.The effect of this is modified to a certain extent by clause 3(7).Not understood The presumptions of non-eligibility are a very important part of the bill and are probably an area that has caused a good deal of confusion because they are not clearly understood.The presumption of non-eligibility of a corporation are: if more than five per cent of the voting shares are owned by any single non-eligible person, the corporation is presumed to be non-eligible or foreign controlled.the corporation is presumed\u2014and 1 emphasize the word presumed\u2014to be non-eligible or foreign controlled.If 25 per cent of the voting shares of a publicly traded company\u201440 per cent of a private company \u2014 are owned by non- eligible persons in aggregate, again the company is presumed to be non-eligible, even if no single non-eligible shareholder owns five per cent or more.The presumptions of non-eligibility do not attempt to define when a corporation is non-eligible or foreign controlled.If a company is controlled by a non-eligible person or foreigner.that company is foreign controlled and subject to review \u2014 regardless of the so called level of presumptions \u2014 whether the foreigner exercises control by means of three per cent of the voting shares or six per cent, ten per cent or any other percentage.The presumption is mainly relevant where a transaction is brought before the court.It merely places the burden of proof on the non-eligible shareholder or shareholders involved, rather than on the government to demonstrate where control does, in fact, lie.; To discuss highly specific points of a bill in an article such as this has its limitations.However.my travel across western Canada recently.and my visit to Westmount have shown that these two questions are those most frequently asked by men of business.To misunderstand these two points is to miss the whole aim of the bill.which is to improve the benefits of foreign investment and to be fair and reasonable towards foreign investors.Should you wish to study the foreign investment review bill in its entirety, copies of it are available through my office at 283- 5789.e City's 1972 finances Westmount's deficit for 1972 turned out to be less than half of the budgeted amount according to the city\u2019s financial statements that were approved by city council at their statutory August meeting Monday evening.\u2018The actual deficit for the year turned out to be $261,513 while that budgeted $503,900; leads to charge for no license A car which went out of control on Cedar avenue last Wednesday evening caused considerable property damage to two different lawns and resulted in charges being laid against the unlicensed driver of the vehicle.Cliff Clemons, a 20-year-old Montrealer, was headed east on Cedar avenue near Mountain avenue at about eight pm in a 1973 Buick owned by a New York City
