But the requirement that the nonsmoking section start at the door, so that non-smokers do not have to pass through a smoking section to get to their table, is going too far.The bylaw should not try to create a scamlessly protective bubble, guarding non-smokers from door to table to bathroom.It is meant to give non-smokers a section in which to eat.Some restaurants are laid out in such a way, like having the bar at the front, that the draft bylaw would require owners to make massive renovations to comply.That just doesn\u2019t make sense.And there should be an exemption for small establishments, like Muffin Muffin\u2019s two seats.A trickier point arose when some restaurateurs argued that patrons are mostly smokers and the bylaw will hurt their revenue.Customers will go elsewhere, where bylaws are less restrictive, some said.This bylaw is supposedly because of citizen pressure.The city has received numerous complaints about the lack of non-smoking sections, according to director Richard McEnroe of the Public Security Unit.In theory, then, a non-smoking section that doubles in size should benefit patrons and merchants.If it doesn\u2019t, then the bylaw is indeed poorly timed and should be revisited.Should restaurant owners have the option to declare their premises 100 per cent smoking, as bars are?It appears to be within their rights now to be 100 per cent non-smoking.Another troubling part of the bylaw is enforcement.Merchants are expected to tell smokers to snuff it.Problem is, many of them won't want to be the bad guy to someone who is a potential customer or repeal customer.They certainly won't want to get on the wrong side of the person fixing their clectrical failure or burst pipe.So merchants won\u2019t do it, and we're back to the current problem of lack of enforcement.It is up to customers themselves to report transgressions, to alert the city to non-conforming restaurants and businesses, which can then be checked for proper signage and compliance.No one brought this up, but a lingering question is how many merchants are really going to put a pictograph (not yet specified) in designated smoking areas with the caption, \u201cWARNING!
