he can also kick. But while he is pulling he can’t kick.likewise while he is kicking he can’t pull.” And so they go on pulling and eliminating the kicking.Get acquainted with some rural letter carrier this swimmer, learn a little about his work and his thoughts, Perhaps he will allow you to ride around his route with him some it will be an interesting experience.Perhaps vou will find that he is happy to take à few magazines with him to leave in roadside boxes which seldom con- Many letter carriers carry much news of the day tain magazines.more than mail: outside world, and often worthwhile reading matter which giit utknown friends to homes which otherwise would know little of lite- thev carry cheer, is à from rary richness.EDITORIAL NOTES When a Medford (Ore) doy of ten felt the need of a little extra spending money, he went to a near-hy gold camp and washed out 75 cents’ worth of the precious metal with a pan.The ordinary voungster, similarly motivated.will find, however.that drying the family dishes.if less romantic, is more likely to bring certain re- with alarm.Soft shirts at dinner.it is felt.will ————————————————————————— turns.— Le | ee RoR, EEE Re EXAMINER PRINTING Letterheads, Envelopes, ' Circulars, Tickets, Folders, Our Job Dept.k Reädy to look after your requirements whether Quotations given upon request 5736 Park Avenue Invoice Forms, etc.large or small te, COURIE THE _EXAMINER-COURIER, THURSDAY, AUG + - By LYON W.In a Judgment rendered by the Supreme Court of Canada, it was decided that where the Respondent chauffer, while using his employer's automobile for purposes of his own, in violation of instructions, and driving the (ar at an excessive rate of speed killed the Appelant’s son.The negligence of the chauffeur in this case was admitted. There, however, was no want of care on the Respondents part in engaging him and from evidence it was also adduced that the employer had exercised reasonable supervision. It was held that the employer was not liable as at the time of the accident the chauffer “was not in the performance of the work for which he was employed.” The owner of an animal, moreover, is responsible for the damages caused by it, whether it be under his own care or under the care of his servants. He who is using the animal is equally responsible while he is using it.The owner of a huilding is responsible for the damage caused by its ruin where it has happened from want of repairs or from original defects in its construction. In all cases where the person injured by the commission of an offence or a quasi-offence dies in consequence, without having obtained indemnity or satisfaction, his consort and his descendant and descendant relations have a right, but only within a year after his death, to recover from the person who committed the offence or quasi-offence, or his representatives, all damages by such death. In the case of à duel, action may be brought in like manner not only against the immediate author of the death, but also against all those who took part in the duel, whether as seconds or us witnesses. In all cases no more than one action can be brought in behalf of those of who are entitltd to the indemnity and the judgment determines the proportion of such indemnity which each is to receive. These actions are independent of criminal proceedings to which the parties may be liable and are with- “LAW AND JUSTICE” — DAMAGES — UST 3rd, 1933 p JACOBS, K.C.limited period of time. The following actions are prescribed by two years:—Damages for seduction.Damages resulting from offences or quasi-offences whenever other provisions do not apply, such as damages for Breach of Promise for marriage. The following actions are prescribed by one year:—Damages for slander or libel, reconing from the date they came to the knowledge of the aggrieved.Damages for bodily injury, save in the special provision contained in! article 1056 which states that in! all cases where the person injured by the commission of an offence or quasi-offence without having indemnity thereof, his ascendant ov cescentau.relations have a right, but only within a year after Hs death, may institute an action against the person who committed the offence of quasi-offence for all damages occasioned by such death.oh- A HEALTH SERVICE OF THE CANADIAN MEDICAL ASSOCIATION AND LIFE INSURANCE COMPANIES IN CANADA BEWARE Beware of summer diarrhoea! To the parents of babies.we repeat the warning, Beware! Summer diarrhoea ix one of the most fatal conditions which attacks young children; it brings death to over five thousand Canadian babies each year, Most of the cases and deaths occur during the months of August and September, and this is the reason why, at this time, we wish to urge upon the parents of babies the need for such extra care as will protect their children.i The most important point in this care has to do with the milk which the child receives. If the baby is breast-fed, there is no danger in so far as his milk needs are concerned. For the child who is using cow's milk, it is absolutely essential that the milk be pure and clean. In warm weather there is a greater chance of contamination; there are out prejudice thereto. In order to exercise a claim for damages it is well to note that the action must be instituted within a CANADIAN MISSION NOTES + f I -—+ eof The regular Sunday Services were held in the Rialto Hall “B”, 571! that in acordance with plans bf the Quebec Amateur Lacrosse Association, the winner in his section would be matched with the champions of the Montreal Senior Group for higher Provincial honors: Should the Intermediates be strong enough against their Senio¥ colleagues, a trip to Cornwall and Toronto has been definitely assured, to compete in the Ontario play-downs.This should tend to increase optimism in the ranks of local lacrosse prayers, who appear quite capable of giving the seniors a hard time, according to President Sylvester.Teams Better Organized It was a source of regret that greeted the withdrawal of two teams in the earlier part of this season in the North End Lacrosse League.Jarry Park and St.Michael's were forced to disband because of insufficient support. To save the situation, Park Extension finally decided to merge forces with the depleted St.Michael's squad, and agreed to adopt the latter name. This friendly move was well received on St.Michael’s side for it had again gave them the ‘pride they held in this name.MacGillvray and Wright became the -leaders of this group.Outremont Invaders, Rosemount and Monte- fiores carried the colors of their three groups to complete a study foursome.Plenty of good playing material has been added to this group in the past few weeks, and all four teams are well equipped for the game. The acquisition of several senior class players from St.Jean de Mantha by the Rosemount team and two for Invaders has served to bolster these squads up fairly well.Montefiores, the only known all-Jewish Lacrosse Club in Canada which is managed by ‘Harry Campbell, himself a player of note in these parts, is a strong aggregation formed mainly of last year’s players. The Irish named team shows no weakness in fast, aggressive style and although their spurioug/drives have gained little so far, there now seems to b: a better chance for them since the re-organ- ization of the team lately.Injuries have added a hard time for the latter team, and the absence of several stellar players for the balance of this season.Veteran Billy Burns of Shamrocks, still young enough to show others how to play the game, suffered severe injuries which confined him to the hospital for two weeks, was a sure loss for St.Michael’s.Montefiores at Outremont Montefiores clash with Outremont Invaders next Wednesday night at Rockiand Park, in a regular scheduled game beginning at 7:15 o’clock. Both clubs have followed a steady but close race for leadership this season, and next week's game is expected to surpass previous tilts, since Montefiores have been defeated twice by the Invaders.Standing of Clubs P.W.L.D.F.A.Pt.Rosemount 7T 43 0 22 17 8 Out, Invaders 6 4 2 0 15 12 8 Montefiores 7 4 3 0 13 10 8
