and having the whole train of its proceedings thus regularly submitted to its inspection, it may take such measures, as upon this review appear to be necessary, in order to correct errors,.to redress wronge, or to enforce the obserrance of general rules, &o.\u201d «Such a right of executive power exeroised witb wisdom,\u201d says Dr.Jamieson, and in the apitit that should characterise a Christian Court is osloulated to be of the greatest utility, as not only a check to the influx of irregularities, but a pre ervative of soundness and purity in dootriue, as well as an orderly and uniform practice in all parts of the Churoh.\u201d It is obvious that a question affecting a change in the form of worship should be brought up in the higher Courts before it is subwitted to the Congregation.The latter nourse is ceutrary tothe whole spirit of Presbyterian Church Government, whereas the former is oonstitutional.Surely if any proposed change has real merit and is likely to prove beneficial, its promoters have nothing to fear from submitting it to and advocating its claims before the intelligent assemblies that legislate for the peace and welfare of the Presbyterian Churoh.The moderator pointed out that thera was only one possible oiroumstance in which the law of the Church of Scotland could apply to churches in this country, and that One was when the Synod itself had not legislated.If that which they were discussing was such a matter it would bo perfectly competent to quote the Church of Scotland authorities, but they were bound, in the firat instance, to consult their own authorities.Me.MoLonnan\u2014If we have no law our solves we ge back to the Scotoh ?The Moderator\u2014Yes, but we have a law.Mr.MeLennan resumed hiz argument.In addition to the laws of the Church of Reot- lard having been violated, tho special bylaws of St.Andrew's Church have been The congrégation of St.Andrew's Clurob, it is perhaps unnecessary to say, is incorporated by Act of Parliament.With the permission of the court I will oite the first article of the by-law to which I have just referred.It roads as follows: ARTICLE 1.This church and congregation now in con- neotion with the Established Church of Soot- land, »nd adhering to the standards thereof, deolars that they shall continue to adhere to the said standards thereof and maintain the form of worskip and government of aaid chureh.This by-law was made by the Trustees of the ohurch, and could only be altered by them.I need only remark thrt it never was siteced.It is said that the form of worship was not altered, but mercly the meds.This, Moderator, is surely a distinction without a difference: three or four standard dioti i which I have consulted, define the two words in torms which are almost completely identical.With regard tothe petition which was drawn up with a vies to putting an end to these unhappy differences, and which was resented to the session on the 15th June ast, I would say that it was signed by 89 persons, and, as far as the respectability of the list is concernod, it would compare favorably with any that conld be drawn up by any portion ef the céngregation of St.Andrew\u2019s Church.In addition to the 89, I have a list of 63 persons who were desirous of an immediate.return to the former mode, but who shrank from involving themselves in the troubls and annoyance which might arise from appending their names to a dosument of that character.Of the 89 who rigned, I believe 58 were members of the Church, and of the 63, 42 were members, so that about a third of the whole membership of the Churoh are dissatisfied with things wa they are at present.I do not think Moderator, that 80 large a minority as this should have been passed over without any sonsideration whatever; they are s minority it is true, but they have their rights, and these rights ought to be respected.Well, the petition was acoom- prnied by a letter signed by the Committee, Aes:rs.Ogilvie, Buntin and MeLeanan, whioh was read at an earlier stage of these prè- ceedings by the Clerk of the Court, and which, as you will remember set forth that we would be most happy to give the Session overy information we eould afford with a view to the restoration of peace in accordance with what we deemed to he right.That letter was signed en behalf of the signers of the petition.It is true, perhaps, that we onght to have sent with the letter an extract of the minutes of the meeting at which we were appointed ; but I appeal to the Court whether it is at sil likely that Mr.Buntin who is a trustee of the church, and Mr.Ogilvie, who is so well and honorably known, and who has been all his life connected with the church, would have signed a document on behalf of others if they were not fully authorised to do so.From that day to this, then, the committee in official oapasity, have received no answer from the session.Now I submit that common courtesy, if nothing else, demanded\u201d that an answer should have been sent to.But, no; were treated with, sontempt ; they were passed over as -if.they were nobodies.It istrue that indiridual/as nigners they were invited to a conference between the signers of the memorial, and a committee of the session to be held on Tuesday night, the night previous to the last meeting of Prosbytery ; but as a committee they were not recognized, and they were nat Invited.The memorial was dissussed on the night of the 18th of January, and yet the meeting for conference was only called for the night of the 5th February.Can any one believe that the session was sincere in its desire to meet the memorialists fairly?They had eighteen days during which to meet the signers, and Jet the conference was put off to the ver last momeñit.To my own mind, it is perfest- ly eloer that they had no intention to meet the minority in a oandid apirit or to yield one iota of the matter in dispute.If they had, they certainly would aot have delsyed calling the cenference till further delay, and full deliberation were both and equally impossible.The session arras od matters so that the complaint could not be made at that mosting of the Presbytery, and they hoped that before the next meeting the matter would be allowed to drop.When a copy of the present complaint was sent to the Moderator of the Session, the Rev.Mr.Lang, he addressed me in a note asking my authority for sending the former.I immediately forwarded to Mr.Lang sn extract from the minutes of the meeting at which we were appointed.This did not satisfy him, for the following day I receiv.d a note from him, which I will read\u2014 749 Dorcrtarer Straer, 1 8re,\u2014I am favored with yours of this afternoon, enclosing an exiract from the minntes of a meeting, in December last, of * the signers\u201d of the petition, afterwards present- od to the Session of St.Androw*s Church, at which, asit spears, tro others and yourseif were appointed to represent the said signors in the proseoution, Lo « final issue, of the objeat contemplated by the said petition.You will pardcn.me asking a farther ox- tract from there minutes, showing who were present at that meeting, or, if no aedernnt wai taken.a list from memory of those who were.Co ; the expression of an American teacher, that when boys and girls were educated apart, the latter invariably went to the wall, and his experience in the legs! profession that women invariably suffered in all disputes.He hoped that she would be more faithfully educated in the future, and reminded the projectors of the prezent scheme of the responsibility which rested upon them.He trusted that the grand work would pros-' per, which he was assured it inevitably would do if their work was wisely and well done.Dr.Dawson moved that Lhe plan of lectures recommended be agreed to, and said that in the course of lectures it was not possible to take up elementary subjests, hence the importance of the students possessing a certain amount of calture before attending, and the desirability of having the lectures of each session related to each other, and still so dis- tinot that that now students could make a beginning at each fresh commencement.He recounted the list of studies which would be followed next year, and the studies deemed most desirable to succeed each of these in the year following.He quite approved of the plan laid down by the executive committee.He congratulated the lesturers upon ast winter's work, and the students for their applivaiion to the various branches and their auccèsses in examination.He highly approy- od of the system by which the ladies manag - ed their own affairs and considered this dis- oipline a necessary part their education.He did not think it worth while for ladies to attempt to obtain sdmission into MoGill Col- loge, but felt certsia that if due energy be shown, they could have a separate college built within three years or less.Heo sald some twenty years ago a Montreal gentleman, in advance of his time, had set apart property for this purpose, which would eventually amonnt to $400,000, and that an act of Parliament had been precured legalising the bequest.Ten wcres of land in a suitable spot was also provided for a site, and he believed that $100,000 could easily be se- oured by subscription, and an institution eet in operation whish would have every pros- ot of becoming more wealthy than the Mo- ill University.Here,
