which it will be regarded as abandoned, and all previous proceedings and payment of fees will be held at the expiration of that period as of no avail.20.Two or more separate inventions cannot be claimed in one application, nor Jatented in one patent, unless they are so dependent of and connected with each other as to Le necessarily taken together to obtain the end sought for by the inventor ; and in this latter case the Commissioner of Patents is the judge as to whether or not the pretensions of the applicant are founded in fact and reason.21.The filing of a protest against the issuing of a patent shall not be taken in itself asa sufficient reason to withhold the granting of such patent to an applicant.22.In cases of doubt, and in accordance with the letter and meaning of the law, patents may be issued for an invention already patented, a trial before a judicial tribunal being in such cages the only means of discovering who is the real or first inventor.23.A caveat must be composed of a specification, (and drawings,) and as long as it remains uninterfered with, and that the filer is not called upon to lodge his application, in due form, on account of an interfering application, the said proprietor thereof can lodge with it additional papers, provided these papers are relevant exclusively to the perfection of the same invention in progress of completion.24.All cases connected with the intricate and multifarious proceedings, issuing from the working of a law of patents of invention, which are not specially defined and provided for in these rules shall be decided, in accordance with the merits of each case, by authority of the Commissioner of Patents, and the decision shall be communicated to the interested parties, through the Departmental correspondent of the Patent Office.The correspondence with the Department is carried, through the Canadian mail, free of postage.The forwarding of any paper should a wars be accompanied by a letter, and a separate letter should be written in relation to each distinct subject.It is particularly recommended that reference should be made to the law before writing on any subject to the Department, in order to avoid unneccessary explanations and useless loss of time and labor; and it is also recommended, in every case, to have the papers and drawings prepared by a competent person, for the interest both of the Applicant and of the public service.À sufficient margin should be left on every paper, and specially on specifications and assignments, for the insertion of references or certificates, and for the affixing of the seal thereto.Although it is optional for the applicant to annex drawings to the specification of a caveat, or not, still it is impertant, in the interest of the party, always to attach drawings to the said specification.It must be remembered, that the better papers are executed, the sooner the work is despatched at the office, and the surer the regularity of the proceedings is guaranteed.It must be remembered, when drawing the petition for a patent of invention, that, if a change in the residences mentioned has taken place during the year next to the date of the petition, the change or changes should be mentioned, in accordance with the 12th section of the Patent Act of 1869.\u2014 ABSTRACT OF PATENT ACT OF 1869.The Canada Patent Act of 1869, 32-33 Vict.cap.11, sec.1, constitutes a Patent Office attached to the Department of Agriculture, the Minister of Agriculture being the Commissioner of Patents of Invention.2.The official seal is received in evidence by all Courts, Judges, &c.3.The Commissioner draws up the necessary rules and regulations subject to the approval of the Governor in Council, notice thereof being given in the Canada Gazette.4.The Deputy Minister of Agriculture is Deputy Commissioner of Patents.6.Proceedings under the Act are reported annually to Parliament, and list of patents granted is published from time to time in the Canada Gazette.6.Any person having been a resident of Canada for one year next before his application, and having invented or discovere ed any new and useful art, machine, manufacture or come position of matter, not known or used by others before his 2324 PATENTS OF INVENTION.[Dominion invention or discovery thereof, or not being in public use or on sale in any of the Provinces of the Dominion with the consent of the inventor, may, on petition to the Cemmission- er, obtain a patent granting to such person an exclusive property therein ; tho said patent shall be under seal and shall avail to the grantee, his heirs and assigns; but no atent shall issue for an invention or discovery having an illicit object in view, nor for any mere scientific principle or abstract theorem.7.A foreign patent taken out within six months before application hi re does not deprive the inventor of the right to ko out patent here.8.The heir or representative of the inventor, entitled to obtain a patent under sec.6, may obtain the patent.9.A resident of Canada for a ear may obtain a patent for an improvement on a patented invention, but this will not give him the right of vending or using the original invention, nor has the original patentee the right of vending or using the patented improvement.10.In cases of joint applications, the patent is granted in the names of all the applicants, and assignients from onc of the applicants to another must bo regis®.d.11.The applicant must make oath before a Justice of the Peace in anada, or before a Minister Plenipotentiary, consul or con- gular agent abroad, that he is the true inventor, and that he was a resident of Canada for a year before the application.12.The applicant must, in his petition, clect a domicile in Canada, and state where Le has resided during the year of residence required by the Act.13.The applicant must also insert in his petition the title of his invention, its object and a short descrip- ton; and must allege all facts necessary under the Act to entitle him to a patent, and with the petition must send a written specification in duplicate, describing his invention in such full, clear and cxact terms as to distinguish it from all contrivances or processes for similar purposes.14.The specification shall correctly and fully describe the mode of operating, the contrivances which he claims as new, name of place where it is made, &c., (as stated in the REGULATIONS).15.A working model of the invention, or specimens of the ingredients of the composition of matter, are to be delivered to the Commissioner.16.Patents granted under the Act contain the name of the invention and a short description, and grant to the patentee the exclusive right of making, using and vending the invention.17.Patents are valid for five years; but two extensions, of five years cach, may be obtained, in all, fifteen years.18.Every patent and instrument granting an extension of patent must be signed and certified by the Minister of Justice before it is signed by the Commissioner.19.In case of unintentional crror in the description or specification, the patent may be cancelled and a new one issued to the inventor.20.The inventor may fyle a disclaimer of anything included in the patent by mistake.This disclaimer being recorded, and a copy attached to the patent, forms part of it.Such disclaimer shall not affect any action pending, except in so far as may relate to the question of unreasonable delay or neglect in making it.21.The Government may use any patented invention on payment to the patentee of a reasonable compensation to be ed by the Commissioner.22.Patents are assignable in whole or part, but the transfers must be by written instrument, and must be registered in the Patent Office ; otherwise they are null against a subsequent assignee who hag registered.23.Persons infringing a patent are liable to the patentee in actions of damages.24.Action for infringement of patent is to be brought in a competent Court within the Province in which the infringement took place, and being the Court nearest to the defendant's residence or place of business; and the Court or Judge may make an order for an injunction restraining the defendant from using the invention ; but such order may be appealed from, as in ordinary cases.25.Though the plaintiff's specification may have embraced too much, yet, if defendant has used or infringed any part of the invention truly specified and claimed as new, the Court may discriminate and give judgment accordingly.26.Defendant may specially lead any fact which would render the patent void by law.27.The patent shall be void if any material allegation in the petition or declaration be untrue, or if there Bo any addition or omission in the specification or drawings wilfully made for the purpose of misleading.But if it appear that the error was involuntary, the judgment of the Court may declare the patent valid in part, and copies of such judgment must be registered in the Patent Office and attached to the putent to form part of it.28.A patent becomes void unless within three years the patentee carry on in Canada the construction and manufacture of the invention or discovery, It also becomes void if, after the expiration of cighteen months, the atentee imports into Canada the invention or discovery or which the patent is granted.29.Proceedings for jp.peachment of patent may bo taken in certain civil Courts of the Provinces, 30.À certificate of the judgment voiding a atent is to be entered on record in the Patent Office, 3) Such judgment is subject to appeal.32.Existing provincial patents remain in force for the terms for which they were issued.A patentee in any Province, qualified by residence may have his patent extended to the other Provinees of {hg Dominion, if the subject matter of the patent has not been known or used, or on sale with the consent of the patentee in the other Provinces; but no patent so issued shall extend beyond the remainder of the term mentioned in the provincial patent.33.The records of the Patent Offices of tho several Provinces shall be handed over to the Commissioner of patents under this Act.34.Tariff of Fees: \u2014On petition for a patent for five years, $20; on petition for extension from five to ten years, $20; on petition for extension from ten to fifteen years, $20.On lodging a caveat, $5.On asking to register o judgment pro tanto, $4.Registering assignment, $2.Attaching a disclaimer to a patent, $4.Copy of patent with specification, $4.On petition to reissue a patent after surrender, and on petition to cxtend a former patent to the Dominion, $4 for every unexpired year.Office copies of documents, 50 cents for cvery single or first folio, and for every subsequent hundred words, 26 cents.35.Tfor copies of drawings, a fair remuneration to be charged by Commissioner.39.An intending applicant for a patent who Las not perfected his invention may file a caveat, to prevent the issue of a patent to another, with a description of his invention; and the Commissioner will keep such caveat secret.But if another person apply for the patent the Commissioner must notify the party who fyled the caveat, and the latter is bound within three months to take proceedings for a patent, otherwise the caveat becomes of no effect.40.The Commissioner may object to grant a patent when he is of opinion that the alleged invention is not patentable in law ; or when it appears that the invention is already in use with the consent of the inventor; or when it Las been described in à book before the date of application ; or when it has already been patented, or the Commissioner doubts whether the applicant is the first inventor, 41.The Commissioner notifies the applicant and states the ground of his objection.42.Within six months after notice of refusal, the applicant may appeal to the Governor in Council.43.In case of interfering applications for any patent the matter is submitted to the arbitration of three skille persons, cne named by cach party and one by the Commissioner.\u2018The decision of the majority of the arbitrators is 6.Conflicting claims to a trade mark are to be decided by the Minister of Agriculture after hearing the Parties and their witnesses.7.The use of another person\u2019s ade mark is a misdemeanor, punishable by a fine of $20 PATENTS OF INVENTION.2325 to $100.8.The registration by any person of another's trade mark, as his own, is also a misdemeanor, penalty game as in last sefion.9.Using the trade mark of a nonresident, with intent to deceive, though guch trade mark is not registered here, is punishable by fine of $10 to $50.11.The use of a close imitation of a trade mark is held to be a use of the mark.12.The proprietor of a trade mark has also an action of damages against any one using hig mark, or imitating it, or selling articles bearing his mark, 13.Degi6ns.\u2014The copyright acquired for an industrial design by registration is valid for five years.14.The design must be registered before publication, and the manufactured articles must bear the proprictors name or the letters \u201cRd,\u201d with the year of registration.15.The author of the design, or the person for whom it has been executed for valid consideration, is considered the proprietor entitled to register it.16.Designs are assignable ; transfers are to be recorded in office of Minister of Agriculture.17.A person using a registered design without license is liable to a penalty of $20 to $120.18.The penalty for marking an unregistered article as registered is from $4 to $30.19.The proprietor may bring an action of damages against a person ping a design without license.20.A person, who has fraudulently registered a design as his own, may be sued by the rightful owner, and his registration shall be cancelled, and the rightful owner declared such.The Court may stop the use while the proceedings are pending.21.The Minister of Agriculture, on being duly notified, shall alter the Register of designs accordingly.\u201c22.Proceedings must be take within twelve months from the
