satisfactory. At the sham fight to which the Emperor of Austria was Invited by the Emperor of Germany, this kind of gunpowder was used, and the absence of smoke, as wall as the Jossening of the noise of the explosion, wore very noticeable. It will make a vast dit- ference when the smokeless gunpowder is generally adopwd. The smoke not only oonoeals the enemy from the viow of the soldlers who are firing, but shows the enemy precisely where the shots come from.In sharpshooting too it will make a difference. In the North-West campaign it was impos- bible at times for the volunteers to tell where & shot! como fiom until the smoke was seen curling up from the muzzle of the gun. There have been improvements in so many things appertaining to war tbat it is time that there wore improvements in the making of gunpowder, but it {8 not a comforting reflection that every improvement in martial matters means facilitating the means of destroying human life.A batile carried on without the noise which characterizes a conflict between ‘modern armiès would be a more deadly affair, but it would lack the excitement which the booming of cannon and the rattle of musketry give to the onlookers.CALIFORNIA Judges seem to have an uncomfortable position. As in every case which comes before them one of the parties is doomed to disappointment, and as every now and then the disappointed party takes a shot at the presiding judge, the wonder is that there should Le such anxiety for the position. The killing of Judge Terry imme- ; diately after ho had slapped Judge Field in “ the face bas been followed by the ebooting of Juage Price, in the same State, by a suitor against whom the judge had given a decision This looks like a revival of the oki days, but whether it ie due to the corruption of the judges orthe system by which they are chosen is not easy to ray.In California the judiciary is elsctive and thus politics are imported into the contest. In the case of Judge Torry it is clear that he began the quarrel by slapping Judge Field's face. The reason he did tnis was because Judge Field had sentenced him to six months’ imprisons ment and his wite to one month for contempt of court, ina case in which Judge Terry was at the time acting as counsel for the lady, whom he afterwards married.… The evidence would go to show that Mrs.Terry wag.as much to blame for tha shont- Jug as @nybody.Instead of seeking to piacaté Judge Terry sho seems to have urged him to begla the quarrel with Judge Field and went from the dining-room to the car to bring him his rovolver. But when she brought it her husband was dead.Ir the sentence of the court ia to be carried out In the Maybrick case the unfortunate woman haa only a few more days to live, Every possible effort le being made to save her from the scaffold. In England there is no court to which the case could be carried for review. The verdict of the jury and the sentence of the judge are final as far as the law is concerned. The only per- eon who has power to wave the hangman aside 18 the Home Secretary, and it is upon the Home Secretary that pressure is now being brought to bear.ln the last case in which Mr.Matthews was urged tocommute a sentence, on the ground that evidence was forthcoming to Jdisprove the condemned man's guilt, Mr.Matthews strenuously resisted, and that he was right wasestablished by the fact that the condemned man made à cunfession on the night before he was led to the scaffold. That Mrs.Maybrick Is gulity of polsoning her husband is pretty generally admitted, and that she bad been been unfaithful to him she herself admitted in court—an admission that appears ta have done her more harm than good. The only point in her favor is that her husband had been known to take arsenic, and itis contended that there is just a glimmer of doubt as to whether his death was the result of the arsenic sclf-administered or arsenic administered by his wito. This doubt existing: 1t is contonded that Mrs, Maybrick is entitled, under tho law, to the benefit of it.The argument that it is a shamo to hang a women will have little force with the Home Boeoretary, if women are to be subject to the same law as men. There is à bare possibility that executive clemoncy may bo &- tonded to Mrs, Maybrick, but the indications seom to show that the chances are all the other way.PRESIDENT HARRISON sent a letter to tho Mayor of Dublin, who happens to be a Nationalist of tho most pronounced type. This letter was openod on the way.The Lord Mayor of Dublin assumes that it was opened by authority of the British Government, or some of its officials, and has made a complaint in parliament in regard to it, The anvelope undeniably shows signs of having been tampered with, nnd the British postal officials have offered to do all they can to discover by whom the lotter was opened, a somewhat difficult thing to do, we should think.Mrs.Maybrick's mother complains that letters addressed to her were also opened. There are occasions when the postal authorities are justified in opan- Ing letters, but it must be dono at the re quest.of the officers of the law, and only then when it is believed to be necessary in order to trace a crime or secure a clue to the perpetrator of some illegal act.The opening of letters by unauthorized persons 1s a serious offence and one for which tho postal authorities of every country have provided severe penalties. It is idle to suppuse that the British Government is inany way concerned in the opening of the letter sent by President Harrison to the Mayor of Dublin. It would not suspéot tho President of the United States of boing engaged in carrying on a conspirauy against Lhe peace of Ireland, whatever opinion any of ita members mint enteftain of Dublin's Lord Mayor. The sanctity of private correspondence sent through the mails is something that overy person will insist upon, 1¥ thore be any truth in the report that the French ambassador to England has been instructed to sound the British Govern- mont on the question of extraditing General Boulanger, Count Dillon and Henri Roche fort, on the ground that they are conspirators and traitors to the State, we may safely assume beforohand what the answer of the British Government will be, The offence of Which the High Court of the Senate, itself a political body, bas found the distinguished trio guilty is & political one, and political offenders are not included in the category of those who are handed over under the treaty potween Great Britain and France.‘lhe corruption of which Guneral Boulanger has been found guilty was practised white ho was Minister of War, and it would bo à nice question, how much of the responsibility of this the Government will have to shoulder when it appeals Lo the people.Thesat!isfactory feature of the trial by the High Court is that tho sentence of deportation will bave the ctfect of putting an end to the agitation whieh General Boulanger has been carrying on in France. It was dolng no good, and 1t was keeping the whole country In a state of nervous apprehension and unrest. Before you can couk your hare you must catch it, and Boulanger, Dillon and Rochefort must first be lald by the heels before they can be “deported to a fortified place.” It will be a pleasant change for France to bo let alone fora while, besides boing a matter of comfort for Lho rest of Europe, for while France was being mado the scene of agitation tho rest of Europe was kept busy wondering what was going to happen, THE EARLY CLOSING MOVEMENT.Measures for the Relief of Clerks in Stores —Legal OUpluions. The Early Closing Movement has agaln been brought into new life by reason of the action taken by the dry goods clerks and the assistance promised them by the different luboring sovietivsof tho city.Mr.L.U.David, M.P.PL Who 18 supposed to be specially charged with labor legislation by the party in power at Quubec, said to a representative of the STAR: “1 have long thought that some remedy shouid be found lo du away with the present system, which there cun no doubt is altogether unfair to the em- plovés, The dificulty 1s to find the exact remedy which cau suit the purpose.lam quite willing for my parttodo all I can to further the movement and to see that justice is done lo tho parties interested, and 1 am willing tointroduve a measure in the House al the next session and Lo sea that it is put through.II means have been found by which the work of i workingman is limited to’ ton hours, I should think that the same could be done for other wage earners and for the class specially interested in this present instance, I Would uot be prepared to say just now what the exact method to be adopted should be, but I am prepared to look into the question and to come to an understanding with the merchants and clerks.Under the general law reiating to health and good order I should think that power coud be secured to obtain the desired result, I would Le quite prepared to confer on the question with any legal gentleman whom the association might name or to go and address any meeting on the subject, and to ASCERTAIN THEIR VIEWS.I waa a clerk once in my life and I know all the hardships which that life entails.” The clerks think that wher a man or woman has been standing in a store for ten hours ho should be allowed to draw a breath of fresh air and to spend a few hours in the evening with their rami- lies and friends. The fmmense majority of the merchants are in favor of early closing, but many have to remaln open because Leir neighbors do so.Mr.C.J.Doherty, ®.C., who has been can- sulied on the question,is of the opinion that Pressure should be brought to peat upon the Âty Council to ask the Legislature for power to urder the closing up of ull places of business ut a uniform hour under the general police regulations. It is well to state that the clerks are willing to Inake an exception for Saturdays and the eve of holidays when they are willing to work until a late hour.Mr.Ethier, the Assistant City Attorney, had not glven the subjeôt any study, but he said that there was nothing in the city charter by which any business place could be closed at any hour except on Sundays. An exception to this, of course, was made for the saloons, Hs, was under the impression that any legislation regarding the closing of stores would have to come from Ottawa, which had control of trade and commerce.RELIGIOUS PROFESSIONS.| Vows Pronounced by a Number of marks a distinct step in medical practice and the treatment of nervous complications, It has been freely admitted by the best medical talent in the land, and also by the leading chemistsand speclal cablegram, dated London, August: 15, says: The Maybrick case found its way into the House of leds to-day and ruffled the temper of the Lord Chancellor to gn extent absolutely dangerous to his health. In languuge mild and choice, Lord Fitzgorald asked 1f during the coming rocess tho question of constituting an effective Court of appeal in criminal cases would be considered.and it 1t were deemed expedient, would the measure to effect such an object be presented. The face of the Lord Chancellor became covered with à hue that betokened a rapid approach of apoplexy. He could onty imperïectly express his regret, he said, that such a question should be raised.‘ It was a matter he preferred not to discuss at such a time.Lord Herschel coolly stated that it was impossible to obtain attention to the necessity of any particular reform except when the public mind was excited on the subjoct. He trusted the matter would be seriously considered by the Government at the coming recess, as there was undoubtedly A WIDESPREAD FEELING that such a tribunal would give additional security against injustice and against such an agitation as the suspicion of injustice created. The importance of the remarks made by Lord Cross lies in the fact that he has been Home Secretary, though the litle that he did say was of such an extraordinary character as to deserve attention if he had never oveupied such a position.Having said that “he would be prepared to express his ideas at a proper time, he added: "I am not quite sure that, with the existing state of things, criminals do not gain an advantage rather than lose one by want of criminal appeal.” Unfortunately he failed to explain what criminals could possibly lose by such a change for the better in their behalf. After Lord Cross had spoken the matter was dropped.NOT THE SAME MRS.YAPP.The despatch sent from New York to the effect that the counsel employed there by Mrs.Maybrick's friends to obtain evidence in support of the appeal for reprieve had received a letter from Mr.fred Monk, lawyer, of Montreal, stating * that Mrs.Yapp, the chief witness against Mrs.May- brick, had to leave Montreal three years ago to avoid Indictment for perjury for testimony given by ber in a divorce suit, in which after entering into a conspiracy with the husband and his mistress, she swore the wife was an adulteress. Her testimony was proved false and she immediately disappeared.” The Mrs.Yapp alinded to above, is evidently Mra.Thomas Yapp, who a peared as a witness for the prosecution in the case of Metvin Smith against his wife for separation. Her maiden name was Margaret Helena Wainwright, wite of Thomas Yapp. She left with her husband soon after and returned to England, The witness in the Maybrick case is Alice Yapp, another person altogether.the was « Irurso in the employ of the family for eighteen months, and probably the most important one, as it was she who produced the famous letter to Brierly which proved to be the unfortunate woman's death warrant.CONFERENCE AT THE HOME OFFICE.LoxpoN, August 16.—Hoine Secretary Matthews, Justice Stephen, the Lord Chan- coltor and medical experts are Nature.Dr.Nolin of the Health Department last “night completed his investigation Into the gases of typhoid fever in “Guose Village," Point St.Charles, and reports that the total ‘number of cases is 40.Of these there are 26 cases on Forfar street, eizht on Menal street, two on Britannia street, one on Conway street and three on St.Etienne street. There is not one serious case In the whole number, as the fever is of a mild character, pevertheless the Inhabitants are greatly ‘geared and were pleased to see the physician Taking the investigation into the cause of the disease.Dr.Nolin explains that the land ln this district 18 very low, even on a level with the river, and this might have some effect, but the real cause he attributes to the stagnant water.Along some of the streets and in the open flolds there are yumerous pools of green water, the obnoxious odor arising therefrom being unbearable, while along the Grand Trun track, almost to the Victoria bridge, is a ditch elght feet deep of stagnant water, In one particular place, between Tait's dry flock and the bridge, there is a pond of this ater, which Is almost sickening to look at.“The basements of the houses are naturally damp owing to the low land, and this bears considerably on the case. The doctor does not consider the sewerage bad and attributes the whole sickness to stagnant water. He will make another tour of the district in company with some of the residents, 25 he has yet to make a close inspection of the district in the vicinity of the ictoria bridge, which le said to be the worst part. The land in which are interred the immigrants who died of this ship fever in 1848, is low and eovered with many pools of green water. The doctor will submit his report to Alderman Hamelin, chairman of the Health Committee, who will call a meeting to see what steps should be taken in this matter.A THIRSTY ALSATIAN.Not Yet Acquainted With the Customs of the Country.J.B.Fournier, a young Alsatian, was charged before the Police Magistrate this morning with obtaining goods under false pretences. He explained that he had run away from home, in order to escape service in the German army; that he hated les Prussiens and would not carry a musket for them against la belle France. He came to Boston, Mass, and thence he travelled on foot to Montreal, the trip taking him seven days.On arriving he had not a cent left, aud being hungry and thirsty, he stepped into Mr.Lemay's grocery, on Sanguinet street, and asked for a goût of French wine. The grocer, judging that the man was only trying to sample the wines previous to buying, gave him a good glassful.“Is that good ?' asked he, when Fournier had guiped down its contents."I have some better here.” And so he gave him five glassfulls.Whereupon Fournier turned around and walked out.The grocer ran after him and him what he was about.“1 was thirsty,” replied the Alsatian, “and I thought it very polite indeed on your part to give me the wine." Lemay did not see things in that light, and took him to the station.Judge Des- noyers, however, let him go this morning. Before leaving the court Fournier
