Maomaster, Q.C., appeared lor Maessra.Twohey and Smith, and R.D.M:Gidbon, Q.C., for Mr.Borrenskey.Mr.Edmund K.Wilis, of 33% Metcalfe streot, storeman for Mr.Miiloy, testified to the truth of the deposition made by him on which the warrant was based.The first time he heard of the matter wus on December 29, when James Rose, outter of tbe ladies\u2019 department at Mr.Milloy\u2019s, told him that Mr.Sorrenskey kad telepboned him stating that a gentleman wished to know his (Rose's) address.This occurred some time previous to the 929th ult.Rose told witness that the gentleman referred to was Mr.Twohey and \u2018that he called -at Roses house and offered him $5000 reward if he would give any information In regard to Mr.Milloy's supposed smuggling.Witness could not tell when next Rose spoke to him on the matter.He jotted down dates and conversatiocs in a note-book as they occurred.He offered to refer to this, but Mr.Macmaster told him not io do so at present.On account of Mr.Milloy's absence in Europe, Rose told him that he had communicated with Mr.Quinn, Mr.Milloy's legal adviser.On the 22nd of January Rose told witness that he had met Mr.Converse J.Smith and authority.On Saturday he laid the note book on a desk in the office where Mr.Quinn and Rose were at the time.Mr.Macmaster : \u201cDid Mr.Quinn look into ite\u201d To this Mr.Quinn objected as irrevelant and illegal.The objection wae maintained, Mr.Macmaster asked for the book, but this was also objected to, and the objection was agaln maintained, on the ground that the magistrate had no power to compel a witness to produce a document which was not in sight, although in the present case witness admitted that he had the note-book with him.2 Mr.MoGibbon began a cross-examination for Mr.Sorrenskey.Witness stated that Borrenskey was a competitor of Mr.Milloy and was formerly in his employ.He saw Rose and Sorrenskey together on January 22, coming out of the Derby saloon when witness
