than it has for years. It must always tend to dwaëf the importance of a second chamber when its majority is able generally to approve at first sight of the legislation passed by the Lower House, The country is easily persuaded that it is paying too high a price for a company of gentlemen to sit on red cushions and say “ditto’ to a creative Chamber. Then let the Senate feel as independent as it likes, party labels affect the judgment of the casual on-looker—and the average voter is no more — with tremendous potency. When the Senate majority is labelled ‘“Conservative’’ and the Government of the day wears the same badge, intelli gent agreemsmt wilh Government mea- ; Sures is called ‘’party subserviency”" and ‘opposition to them seldom earms a more dignified description than ‘“kicking.” But the Senate is liberated from these disadvantages when the Government falls into the bands of a party which can only claim a minority in fis ranks.Suspicion ! ‘The coming session will bring to the Senate its severest test. The Government i programme is already known to be an ambitious one.Several costly projeots are on the cards and the public will anx- lously hope for the fullest discussion of them before the country is finally com- mitted. The members of the House ot Commons can do much, A spirit has been making itsel! known within the ranks of the Liberal panty M- sel, which may be looked to for a thorough and patriotic examination of the details of the ministerial programme; and the Opposition shows no sign of discour- umement. But the Senate Is the only Chumber where the ringing of the divi- ston bell cannot be utilized as a sufficient reply to all argument. There the Govemn- ment must prove ita case to win, If the Senate lives up to its opportunity. No one will advise tbat the Upper House to per- mnently plant itsel?in opposition to the will of the people, as shown in the composition ul the Commons; but it is.surely a legitimate function o! Joliette, Que., February 3.—Thé hearing of the evidence in the Nulty murder trial will probably be concluded this afternoon. The summing up by the opposing counsel will take all of Thursday, at least.and between that and the judge's address to the jury, it is not likely that the case will be finally disposed ol before Friday night or Saturday morning. The Crown produced tbe first of {ts medical experts yesterday afternoon in Dr, J A.Barolet of Montreal.Dr.Barolet was very positive that the prisoner could not have committed the murder while tn an epileptic fit.The full force of his evidence, however, was rather impaired by the special pleading he mdulg- ed in on behalf of the Crown, showing quite plainly that be was determined to strengihen that side of the case às rar as he could. In a number of instances where Mr.Archer read quotations trom medical authors which were not In harmony with the witness’ statements, Dr.Baralet said he did not accept the authors In question as standard authorities and begged to differ from them. The first witness in the alternoon was Wm.McConnell, a Montreal newspaper mani who told once more the story of his visit to Rawdon. He also d that he had heard Nulty, sc, say at the time that the place where Tom's shirt was iound was an unusual place to put it.Dr.Barolet was then called, and des- eribed in detaïl the symptoms und signs of epilepsy. In reply to a question by Mr.Dugas, he said that it was not cha- racteristio of an epileptic to show {naift- erence after committing à crime. On the contrary, an epileptic would be stupified with grief on learning of his deed.Witness said he had made a very careful examination o! the prisoner tor the purpose ol seeing if he had any external signs of epilepsy or Foe any evidences of insanity of any kind.He had been unable to discover any such signs.Continuing, witness said fe had er- amined the Jump on the head of the rri- soner, and found that it was not of a character to indicate any necessary connection with any epileptic outbreak.Mr.Dugas then asked witness a question which had been asked by the defence of their medical experts.Being given, salt Mr.Dugps, the several symptoms of Ins OF memory, absence of mind, ~ head: aches, pains and aches at periodic intervals, ete, what conclusion would the witness come to.In reply.witnesa said he would have considerable diffienlty in coming to ahy definite conclusion, as the several symptoms mentioned might go with epilepsy, hysteria and other different affections.Cross-examined by Mr, Archer, witness said that he did not consider that an act committed by a person a recollection of which act afterwards existed in that per ron’s mind could be the act of an epilep- tit at the time of an epileptic fit.An attack of epilepsy carried with it entire loss of consciousness for time being.degenerate was not necessarily ap epilep- te.+.- Lo .“Mr.Archer asked iY witneds had aot read cases cited by high medical authorities where epileptica had committed crimes and had afterwards retained par tial recollection of their decd.Witness said he had read of a few such instances, but he did not accept them. The authors who cited them were not standard authorities on epilepsy and its kindred diseases, Cranial deformity, continued witnees, ‘wus 5 sign “of degeneracy, but mot neces: sarily of epilepsy.‘Every degenerate is not an epileptic. When witness bad compressed the prisoner's head with his ands, he had given way slightly, hnt there were no signs o! any tears coming to his eyes.Witness further sald that while in many cases of epilepsy it appeared that the patient’s i iste ancestors had heen hard drinkers, the fact of a person being a hard drinker did not necessarily bring about that his children became epileptics, Mr, Archer asked if it had not often happened that the first time the existence of epilepsy was made own was through the commission of a crime he the epileptic.Witness admitted suc cases were quité possible.Witness sald, however, that the crimes of epileptiés were generally characterized by a useless repetition of blows and sometimes mutilation of! the bodies of the victims, Crimes committed by epileptics under the impulse of the malady were, generally speaking.without motive, though there might or lingering in epileptic’s brain an idea which be had entertained while same, - Mr.Archer then asked witness had heard of the case of a man named Drolet, who, some years ago, in the county of St.Hyacinthe, killed his mother.Up to that time lot was looked upon as a man of intelligence, but he is now in Beauport Asylum.Witness said he had never neard of the case. However, he would not consider that a single isolated murder was proot of epilepsy.UNNERSITY OF OTTAWA High Authority gives Uanimpeach- able Testimony for RYCKMANS KOOTENAY CUBE He Used the Medicine Himself and Recommends It.BE SURE AND READ HIS LETTER, University of Ottawa, Ottawa, Ca » April ‘10, 1696.Dear Mr, R.I In July last alating hat, 1 benefit to my health fro bottles of your truly marvellous re “Kootenay Cure.” BSinos then 1 have taken three more bottles, and am now pleased to be able to laform you that I am freed from chronic and acute rheumatism, Diabetes and La Grip the firet winter since 1890 wrote to you derived much tal two y, pe.This ia that !
