JURY.vr The Prisoner Anxiocusly Awaiting the Erid-His Counsel Present a ‘Strong Case-There Was No Crime.|SPECIAL TO.THE STAR.] JOLIETTE, Que., January 18.—To hear Mr.J.Adolphe Renaud address the jury on be- “half of John Reginald Hooper, the largest “crowd of the many that have cccupied the room of the Court House since the beginning of the trial on the third of January, gathered yesterday afternoon. It is along time since 50 many ladies attended a murder trial in this province, for they (most of them) had attended every day and were reinforced yesterday afternoon by many who had driven in from tlie surrounding country. In opening his address, Mr.Renaud laid down the principle that.a man did not become a murderer in one day; that there must be a process of development, in- -dicating the characterof a man who would-be guilty of such a crime. He would, therefore, divide his address into three parts; the life of the accused up to the time he took his wife out of the Kingston Asylum, the events from that time till the death of his wife, and the occurrences succeeding the death.Ten years ago, the accused married Geurgiana Leblanc, who was then a poor irl almost without friends. There could no ulterior motives for such a marriage; it was the act of an honest man who believed that he was furthering -their mutual happiness. But, unfortunately, shortly afterwards the poor woman began to show signs of insanity, and two ears ago it became necessary to incarcerate her in an asylum. At that time accused wn his sorrow, and during her stay on tre Hock wood Asylum he had repeatedly’ J.A, RENAUD, COUNSER-KOR THE DEFENCE.sent her clothing and made affectionate enquiries about her condition. It had been wn by the Crown that accused had not written s0 often from the autumn of 1392 to the spring of 1893, but that was easily ex- lained when it was found that he imself pas ve sick at that time. After recovery he appear: ed to have made wup- his Pind to transfer his wife from.the asylum at Kingston to ee one at Longue Pointe. It was when ti to bring about, this end that the [pth e incident occurred. This; although it had nothi whatever to do with thea crime as charged in the indictment, bad been introduced by the Crown in order to prejudice the minds of the Jurors nst the prisoner. The Crown had not him with ATTEMPTING TO DROWN .HIS WIFE at Louiseville, but with the murder of his wife on a Canadian Pacific Railway train several days later, between Lanoraie and Terrebonne. The Court having allowed the evidence the jury must remember that the accused was travelling with a orazy woman, and that ap, ntly unaccountable things could explained on that account. After his wife s disap) nce, he had done all in his wer to tind.ber.He sent telegrams when om ight § have ve Quistly sal said nothing about it his wife's family of her ppeat arate and secured the aid of his ne er-in/law to look for his wife.On finding the woman her t act was to, throw her arms around the prisoner's neck exclaiming, ‘‘John,my husband, I love you.She was insane, but-if he had attempted to kill her, she would have been frightened then, for oven a dumb brute will shrink from those who ill-treat it.Accused asked her how she had fallen the water. If he had been instrumental in that, he would never have asked her in the presence of others. Then the scraps of paper, saying, * *Good-by, John, I am going to drown,” signed “Georgiana Hooper,” was positive Justific cation as far as accu was inp The counsel contended that, in to the events immediately preced- wn death of Mrs.Hooper, the evidence ing the.the baggageman, should have more weight than that of Conductor Robitaille, who had contradicted himself at each of his examinations.Dion had sworn that he was ed by the prisoner himself, who was sing water on his wife's face, not into Ber mouth. When accu so many + q portunities to poison his wife when alone, stand to reason that he would have chosen the busy baggage-car of a railway train as his place of operation? It was quite natural for bin to suppress his real name at Terrebonne, for it was in keeping with his proud spirit to be ashamed to recognize his wife, a crazy woman, who constant] used obscene lan That had bee readily understood by Di r.Duchesneau and Father Laporte.ter her death he had admitted to those who had business to know that the was his wife, Great stress the statements that accus Tears were NOT ALWAYS THE SINCEREST EXPRESSIONS of sorrow, hut if they must have tears, they were supplied by Mra.Malo, who swore that Hooper wept when telling her about “his wifes having jumped- There was nothing unusual in the relations had not cried.existing between Miss Stapley and the accu uring his wife's confinement in the ‘asylum. These relations were of a business nature and when he told her his wife was dead he did so because he did not wish to explain to every person that his wife was a lunatic. Not until after his wife was really buried did he suggest marriage to Miss Sapley and the was anxious to walt for a year. When he learned on his return to Ottawa that he was under suspicion le at once took steps to bave a thorough investi tion made, and went up to Port Hope an obliged to deposit money to cover there expenses of the inquest. If he had been guilty would he not have waited until compelled to nove in the matter? The prisoner had bought russic acid, but the reason been explained by Miss Stapely, who swore thot he had threatened to poison a large dog that annoyed her.The fate of that bottle of poison had been told ur the father and sister of accused and Ward, one of thé counsel for the etencé.The Crown had gone to enormous expense to brinæ deceased wi 1 Ald.stress had been Taid the Crown on The $%0.000 had been voted the - train, witnesses from all over the country, but they had not brought a single one to prove the condition of the woman's health after leaving the asylum. That had been left to the efence to pve by the mother of deceased. Then as to the medical evidence, an autopsy had been held and .certain organs analyse without the slightest traces of prussic pos being discovered. All the experts brought by the Crown had sworn that the symptoms described applied equally to death from fatty degeneration of the heart as to death from prussic acid poisoning. The jurors could not go beyond their oath and decide what the doctors could not that prussic acid poisoning was the cause of death. The defence had been perfectly satisfied with the expert evidence of the Crown, but they had gone still further, and by experi ments had proved that prussic acid, if present, could be detected eleven days after death. The learned counsel closed by warning the jury of the danger of circumstantial evidence and citing-vases in which innocent men_had suff nifered b by.it._ He had Lad spuxen in French for four hours.‘To-Day's Proceedings. When the prisoner was brought into the dock this morning it was easily seen that he had passed a sleepless night. His face was haggard, almost ghastly, and during Mr, Greenshields’ masterly defence he sat with his left arm on the railing, while tears dropped silently from his eyes, to the.tloor.Mr.J.N.Greenshields, Q.C., addressed the Jury on behalf of John Reginald Hoo, this morning. He began by stating that the charge against.the accused was wurder, and the: penalty, death. If the jurors found him guilty ‘ the learned Judge presiding” would impose the penalt of death” and in the -same breat ask our Creätor to have mercy on his soul.Aided by one of the most experienced and skiltul detectives in Cana.-du, the Crown had adduced an enor mous sunount of evidence, but they had been unable to bring one tittle of direct proof. The whole case rested ‘on circumstantial evidence, which was at tifnes most dangerous, for unexplained incidents sometimes created an unfavorable impression. The question of whatever he had done at Louiseville conid have no influence upon the case before the jury.‘The Crown would claim that e had attempted to drown his wife at Louiseville. If they could sustain that, why had they not made such a charge against him Then they would have brought cvidence to disprove that. All through the Louise.ville matter the evidence showed that the dominant ides of accused had been to put his wife into a lunatic asylum in this her tive province. Why had he taken so ie ch trouble to try to get fier into an as lum if he intended to murder hert He took her from the Notre Dame Hospital, and having asked an attendant from the Notre Dame Hospital to Jecompany them to the cars, starts for Louiseville. They had taken tickets to Three Rivers, but got off at Louiseville. For what reason, it was not known. An hour afterwards prisoner turned upagain at the station, and as soon as he got on board a train he gave the conductor telegrams to set every one on the lookout for her.Was that an act of a murderer Then the Crown Attorney attempted to prove that the Louiseville occurrence by the insane ravings of the deceased, vho also accused her husband (according to Grenier's evidence) of having imardered.her child, a child that never existed save in her diseased imagination. The antidote to all that was the words of wife. When the prisoner went her at Louiseville and she ran to him with outstretched arms crying: ‘John, my husband, I love you.” Then there was the scrap of paper with the words declaring her intention to drown herself. All those ravings must be set aside, for they could not believed by reasonable men.Coming down to the eveuts directly surrounding the death of Mrs.Hooper, the Crown should have proved; tirst, that the poison had n administered to the womun by accused; second that the symptoms before and after death were that of prussic acid poisoning and that alone; and third that prussic acid was was found in the body of the decea.ed.Not one of these facts had been proved. Then the learned counsel pointed out pancies in the story told by Robitaille and eld that the evidence of Dion, who remained in the car all the time and saw no fluid being ured down her throat, was the most reliable.Coming down to the alleged object of the crime, Mr, Greenshields contended that accused h never breathed a word of love to Miss Stapeley until after his wife's death, He’ could not know that Miss Stapeley would marry, him until he asked her, so that when the crime was alleged to have been committed there could be no ohject. Then there were the actions of the accused to considered. After he had found that he was under suspicion he was most anxious to have every investigation made. The medical evidence for the Crown had been unanimous that fatty degeneration of the heart might have produced death as well as poisoning by prussic acid. They had show n that death could not have been caused coun or it.“They had also produced the second b bottle .of Seid which had been obtained by accused several days later in Ottawa, 'The learned counsel concluded byt “J citing the case of a girl condemned by circumstantial evidence for poisoning a child, who was afterwards proved innocent. The Court adjourned at half-past twelve.THE WATER COMMITTEE Expresses Confidence in the Superintendent. At ‘yesterda afternoon’s meeting of the Water Committee, Ald.Leclerc proceeded to relate his complaint against the superintendent of the Water Department who had recently received a special grant of $50,000 and out of that St.Jean Kaptiste Ward only got à “shop.” Men had previously been discharged and when work was resumed pangs had been brought from other wards. This was not fair to his constituents.Aid.Thompson thought it was curious that Ald.Leclerc had not specific cha, charges.Mr.Davis, in answer to y, said he had never been asked to discharge n French-Canadian.He then produced a list of some fifty laborers, working in St.Jean Baptiste Ward, and said that when work had become scarce, men had had to be discharged, but all the accusations made Ald.” Leclerc
